The accompanying plat represents a division survey of a
portion of the land conveyed to Fort. Collier Group, L.C. by
deed dated September 18, 1991 of record in the Frederick
County Circuit Court Clerk's Office in Deed Book 766 at Page
73. The said land fronts the northeastern boundary of Park
Center Drive approximately 1950 feet east of Martinsburg Pike
(U.S. Route 11) within the development now known as Fort
Collier Industrial Park in Stonewall District, Frederick
County, Virginia and is bounded as follows:
Beginning at an iron pin found in the northeastern
boundary of Park Center Drive corner to Green Bay Packaging,
Inc. (Lot 28); thence with Green Bay Packaging, Inc. for the
following three courses: along the arc of a curve to the left
317.98' (Radius = 260.00' - Chord = S81015'47"E - 298.53') to
an iron pin found at the P.T.; Thence N63042'03"E - 416.38'
to an iron pin found; thence N10°12'03"W - 845.21' to an iron
pin found in the southern boundary of the C.S.X. Railroad;
thence with said railroad boundary for the fol.lowing three

THIS DEED OF SUBDIVISION, made and dated this v �j> day of
October, 1996, by FORT COLLIER GROUP, L.C., a Virginia limited
liability company, party of the first part, hereinafter called
the Grantor.
WITNESSETH:
WHEREAS, the Grantor is the owner in fee simple of a certain
tract or parcel of land situated in Frederick County, Virginia,
containing 5.193 acres, being a portion of the land conveyed to
the Grantor herein by James L. McIlvaine, Sr., et als, by deed
dated September 18, 1991 of record in the Clerk's Office of the
Circuit Court of Frederick County, Virginia in Deed Book 766,
Page 73; and
WHEREAS, the Grantor now desires to put to record a plat of
subdivision, so as to create said 5.193 acres as a separate
parcel from the remainder of its land.
NOW THEREFORE, the Grantor hereby subdivides the aforesaid
5.193 acres, to be known hereafter as Lot 36N, Fort Collier
Industrial Park, in accordance with that certain plat and survey
of Mark D. Smith, Land Surveyor, dated September 23, 1996, which
plat and survey are attached hereto and by this reference made a
part hereof, more fully describing the property as set forth
above, and asserts that this subdivision is made with full
consent and in accordance with the desires of the undersigned
owner.

THIS DEED OF SUBDIVISION, made and dated this 11A— day of
October, 1996, by FORT COLLIER GROUP, L.C., a Virginia limited
liability company, party of the first part, hereinafter called
the Grantor.
WITNESSETH:
WHEREAS, the Grantor is the owner in fee simple of a certain
tract or parcel of land situated in Frederick County, Virginia,
containing 25.499 acres, being a portion of the land conveyed to
the Grantor herein by James L. McIlvaine, Sr., et als, by deed
dated September 18, 1991 of record in the Clerk's Office of the
Circuit Court of Frederick County, Virginia in Deed Book 766,
Page 73; and
WHEREAS, the Grantor now desires to put to record a plat of
subdivision, so as to create said 25.499 acres as a separate
parcel from the remainder of its land.
NOW THEREFORE, the Grantor hereby subdivides the aforesaid
25.499 acres, to be known hereafter as Lot 29, Fort Collier
Industrial Park, in accordance with that certain plat and survey

Dear Mr. Jones:
We are returning your transmission deed dated January 20, 1993 for the 12" sanitary sewer line
which crosses West Brooke Road in the referenced development.
After review of the deed by our District Right -of -Way Manager and Staff Attorney, we
unfortunately will be unable to accept it. The basis for our decision is that Condition No. 3 does
not contain a non -betterment clause should the Commonwealth need to relocate or adjust the
facility in the future. Please refer to the enclosed copy of our draft transmission quitclaim deed
for needed terminology of Condition No. 3.
The distribution deed for the 8" sanitary sewer line crossing appears acceptable and is currently
being processed. However, please keep in mind without the necessary changes to the
transmission deed Frederick County cannot guarantee us an unrestricted street right-of-way.
Therefore, West Brooke Road cannot be added to the State's Secondary Road System.

Frederick County
During a routine inspection of the referenced project we have noticed guardrail has been installed
at the Hershey Foods entrance at the end of Park Centre Drive.
The rail is necessary due to the installation of the box culvert under the plant entrance. The
contractor appears to have extended the rail beyond the Hershey property line and onto the Park
Centre Drive right-of-way. Furthermore, the end sections used do not meet VDOT's standards
and create a serious hazard if left uncorrected.
Before we could accept Park Centre Drive into the State Secondary Road System, the portions
of the rail on the street right-of-way will need to be removed and the present end sections
removed and replaced with either a Standard GR-7 or a short section (approximately 15') of
radial guardrail. We have enclosed a copy of our Standard GR-7 Specification for your use.
We trust the above is self-explanatory. However, should you have any questions or would want

currently not in the State's Secondary Road System. However,
all entrance design and drainage related features must meet
VDOT requirements if the street is to be eligible for
acceptance. A complete set of construction plans will be
required for review. The developer should also be made aware
any future extension of Park Center Drive may be prohibited
due to the configuration of this parcel
County Engineer: I have no specific comments related to the
proposed lot subdivision at this time. Indicate whether the
annotated drainage easement reflects the existing channel or
proposed channel realignment.
Sanitation: No comments

Planning & Zoning: This proposed lot has required road
frontage and although this road is not in the secondary
system, action is underway to accomplish this and is a
required action by the developer. There is an approved Master
Development Plan for Fort Collier and division of this lot
would be in conformance with the Master Plan. This division
also meets the requirements of the Subdivision and Zoning
Ordinances.
