Dear Ron:
This letter is in regards to the road plan and profile for Petticoat Gap Lane received by
this office on February 29, 2008. The road plan and profile do not reflect a design of a
four (4) lane road with turn lanes and striping detail per the proffers assigned with this
rezoning. The sidewalk on the north side of Petticoat Gap Lane cannot be deferred per
the Frederick County Subdivision Ordinance and approved Master Development Plan.
Please note that the sidewalks and four (4) lane road are to be completed prior to the first
occupancy permit for Phase 2.

Dear Madam and Gentlemen:
As development continues to progress on various projects associated with the WWW, LC
(Rz. 403-03) and Winchester Medical Center — West Campus (Rz. 402-03) rezoning
applications, I felt it was appropriate to restate our previous understanding concerning the
issuance of Certificates of Occupancies (CO) for the sites within these large
developments. In various discussions from May 2005 through current day, County and
VDOT staff have met with representatives from your development groups and advised of
the transportation improvements which must be in place prior to the issuance of COs for
new development within the WWW and WMC properties. This letter merely restates
our expectations.
The proffer statements associated with the rezoning applications included a number of
transportation improvements that are to be constructed prior to the issuance of the
certificate of occupancy. These improvements were identified in your respective
rezoning applications as being necessary in order to maintain a Level of Service (LOS)
"C" along the analyzed Route 50 and Route 37 road segments. These proffered
improvements are significant transportation improvements to Route 50 and the ramps at
Route 37. While progress on these proffered improvements continues, all of the
improvements have yet to be completed.

I bring this to your attention because it is both the Virginia Department of
Transportation's and the County's expectations that these significant road improvements
be constructed prior to the issuance of Certificates of Occupancies so that the Level of
Service (LOS) on the affected roadways will continue to operate at a LOS "C" or better.
In an effort to work with you and your development groups, we have enabled the
issuance of COs when the proffered road improvements directly associated with the
increase in traffic generation resulting from particular sites are installed. Quite simply, if
the roads are able to maintain LOS "C" or better, then we are agreeable to the issuance of
the CO for that particular site. The COs for the Wal-Mart and the Bank of Clarke County
were authorized on that basis.
The proffered road improvements must be installed. In the event that you seek a CO
prior to the completion of the proffered improvements, you will be expected to provide a
transportation analysis which demonstrates that the existing conditions would not degrade
below LOS "C". Failure to maintain the LOS "C" will delay the issuance of future COs.

$1,672,575.02 provided by Patton, Harris, Rust and Associates, p c and performed a site
inspection for the subject project. Based on my inspection and review of the construction cost
estimate, it is my recommendation that a bond in the amount of $1,672,575.02 be established to -ry
cover the costs associated with construction of the infrastructure associated with the subject
project.

Frederick County administratively approved the above -referenced master development plan on June
30, 2004. The final master development plan is approved for the development of approximately 71
acres of land zoned B2 (Business General) District. All conditions of the associated rezoning proffer
statement and relevant review agencies have been preliminarily satisfied in the approved plan.
Approval of the subdivision and individual plats is required prior to any land division. Furthermore,
an approved site plan is required for each individual use prior to development. I am providing you

Hill Crossing (WWW Property), received on June 17, 2004. Please make the following changes prior
to submission for administrative approval:

1) Waiver Request. Please update the waiver request notation on page 2 of 3 to state that a
waiver was granted by the Frederick County Board of Supervisors on June 9, 2004 to allow
individual lots to have access to the proposed private roads.

