and between KRA FOOD SERVICE. L.L.C., a Virginia Limited Liability Company, parry of
the first part, hereinafter called the Grantor, and THE COUNTY OF FREDERICK,
VIRGINIA, party of the second part, hereinafter called the Grantee for indexing purposes and
THE FREDERICK COUNTY SANITATION AUTHORITY, party of the third part,
hereinafter called the Grantee for indexing purposes, and VIRGINIA DEPARTMENT OF
TRANSPORTATION, party of the fourth part, hereinafter called the Grantee for indexing
purposes.
n WHEREAS, the Grantor is the owner of a certain tract or parcel of land containing
5.6490 Acres, lying and being situate on the West side of Fox Drive (Virginia Secondary Route
1 739) in Stonewall Magisterial District, Frederick County, Virginia and the same land conveyed
to KRA Food Service, L.L.C. by Deed dated June 22, 1998 of record in the Clerk's Office of the
Circuit Court of Frederick County, Virginia in Deed Book 907 at Page 1670 and by Boundary
Line Adjustment of record in the aforesaid Clerk's Office as Land Record 01-0013020; and
WHEREAS, the Grantor desires to subdivide the same into Lots 1 through 4 inclusive,
Foxe Towne Plaza and as more particularly shown on Plat of Survey drawn by P. Duane Brown,
Land Surveyor, dated the 19th day of February, 2003. The subdivision of said real estate as it
now appears on the aforesaid attached plat is with the free consent and in accordance with the
desires of the undersigned Grantor and the Grantor hereto further desires to subdivide the
aforesaid real estate in accordance with the provisions of "The Virginia Land Subdivision Act"
as are applicable and in force and effect as of the date of execution of this Deed of Dedication.
NOW THEREFORE, this Deed of Dedication wittnesseth: That for and inconsideration
of the premises and the benefits which will accrue by reason of this Dedication, the Grantor does

hereby subdivide all of that certain tract or parcel of land into Lots 1 through 4, Foxe Towne
Plaza as shown on the Plat of Survey drawn by P. Duane Brown, Land Surveyor, dated the 19th
day of February, 2003, and by this reference made a part hereof as if set out in full and which plat
is drawn in conformity with the Final Master Development Plan for Foxe Towne Plaza on file in
the Office of the Frederick County Department of Planning and Development. This is the same
land conveyed to KRA Food Service, L.L.C. of record as aforesaid.
Section 1: Surface Water Drainage Easement: The property hereby dedicated is subject
to those certain drainage easements designated "Drainage Esmt." on the aforesaid Final Master
Development Plan of the County of Frederick for the purpose of Surface Water Drainage
Easement. No structures of any kind which substantially impede or obstruct the flow or ponding
of surface drainage water may be placed within said Surface Water Drainage Easement designated
on the aforesaid plat. The Drainage Easement may not be altered or modified without the prior
consent of the County of Frederick, and the Grantor does hereby grant and convey unto the
County of Frederick a Perpetual Rights of Way or Easements over the aforesaid designated
Drainage Easements for the purpose of so providing surface drainage. Grantor does further agree
that the County of Frederick shall be under no obligation to maintain said drainage easements,
provided, however, that in the event the Grantor or its successors and assigns fails to maintain
said easements then and in that event the County of Frederick shall have the right to maintain the
same and charge the owner pursuant to the provisions of the Frederick County Ordinances related
thereto.
Section 2: Easement for VDOT. The property subdivided hereby is subject to certain
permanent ingress/egress easement which is shown on Sheet 6 of the survey drawn by P. Duane

Brown dated the 19th day of February, 2003 attached hereto and by this reference made a part
hereof as if set out in full; and the Grantor does hereby grant and convey a Non -Exclusive
Permanent Ingress -Egress Easement to the Virginia Department of Transportation for its use as
it shall deem necessary.
Section 3 : Sewer and Water Easement. The property subdivided hereby is subj ect to those
certain easement(s) designated Sanitary Sewer and Water Easements on the aforesaid plat. The
Grantor does hereby grant and convey unto Frederick County Sanitation Authority, Perpetual
Rights of Way or Easements over the aforesaid rights of way for the installation and maintenance
of water and sewer mains and any related facilities designated on the aforesaid plat as Sanitary
Sewer and Water Easement. The permanent easements established hereby for sewer mains and
water mains grant to the Frederick County Sanitation Authority the perpetual right to operate and
maintain sanitary sewer mains and water mains, including the right to go on, over and upon said
permanent easements for the purpose of operating, maintaining, repairing and replacing the same
as needed. The Grantor shall retain the right to use this land which is subject to the easement
acquired herein in any manner which shall not interfere with the use and enjoyment of said rights
by the Frederick County Sanitation Authority.
The Grantor shall at all times have the right to cross over and upon the said easements and
to use the surface over the easements in such manner as will neither injure nor interfere with the
operation or maintenance of the sanitary sewer main and water main, except that no building or
other structure shall be erected over said permanent easements unless by mutual consent of the
parties or their successors. Whenever the enjoyment of its rights hereunder require the Frederick
County Sanitation Authority to disturb the surface of the ground, it shall be the obligation of the
Frederick County Sanitation Authority to restore the same to its condition prior to being so

