Perkins, AICP, Senior Planner This report is prepared by the Frederick County Planning Staff to provide information to the Planning Commission and the Board of Supervisors to assist in the review of this application. It may also be useful to others interested in this zoning matter. The submitted master development plan dated October 29, 2007 is acceptable. Before making any final continents, this office will require a complete set of site plans, drainage calculations and traffic flow data from the I.T.E. Trip Generation Manual, Seventh Edition for review. VDOT reserves the right to comment on all right-of-way needs, including right-of-way dedications, traffic signalization, and off -site roadway improvements and drainage. Prior to construction on the State's right-of-way, the developer will need to apply to this office for issuance of appropriate permits to cover said work. Frederick County Fire Marshal: Plan approval recommended. Frederick County Public Works: Your letter dated October 17, 2007 has addressed all of our previous comments outlined in our letter of September 18, 2007. Consequently, we grant our final approval of the revised master development plan. Frederick County Inspections Department: No comment required at this time. Frederick County Sanitation Authority: lst review — approved. GIS Department: No additional road names are required at this time. Structure numbering will be assigned during the permit and construction phase of development. Winchester Regional Airport: We have reviewed the proposed master development plan and determined that the proposed development plan will not have an impact on operations at the Winchester Regional Airport. While the proposed site lies within the airport's airspace, it does fall outside of the airport's Part 77 close in surfaces. Planniniz & Zoning: A) Master Development Plan Requirement A master development plan is required prior to development of this property. Before a master development plan can be approved, it must be reviewed by the Planning Commission, Board of Supervisors and all relevant review agencies. Approval may only be granted if the master development plan conforms to all requirements of the Frederick County Zoning and Subdivision Ordinances. The purpose of the master development plan is to promote orderly and planned development of property within Frederick County that suits the characteristics of the land, is harmonious with adjoining property and is in the best interest of the general public. B) Location The subject properties are located on Route 7 at Getty Lane. C) Site History The original Frederick County Zoning Map (U.S.G.S. Winchester Quadrangle) identified these MDP #13-07, Winchester Ga#ay December 26, 2007 Page 3 properties as being zoned B2 (Business General). D) Site Suitability & Project Scope Comprehensive Policy Plan: The Frederick County Comprehensive Policy Plan is an official public document that serves as the community's guide for making decisions regarding development, preservation, public facilities and other key components of community life. The primary goal of this plan is to protect and improve the living environment within Frederick County. It is in essence a composition of policies used to plan for the future physical development of Frederick County. [Comprehensive Policy Plan, p. 1-1] Land Use Compatibility: The Eastern Frederick County Long Range Land Use Plan shows this area with a commercial designation. The majority of this site was developed under Site Plans #14-05 and #57-05 for Winchester Gateway; these site plans were for the new commercial development that existing on the site. The existing and proposed uses with this development are in conformance with the Comprehensive Policy Plan. Transportation The Eastern Road Plan of the Comprehensive Policy Plan shows a road connecting Route 7 to Regency Lakes Drive. Getty Lane, which is the existing road within the project, currently terminates on parcel 54-A-99C. This Master Development shows the continuation of this road through the property and connecting with Regency Lakes Drive. Regency Lakes Drive will be modified to accommodate a 120 foot left turn lane into the new Getty Lane extension. The pavement for westbound Route 7 will be shifted to provide for a wider right turn lane onto Regency Lakes Drive. A 100 foot transition will also be added to westbound Route 7 for vehicles turning right onto Route 7 off of Regency Lakes Drive. Proffers — There are no proffers associated with these properties Waivers This development is proposing to utilize private roads for access. The subdivision ordinance states that all lots must have state road frontage to be subdivided. In order for the proposed commercial lots on the Winchester Gateway property to be subdivided utilizing private roads, the Board of Supervisors would need to grant a waiver of § 144-24C of the Frederick County Subdivision Ordinance. At the Planning Commission's December 5, 2007 meeting a unanimous recommendation was forwarded to the Board of Supervisors for approval of this waiver request. STAFF CONCLUSIONS FOR THE 12/05/07 PLANNING COMMISSION MEETING: The master development plan for Winchester Gateway depicts appropriate land uses and appears to be consistent with the requirements of Article XVII, Master Development Plan, of the Zoning Ordinance and this preliminary Master Development Plan is in a form that is administratively approvable. All of the issues brought forth by the Planning Commission should be appropriately addressed prior to a recommendation to the Board of Supervisors. MDP 913-07, Winchester Gateway