REVIEW EVALUATIONS:
Department of Transportation: The Preliminary Master Plan for this property appears to have significant
measurable impact on Route 50 and 37, the VDOT facilities which would provide access to the property.
Due to the very small scale, it was difficult to determine details in regards to this Master Development Plan.
In the future, please take this into consideration. Our comments are as follows:
1. A signalization agreement will be required for the intersection of Periwinkle Drive, Perennial Drive
(private street) and Botanical Boulevard.
2. Please delineate the right-of-way width for Honeysuckle Boulevard and Periwinkle Drive.
3. Where and how will large retail access Honeysuckle Boulevard, Route 50, and Periwinkle Drive?
4. Are there any interior road networks that will exit for the large retail and other out parcels?
5. What kind of intersection will be at the intersection of Honeysuckle Boulevard and Periwinkle Drive?
Will Honeysuckle Boulevard be extended beyond Periwinkle Drive? Will Periwinkle Drive be
extended past Honeysuckle Boulevard?
6. Will the roads in the business office park portion be public or private?
7: Please be aware, as stated in Proffer # 1 under Street'Improvements, the relocation of Route 803 has
not been finalized. It will be the responsibility of the developer to provide funding should VDOT
firnding not be available. VDOT is currently investigating the necessary steps that would be required
to provide the necessary right-of-way for the relocation.
8. Please provide a specific date in regards to the development of Phase II and the construction of
Periwinkle Drive. We have concerns that all traffic. for this development will be utilizing either
Honeysuckle Boulevard or two un-signalized intersections.
9. According to Proffer #5: "The applicant shall limit entrance connections onto U. S. Route 50 to three
points as shown on the general development plan." Please delineate the three entrances. It appears
there is an entrance listed as being opposite the VDOT Area Headquarters entrance, but appears to
be no internal roads accessing that entrance. Is it still the expectation to utilize this entrance?
10. Will Echo Lane access Periwinkle Drive or Botanical Boulevard?
11. Please be aware of the required transitions for dual left turn lanes and the necessary widening on the
receiving lanes (minimum 15' wide lanes).
Before making any final comments, this office will require a complete set of site plans, drainage calculations
and traffic flow data from the I.T.E. Trip Generation Manual, 7fl' Edition for review. VDOT reserves the right
to comment on all right-of-way needs, including right-of-way dedications, traffic signalization, and off -site
roadway improvements and drainage. Prior to construction on the State's •right-of-way, the developer will
need to apply to this office for issuance of appropriate permits to cover said work.
Frederick County Fire Marshal: Buildings exceeding 30 feet in height shall not be setback more than 50
feet from the edge of fire department access. Water supplies for firefighting shall be extended to the site and
be consistent with the requirements of the 2000 International Fire Code. Plan approval recommended.

Frederick County Public Works: A comprehensive review shall be performed at the time of site plan
submission. Evaluations of stormwater run-off and drainage shall be performed at the time of site plan
submission.
Frederick County Inspections Department: No comment at this time. Approval of individual site plan
required.
Frederick County Sanitation Authority: 2"' review. Correct & resubmit 2 items.
Planning Staff Note: The two items referred to in the Sanitation Authority's review letter are as
follows: 1) show water lines, and 2) show water force main.
Frederick -Winchester Service Authority: No comments.
Frederick County - Winchester Health Department: All proposals for this development are to be served
by approved.public water and sewer. Applications for restaurant, hotel permits, and continuing care and
assisted living establishments (if applicable) must be submitted to the local health department
Department of GIS: The GIS Department is not accepting any road names that have7the same first word :..
either by spelling or phonetically the same as a road name already in the system. The road name suffix of
"Road" is reserved for use by,state numbered, cross-country through routes and does not apply to the road
names requested for this development. Therefore, the suffixes of the requested road names need to be
changed to another format, such as Drive, Street, Lane, Court, Circle, or Place.
1. The following changes have been made to the reserved names in the Frederick County Road Naming
System: FROM: Periwinkle Drive TO: Petticoat Gap Lane
2. The request to change Honeysuckle Boulevard to Round Hill Crossing Boulevard is denied as the
name conflicts with Round Hill Road.
3. The following new road names have been APPROVED and RESERVED in the Frederick County
Road Naming System: Parishs Spring, Toll House, Walmart Drive, Chambersville:
4. The following new road name requests have been DENIED acceptance into the Frederick County
Road Naming System, due to conflicts with other road names currently in the system:
Little North Mountain
Frederick County Department of Parks & Recreation: Plan appears to meet open space requirements.
The trail provided also appears to meet county recommendations and offers a connector for future
development along Route 50.
Winchester Regional Airport: The referenced Master Plan was reviewed and it appears the proposed site
should not impact operations at the Winchester Regional Airport as the area lies outside ofthe Airport's Part
77 surfaces.