disturbed at the Frederick County Sanitation Authority's expense. 'J
Section 4: The Grantor does hereby dedicate and establish a private, fifty -foot (50') wide
ingress/egress easement for the benefit of Lot 2 and Lot 3 over Lots 2, 3 and 4 Foxe Towne Plaza,
as shown on the plat of survey drawn by P. Duane Brown dated February 19, 2003 and which is
by this reference made a part hereof as if set out in full. Said fifty -foot (50') wide ingress/egress
easement to/from Foxridge Lane and Ferris Property shall be non-exclusive and appurtenant to
Lot 2, Lot 3 and Lot 4 and shall be maintained by the owner of each lot on an annual basis of
proration for upkeep and expense of the private ingress/egress easement. The amount which each
lot owner shall pay shall be the proportionate share determined by computation by dividing the
square footage of the improvements on each lot of the Foxe Towne Plaza by the total square
footage of all improvements on all three lots constituting Lots 2 - 4 of Foxe Towne Plaza.

Land Surveyor, dated the 19th day of February, 2003. The subdivision of said real estate as it
now appears on the aforesaid attached plat is with the free consent and in accordance with the
desires of the undersigned Grantor and the Grantor hereto further desires to subdivide the
aforesaid real estate in accordance with the provisions of "The Virginia Land Subdivision Act"
as are applicable and in force and effect as of the date of execution of this Deed of Dedication.
NOW THEREFORE, this Deed of Dedication wittnesseth: That for and inconsideration
of the premises and the benefits which will accrue by reason of this Dedication, the Grantor does
hereby subdivide all of that certain tract or parcel of land into Lots 1 through 4, Foxe Towne
Plaza as shown on the Plat of Survey drawn by P. Duane Brown, Land Surveyor, dated the 19th
day of February, 2003, and by this reference made a part hereof as if set out in full and which plat
is drawn in conformity with the Final Master Development Plan for Foxe Towne Plaza on file in
the Office of the Frederick County Department of Planning and Development. This is the same
land conveyed to KRA Food Service, L.L.C. of record as aforesaid.
Section 1: Surface Water Drainage Easement: The property hereby dedicated is subject
to those certain drainage easements designated "Drainage Esmt." on the aforesaid Final Master
Development Plan of the County of Frederick for the purpose of Surface Water Drainage
Easement. No structures of any kind which substantially impede or obstruct the flow or ponding
of surface drainage water may be placed within said Surface Water Drainage Easement designated
on the aforesaid plat. The Drainage Easement may not be altered or modified without the prior
consent of the County of Frederick, and the Grantor does hereby grant and convey unto the
County of Frederick a Perpetual Rights of Way or Easements over the aforesaid designated
Drainage Easements for the purpose of so providing surface drainage. Grantor does further agree
that the County of Frederick shall be under no obligation to maintain said drainage easements,
provided, however, that in the event the Grantor or its successors and assigns fails to maintain
said easements then and in that event the County of Frederick shall have the right to maintain the
same and charge the owner pursuant to the provisions of the Frederick County Ordinances related
thereto.
Section 2: Easement for VDOT. The property subdivided hereby is subject to certain
permanent ingress/egress easement which is shown on Sheet 6 of the survey drawn by P. Duane

