REVIEW EVALUATIONS:
VA. Dept. of Transportation - No objection to the preliminary master
development plan providing there is adequate sight distance at this location
for safe egress and ingress of traffic onto Route 706. A commercial entrance
permit will have to be applied for and approved before doing any work on the
State's right-of-way.
Sanitation Authority - The development will be serviced by the City of
Winchester. Water and sewer services must be installed per their specs.
Sanitation Authority will review for fire protection.
City of Winchester - City has had no request to provide water and sewer, nor
will we consider, except in compliance with the County water and sewer
extenstion policy.
Stephens City Fire Company - Shall comply with Chapter 10 of the Frederick
County Code as a minimum.
Inspections Department - This request for master development plan shall
comply to Use Group R, Residential, Section 309.0, of the BOCA Basic National
Building Code, 1984.

The Virginia Supreme Court of Appeals of Virginia, adopted the following test
of what constitutes illegal spot zoning policy:
"If the purpose of a zoning ordinance is solely to serve the
private interests of one or more landowners, the ordinance
represents an arbitary and capricious exercise of legislative
power, constituting illegal spot zoning; but if the legislative
purpose is to further the welfare of the entire county or city as a
part of an overall zoning plan, the ordinance does not constitute
illegal spot zoning, even though private interests are
simultaneously benefitted". (Wilhelm V. Morgan, 1967).
Under the A-1 regulations the site could be used for a service station,
general store, restaurant, or other uses with a conditional use permit.
There appears to be no general public need for this rezoning or general
public interest to be served. B-2 zoning would not appear to fit the general
zoning pattern in this area. The site is not located in a rural community
center.
Conclusions: Business uses are allowed in the A-1 district. The shape of
the lot, soil conditions, and limited site distance make the site limited in
terms of quality for intensive use. A conditional use permit could be used
to control the use and require optimal arrangement on the site. For
instance, grading could be required to improve sight distance, as a
condition.
In general, rezoning to B-2 would not appear to fit zoning in the area and
would appear to violate spot zoning policies.

I am writing in response to our conversation of several days ago
regarding the proposed patio home development of Z and S
partnership. I apologize for the delay in getting back to you.
In looking over the plan I note the following items;
* A vicinity map is needed.
* The plan should be labeled as a MDP with the appropriate
.signature block.
,-*,.,,The zoning and use of adjoining parcels should be stated
on the plan.
* The provision of recreational facilities needs to be
addressed.
* An indication of the location of sewer and water line
locations should be provided.
* Comments need to be obtained from both the City of
Winchester and the Frederick County Sanitation Authority.
Also, I am enclosing a copy of the new Subdivision application
package as you requested.

Your letters of March 25, 1988 are acknowledged. Please be
advised that requests for water and sewer for Plan #022-87, Z & S
Partnership, and Plan #023-87, Kernstown Heights, have been tabled by
the Utilities Canmi_ttee. The comittee has no timetable for
considering the requests. Wastewater Treatment Plant capacity issues
continue to.be of great concern to the City, and until these issues are
resolved, I would anticipate County extension requests will remain on
the table.
The developers of Plan #024-87, Star Fort Estates, have not
formally requested water and sewer service from the City. Therefore,
extensions have not been considered. I would anticipate that the City
would table a formal request.
Please advise if further information is required.