Planning & Zoning_
A) Master Development Plan Requirement
A master development plan is required for most subdivisions and development of property in
Frederick County. Before a master development plan can be approved, it must be reviewed by the
Planning Commission, Board of Supervisors and all relevant review agencies. Approval may only be
granted if the master development plan conforms to all requirements ofthe Frederick County Zoning
and Subdivision Ordinances. The purpose ofthe master development plan is to promote orderly and
planned development ofproperty within Frederick County that suits the characteristics ofthe land,
is harmonious with adjoining property and is in the best interest of the general public.
B) Location
This property is located in the Round Hill neighborhood, north and adjacent to.Northwesterri Pike
(Route 50 West),. approximately 1,700 feet west of Route 37. The two parcels of land which
comprise the WWW Property consist of approximately 70.9 acres of land. Echo Lane is located
adjacent to the eastern boundary line of the site; and Round Hill Road is south of the site, across
Route 50 West:
C) Site History
The original Frederick County zoning map (U.S.G.S. Winchester Quadrangle) identifies the subject
parcels as being zoned A-2 (Agricultural General). The County's agricultural zoning districts were
reclassified to the RA (Rural Areas) District upon adoption of an amendment to the Frederick County
Zoning Ordinance on May 10,1989. The corresponding revision ofthe zoning map resulted in the
re -mapping ofthe subj ect parcels and all other parcels zoned A-1 and A-2 District. On July 9, 2003
the two subj ect parcels were rezoned with proffers from the RA (Rural Areas) District to the B2
(Business General) District.
D) Intended Use
The proposed master development plan could facilitate the establishment of any permitted use in the
B2 (Business General) Zoning District, as found in the Frederick County -Zoning Ordinance. Atthis .
point in time, a site plan application has been received for a Super Wal-Mart Center in Phase 1 ofthe
development. The proposed Super Wal-Mart Center would be located on approximately 23 acres
of land, in the area shown as "Large Retail" on the master development plan. Phase 1 consists ofthe
land east of Roland Hill Crossing Boulevard (major collector road). Phase 2 consists ofthe land west
of Round Hill Crossing Boulevard.

E) Site Suitabili . & Project Scope
Land Use Compatibility:
The WWW Property is strategically located in an area with a mixture of land uses, consisting of
orchard, agriculture, residential, govenunent, and commercial. The Winchester Medical Center
property is located to the east. Between the WWW Property and the WMC Property are several
existing residential properties. The future demand for this area appears to be the emergence of new
retail, office and medical support land uses, accompanied with the phasing -out of some existing
residential uses.
Comprehensive Policy Plan:
The approximately 70-acre site is a component of the Phase 1 and Phase 2 Round Hill Community
Land Use Plan. Both phases call for the establishment of new commercial and office uses. The long-
term Phase 3 component of the Round Hill Community Land Use Plan would include the extension
of public sewer and water services to existing and new residential development. .
The subject property is within close proximity -of the Route 37 Interchange. As described in the
Frederick County Comprehensive Policy Plan, the "Idealized Interchange Development Pattern"
includes retail and service uses within closest proximity of interchanges, followed by buffered
residential uses. The proposed master development plan is consistent with this land use policy
standard. (Comprehensive Policy Plan, page 6-10).
The UDA (Urban Development Area) is the principal land use tool of the Frederick County
Comprehensive Policy Plan. The general purpose of the UDA is to define the areas in the county
where more intensive forms of development will occur. It does this by dividing the County into rural
and urban areas. The UDA was originally created with the intent that it would be adequate enough
to accommodate long term growth needs in areas of the County where public services are most
available. Substantial areas of land are needed for business uses in the UDA. The subj ect property
is located entirely within the UDA. (Comprehensive Policy Plan, p. 6-1, 6-2, 6-5).
Historic Resources:
The historic structure Folk Victorian Farmhouse (ID#34-469) is located on the WWW Property.
This structure is not listed as potentially significant in the Frederick County Rural Landmarks Survey
Report. During the review of the rezoning application for the property the HRAB recommended that
a detailed history and documentation of the existing historical structure be characterized by historical
report prior to removal.
Environment:
There are no environmental features identified on the WWW Property. During the site plan process
a geoteclulical analysis and study will be conducted prior to construction for each individual lot.