Brown dated the 19th day of February, 2003 attached hereto and by this reference made a part
hereof as if set out in full; and the Grantor does hereby grant and convey a Non -Exclusive
Permanent Ingress -Egress Easement to the Virginia Department of Transportation for its use as
it shall deem necessary.
Section 3 : Sewer and Water Easement. The property subdivided hereby is subj ect to those
certain easement(s) designated Sanitary Sewer and Water Easements on the aforesaid plat. The
Grantor does hereby grant and convey unto Frederick County Sanitation Authority, Perpetual
Rights of Way or Easements over the aforesaid rights of way for the installation and maintenance
of water and sewer mains and any related facilities designated on the aforesaid plat as Sanitary
Sewer and Water Easement. The permanent easements established hereby for sewer mains and
water mains grant to the Frederick County Sanitation Authority the perpetual right to operate and
maintain sanitary sewer mains and water mains, including the right to go on, over and upon said
permanent easements for the purpose of operating, maintaining, repairing and replacing the same
as needed. The Grantor shall retain the right to use this land which is subject to the easement
acquired herein in any manner which shall not interfere with the use and enjoyment of said rights
by the Frederick County Sanitation Authority.
The Grantor shall at all times have the right to cross over and upon the said easements and
to use the surface over the easements in such manner as will neither injure nor interfere with the
operation or maintenance of the sanitary sewer main and water main, except that no building or
other structure shall be erected over said permanent easements unless by mutual consent of the
parties or their successors. Whenever the enjoyment of its rights hereunder require the Frederick
County Sanitation Authority to disturb the surface of the ground, it shall be the obligation of the
Frederick County Sanitation Authority to restore the same to its condition prior to being so
disturbed at the Frederick County Sanitation Authority's expense.

Section 4: The Grantor does hereby dedicate and establish a private, fifty -foot (50') wide
ingress/egress easement for the benefit of Lot 2 and Lot 3 over Lots 2, 3 and 4 Foxe Towne Plaza,
as shown on the plat of survey drawn by P. Duane Brown dated February 19, 2003 and which is
by this reference made a part hereof as if set out in full. Said fifty -foot (50') wide ingress/egress
easement to/from Foxridge Lane and Ferris Property shall be non-exclusive and appurtenant to
Lot 2, Lot 3 and Lot 4 and shall be maintained by the owner of each lot on an annual basis of
proration for upkeep and expense ofthe private ingress/egress easement. The amount which each
lot owner shall pay shall be the proportionate share determined by computation by dividing the
square footage of the improvements on each lot of the Foxe Towne Plaza by the total square
footage of all improvements on all three lots constituting Lots 2 - 4 of Foxe Towne Plaza.

to KRA Food Service, L.L.C. by Deed dated June 22,1998 of record in the Clerk's Office of the
Circuit Court of Frederick County, Virginia in Deed Book 907 at Page 1670 and by Boundary
Line Adjustment of record in the aforesaid Clerk's Office as .Land Record 01-0013020; and
WHEREAS, the Grantor desires to subdivide the sane into Lots 1 through 4 inclusive,
Foxe Towne Plaza and as more particularly shown on Plat of Survey drawn by P. Duane Brown,
Land Surveyor, dated the 19th day of February, 2003. The subdivision of said real estate as it
now appears on the aforesaid attached plat is with the free consent and in accordance with the
desires of the undersigned Grantor and the Grantor hereto further desires to subdivide the
aforesaid real estate in accordance with the provisions of "The Virginia Land Subdivision Act"
as are applicable and in force and effect as of the date of execution of this Deed of Dedication.
NOW THEREFORE, this Deed of Dedication wittnesseth: That for and inconsideration
of the premises and the benefits which will accrue by reason of this Dedication, the Grantor does

day of February, 2003, and by this reference made a part hereof as if set out in full and which plat
is drawn in conformity with the Final Master Development Plan for Foxe Towne Plaza on file in
the Office of the Frederick County Department of Planning and Development. This is the same
land conveyed to KRA Food Service, L.L.C. of record as aforesaid.
Section 1: Surface Water Drainage Easement: The property hereby dedicated is subject
to those certain drainage easements designated "Drainage Esmt." on the aforesaid Final Master
Development Plan of the County of Frederick for the purpose of Surface Water Drainage
Easement. No structures of any kind which substantially impede or obstruct the flow or ponding
of surface drainage water may be placed within. said Surface Water Drainage Easement designated
on the aforesaid plat. The Drainage Easement may not be altered or modified without the prior
consent of the County of Frederick, and the Grantor does hereby grant and convey unto the
County of Frederick a Perpetual Rights of Way or Easements over the aforesaid designated
Drainage Easements for the purpose of so providing surface drainage. Grantor does ftu-ther agree
that the County of Frederick shall be under no obligation to maintain said drainage easements,
provided, however, that in the event the Grantor or its successors and assigns fails to maintain
said easements then mid in that event the County of Frederick shall have the right to maintain the
same and charge the owner pursuant to the provisions ofthe Frederick County Ordinances related
thereto.
Section 2: Easement for VDor The property subdivided hereby is subject to certain
permanent ingress/egress easement which is shown on Sheet 6 of the survey drawn by P. Duane