December 26, 2007 Page 4 PLANNING COMMISSION SUMMARY AND ACTION OF THE 12/05/07 MEETING: The applicant pointed out that the series of transportation narratives on the MDP were created to deal with off -site transportation improvements. He stated that the language was reviewed by both VDOT and the County's Deputy Director -Transportation. There were no public comments. No issues of concern were raised by the Planning Commission. By a unanimous vote, the Planning Commission recommended approval of a waiver to allow the subdivision of proposed commercial lots on Winchester Gateway property using private roads. Also by a unanimous vote, the Planning Commission recommended the approval of MDP #13-07 of Winchester Gateway. (Note: Commissioners Kriz and Ours were absent from the meeting.) STAFF CONCLUSIONS FOR THE 01/09/08 BOARD OF SUPERVISORS MEETING: The master development plan for Winchester Gateway depicts appropriate land uses and appears to be consistent with the requirements of Article XVII, Master Development Plan, of the Zoning Ordinance. Therefore, the preliminary Master Development Plan for Winchester Gateway is in a form that is administratively approvable. All of the issues brought forth by the Board of Supervisors should be appropriately addressed by the applicant. Staff would note that two actions are required for this application, one for the waiver and the other for the MDP. The applicant is seeking authorization of the preliminary master development plan by the Board of Supervisors as well as approval of a waiver to enable the property to be subdivided usinz private streets. The Board's authorization will -rant staff with administrative approval authority for the final master development plan. The submitted master development plan dated October 29, 2007 is acceptable. Before making any final comments, this office will require a complete set of site plans, drainage calculations and traffic flow data from the I.T.E. Trip Generation Manual, Seventh Edition for review. VDOT reserves the right to comment on all right-of-way needs, including right-of-way dedications, traffic signalization, and off -site roadway improvements and drainage. Prior to construction on the State's right-of-way, the developer will need to apply to this office for issuance of appropriate permits to cover said work. Frederick County Fire Marshal: Plan approval recommended. Frederick County Public Works: Your letter dated October 17, 2007 has addressed all of our previous comments outlined in our letter of September 18, 2007. Consequently, we grant our final approval of the revised master development plan. Frederick County Inspections Department: No comment required at this time. Frederick County Sanitation Authority: 1st review — approved. GIS Department: No additional road names are required at this time. Structure numbering will be assigned during the permit and construction phase of development. Winchester Regional Airport: We have reviewed the proposed master development plan and determined that the proposed development plan will not have an impact on operations at the Winchester Regional Airport. While the proposed site lies within the airport's airspace, it does fall outside of the airport's Part 77 close in surfaces. Planning & Zoning: A) Master Development Plan Requirement A master development plan is required prior to development of this property. Before a master development plan can be approved, it must be reviewed by the Planning Commission, Board of Supervisors and all relevant review agencies. Approval may only be granted if the master development plan conforms to all requirements of the Frederick County Zoning and Subdivision Ordinances. The purpose of the master development plan is to promote orderly and planned development of property within Frederick County that suits the characteristics of the land, is harmonious with adjoining property and is in the best interest of the general public. B) Location The subject properties are located on Route 7 at Getty Lane. C) Site History The original Frederick County Zoning Map (U.S.G.S. Winchester Quadrangle) identified these MDP #13-07, Winchester Gateway November 19, 2007 Page 3 properties as being zoned B2 (Business General). D) Site Suitability & Project Scope Comprehensive Policy Plan: The Frederick County Comprehensive Policy Plan is an official public document that serves as the community's guide for making decisions regarding development, preservation, public facilities and other key components of community life. The primary goal of this plan is to protect and improve the living environment within Frederick County. It is in essence a composition of policies used to plan for the future physical development of Frederick County. [Comprehensive Policy Plan, p. 1-1] Land Use Compatibility: The Eastern Frederick County Long Range Land Use Plan shows this area with a commercial designation. The majority of this site was developed under Site Plans #14-05 and #57-05 for Winchester Gateway; these site plans were for the new commercial development that existing on the site. The existing and proposed uses with this development are in conformance with the Comprehensive Policy Plan. Transportation The Eastern Road Plan of the Comprehensive Policy Plan shows a road connecting Route 7 to Regency Lakes Drive. Getty Lane, which is the existing road within the project, currently terminates on parcel 54-A-99C. This Master Development shows the continuation of this road through the property and connecting with Regency Lakes Drive. Regency Lakes Drive will be modified to accommodate a 120 foot left turn