MAGISTERIAL DISTRICT: Gainesboro ADJACENT LAND USE AND ZONING: Single-family residential and vacant land use; RP (Residential Performance) and A-2 (Agricultural General) zoning. PROPOSED USE AND IMPROVEMENTS: Single-family detached lots, open space, Virginia Department of Transportation roads, sewer and water. REVIEW EVALUATIONS: VA Dept. of Transportation - See attached letter. Sanitation Authority - Plats 8 -28 are OK. Plats 1-6 are in City. Round Hill Fire Company - No comment. City of Winchester - City water & sewer will be provided to Fort Braddock Heights, Section 2, in accord with plans for water & sewer extensions as prepared by Dove and Associates. FCSA, County, and City approvals have been obtained. Contracts for the extensions have been forwarded for execution. Planning and Zoning - No objections. Final plats are drawn in accord with the approved master development plan. VDOT comments have been added to the final plats and a 20 foot easement has been provided to the open space area. Due to the type of soils in this area, we feel it is in our best interest to continue with this policy. There are several locations where the storm is located outside of the street right-of-way. Additional right-of-way or permanent sewer easements will be required at these locations. Regarding the proposed water and sewer installation, it has been our policy to locate utilities along the aright -of -way line. Since Fort Braddock Court lies within the City of Winchester, we assLuurne the City will review the street drainage and proposed detention pond. Before making our final comment, we will need a complete set of the proposed subdivision plans. - Sanitation Authority - Design appears to meet County fire regulations. This is within the zoning standards for such disturbance. A portion of the steep slope area will be in open space, 15% open space is required. This plan shows 35% or 3.14 acres of open space. There are no recreational facilities required. However, the applicant is proposing a recreation facility bonus and a pedestrian/bike path bonus. The location of these bonus improvements are shown on this plan and will need to be detailed on the final plan. There are no buffers and screens required. All lots and dimensional requirements appear to meet the RP (Residential Performance) standards. General parking, access, and layout appear satisfactory for this preliminary plan. The applicant is not required to show lot lines at this point in the process. However, the applicant has shown lot lines and proposed lots which use pipe stem driveways as access to public streets for certain lots. Technically, such an approach does not violate the ordinance. In addition, pipe stem or flag lots are useful in some situations. However, in this case it appears that such an approach is being used to avoid street construction. The County Code is not clear on this issue, but it is the staff's opinion that it is not the intent of the Subdivision Ordinance as expressed in Section 3-4-8, to use flag lots to avoid street construction. This Preliminary Master Development Plan conforms with the Master Plan requirements and the requirements for single-family cluster lots in the RP (Residential Performance) Zoning District. The vote for such Lot shall be exercised as they among themselves determine, but in no event shall more than one vote be cast with respect to any Lot. A R T I C L E V BOARD OF DIRECTORS Section 1. Term. The affairs of the Association shall be managed by a Board of not less than three (3), but no more than five (5) directors, who must be members of the Association. The initial Board of Directors shall be appointed by the Association and serve until the first annual meeting following conveyance of the first Lot in the Properties; thereafter, the Board of Directors shall be elected by the membership as determined in the By -Laws of the Association. A R T I C L E V I PROPERTY RIGHTS IN COMMON PROPERTIES Section 1. Members' Easements of Enjoyment. (b) The rights of the Association to suspend the voting rights and the right to the use of the Common Elements by a member for any period during which any assessment against his Lot remains unpaid; and for a period not to exceed thirty (30), days for any infraction of its published rules and regulations. (c) The rights of the Association to dedicate or transfer all of part of the Common Elements to any public agency, authority, or utility for such purposes and subject to such conditions as may be agreed to by the members. No such dedication or transfer shall be effective unless an instrument signed by members entitled to cast two-thirds (2/3) of the votes has been recorded; agreeing to such dedication or transfer, and unless written notice of the proposed action is sent to every member not less than twenty- five (25) days nor more than fifty (50) days in advance. Section 2. Delegation of Use. Any Member may delegate, in accordance with the By -Laws, his right of enjoyment to the Common Elements to the members of his family, his tenants, or contract purchasers who reside on the property. Section 3. Title to the Common Elements. The Declarants hereby covenant for themselves, their heirs and assigns, that they will convey fee simple title to the Common Elements to the Association, prior to the conveyance of the first Lot. In the event of dissolution of the Association, other than incident to a merger or consolidation, the assets of the Association shall be dedicated to an appropriate public agency to be used for purposes similar to those for which the Association was created. In the event that such dedication is refused acceptance, such assets shall be granted, conveyed and assigned to the then owners of each lot on an equal basis and which am ownership shall be devoted to