Brown dated the 19th day of February, 2003 attached hereto and by this reference made a part
hereof as if set out ul full; and the Grantor does hereby grant and convey a Non -Exclusive
Pennanent Ingress -Egress Easement to the Virginia Department of Transportation for its use as
it shall deem necessary.
Sectio_ n 3: Sewer and Water Easement. The property subdivided hereby is subject to those
certain easement(s) designated Sanitary Sewer and Water Easements on the aforesaid plat. The
Grantor does hereby grant and convey unto Frederick County Sanitation Authority, Perpetual
Rights of Way or Easements over the aforesaid rights of way for the installation and maintenance
of water and sewer mains and any related facilities designated on the aforesaid plat as Sanitary
Sewer and Water Easement. The permanent easements established hereby for sewer mains and
water mains grant to the Frederick County Sanitation Authority the perpetual right to operate and
maintain sanitary sewer mains and water mains, including the right to go on, over and upon said
permanent easements for the purpose of operating, maintaining, repairing and replacing the same
as needed. The Grantor shall retain the right to use this land which is subject to the easement
acquired herein in any manner which shall not interfere with the use and enjoyment of said rights
by the Frederick County Sanitation Authority.
The Grantor shall at all times have the right to cross over and upon the said easements and
to use the surface over the easements in such manner as will neither injure nor interfere with the
operation or maintenance of the sanitary sewer main and water main, except that no building or
other structure shall be erected over said permanent easements unless by mutual consent of the
parties or their successors. Whenever the enjoyment of its rights hereunder require the Frederick
County Sanitation Authority to disturb the surface of the ground, it shall be the obligation of the
Frederick County Sanitation Authority to restore the same to its condition prior to being so

Section 4: The Grantor does hereby dedicate and establish a private, fifty -foot (50') wide
ingress/egress easement for the benefit of Lot 2 and Lot 3 over Lots 2,3 and 4 Foxe Towne Plaza,
as shown on the plat of survey drawn by P. Duane Brown dated February 19, 2003 and which is
by this reference made a part hereof as if set out in frill. Said fifty -foot (50') wide ingress/egress
easement to/:from Foxridge Lane and Ferris Property shall be non-exclusive and appurtenant to
Lot 2, Lot 3 and Lot 4 and shall be maintained by the owner of each lot on an annual basis of
proration for upkeep and expense of the private ingress/egress easement. The amount which each
lot owner shall pay shall be the proportionate share determined by computation by dividing the
square footage of the improvements on each lot of the Foxe Towne Plaza by the total square
footage of al l improvements on all three lots constituting Lots 2 - 4 of Foxe Towne Plaza.

I have had the opportunity to review the Foxe Towne Plaza final plats received by our office March 7,
2.003. The Master Development Plan (MDP) for the associated development was administratively
approved on January 28, 2003. i offer the following review comments:
I. The right-of-way for Foxridge Lane needs to be dedicated.
2. A 50' access easement needs to be included so that all lots have access to Foxridge Lane or
Fox Drive.
3. Lot 2 needs to have a 50' building restriction line off of RT. 522 and RT. 37 and Lot 3 needs
to have a 50' building restriction line off of RT. 37.
4. On sheet 4 of 6, include the width of the drainage easement that goes through lot 2.
5. On sheet 6 of 6, include the width of the sanitary sewer and water easement that goes through
lot 4.
Please address the above comments and resubmit. I have enclosed a marked set of final plats to assist

I have had the opportunity to review the Foxe Towne Plaza. final plats received by our office January 29, 2003.
The Master Development. Plan (MDP) for the associated development was administratively approved on
January 28, 2003. I offer the following review comments:
The correct Magisterial District is `Stonewall.'
I Provide a specific day of plat preparation.
_i. Provide the current use of each parcel.
Al. Provide property identification numbers for all adjoining properties (Fox Ridge).
5. Provide an area tabulation illustrating area of each lot, total area of subdivision, area in lots, and area
of right-of-way dedication.
6. The right-of-way legal reference for Fox Ridge Lane is unclear and the right-of-way width is not
provided.
7. The proposed dedication ofan iiigress/egresseasemeiittoVDOTinustbeadedicatioii of right-of-way
of a specific width.
8. Provide setback lines per B2 Zoning District as indicated.
Please address the above comments and resubmit. I have enclosed a marked set of preliminary final plats to
,..ssist with the revision process. Before the final plats are officially approved by this office, the approval
signatures of the Frederick County Sanitation Authority and the Virginia Department of Transportation must