Transportation:
According to the TIA (Traffic Impact Analysis), which was compiled as part of the rezoning
application for the WWW Property, Northwestern Pike (Route 50 West) is an arterial road with a
2002 ADT (Average Daily Traffic) count of 24,570 vehicles. The TIA projected that the number of
daily trips produced for the WWW Property would be 24,252, effectively doubling existing traffic.
To maintain a level of service C, or better, the TIA assumed that a number of transportation
improvements would be made. The following transportation improvements have been proffered as
part of the development of the WWW Property:
A) Construction of anew major collector road (Round Hill Crossing Boulevard) which will
connect with the new major collector road proffered by the WMC site to the east.
B) Relocation of the Round Hill Road (Route 803) intersection to line-up with the new major
collector road.
C) Construction of a new travel lane on the north side of Northwestern Pike (Route 50 West).
D) A maximum ofthree entrances off ofNorthwestern Pike (Route 50). Ofthese entrances, only
the intersection for the new major collector road shall be at a new crossover point. .
E) Numerous improvements to the Route 37 interchange including new travel lanes and
transitions.
F) ADT shall not exceed 15,000 trips per day without further approval by the County.
Planning Staff Note: As individual site plans are submitted for the WWW Property, an
ADT traffic tabulation shall be required to assess the overall trips generated.
Landscaping, Buffers & Trails:
Pursuant to the proffer statement, a 50 foot wide landscaped green strip shall be provided along
Northwestern Pike (Route 50 West). Included within this landscaped green strip shall be an eight foot
wide trail. Bike trails and sidewalks will also be provided along roads in the development as
recommended by the Department of Parks and Recreation. Also proffered is a ten foot wide
landscaped buffer along the northern property line to serve as a screen. Along the eastern property
line a Category B zoning buffer is required by the Zoning Ordinance. This would screen the fixture
land uses from the existing residential land uses.
Proffered Monetary Contributions:
A voluntary contribution of $35,000 was proffered as part of the rezoning application for Fire&
Rescue Services, Police Services, and Administration Services.

1. LOT ACCESS WAIVER. Pursuant to Section 144-24 C, of the Frederick County Subdivision
Ordinance, all lots shall have direct access to a public street or right-of-way dedicated for
maintenance by the Virgiinia Department of Transportation. The applicant for the WWW Property
MDP is requesting a waiver to this requirement. Since this ordinance is part ofthe Frederick County
Subdivision Ordinance, the Board of Supervisors could grant such a waiver. This waiver would allow
individual cominercial lots to be subdivided with access to the proposed private internal circulation
road, referred to as Little North Mountain Road on the preliminary MDP.
PLANNING COMMISSION SUMMARY AND ACTION OF THE 06/02/04 MEETING:
Although there were no issues of outstanding concern raised by the Connnission, general questions were raised
concerning how the phasing of Petticoat Gap Lane could be accomplished. The applicant agreed to construct
two of the proffered four lanes of Petticoat Gap Lane during Phase I construction, so long as Botanical
Boulevard on the WMC II property is constructed.
It was determined that the Planning Commission did not need to provide a formal recommendation on the
requested lot access waiver because it is a Board action.
A member ofthe Commission voiced an opinion that the types of businesses proposed in this MDP were in
direct conflict with what is being envisioned for the community centers promoted by the.rural areas study.
Other members of the Commission believed the MDP was appropriate and was consistent with the. .
requirements ofthe zoning ordinance. The Planning Commission recommended approval by the following
majority vote:

(Commissioners Ours and Triplett were absent from the meeting.)
STAFF CONCLUSIONS FOR 06/09/04 BOARD OF SUPERVISORS MEETING:
Upon resolution ofthe lot access waiver this Master Development Plan will be consistent with the requirements
of Article XVII, Master Development Plan, ofthe Zoning Ordinance. All ofthe issues identified by the Board
of Supervisors should be appropriately addressed by the applicant. The Planning Commission recommended
that administrative approval be authorized during their meeting on June 2, 2004.
The applicant is seeking authorization of the preliminary master development plan by the Board
of Supervisors. The Board's authorization will grant staff with administrative approval
authority for the final master development plan. It would also be appropriate for the Board to
either approve or deny the proposed lot access waiver to allow lots to access private streets.

Responses to Requests for Public Records
as required by the
Virginia Freedom of Information Act
Prepared August, 2001