such similar purposes as stated herein. A R T I C L E V I I COVENANTS FOR MAINTENANCE ASSESSMENTS FOR THE ASSOCIATION Section 1. Assessments. The Declarants for each Lot owned within the Properties, hereby covenant, and each Owner of any Lot by acceptance of a deed therefor, whether or not it shall be so expressed in any such deed or other conveyance, is deemed to covenant and agree to pay to the Association 1) annual assessments or charges, and (2) special assessments for capital improvements, such assessments to be fixed, established, and collected from time to time as hereinafter provided. The said Committee is empowered to reject any plans and/or specifications which it does not deem adequate. The Committee approval or disapproval as required in these covenants shall be in writing. In the event the Committee, or its designated representatives, fails to approve or disapprove within thirty (30) days after plans and specifications have been submitted to it, approval will not be required and the related covenants shall be deemed to have been fully complied with. A R T I C L E I X USE RESTRICTIONS AND COVENANTS All lots of Fort Braddock Heights are subject to the following covenants and restrictions which shall be considered covenants real, running with the land, for the protection of the owners of all the said lots in this subdivision and for their successors in title and for the protection of the DECLARANTS, their heirs, assigns and successors in title, and must be set out in full or incorporated by reference in all deeds of conveyance of lots in this subdivision, to -wit: 1. All lots shall be used for residential purpose only) and no building or structure may be erected upon said lots except) for residential purposes. 2. No more than one single-family residence shall be erected on any lot. DECLARANTS reserve the right to disapprove the exterior design of any and all houses constructed on the subject lots. No construction shall be allowed without the plans and specification of such having been approved by DECLARANTS. 4. No poultry or livestock shall be kept or maintained on said lots nor may any animals be kept except household pets. 5. No nuisance, noxious or offensive activities shall be permitted or maintained or said lots. No TV satellite antenna dishes shall be permitted on the lots. 6. No structure may be built closer to any street than thirty-five (35) feet and this setback shall apply to any and all portions or parts of any building or structure erected thereon including outbuildings, porches, bay windows and overhang. 7. No building or structure, nor any part thereof, may be erected closer than ten (10) feet to the common property line of an adjoining lot. 8. No abandoned motor vehicles will be permitted on any lot or parking area. (For this purpose, an abandoned motor vehicle is defined as one which bears no or expired license plates or has not been operated within six (6) months on a public street or highway.) 9. No sign of any kind shall be displayed to the public view on any lot except one (1) sign of an area not greater than five (5) square feet advertising the property for sale or rent or a similar sign of a builder or architect exhibited during construction and sales period. 10. No business may be conducted or carried on nor mayl any profession be practiced on any of the subject lots. 11. V IRGINIA 22601 to, water, sewer, gas, electricity, telephone and television cable, shall be kept and maintained underground and this restriction shall apply to distribution service lines and connections. 12. No temporary structure of any kind may be constructed or maintained on any lot except those necessary in connection with the construction of permanent improvements permitted within the subdivision and even construction -related temporary structures shall not be maintained for a period exceeding twelve (12) months. 13. There is reserved a ten foot (10') easement along all property lines for public utilities and a further reservation of the right to grant easements or rights of way therefor under said ten foot (101) strip. 14. Invalidation of any one of these covenants or restrictions by judgment or Court order shall in nowise affect any of the other provisions which shall remain in full force and effect. 15. No individual sewage disposal system shall be permitted on any lot. 16. No individual water supply system shall be permitted on any lot. A R T I C L E X EASEMENTS Section 1. Sewer and Water Easement. Enforcement. The Association, its successors or assigns, or any Owner, shall have the right to enforce, by any proceeding at law or in equity, all restrictions, conditions, covenants, reservations, liens and charges, now, or. hereafter, imposed by the provisions of this Declaration. Failure by the Association, its successors or assigns, or by any Owner to enforce any covenant or restriction herein contained shall in no event be deemed a waiver of the right to do so thereafter. Section 2. Amendment. The covenants and restrictions of this Declaration shall run with the land and bind the land, and shall inure to the benefit of and be enforceable by the Association, or the Owner of any Lot subject to this Declaration, their respective legal representatives, heirs, successors and assigns, for a term of thirty (30) years from the date this Declaration is recorded, after which time, said covenants shall be automatically extended for successive periods of ten (10) years. The covenants and restrictions of this Declaration may be amended during the first thirty (30) year period by an instrument signed by not less than ninety percent (90%) of the Lot Owners, and thereafter, by an instrument signed by not less than seventy- five percent (75%) of the Lot Owners. Any amendment must be properly recorded.
