Our File No. 600.001 Dear Mr. Chairman and Members of the Board of Supervisors: I have been engaged by Toll VA IV, L.P. ("Toll") to represent its interests with regard to a request to amend the proffers for the Haggerty property. Said proffer amendment includes an alteration of a previously approved General Development Plan ("GDP"), which connects the road network of the Haggerty property to the Toll property. If the proposed Haggerty proffer amendment is approved, then the connection that currently exists between .Toll's property and the Haggerty property will be severed. Further, it is Toll's understanding that if the Haggerty proffer is accepted, then Toll will be forced to seek an amendment of its previously approved Master Development Plan ("MDP"). Toll has been in contact with the owners of the Haggerty tract concerning the Haggerty owners' proposed request to amend the proffers. Toll remains willing to work with the owners of the Haggerty property and Frederick County Planning Staff to reach a solution that meets the needs of the owners of the Haggerty tract, without requiring Toll to amend its approved MDP. Toll has previously proceeded through the MDP approval process in September, 2004. Box 3542 Winchester, VA 22604 RE: Twin Lakes Overlook Community Center Dear Mr. Lowman: This letter is in response to your e-mail dated January 24, 2006, regarding our meeting of January 20, 2006. At this meeting we discussed the community center for the Twin Lakes Overlook Development. You had questions regarding the trail system and community center. The first question was regarding ADA requirements for wood chip trails. There are ADA guidelines and requirements that apply for trail systems. You will need to consult your engineer about these requirements. Please note this trail system is proffered as per Rezoning #15-99, and does not count toward the recreational unit facilities cost as required by the Frederick County Zoning Ordinance. The second question involved the type of structure of the community center and accessibility to the center. The approved Master Development Plan (MDP # 05-04) calls for the existing dwelling to be remodeled and to be used as the community center for Twin Lakes Overlook. You indicated at our meeting that Toll Brothers is requesting to build a 30 x 30 square foot picnic gazebo, in lieu of remolding the existing dwelling currently located on the property. You presented an illustration of this gazebo that could only be of use half the year (spring and summer). This proposed picnic gazebo does not meet the requirement of an appropriate year-round community center for the Twin Lakes Overlook Development The County of Frederick will require that this gazebo be constructed for year-round utilization. In order to use this proposed picnic gazebo as a community center, the following issues shall be required and addressed at site plan submission: 1. Constructed for year-round use. 2. Connected for electrical service. 3.