General
1) The Freedom Of Information Act (FOIA) only covers existing public records. It does not
require the county to create a new record or report that does not exist. Requests for
information about a particular subject or lists of questions to be answered are not subject to
the Act. We are not required to summerize information from existing records. Only requests
for particular documents or other specific existing records are subject to the act.
2) Persons requesting public records need to identify the records they are seeking "with
reasonable specificity."
3) The individual does not need to cite that their request is a Freedom of Information Request
nor the reason they want the information.
4) The FOIA does not speak to whether or not a locality may insist that requests be in writing,
however, for efficiency and accuracy and in order to achieve a "reasonable specificity" in
requests, departments should utilize the attached FOIA request form.
5) The initial response to a request must occur within five working days. The response may be
in one of three forms.
providing the requested records;
inform the requestor that the records (or a portion thereof) are being withheld based
on an exemption from the FOIA. If this is the response, it must also cite that
section(s) of the code that exempt the record and the approximate volume and subj ect
of the records being withheld; or
inform the requester that it is not practical to identify or collect the requested records
within the five days and why. If this is the case, the county is given seven additional
days to make one of the above responses.
(If needed, additional time beyond this seven day extension can be negotiated with the individual
making the request, otherwise, to obtain more time a petition to the local circuit court is necessary)

Charging for Time Spent
1) The act permits the locality to recoup only the actual costs incurred to locate, duplicate and
supply records. The county does not charge for overhead.
2) If the charges for providing the records are expected to exceed $200, payment may and
should be required in advance.
3) An estimate for fulfilling a request will include an hourly rate for the staff person(s)
retrieving, copying or otherwise preparing the records requested as well as copying charges
at a rate of .20 cents per 8.5xl 1 page (.40 cents if the page is a 2 sided copy), .25 cents per
legal sheet (.50 cents for 2 sided), and .50 cents for 1 lxl7 (100 for 2 sided copies), $1.60 for
tapes, and $2.00 for video tapes plus any fees associated with duplicating the video if sources
other than staff are used.

The Virginia Freedom of Information Act (Virginia Code Section 2.2-3700, et. seq.) provides for
inspection and copying of the official public records of the County of Frederick by citizens of the
Commonwealth and media representatives.
The procedures for inspecting or obtaining copies of County of Frederick public record(s) are as
follows:
1) A request must be submitted to the County of Frederick identifying the public record(s)
sought with reasonable specificity.
2) The County of Frederick will act diligently to locate and produce requested public records.
However, the Freedom of Information Act allows five (5) work days to respond, and
citizens should not expect the county's response to be instantaneous. If an extraordinary
volume of records is requested, the county will advise the requestor in writing within the five
(5) work day period which provides the county with an additional seven (7) work days to
respond by statute.

3) The Freedom of Information Act allows the County of Frederick to assess a reasonable
charge to access, search for, duplicate, and supply requested public records. There is a fee
for the county's services which must be paid before the records are received. The
County of Frederick will charge the hourly rate of pay for the time expended by its
employees in searching for and reproducing the record. The County of Frederick will also
charge for copying at the rate of $0.20 per page for letter size duplication, $0.25 per page for
legal size duplication, $0.50 per page for 11 x 17 duplication, $0.40 per page to duplex letter
size public records, $0.50 to duplex legal size public records, and $1.00 to duplex 11 x 17
public records. Prior to the search, the County of Frederick will estimate the cost of
providing the public record(s) to the requestor. Where estimated costs exceed $200, the
County of Frederick will require payment of the estimated cost by the requestor in advance.
4) The County of Frederick is not required to create or prepare a particular requested
record if it does not already exist. The County of Frederick is not required to abstract
or summarize information from official records, or to convert a record from one form
to another. Only existing public records are subject to the Freedom of Information Act.
Not all public records of the County of Frederick are obtainable under the Freedom of Information
Act. Examples of exempt public records include, but are not limited to, police investigation records,
personnel records, closed session memoranda, tax returns, opinions of the county attorney, litigation
records, customer utility records (including the customer's name and service address, but excluding
the amount and costs of service), appraisal and cost estimates, and trade secret information.
If it is determined that all or part of requested public records are exempt under the Freedom of
Information Act, the county will respond with a written explanation.

Dear Mr. Price:
The Preliminary Master Development Plan for this property appears to have significant
measurable impact on Routes 50 and 37, the VDOT facilities which would provide access to
the property. Due to the very small scale, it was difficult to determine details in regards to
this Master Development Plan. In the future, please take this into consideration.
Our comments -are as follows:
• A signalization agreement will be required for the intersection of Periwinkle. Drive,
Perennial Drive (private street) and Botanical Boulevard.
• Please delineate the right-of-way width for Honeysuckle Boulevard and Periwinkle
Drive. .
• Where and how will large retail access Honeysuckle Boulevard, Route 50, and
Periwinkle Drive?
• Are there any interior road networks that will exit for the large retail and other out
parcels?
• What kind of intersection will be at the intersection of Honeysuckle Boulevard and
Periwinkle Drive? Will Honeysuckle Boulevard be extended beyond Periwinkle Drive?
Will Periwinkle Drive be extended past Honeysuckle Boulevard?
• Will the roads in the business office park portion be public or private?

