Frederick County Public Works Requirements Provide the Responsible Land Disturber signature J block on the plans. Provide a seeding schedule in accordance with VESCH standard 3.31 and 3.32. Provide a 20-foot drainage easement for all concentrated flows within on- or off -site residential lots. Provide a minimum of 2% slope on grass channels. 1/ If lass than 2%, provide an alternative design. Any area in which drainage collects from more than three (3) lots shall be placed within a platted drainage easement. All silt fence shall be wire reinforced. Drop Inlets in areas accessible to the public will l� require a smaller grate opening. Ensure that the backwater condition for the post - developed 100-year storm does not impact adjacent properties. Provide the dewatering structure details for the proposed sediment basins. The details shall include N elevations, type of structures, pipe sizes, etc. Revised 01/21/07 Public Works Plan Review Checklist Page 4 of 4 • Patton Harris Rust & Associp Brooke Road Phase 2 Road Improvements Plan Frederick County, Virginia Erosion and Sediment Control Narrative August 11, 2008 Proiect Description The purpose of this project is to develop the road improvements associated with the development of the Winchester Industrial Properties in Fort Collier Industrial Park. Proposed Brooke Road Phase 2 is located off Park Center Drive, approximately 0.46 miles southwest from Park Center Drive and US Route 11 intersection in Frederick County, Virginia. The improvements associated with the proposed road encompass Kraft truck entrance, road widening, box culvert extension, and Brooke Road Phase 2-Park Center Drive intersection. Construction will consist of pavement widening, commercial entrance, storm drains and culverts, and the appropriate erosion and sediment control measures. All construction will be done within the VDOT right-of-way'limits, property owned by the developer. The total disturbed area during construction will be approximately 10.5 acres and the total impervious area created by this development will be approximately acres. Existing Site Conditions The site is partially disturbed with grading in the southeast corner of the limit of disturbance. The southwest side is currently vacant and covered with grass, some trees and brush areas. Slopes range from 0.5 to 37.0 percent. All existing and proposed slopes are shown in the plans. The limits of disturbance are clearly marked on the plans and every effort has been made to keep disturbed areas to a minimum. All areas not paved will have grass planted to facilitate erosion control. There are no known existing drainage and erosion problems for this site. Every effort has been made to control post -development erosion which include the use of outlet protection for the culvert extension and proposed culvert under Brooke Road Phase 2. The drainage areas of the pre and post -development can be seen in the Drainage Calculations, in Attachment C and also on the site plan. The existing topography and drainage ways of the site will help to reduce erosion on to adjacent properties. Adjacent Areas The site is bordered by open field to the Southeast and northeast, Kraft Food to the north, wooded area and industrial park to the southwest. Silt fencing shall be used to control sediment transportation to off site areas. Offsite Areas No offsite area shall be disturbed during construction. Soils The on site soils are Frederick Poplimento Loams (14B); Frederick Poplimento Loams, very rocky, 2 t o7 percent slopes (16B); Frederick Poplimento loams, very rocky, 7 to 15 percent slopes (16C). The first soil is 14B Frederick Poplimento loan -is. These gently sloping soils are very deep, and well drained. The surface layer consists of 5 to 7 inches of brown loam. The subsoil, to about 9 to 12 inches is silty clay loam or clay loam, below that to 60 inches is brown silty clay loam or clay. These soils are in the hydrologic soils group B. The second types of soils (16B and 16C) on site are Frederick Poplimento Loams which is well drained with slopes ranging from 2 to 15 percent. (A soil map is provided as Attachment A). These soils are in the hydrologic soils group B. Typically, the surface layer is 0 to 7 inches of loam. The subsoil, to about 5-12 inches is clay -loam or silty clay -loam, below that is clay. The bedrock is varies about 72-80 inches. The soil belong to hydrologic soil group B. All soil information was taken from USDA and SCS Soil Survey of Frederick County -Virginia. Critical Areas There are currently no critical areas associated with this site. Erosion and Sediment Control Measures 1.0 General 1.1 Description: A. Work Included: Erosion and sediment control operations and devices required for this work are indicated on the drawings and include but are not necess arily limited to: 1. Installation of temporary control devices; 2. Maintenance of temporary control devices; 3. Temporary -forms of stabilization; 4. Installation of permanent control devices; 5. Removal of devices and site restoration. 