Dear Mr. Chairman and Members of the Board of Supervisors:
I have been engaged by Toll VA IV, L.P. ("Toll") to represent its interests with regard to
a request to amend the proffers for the Haggerty property. Said proffer amendment includes an
alteration of a previously approved General Development Plan ("GDP"), which connects the
road network of the Haggerty property to the Toll property. If the proposed Haggerty proffer
amendment is approved, then the connection that currently exists between .Toll's property and
the Haggerty property will be severed. Further, it is Toll's understanding that if the Haggerty
proffer is accepted, then Toll will be forced to seek an amendment of its previously approved
Master Development Plan ("MDP").
Toll has been in contact with the owners of the Haggerty tract concerning the Haggerty
owners' proposed request to amend the proffers. Toll remains willing to work with the owners
of the Haggerty property and Frederick County Planning Staff to reach a solution that meets the
needs of the owners of the Haggerty tract, without requiring Toll to amend its approved MDP.
Toll has previously proceeded through the MDP approval process in September, 2004.

ordinances. While Toll has no objection to the adjoining Haggerty property seeking to amend its
GDP and its road connection to Toll's property, Toll does not consent to an amendment of an
adjoining property owner's GDP that would have the effect of not connecting with the Toll
property and which would place Toll in a position, which is unfairly prejudicial, where it would
be required to seek an amendment to its previously approved MDP.

Dear Mr. Lowman:
This letter is in response to your e-mail dated January 24, 2006, regarding our meeting of January 20,
2006. At this meeting we discussed the community center for the Twin Lakes Overlook
Development. You had questions regarding the trail system and community center.
The first question was regarding ADA requirements for wood chip trails. There are ADA guidelines
and requirements that apply for trail systems. You will need to consult your engineer about these
requirements. Please note this trail system is proffered as per Rezoning #15-99, and does not count
toward the recreational unit facilities cost as required by the Frederick County Zoning Ordinance.
The second question involved the type of structure of the community center and accessibility to the
center. The approved Master Development Plan (MDP # 05-04) calls for the existing dwelling to be
remodeled and to be used as the community center for Twin Lakes Overlook. You indicated at our
meeting that Toll Brothers is requesting to build a 30 x 30 square foot picnic gazebo, in lieu of
remolding the existing dwelling currently located on the property. You presented an illustration of
this gazebo that could only be of use half the year (spring and summer). This proposed picnic gazebo
does not meet the requirement of an appropriate year-round community center for the Twin Lakes
Overlook Development
The County of Frederick will require that this gazebo be constructed for year-round utilization. In
order to use this proposed picnic gazebo as a community center, the following issues shall be
required and addressed at site plan submission:
1. Constructed for year-round use.
2. Connected for electrical service.
3. Connected to public sewer and water to address bathroom facilities.

4. Meet all parking, ADA, and accessibility requirements as required by the Frederick County
Zoning Ordinance.
5. Meet all other requirements of the Frederick County Zoning Ordinance.
If theses issues are resolved, the proposed gazebo will meet the community center requirements for
the Twin Lakes Overlook Development.

SITE TO CREATE A LOOPED SYSTEM. THE EXISTING WATER DISTRIBUTION SYSTEM IS
PART OF THE FREDERICK WATER WATER SYSTEM. A 12- WATER MAIN IS PROPOSED
WITH THE HAGGERTY BOULEVARD PLAN TO CONNECT FROM TWIN LAKES TO THE FWSA
OPEOUON WATER RECLAMATION FACILITY.
9. ELECTRIC, GAS, AND COMMUNICATION UTILITIES WILL BE COORDINATED DURING FINAL
ENGINEERING PRIOR TO CONSTRUCTION.

Frederick County Public Schools has reviewed the Opequon Crossing Master Development Plan
application submitted to us on January 3, 2022. Our understanding is that this development proposal
includes 407 single-family detached units and 167 single-family attached units. We estimate that this
development will house 212 students. In order to properly serve these additional students, Frederick
County Public Schools would spend an estimated $2,775,000 more per year in operating costs (or $4,834
average per unit per year) and an estimated $13,190,000 in one-time capital expenditures (or $22,979
average per unit). You will find, enclosed with this letter, a more detailed assessment of the estimated
impact of Opequon Crossing on FCPS, including attendance zone information.

• Future Route 37: Future Route 37 alignment, as included in the County's
geographic information system (GIS) records should also be shown. Although this
alignment is not proffered, it may have a future impact on the development and
should be provided for reference.
• Buffers: A category A type residential separation buffer is required between the
proposed single-family detached units (Phase II) and the adjoining Fieldstone
Development to the west (townhomes)(§165-203.02(C)(1)). The location and
extent of proposed buffers, with statements, profiles, cross sections or examples
clearly specifying the screening to be provided (§ 165-801.05(B)(10)).

4. Agency Approvals. Comment sheets (approvals) are required from the following
agencies: Frederick County Fire Marshal, Frederick County Department of Building
Inspections, Frederick County Department of Public Works (County Engineer),
Frederick County Department of G.I.S., Frederick County Parks & Recreation,
Frederick County Public Schools (FOPS), Frederick Water, and the Virginia
Department of Transportation (VDOT).
Additional review comments may be provided on subsequent submissions.

Environmental Features: Staff notes a proposed ordinance amendment to the definition for
steep slopes is under consideration by the Frederick County Board of Supervisors. The
definition may change the requirement to "land where the slope exceeds 35%." Staff anticipates
this change to be approved by the end of January 2022 and such change will need to be shown
on any plans approved after adoption of the ordinance amendment.
After you have revised the MDP, please resubmit (electronic submission preferred) so that
Staff may verify the information contained on the plan addresses the above comments. Once
all Planning & Development comments are addressed you will need to submit five (5) full size
hard copies, all request review agency comment letters, and a digital (.pdo of the Master
Development Plan is also required. Once this information is received, the MDP will be deemed
"administratively approvable" and signed by the Director of Planning and County