• Please be aware, as stated in Proffer #1 under Street Improvements, the relocation of
Route 8.03 has not been finalized. It will be the responsibility of the developer to
provide funding should VDOT funding not be available. VDOT is currently
investigating the necessary steps that would be required to provide the necessary right-
of-way for the relocation.
• Please provide a specific date in regards to the development of Phase II and the
construction of Periwinkle Drive. We have concerns that all traffic for this development
will be utilizing either Honeysuckle Boulevard or two un-signalized.intersections.
Accordingly 'to Proffer #5:. "The applicant shall limit entrance connections onto U.S.
Route 50 to three points as shown on the general development plan." Please delineate
the three entrances. It appears there is an entrance listed as being opposite the VDOT
Area Headquarters entrance, but appears to be no internal roads accessing that entrance.
Is it still the expectation to utilize this entrance?
• Will Echo Lane access Periwinkle Drive or Botanical Boulevard?.
Please be aware of the required transitions for dual left turn lanes and the necessary
(r widening on the receiving lanes (minimum 15' wide lanes).
Before making any final comments, this office will require a complete set of site plans,
drainage calculations and traffic flow data from the I.T.E. Trip Generation Manual, 7th
Edition for review. VDOT reserves the right to comment on all, right-of-way needs,
including right-of-way dedications, traffic signalization, and off -site roadway improvements
and drainage. .Prior to construction on the State's right-of-way the developer will need to
apply to this office for issuance of appropriate permits to cover said work.

Planning Staff have reviewed the •preliminary master development plans for the above -referenced
properties. In light of the intertwining between the rezoning proffers for these properties, review
comments for both properties are being included together in this letter. However, separate master
development plan applications will need to be submitted at the time of formal submission to the
County. Please adequately address each of the following. issues prior to formal submission.
Review Comments for Winchester'Medical Center Preliminary Master Deyelopment'Plan:
1. MS District Buffers. Please show all buffers required per Section 165-101 C. The following
buffers are required, where applicable, for the subject property:
i. A 200' buffer adjacent to any RA District parcel with an orchard as the primary
use. Within this buffer. a 40' (inactive portion) landscape easement is required
with a double row of evergreen trees on ten -foot centers and a 3:1 slope earth
berm a total of six feet tall.
,
ii. A 1,00' buffer adjacent to any RA -District parcel with a residence as the primary
use. Within this buffer a 20' (inactive portion) landscape easement is required
with a single row of evergreen trees on ten -foot centers and a 3:1 slope earth
berm a total of four feet tall.
iii. -A-50' buffer adjacent to all other adjoining parcels. Within this buffer a 25,
(inactive portion) landscape easement is required with a single row of evergreen
trees on ten -foot centers and a single row of deciduous trees planted 30 feet.'

2) Open Space., The five (5) acres"of open space is less than the minimum required open space
for this development. As noted on the cover sheet of the preliminary. MDP, 20% of the entire
MS District Zone shall be open.space (if master planned together) and 15% of the B2 District
shall be landscaped area. This calculates to 10.37 acres of open space in the MS District and .
7.51 acres of landscaped area in the B2 District. Please make all necessary changes to reflect
this and show the location of all proposed open space.
3) " _ Trail. A detail of a bike trail is shown in the upper right hand corner of page 2 of 3. However,
I am unable to find, a trail on the preliminary MDP. Please show the proposed bike trail.
Consideration of a trail parallel 'to Botanical Boulevard and Perennial Drive should. be
considered to link such a trail to future regional trails in Frederick County and.,the City of
Winchester. Please note that a pedestrian crossing over Route 37 should be included_' any
future design plans of the possible future bridge.
4) Proffer 8 - Route 50 Landscape Buffer. • The detail of the proffered landscape buffer is shown
as 30 feet wide. This is inconsistent with the proffer• statements for the WMC and WWW
properties. The WWW MDP's same illustration correctly shows the buffer as 50 feet wide as
proffered. Regarding this trail, please coordinate a crosswalk design acceptable to the standards
of the VDOT and the Frederick County Department of Parks & Recreation.
5) Category B Buffer. The details of the proposed category B Buffer do not meet the minimum
standards of the Zoning Ordinance, because there are too few trees. Instead of a single row of
evergreens, please provide a minimum of three (3) trees per ten (10) feet, 1/3 deciduous and 2/3
evergreen.
6) Types of Residential Uses. Please clarify what housing type and how many units are proposed
within the area shown for future continuing care and elderly housing.
7) Road Design Types. Please clarify which of the proposed private streets will be�classified as
I,
"urban local streets" and which roads will be classified as "urban collector streets". Please also
".provide a typical detailed section of each road type on'the master development plan.
8) FCSA Well Site. Please_ clarify the intent:of the area depicted as FCSA well site. Will this be
a production or iesting•well site, or both? Will this area be later subdivided, and if "so, is it
intended to be transferred to the ownership of Frederick County?
/ 9) Sinkholes. Please identify all known sinkholes located on the entire parcel of land.
10), Utility Lines. Please show all proposed utility lines, including electric, gas, water and sewer.