1.2 Standards: A. The following codes and standards, latest editions form a part of this specification, to the extent of all provisions applicable to the work required for this project, and as specifically referenced herein. 1. All work shall comply with the Virginia Erosion and Sediment Control Handbook and as amended by local codes and regulations. 2. VDOT Specifications and Standards. 1.3 Protection: A. Use all means necessaryto protect all materials incorporated into the work of this section before, during and after installation. In the event of damage, immediately make all repairs and replacements necessary to the approval of the Owner's Representatives and at no additional cost to the Owner. B. Maintain and protect all benchmarks, monuments and similar reference points and, if they are displaced or destroyed by these operations, replace same as directed at no additional cost to the Owner. 1.4 Permits: A. The owner will secure certificates and permits and pay for all fees required by local codes and regulations. Limit grading to onlythose areas involved in current construction activities. Limit length of time for exposure of unprotected graded areas. Permanent stabilization of graded areas shall be done within seven days after construction. If permanent stabilization cannot be provided, temporary seeding, mulching or other forms of stabilization shall be provided. B. Construction of the devices shall agree with the details shown on the plan subject to modifications thereof that the Inspector deems advisable. Regardless, the sediment control devices shall comply with all requirements of the Virginia Erosion and Sediment Control Handbook. They shall remain in place until all surfaces within the project are stabilized such that siltation will not occur; i.e., all upstream areas from the control devices have vegetation established, mulch in place or furnished pavement completed. All temporary erosion and sediment control measures shall be removed within 30 days after final site stabilization or after the temporary measures are no longer needed, unless otherwise authorized by the local program authority. Trapped sediment and the disturbed soil areas resulting from the disposition of temporary measures shall be removed off site or permanently stabilized to prevent further erosion and sedimentation (4VAC50-30-40 Minimum Standard No. 18). C. The Contractor agrees to hold the Owner or any of its agents harmless from any and all liability or damage that may arise from a violation of the siltation ordinance and agrees to indemnify them against any loss. D. Underground utility lines shall be installed in accordance with the following standards in addition to other applicable criteria (4VAC50-30-40 Minimum Standard No. 16): 1. No more than 500 linear feet of trench may be opened at one time. 2. Excavated material shall be placed on the uphill side of trenches. 3. Effluent from de -watering operations shall be filtered or passed through an approved sediment trapping device, or both, and discharged in a manner that does not adversely affect flowing streams or off -site property. 4. Restabilization shall be accomplished in accordance with these regulations. 5. Applicable safety regulations shall be complied with. E. Soil Stabilization: Permanent or temporary soil stabilization shall be applied to denuded areas within seven days after final grade is reached on any portion of the site. Temporary soil stabilization shall be applied within seven days to denuded areas that may not be at final grade but will remain dormant (undisturbed) for longer than 30 days. Permanent stabilization shall be applied to areas that are to be left dormant for more than one year (4VAC50-30-40 Minimum Standard No. 1). During construction of the project, soil stockpiles and borrow areas shall be stabilized or protected with sediment trapping devices (i.e., silt fence). Contractor is responsible for the temporary protection and permanent stabilization of all soil stockpiles on site as well as borrow areas and soil intentionally transported from the project site (4VAC50-30-40 Minimum Standard No. 2). Permanent stabilization shall not be considered established until a ground cover is achieved that, is uniform, mature enough to survive and will inhabit erosion (4VAC50-30-40 Minimum Standard No. 3). Permanent Stabilization: All disturbed areas not paved will receive at a minimum 4" of topsoil if required (see Topsoiling STD &SPEC 3.30) and be seeded as follows: 125 lbs. Minimum of three (3) up to five (5) varieties of bluegrass from the approved list for use in Virginia. 