lane into the new Getty Lane extension. The pavement for westbound Route 7 will be shifted to provide for a wider right turn lane onto Regency Lakes Drive. A 100 foot transition will also be added to westbound Route 7 for vehicles turning right onto Route 7 off of Regency Lakes Drive. Proffers — There are no proffers associated with these properties Waivers This development is proposing to utilize private roads for access. The subdivision ordinance states that all lots must have state road frontage to be subdivided. In order for the proposed commercial lots on the Winchester Gateway property to be subdivided utilizing private roads, the Board of Supervisors would need to grant a waiver of § 144-24C of the Frederick County Subdivision Ordinance. A recommendation to the Board of Supervisors from the Planning Commission is needed on this waiver request. STAFF CONCLUSIONS FOR THE 12/05/07 PLANNING COMMISSION MEETING: The master development plan for Winchester Gateway depicts appropriate land uses and appears to be consistent with the requirements of Article XVII, Master Development Plan, of the Zoning Ordinance and this preliminary Master Development Plan is in a form that is administratively approvable. All of the issues brought forth by the Planning Commission should be appropriately addressed prior to a recommendation to the Board of Supervisors. Two actions are needed from the Planning MDP #13-07, Winchester Gateway November 19, 2007 Page 4 Commission for this MDP: a decision on private street waiver request and a recommendation to the Board of Supervisors on the MDP. Following the Planning Commission discussion, it would be appropriate to forward a recommendation to the Board of Supervisors regarding this MDP conformance with County codes and review agency comments. All issues and concerns raised by the Planning Commission will be forwarded to the Board of Supervisors for their consideration. If the latter option is selected, these locations should be reflected on the MDP. A possible location may be the existing depression created north of the 99C parcel parking area. 2. The MDP indicates an existing right-of-way connection to Regency Lakes Drive. Verify that there is sufficient right-of-way to construct the required turning radius at the intersection with Regency Lakes Drive. Also, indicate when this connection (Getty Lane extended) will be constructed. 3. The out parcel designated as 54-A-99F appears to be land locked without an adequate access connection. Indicate if there are any future plans to obtain additional property to facilitate an adequate connection. 4. The table of environmental features includes natural swales/detention areas as a feature. Under existing acreage, this feature is listed as zero. However, as previously alluded to under the stormwater management narrative, the existing development utilized a natural swale as a detention area. This area should be accurately reflected in the table of environmental features. Any future disturbance of this area to accommodate additional development should also be reflected in this table. Staff s review comments are listed below for your consideration. 1. Regency Lakes Drive Connection. This MDP needs to show and ensure the connection of Getty Lane to Regency Lakes Drive. A detail for the road needs to be provided as well. 2. Route 7 and Regency Lakes Improvements/Site Improvements. Show any necessary improvements to Route 7 and Regency Lakes Drive that will be needed due to this project on the MPD. The statement regarding site improvements being identified with individual site plans is inappropriate. 3. Interstate 81. Indicate if any ROW dedication is needed for I-81. 4. Adjoining Properties. Provide all adjoining properties, including those across roads. Parcel 54-A-90 is zoned RA, not RP. 5. Property Lines. Provide a darker line for the property boundaries. 6. Interparcel Connections. Revise and provide Interparcel connections as indicated on sheet 2. 7. Getty Road. Provide a road detail for the Getty Road extension. 8. Access. It is unclear how the back portion of 54-A-99F will be accessed due to the buffer. 9. Utilities. Provide the location of all utilities (water, sewer, gas, electric) on the MDP. 10. MDP Notes. On the coversheet, provide a note regarding the availability of public water and sewer. Based on these discussions, I would offer the following revisions (in bold text) for your consideration: Transportation Narratives 1) A Traffic Impact Analysis (TIA) dated June 17, 2005 was prepared by PHR&A for the Winchester Gateway development. Any new development which exceeds the development projections or levels of service (LOS) demonstrated in the June 17, 2005 TIA, or any redevelopment of existing land uses to a greater intensity than demonstrated in this TIA shall be required to provide updated traffic analysis information as determined by VDOT during the site development plan process. 2) OK as written 3) VDOT and Frederick County will require Traffic Impact Analysis (TIA) studies for the undeveloped portions of the Master Planned area not accounted for in the June 17, 2005 TIA during the site development plan process. The results of the TIA studies will be used by VDOT and Frederick County to determine if additional off -site transportation improvements are warranted by the developer. Please review the revised language and advise me if this addresses your previous comments. If so, we will make these revisions and forward the MDP for your formal comments so we can formally process the MDP for consideration by the Planning Commission and Board of Supervisors.