11) Access To Adjoining Residential Parcels. Please provide the possibility for future access to
Botanical Boulevard for the'residential parcels located between the WMC and WWW site. This
access would be most appropriate at a "T" intersection with the proposed entrance on the other
'side of the street.
12) Route 50 Speed Limit., Please provide the posted speed limit for the portion of Route 50
fronting the subject property. I believe the speed limit at this location is 35 mph, however,
,
please verify this information.
13) Entrance -Spacing From Route 50 Intersection. Please remove the first entrance onto
Botanical Boulevard. All entrances shall be at least 150 feet from this intersection,• assuming
the speed limit is •35 mph. The same standards would apply to the double intersections located
off of the right -in only.
14) Periwinkle Drive. Please show and label Periwinkle Drive as a future major collector road.
This is the road which will connect the WWW and WMC properties and eventually tie into
Route 50 further north of Botanical'Boulevard.
15) • Botanical Boulevard Beyond Perennial Drive. When
Y will the rear portion of Botanical
Boulevard beyond Perennial Drive be constructed during the development process? Please
clarify.
16) . Owner Contact and Special Limited Power of Attorney Form. Please provide a contact for
the property owners with a telephone number on the cover page. Please also have the property
owner complete, sign and notarize the attached Special Limited Power of Attorney Form.
Applications for master development plans are incomplete without this form.
17) Review Agency Comments. Please provide review agency comments to Planning Staff from
the following review agencies: Building Inspections, Parks & Recreation, Health Department,
GIS, Fire Marshal, Public Works, Sanitation Authority, AirportAuthor'ity, Virginia Department
of Transportation, and the City of Winchester. ,
Review Comments for WWW L".C. Preliminary Master Development Plan
1) Street Standards. Please provide typical street design standards for the internal streets
proposed for the site. As proffered, these streets shall be constructed to VDOT standards.
Please note that unless specified otherwise, all streets shall be public streets.
2) Street Names. Please provide street names for all proposed osed streets. This includes the internal
streets to the east and west of Honeysuckle Boulevard.
3) Possible Future Interparcel Connector Roads. Please provide a possible future interparcel
connector road between the internal street to the far east of the property and the adjoining
residential parcels to the east.
4) Phasing of Periwinkle Drive. It would be appropriate to have Periwinkle Drive constructed
at the time when both Honeysuckle Boulevard and Botanical Boulevard (on the WMC properly)
are constructed. Therefore, staff recommends that language be provided on this MDP to the
effect that Periwinkle Drive be constructed prior to the development of Phase II or at the point
of time when Botanical Boulevard is constructed on the WMC property, whichever occurs first
5) Intersection of Honeysuckle Boulevard and Periwinkle Drive. The GDP of the rezoning
illustrates a continuous flow of traffic from Route 50 to the major collector road on the WMC
property (Botanical Boulevard), while the MDP does not.. Staff recommends a roundabout or
intersection that allows continuous -traffic flow at the intersection of Honeysuckle Boulevard
and Periwinkle Drive. The use of a 90 degree intersection at this location may warrant
additional analysis of how traffic will circulate.
6) Category B Buffer. The details of the proposed category B Buffer do not meet the minimum
standards of the Zoning Ordinance, because there are too few trees. Instead of a single row of
evergreens, please provide a minimum of three (3) trees per ten (10) feet, 1/3 deciduous and 2/3
evergreen.