20 lb. Annual Rye per ac. 1000 lbs. 10-20-10 Fertilizer per ac. 3 tons agricultural limestone per ac 2 tons straw mulch per ac. Permanent seeding will occur as a final phase of construction. Temporary Stabilization: Seeding to stabilize areas left denuded for more than seven days, but not yet at final grade shall be as follows: 60 lbs. German Millet per ac. (May through August 15) 60 lb. Annual Rye per ac. (August 15 through April) 4501bs. 10-20-20 Fertilizer per ac. 3 tons agricultural limestone per ac 2 tons straw mulch per ac. Seeded areas to be watered and cared for as necessary to provide grass emergence. F. Description of Controls: Control will be exercised through sequence of land disturbing operations, limiting duration of exposure of unstabilized areas and installation and maintenance of physical control devices coordinated with sequence of construction. Details for the standards referenced below are included on the plans. The devices to be used on the site are also shown on the drawings and include the following: 1. Construction entrances - (STD & SPEC 3.02) There is a high potential for tracking mud on to adjacent roads during wet site conditions. Construction entrances are needed at the location shown on the plans to clean the tires of vehicles and equipment exiting the job site. 2. Silt Fence - (STD & SPEC 3.05-1) Silt fencing shall be placed along the down -slope side to filter sediments before runoff exits the construction area. 3. Storm Drain Inlet Protection- (STD &SPEC 3.07) Storm drain inlet protection shall be installed immediately following installation of stormwater controls or prior to construction activities for existing storm drains, to prevent sediment from entering the storm drains 4. Culvert Inlet Protection - (STD &SPEC 3.08) Culvert inlet protection shall be installed immediately following installation of stormwater controls or prior to construction activities for existing culverts, to prevent sediment from entering the storm drains. Outlet Protection - (STD & SPEC 3.18) Riprap outlet protection has been sized to prevent erosion at culvert outlets. Riprap aprons shall be constructed to the dimensions tabulated on the Plans. See VDOT detail is EG1 6. Rock Fill Check Dams- (STD & SPEC 3.20) Rock check dams shall be constructed at locations shown on the plans. Check dams shall be installed in accordance with the detail provided on the plans 7. Soil Stabilization Blankets and Matting — (STD & SPEC 3.36) Soil stabilization blankets and matting are designed to aid in controlling erosion on critical areas by shielding exposed soil from impact erosion and promoting the establishment of vegetation. Treatment 1 is equivalent to VDOT EC-2. Treatment 2 is equivalent to VDOT EC-3. G. Sequence of Land Disturbing Activities: 1. General: All applicable mechanical controls are to be constructed as the first item of work. Following their completion, rough grade, finish grade, and install appropriate erosion and sedimentation aids. Before newly constructed stormwater conveyance channels or pipes are made operational, adequate outlet protection and any required temporary or permanent channel lining shall be installed in both the conveyance channel and receiving channel (4VAC50-30-40 Minimum Standard No. 11). Retain control devices until final stabilization of all areas or as directed by the Inspector. Sequence of Construction: a. First Phase: 1. Construction entrances; 2. Install wire silt fence; 3. Widen Park Center Drive east side; 4. Improve Kraft Food truck entrance; 5. Install box culvert extension 6. Install culvert inlet and outlet protection. b. Second Phase: 1. Strip topsoil to stockpile area if applicable. 2. Provide vegetative cover if over 7 days; 3. Install culvert under Brooke Road Phase 2 near Park Ctr Drive intersection; 4. Install culvert inlet protection and outlet protection; 5. Rough grade. c. Third Phase: 1. Install utilities if applicable; 2. Install roadway stone base; 3. Finish grade and paving; 4. Install rock check dams along Brooke Road Phase 2. 5. Seeding of disturbed areas not paved. 6. Seed stockpiles of surplus soils. 