REVIEW EVALUATIONS: 26 Single Family Detached Cluster VADept. of Transportation: Preliminary review indicated adequate sight distance for a secondary road connection. See attached letter dated August 22, 1988. Sanitation Authority. Approves the City of Winchester providing water and sewer services to the 26 lots in -the referenced subdivision. City of Winchester: See attached letter dated December 13,, 1989. Fire Marshal: Move fire hyd ant from west to east on Lot 4. Everything else will be satisfactory. It would be a great benefit to the community if the fire department had access across this property to subdivisions behind it. Ins ections Department: Shall comply to Use Group "R" (Residential), Section 309.0 of the BOCA Building Code. Planning _& Zoning: The proposed Single Family Detached Cluster housing is a permitted use in the RP zone. With the 26 units proposed on 8.99 acres the overall density is 2.9 units per acre which is well below the maximum allowed. The ordinance also requires a minimum area of10,000 square feet per dwelling unit, which should be easily met with the 26 units proposed on this site. Cluster housing requires 250 open space dedication or in -this case, 2.25 acres. The applicants are requesting a 100 reduction in open space through the use of 2 bonus points for installing underground utilities as provided for in the ordinance. This would result in 151 open space being required or 1.34 acres, the plan indicates that 1.35 acres are provided. ADDITIONS/CHANGES 1) The possibility of a connection to the end of Village Road in Heritage Hills Subdivision should be examined. The staff has contacted the VDOT's Edinburg office regarding the possibility of a connection. VDOT indicated no objection, but stated that turning lanes may be necessary if the through road were included. 2) The plan needs to show thezoning and use of all adjoining property. 3) A 50' full landscaped buffer is required along Route 657 rather than the 40' shown on the plan, a profile should also be provided. 4) Information on environmental features needs to be provided on -the plan. 5) The plan should indicate the applicant and owners name Staff Recommendation - 12/19/89 Approval with review agency comments and those of staff being addressed. Normally, the City requires a bond, letter of credit or otherwise to assure that the funds will be available for the construction of the water and sewer. However, in this case, as the property is located in Frederick County, the County has requested a letter of credit for the total contract cost of the water, sewer and streets (a copy of letter of credit attached). To avoid any duplication, Mr. Miller has agreed to assign a portion of their letter of credit or to execute any other papers that you might deem appropriate to protect the City in regard to the water and sewer construction. He is open to any suggestions you might have in order to provide you with part of the security they received. After you have had a chance to review the above, I would appreciate your calling Mr. Miller or myself in order to try to work out some arrangement that will protect the City and will not be a duplication. The Utilities Ccnmittee has decided to rearrmend that City Council approve a standard water and sewer extension contract at its regular meeting of December 13, 1988. The Carnuttee will further reccannend that said anal be contingent upon receipt of confirmation from both the County of Frederick and the Frederick �ation Author_yt that any sewer dischar e from within the subdivision is chargeable to the dooms allocation at the on Water Rec amation`Facility To date; tiei y Chas received the confirmation from tliie County of Frederick; however, we will still need same from the Sanitation Authority. Mains extended under the terms of the contract are at the developer's expense, and upon completion and acceptance become the property of the City of Winchester, Virginia. Contract execution will not occur until such time as all confirmations are received and until the City has approved detailed construction plans for the water and sewer extensions. Hopefully the above responds to your present needs. You will be advised of Councils decision following the December 13 meeting. I offer the following comments. - Final pavement design will be determined by a CBR Test conducted by VDOT at the developer's expense. - Materials used and method of construction shall apply to current observed VDOT Road and Bridge Specifications applicable during construction of this development. - A preconstruction conference held by the engineer- and/or developer with the attendance of the contractor, various County agencies and VDOT shall be conducted prior to initiation of work. - A land use permit shall be obtained for the entrance before any work is done on the right-of-way. - If mail boxes are to be placed along the roadway fronting lots, posts shall be set at the backside of shoulder or break of ditch slope. - Our review and comments are general in nature; should conditions in the field exist such that additional measures are warranted, such measures shall be completed to the satisfaction of the Department prior to inclusion into the Secondary System. - Attached is a copy of the minimum requirements and data for subdivisions streets and private entrances prior to acceptance into the Secondary System. "ohn Frederick Mall Land Trust recently purchased the above referE:nced property. Although the property is zoned O "multi -family", Frederick Mall has chosen to subdivide the property into single family lots, the subdivision plan having been submitted>last month to the Planning Commission. The subdivision plan is simple and generally acceptable by Steve MGyurisin. The problem - the water and sewer lines adjacent to the property belong to the City of Winchester, which services all three of the adjacent properties, and the City will not approve the servicing of the 9 Acres without an agreement with the County regarding it. I am advised that Ed Daley mailed a letter to you in January regarding the water and sewer problem and that no response has bean received by Daley. The City would like to have a policy for the handling of water and sewer to County land lying near City facilities, even if conditioned upon the County determining which County parcels shall be subject tc the policy. Such a pclic.r as it would apply to said 9 Acres would be for the City to supply both water and sewer, that the appropriate lines be metered so that the sewage would,be charged against the County's portion of the regional sewage, capacity, that the City's sewage lines servicing the subdivision be of sufficient size"to handle the additional sewage (should not be a problem regarding 26 units on the 9 Acres) anc that some compensation he paid the City For the use of its lines. 7ohn, if you would confirm the above with Ed Daley and discus,: some nominal fee, if any, for the use of lines, r R !
