Adjust sheet index to reflect correct sheets. Sheet 30 seems to be missing. Response: Sheet 30 is now included with the plan set and the Sheet Index is correct. Comment 2: Sheet 9 of 31. Provide detail of 6' high iron fence. Response: An iron fence detail has been added to Sheet 30. Please note the exact style is yet to be determined. Comment 3: Sheet 9 & 10 of 31. Annotate handicap ramps at the intersection of Sovereign Drive and Papermill Road and Equity Drive and Front Royal Pike. Response: The handicap ramp at Papermill Road has been labeled and explained in a note on Sheet 9. The ramp at Front Royal Pike on the south corner is noted as a CG-12. A ramp on the north corner is not possible because the property is private and the landowner will not provide an easement or additional right-of-way. VDOT is aware of this situation and has approved these plans. See explanation in comment 6 for more information. Comment 4: Sheet 9 & 10 of 31. Is there a subdivision entrance sign? If so, please annotate location. Response: No subdivision entrance signs are proposed at this time. Comment S: Sheet 10 of 31. Recalculate open space areas. There is some discrepancy with some of the total areas of open space. Comment 6. General. Remove spite strip whereas Frederick County Zoning Ordinance prohibits spite strips. Response: As discussed over the phone on January 8, 2009, the agreement for access from Route 522 was limited to the 50-foot right-of-way. No other improvements can be provided outside the right-of-way. The owner of the parent tract has retained ownership of the "spite strip" and will not allow any improvements outside the right -of way. Despite numerous attempts the developer has been unsuccessful in negotiating any further options to remove the spite strip or obtain additional easements or right-of-way on this adjacent property. It would appear that the revisions made to the landscaping for this site do not yet meet the requirements of Ordinance §135-36.A. (1). Please be sure that trees are located every 40 feet along all of the proposed roads, even along portions that do not have housing lots. Note that in places where houses do run along the road, the ordinance requires that those lots have at least two trees on the lot even if this means that trees are planted more frequently than every 40 feet. "Street tree landscaping shall require one street tree for every 40 feet of street frontage in a residential development... Two or more street trees shall be planted on each building lot. The Zoning Administrator may allow fewer than two street trees for an individual building lot if topographical features, utilities, easements, or the width of the lot makes it impractical to do so. " Response: The tree totals have been recalculated based on the greater value, which was 1 tree per 40-feet of road frontage. Additional trees have been added to the plant list and the landscape plan. Due to certain restrictions (driveways, utilities, etc.) trees are not always able to be planted in 40- foot intervals. Trees cannot be planted outside the right-of-way along the portion of Equity Drive that intersects with Route 522 here since the agreement for access from Route 522 was limited to the 50-foot right-of-way and the developer does not own that land. Comment 2: Street Tree caliper. According to §135-36.A. (1). of the County Ordinance, "street trees must be at least two -and -one -half -inch caliper at the time of planting. " Please revise the landscaping chart to reflect this. Response: The plant list has been revised to reflect the minimum caliper. On sheet 31 of 31, regarding the road efficiency buffer and proffered buffer against the memorial park, provide the type of screening tree(s) planned for the buffer and the number of each type of tree. Please note that White Pines (Pines Strobus) are an undesirable screening tree and an alternative evergreen, such as the Leyland Cypress, would be more appropriate. Response: A planting list has been added to Sheet 31. A combination of three different species is now proposed along this buffer. Additionally, the trees around the existing pond were revised to provide a species that will thrive in predominantly wet conditions. Comment 8: On sheet 31 of 31, provide a detail of the actual bike trail in addition to the provided buffer detail. • Response: A typical section of the bike trail has been added to Sheet 31. Comment 9: On sheet 31 of 31, lot 64 requires a minimum of two street trees. Response: Two trees added to Lot 64. Comment 10: On sheet 31 of 31, the trees on lots 22, 36 and 49 (the pipe stem lots) do not count towards the required 175 street trees as they are located more than 20 feet from any road right-of- way. Revise the landscape plan accordingly. Response: The tree plantings have been adjusted so that ALL of the trees credited towards "street trees" are along the street. Also note that in some cases it is not possible to plant street trees within 20-feet of the right-of-way due to conflicts with underground utilities. Because the trees on the pipe stem lots are not counted some lots along the streets will have more than two trees. Comment 11: As discussed in our conversation today, please provide a Special Limited Power of Attorney form for the file and a signature for the application. In regards to the requests of my attorney's letter dated Nov. 29 h, for the surveyed locations of ; the access right of way, drainage pond(s), water and sewer lines, drainage ditches, traffic choker, turn lane, and entrance way specifications, etc....,certain notations and locations on the platts are ambiguous and contradictory. My attorney's phone call on Dec. 13'to your office,( per your request) , to schedule a meeting to resolve these matters and settle on the right of way access, has been ignored. I have not accepted/cashed the late payment you sent to me Nov. 14' for the option on the access right of way . Should you still desire an access road through my property for Freedom Manor we must meet between Jan. 18* and Jan.30th 2007. Please contact Mr. Clinton Ritter's office to schedule said meeting. Please address the following comments, questions, or concerns: Street Tree Spacing. It would appear that the revisions made to the landscaping for this site do not yet meet the requirements of Ordinance §135-36.A.(1). Please be sure that trees are located every 40 feet along all of the proposed roads, even along portions that do not have housing lots. Note that in places where houses do run along the road, the ordinance requires that those lots have at least two trees on the lot even if this means that trees are planted more frequently than every 40 feet. "Street tree landscaping shall require one street tree for every 40 feet of street frontage in a residential development... Two or more street trees shall be planted on each building lot. The Zoning Administrator may allow fewer than two street trees for an individual building lot if topographical features, utilities, easements, or the width of the lot makes it impractical to do so. " Street Tree caliper. According to § 13 5-36.A.(1). of the County Ordinance, "street trees must be at least two -and -one -half -inch caliper at the time of planting." Please revise the landscaping chart to reflect this. 3. Spite Strip. The right-of-way for Equity Drive should extend all the way to what is currently the southern property line of 64-A-23A. Presently, there is a strip of land between the right-of-way for Equity Drive, and the parcel identified as 64-3-A1. 4. Multiuse Trail. The multiuse trail should extend all the way to Route 522. It would be acceptable to tie the sidewalk into the multiuse trail at the point at which the trail currently ties back into the sidewalk.