7. Removal of temporary sediment control measures. Maintenance Program: All control measures are to be inspected daily bythe site superintendent or his representative. Any damaged structure should be repaired at the close of the day. Inlet protection devices and silt fencing should be cleaned at 50% capacity and spread on -site where practical. Control strictures shall not be removed until all areas above have been finally stabilized and seeded areas established. No control shall be removed without the site inspector's prior approval. The daily control measure inspections by the contractor shall be documented to indicate findings and corrective action taken. These reports shall be submitted to the authorities once every two week's basis. Where sediment is transported onto a paved or public road surface, the road surface shall be cleaned thoroughly at the end of each day. Sediment shall be removed from the roads by shoveling or sweeping and transported to stockpile areas. Street washing shall be allowed only after sediment is removed in this manner. (4VAC50-30-40 Minimum Standard No. 17). 3.0 Storm -water Management: All new on -site storm structures have been sized to pass the appropriate post development storm event as outlined in the VDOT drainage manual using the Rational Method. Storm culvert and storm drain inlet sizing calculations are provided in Attachment C. The existing three (3) 9'x4' box culverts under Park Center Drive are adequate to handle the peak flows from the 10 year and 25 year storm events without over topping the road. The box culverts will need to be extended approximately 6 feet at the west side and 16 feet at the east side to accommodate proposed Brooke Road Phase 2. The presented master development plan dated May 10, 2007 is acceptable. Before making any final comments, this office will require a complete set of site plans, drainage calculations and traffic flow data from the I.T.E. Trip Generation Manual, Seventh Edition for review. VDOT reserves the right to comment on all right-of-way needs, including right-of-way dedications, traffic signalization, and off -site roadway improvements and drainage. Prior to construction on the State's right-of-way, the developer will need to apply to this office for issuance of appropriate permits to cover said work. Frederick County Fire Marshal: Plan approval recommended. Frederick County Public Works: The revised MDP for Winchester Industrial Properties, LLC dated May 20, 2007, has adequately addressed the intent of our previous review comments. We recommend that the note referencing the geotechnical evaluation shown on Sheet 1 of 2 be amended to read "prior to submittal of the detailed site plans". A resubmission of the MDP will not be required. However, we would appreciate a copy of the revision to Sheet 1 of 2 reflecting the above change. Also, we noted that it is the intent of the developer to utilize the existing stormwater pond in the development of the pasta tract. We have no objection to this approach, assuming that the stormwater calculations and as built conditions support this use. However, during the construction phase of the site development, it will be necessary to remediate a sinkhole that has developed within this stormwater detention pond near the outfall. The extent of this remediation should be included within the scope of the geotechnical evaluation proposed on Sheet 1 of 2. The purpose of the master development plan is to promote orderly and planned development of property within Frederick County that suits the characteristics of the land, is harmonious with adjoining property and is in the best interest of the general public. B) Location The subject properties are located on Brooke Road (Route 1328) in and adjacent to the Fort Collier Industrial Park. C) Site History "Pasta Tract" 54-A-36T: The original Frederick County Zoning Map (U.S.G.S. Winchester Quadrangle) identified this parcel/area as being zoned M1 (Light Industrial). The Fort Collier Industrial Park . was originally master planned in 1990 and was revised in 1991 and 1998. "Seefried Tract" 54-A-91A (formerly parcels 89 and 91): The original Frederick County Zoning Map (U.S.G.S. Winchester Quadrangle) identified all of 54-A-89 as being zoned A-2 (Agricultural General) and 54-A-91 as being split zoned A-2 and MH-1 (Mobile Home Community). With rezoning #14-83, the remainder of 54-A-91 was rezoned from A-2 to MH-1. The County's agricultural zoning districts were combined to form the RA (Rural Areas) District upon adoption of an amendment to the Frederick County Zoning Ordinance on May 10, 1989. The corresponding revision of the zoning map resulted in the re -mapping of parcel 54-A-89 and all other A-1 and A-2 zoned land to the RA District. On December 13, 2006 the Board of Supervisors approved Rezoning #16-06 whichrezoned the Seefried parcels to the M1 (Light Industrial) Zoning District with proffers. D) Site Suitability & Project Scope Comprehensive Policy Plan: The Frederick County Comprehensive Policy Plan is an official public document that serves as the community's guide for making decisions regarding development, preservation, public facilities and other key components of community life. The primary goal of this plan is to protect and improve the living environment