K. Benham, III, Trustee of Frederick Mall Land Trust pursuant to Trust Agreement dated October 1, 1977, a Memorandum of which is recorded in the Clerk's Office of the Circuit Court of Frederick County, Virginia in Deed Book 488, at Page 107, of the first part, hereinafter called the Trust; H. K. Benham, III, of the second part, hereinafter called Benham; and The County of Frederick, Virginia, of the third part, hereinafter called the Grantee. WHEREAS, the Trust is the owner of a tract of land, containing approximately 16 Acres, fronting on the South side of Route 522 and on the East side of Fox Drive, just Northwest of Winchester in Frederick County, Virginia, which property is subdivided into eight (8) parcels of land by the survey of Elliott Ritchie, Jr., C.L.S., attached hereto and by this reference made a part hereof, except for Benham's half interest in one of the lots on Route 522; and, WHEREAS, the Trust desires to subdivide the land as platted on the attached plat, the same to be known as Frederick Plaza Subdivision, in accordance with the provisions of the Subdivision Ordinance of the County of Frederick, Virginia. NOW, THEREFORE, WITNESSETH: That for valuable consideration and the benefits that will accrue by reason of this dedication, the Trust, by its signature hereto, dedicates with its free consent and in accordance with its desire, unto the Grantee, the .2180 Acres of said property HARRISON & JOHNSTON ATTORNEYS AT LAW WINCHESTER, VIRGINIA set aside on the attached plat for the widening of Fox Drive (Route 739). The 'Trust, with Benham's approval, does hereby subdivide the above described property as shown on the attached plat. The property subdivided is a portion of the land conveyed to the Trust herein by C. D. Hylton, et ux, by deed dated March 6, 1981 and recorded in the Clerk's Office of the Circuit Court of Frederick County, Virginia in Deed Book 511, at Page 1 and at Page 5. The following lots shall have the following rights of way running with the land: A. Parcels 2, 3 and 4 shall have a twenty (20) foot wide right of way for purposes of ingress and egress from their Western boundary lines to Route 522 over a forty (40) foot wide strip of land being a portion of the Shopping Center parcel. The Trust shall have the right to designate the location of the right of way and to move the right of way at its expense. B. Parcel 5 shall have a twenty (20) foot wide right of way for purposes of ingress and egress from its Eastern boundary line to Route 522 over a forty (40) foot wide strip of land being a portion of the Shopping Center parcel. Parcel 7 shall have a twenty (20) foot wide right of way for purposes of ingress and egress along the Southern side of its Southern boundary line to Fox Drive. The Trust shall have the right to designate the exact location of the right of way and to move the right of way (at its expense). D. Parcels 5, 6 and 7 shall have a right of way for surface water drainage over the area marked "Drainage Esm't". F. Parcels 3 and 4 shall have a thirty (30) foot wide right of way for surface water drainage Westward to the "Drainage Esm't" area. G. The owners of Tract 7 shall have the right to designate the location of the right of way and to move same at its expense. Parcels 1 through 7 are subject to the following restrictions which are to constitute covenants real and running with the land and shall be binding on all parties and persons claiming under them, and shall be for the benefit of and constitute limitations upon all future owners in said Subdivision: SET BACK REQUIREMENTS: 1. The surface of all lots which are not covered by buildings, lawns or landscaping shall be treated so as to be dust free. 2. All buildings constructed on Parcel 2 shall be located as near as practical to the Eastern boundary of said lot. This restriction is for the benefit of the 9.5180 Acre Parcel and is only enforceable by the Trust, not by its assigns. PARKING: 3. No vehicular parking whatsoever shall be permitted on any street, public or private, shown on the attached plat. There shall be maintained on each lot facilities for parking and - 4 - materials loading and unloading sufficient to serve the business conducted ont the lot without using adjacent streets. All driveways and off street parking areas shall be paved or treated in such a manner as to be dust free. USES: 4. No lot shall be permitted to be used for a junk or salvage yard. 5. No lot shall be used in a manner that is offensive to the use of the other lots by reason of odor, fumes, dust, dirt, smoke, industrial waste or television or radio interference. LANDSCAPING AND SCREENING: 6. The exterior of all structures and all walks, driveways, parking areas, lawns and landscaping shall be maintained in good repair and condition. 7. No open storage shall be permitted on any lot unless adequately protected by screening. UTILITIES: 8. All exterior lighting shall be installed by concealed wiring. 9. All on -site electrical, telephone, and other utility lines shall be underground from street to building and shall be installed in buried conduit. DESTRUCTION OF BUILDING OR OTHER STRUCTURES: 10. The proposed drainage along Route 522 to be adjusted as noted on Plan Sheet 1 of 1, showing increasing the outfall pipe to 60' of 53" x 831, RCEP and mitering the outlet end on a 2:1 slope. Due to the high velocity of flow, erosion control stone standard EC-1, type A and B to be installed at the outlet end of the pipe as noted. 2. A manhole opening is to be provided in the box culvert junction for access. 3. The drainage on the proposed entrance road appears satisfactory.