within Frederick County. It is in essence a composition of policies used to plan for the future physical development of Frederick County. [Comprehensive Policy Plan, p. 1-1] Land Use Compatibility: The properties are located within the Urban Development Area (UDA) and the Sewer and Water Service Area (SWSA); and.are not within the limits of any small area land use plan. The site is within the limits of the Eastern Frederick County Long Range Land Use Plan. The plan shows a portion of this property referred to as the Seefried tract with a MDP 906-07, Winchester Arial Properties June 18, 2007 Page 4 residential designation and the remainder with no designation. The residential designation reflected the MH-1 zoning of the property which was eliminated by rezoning application #19-06 which rezoned the property to the Ml (Light Industrial) Zoning District. The portion of the property referred to as the Pasta Tract has a designation of Industrial. This Master Development Plan application is in conformance with the current M1 zoning designation of both properties. Transportation The proposed development would be accessed off of a public road extension of Brooke Road which will connect to Park Center Drive as well as a public road connection which will connect into the Seefried tract. Originally, the Seefried property was accessed via an easement through the Frederick County Animal Shelter/Regional Jail Property. The proffers from the Seefried Rezoning stated that the property would be accessed off of Brooke Road and that the easement would be vacated. The easement will need to be vacated prior to this application being reviewed by the Board of Supervisors. Proffers The "pasta tract" does not have any proffers. The following proffers pertain to the "Seefried" property (Rezoning #19-06): 1. Monetary Contribution • $15,000 for fire and rescue • $3,000 for Sheriff's Office • $2,000 for general governmental purposes • $400,000 to be used by the County for transportation improvements to the Route 1 1. North — Fort Collier — Route 7 East Area. 2. Site Development • Development shall not exceed 1,000,000 square feet of gross floor area and office uses shall only be permitted as an accessory use to industrial uses. • Stormwater management pond facilities shall be lined with an impervious surface to avoid groundwater impacts. • The future access ,road shall be built to VDOT standards and have a minimum pavement width of 26 feet. • Street trees located a maximum of 50 feet apart shall be provided on both sides of the future access road. • A geotechnical analysis shall be prepared and submitted to Frederick County for any industrial structures prior to site plan approval. 3. Transportation • A direct connection between the Property and Fort Collier Road shall be prohibited. The access easement located on parcel 54-A-92B (Regional Jail/Animal Shelter property) shall be vacated within 120 days of rezoning approval. • The project entrance will be located on Brooke Road. 0 9. MDP #06-07, Winchester Industrial Properties June 18, 2007 Page 5 • The Applicant shall construct a northbound right turn lane on Brooke Road at the project entrance prior to occupancy of 'the first industrial building. Waiver Parcel 54-A-91A (Lockhart/Seefried) will be served by a public road as indicated on the Master Development Plan; however, if this parcel is subdivided, a public road extension may not be appropriate for the eastern portion of the property. The subdivision ordinance states that all lots must have state road frontage to be subdivided. In order for the. Lockhart/Seefried Tract to be subdivided using private roads, the Board of Supervisors would need to grant a waiver of §144-24C of the Frederick County Subdivision Ordinance. At the Planning Commission's June 6, 2007 meeting, a unanimous recommendation was forwarded to the Board of Supervisors for approval of this waiver request. STAFF CONCLUSIONS FOR THE 06/06/07 PLANNING COMMISSION MEETING: With the exception of the identified issues, the master development plan for Winchester Industrial Properties depicts appropriate land uses and appears to be consistent with the requirements of Article XVII, Master Development Plan, of the Zoning Ordinance. The preliminary master development plan is also in accordance with the proffers for Rezoning #19- 06. All of the issues brought forth by the Planning Commission should be appropriately addressed prior to a recommendation to the Board of Supervisors. PLANNING COMMISSION SUMMARY AND ACTION OF THE 06/06/07 MEETING: Staff reported that a revised MDP had addressed all of the comments raised in the staff s report. The staff also received a Deed of Release which eliminates the easement through the Detention Center property, originally proffered with the Seefried rezoning. In addition, staff noted that the applicant was requesting a waiver of Section 144-24C of the Subdivision Ordinance regarding State Road Frontage Requirements. Staff explained that Parcel 54-A-91 A, the Lockhart tract, will be served by a public road; however, if this parcel is subdivided in the future, a public road connection may not be appropriate for this area. The applicant's representatives were available for questions. There were no public comments. The Planning Commission unanimously recommended approval of the waiver of Section 144- 24C of the Subdivision Ordinance, State Road Frontage Requirements, for Parcel 54-A-91A, known as the Lockhart tract, with the stipulation that the waiver be valid only while the property is zoned M1 (Light Industrial). In addition, the Planning Commission unanimously recommended approval of MOP #06-07 of Winchester Industrial Properties, LLC, with a notation that the connection of the two State roads, Brooke Road (Rt. 1328) and Park Center Drive is a vital part of the MDP. C) Site History "Pasta Tract" 54-A-36T: The original Frederick County Zoning Map (U.S.G.S. Winchester Quadrangle) identified this parcel/area as being zoned M1 (Light Industrial). The Fort Collier Industrial Park was originally master planned in 1990 and was revised in 1991 and 1998. "Seefried Tract" 54-A-91A (formerly parcels 89 and 91): The original Frederick County Zoning Map (U.S.G.S. Winchester Quadrangle) identified all of 54-A-89 as being zoned A-2 (Agricultural General) and 54-A-91 as being split zoned A-2 and MH-1 (Mobile Home Community). With rezoning #14-83, the remainder of 54-A-91 was rezoned from A-2 to MH-1. The County's agricultural zoning districts were combined to form the RA (Rural Areas) District upon adoption of an amendment to the Frederick County Zoning Ordinance .on May 10, 1989. The corresponding revision of the zoning map resulted in the re -mapping of parcel 54-A-89 and all other A-1 and A-2 zoned land to the RA District. On December 13, 2006 the Board of Supervisors approved Rezoning #16-06 which rezoned the Seefried parcels to the M1 (Light Industrial) Zoning District with proffers. D) Site Suitability & Project Scope Comprehensive Policy Plan: The Frederick County Comprehensive Policy Plan is an official public document that serves as the community's guide for making decisions regarding development, preservation, public facilities and other key components of community life. The primary goal of this plan is to protect and improve the living environment within Frederick County. It is in essence a composition of policies used to plan for the future physical development of Frederick County. [Comprehensive Policy Plan, p. 1-1] Land Use Compatibility: The properties are located within the Urban Development Area (UDA) and the Sewer and Water Service Area (SWSA); and are not within the limits of any small area land use plan. The site is within the limits of the Eastern Frederick County Long Range Land Use Plan. The plan shows a portion of this property referred to as the Seefried tract with a MDP #06-07, Winchester Industrial Properties May 21, 2007 Page 4 residential designation and the remainder with no designation. The residential designation reflected the MH-1 zoning of the property which was eliminated by rezoning application #19-06 which rezoned the property to the M1 (Light Industrial) Zoning District. The portion of the property referred to as the Pasta Tract has a designation of Industrial. This Master Development Plan application is in conformance with the current M1 zoning designation of both properties. Transportation The proposed development would be accessed off of a public road extension of Brook Road which will connect to Park Center Drive as well as a public road connection which will connect into the Seefried tract. Originally the Seefried property was accessed via an easement through the Frederick County Animal Shelter/Regional Jail Property. The proffers from the Seefried Rezoning stated that the property would be accessed off of Brook Road and that the easement would be vacated. The easement will need to be vacated prior to this application being reviewed by the Board of Supervisors. Proffers The "pasta tract" does not have any proffers. The following proffers pertain to the "Seefried" property (Rezoning #19-06): 1. Monetary Contribution • $15,000 for fire and rescue • $3,000 for Sheriff's Office • $2,000 for general governmental purposes • $400,000 to be used by the County for transportation improvements to the Route 11 North — Fort Collier — Route 7 East Area. 2. Site Development • Development shall not exceed 1,000,000 square feet of gross floor area and office uses shall only be permitted as an accessory use to industrial uses. • Stormwater management pond facilities shall be lined with an impervious surface to avoid groundwater impacts. • The future access road shall be built to VDOT standards and have a minimum pavement width of 26 feet. • Street trees located a maximum of 50 feet apart shall be provided on both sides of the future access road. • A geotechnical analysis shall be prepared and submitted to Frederick County for any industrial structures prior to site plan approval. 3. Transportation • A direct connection between the Property and Fort Collier Road shall be prohibited. The access easement located on parcel 54-A-92B (Regional Jail/Animal Shelter property) shall be vacated within 120 days of rezoning approval. • The project entrance will be located on Brooke Road. Issues The following issues need to be resolved on the MDP prior to review by the Board of Supervisors: 1. The applicant has committed to providing a public street connection from Brooke Road to Parke Center Drive. The public road needs to be labeled. 2. The zoning district buffer detail is incorrect and needs to be revised. 3. The building restriction lines (BRL's) need to be revised to show a 75 foot BRL off of the new public road. 4. One of the proffers from the Seefried Rezoning stated that the easement through the Frederick County Animal Shelter/Regional Jail property would be vacated. This easement needs to be vacated before the Board of Supervisors meeting. 5. Additional information needs to be provided for all adjoining properties. STAFF CONCLUSIONS FOR THE 06/06/07 PLANNING COMMISSION MEETING: With the exception of the identified issues, the master development plan for Winchester Industrial Properties depicts appropriate land uses and appears to be consistent with the requirements of Article XVII, Master Development Plan, of the Zoning Ordinance. The preliminary master development plan is also in accordance with the proffers for Rezoning #19- 06. All of the issues brought forth by the Planning Commission should be appropriately addressed prior to a recommendation to the Board of Supervisors. Following the Planning Commission discussion, it would be appropriate to forward a recommendation to the Board of Supervisors regarding this MDP conformance with County codes and review agency comments. All issues and concerns raised by the Planning Commission will be forwarded to the Board of Supervisors for their consideration. Staff s review comments are listed below for your consideration. 1. Engineer/Surveyor Seal. This MDP needs to be certified by an engineer, architect or surveyor licensed in the Commonwealth of Virginia; this seal needs to be on both sheets of the MDP. 2. Site Summary. On the coversheet, the Building Restriction lines need to read: • Public Street: 75' • Side and Rear: 25' The Lockhart Tract has a 100' buffer not 75'; this buffer is 75' inactive and 25' active. The zoning of the site is M1 (Light Industrial), not manufacturing. 3. Zoning District Buffer. The second sheet of the MDP only shows the 75' inactive portion of the buffer. This is a 100' buffer which has a 75' inactive portion that has the landscaping and berm and a 25' active portion where parking can be placed but no buildings. The total 100' area needs to be shown as well as a detail of the buffer. The detail needs to show the distance as well as the landscaping (three trees per ten linear feet (2/3 evergreen and 1/3 deciduous); include the height of the trees (4' for evergreen and 2" caliper for deciduous). 4. Brooke Road/Park Center Road Connection. This MDP needs to show a public road connection from Brooke Road to Park Center Road. We spoke briefly with Scott Scheel on April 23rd regarding this issue. 5. Road Detail. Street trees need to be shown on the Brooke Road Detail. 6. Easement. The revised MDP has a statement that the easement though the regional jail property will be vacated once Brooke Road has been extended to the property. The proffers from the rezoning stated that this easement would be vacated within 120 days of rezoning approval. This rezoning was approved on December 13, 2006, therefore the easement should have already been vacated. The new note needs to be removed and the plats to vacate this easement need to be processed. This easement must be vacated before the plan will be scheduled for review by the Board of Supervisors. 1,. 7. Interstate 81. Verify if any right-of-way dedications are needed from PIN 54-A-91 for Interstate 81. 8. Environmental Features. The environmental features table needs to show wetlands and karst features or any other environmental feature present on the site. 9. MDP Checklist. Remove the box on the MDP that states certain information from the MDP checklist is not applicable to this .plan..
