Dear Mr. Wyatt:
I am writing on behalf of the Village at Sherando Homeowners Association to
resolve the situation concerning the proposed tot lot that was to be installed in
the Village at Sherando.
As you are aware, the homeowners in the Village at Sherando do not want the
tot lot. We are concerned about the cost of maintaining it, potential liability
issues, and the possibility that a tot lot would become an attraction for non-
residents of the community, among other factors. In order to resolve this issue
we are amenable to having the developer pay twelve thousand dollars ($12,000)
to the Frederick County Parks and Recreation Department to be used in the
construction of a bike path in our area. This contribution would be in lieu of
constructing the tot lot.

Mr. Hott:
The purpose of this letter is to propose an alternative to the construction of a
tot lot in the Village at Sherando subdivision located near Stephens City . As
we discussed on the phone, the Village at Sherando homeowners are opposed
to the construction of a tot lot, or any other recreational amenity, in the
subdivision's open space. Among their reasons are: 1) liability concerns;
2) cost of maintenance; 3) security concerns about the possible use of any
amenity by non-residents of the subdivision. The residents want the land to
remain as unimproved open space.
In lieu of constructing a tot lot or any other amenity that the residents could
just turn around and remove, the developer, Sherando Village, L.L.C., proposes
to give the Department of Parks and Recreation a check for Eleven Thousand
Five Hundred Dollars ($11,500) for use in improving the County's parks as it
sees fit. This dollar amount is the budgeted figure for the tot lot provided by
the excavation contractor that performed the infrastructure work at the
subdivision.
We hope the County will find this a useful and acceptable alternative. Please

THIS DEED OF VACATION AND DEDICATION, made and dated this ZOTH i
day of August, 1997, by and between J. E. J. P. CORPORATION, A Virginia
Corporation, party of the first part, hereinafter called the Declarant; the COUNTY OF
FREDERICK, VIRGINIA, party of the second part; THOMAS A. LOUTHAN, Sole Acting
Trustee, party of the third part; and F & M BANK - WINCHESTER, Beneficiary, party of
the fourth part. !
WHEREAS, Declarant dedicated Golladay Road for public use as more particularly
reflected in the Deed of Dedication for The Village at Sherando dated 15 July 1991, of record
in the Clerk's Office of the Circuit Court of Frederick County in Deed Book 762 at page 1741;
and as more particularly described in the Final Plat of The Village at Sherando, drawn by
Douglas C. Legge, Certified Land Surveyer, dated 31 October 1990 and revised 13 November
1990, of record in the aforesaid Clerk's Office in Deed Book 762 at Page 1760; and
WHEREAS, the County of Frederick, Virginia, subsequently changed the name of
Golladay Road to Warrior Drive; and
WHEREAS, it is the desire of the Declarant and the County of Frederick, Virginia to
provide for certain easements and to modify the right of way for Warrior Drive at its
intersection with Fairfax Pike (Virginia Route 277), as more particularly described on the
attached Plat showing Relocated Warrior Drive (formerly Golladay Road), The Village at
Sherando, drawn by P. Duane Brown, Land Surveyor, and dated 29 July 1997; and
WHEREAS, the Declarant is the owner in fee simple of the area to be dedicated and
from which easements will be granted as shown on the attached plat; and
WHEREAS, the County of Frederick, Virginia, is the owner in fee simple of the area
to be vacated as shown on the attached plat; and
WHEREAS, the area to be dedicated and from which easements will be granted is
subject to a Deed of Trust dated 14 December 1995, of record in the aforesaid Clerk's Office
in Deed Book 850 at Page 706, to secure F & M Bank -Winchester, a certain indebtedness
described therein.
NOW, THEREFORE, THIS DEED OF VACATION AND DEDICATION
WITNESSETH:
That for and in consideration of the premises and the benefits which will accrue by
reason of this Vacation and Dedication, the Declarant does hereby grant slope and drainage
easements and dedicate in fee simple all of that certain tract or parcel of land containing 14,617
square feet shown as "Area Hereby Dedicated," both as more particularly described on the
attached Plat showing Relocated Warrior Drive (formerly Golladay Road), The Village at
Sherando, drawn by P. Duane Brown, Land Surveyor, and dated 29 July 1997, attached hereto
L..Im.PAWN.P.C. and made a part hereof and by this reference incorporated herein as if set out in full.
That for and in consideration of the premises and the benefits which will accrue by

reason of this Vacation and Dedication, the County of Frederick, Virginia, does hereby vacate
and reconvey to the Declarant all of that certain tract or parcel of land containing 9,986 square
feet, and as more particularly described as "Area To Be Vacated" on the attached Plat showing
Relocated Warrior Drive (formerly Golladay Road), The Village at Sherando, drawn by P.
Duane Brown, Land Surveyor, and dated 29 July 1997, attached hereto and made a part hereof
and by this reference incorporated herein as if set out in full.
These areas are portions of the same real estate conveyed to the Declarant by Deed
dated 2 March 1990, from Robert J. Snyder, by M. Elizabeth Sargent, his Attorney -in -Fact,
and of record in the Clerk's Office of the Circuit Court of Frederick County, Virginia, in Deed
Book 740 at Page 515.
The Vacation and Dedication of the land as shown on the attached plat is with the free
consent and in accordance with the desire of the undersigned Declarant, Trustee, and
Beneficiary as to the land being dedicated; and of the County of Frederick, Virginia, as to the
land being vacated; and is in conformity with the applicable ordinances and regulations of the
governing body of the County of Frederick, Virginia.
The County of Frederick, Virginia, by the signature of its agent hereon, does accept
the dedication to public domain of the land and easements herein described as such.

I am writing in response to a copy of a letter dated October 14, 1994 we received from
Mr. Mike Hammer of G. W. Clifford & Associates concerning the referenced project.
Mr. Hammer is correct in stating we will not renew your contractor's, Buckley-Lages, Inc.,
land use permit to cover the construction of the "temporary street connection" into the
project. The permit will expire February 8, 1995.
We understand the position you are in with dealing with the adjacent Snyder life estate and
your inability to complete the permanent Warrior Road entrance. However, the temporary
entrance needs to be completed. Since installed over three years ago there has been
approximately fifty-five (55) various types of dwellings constructed within the development.
At times the condition of the entrance has been extremely bad, causing a hazard for the
residence as well as motorists on Route 277.
If Buckley-Lages does not have the temporary entrance completed by the expiration date
of February 8, 1995, you will need to provide a replacement permit and bond in the amount
of $5,000.00 to do so. I am enclosing for your use Land Use Permit Application #65535
and copies of our standard bonding forms. We realize at this time of year completion of
the entrance may not be possible due to winter weather. Therefore, we can grant you a
permit for 180 days from February 8, 1995. We feel this will give you sufficient time to
complete the entrance.
On another matter, I have discussed recently with Mr. Hammer the possibility of adding
some of the internal streets after completion to the Secondary Maintenance System. As
you know, we cannot add the temporary section of Warrior Road since it is on an
easement. Also, a condition of the permit for the temporary entrance was no internal
streets could be opened to adjacent developments, specifically Jefferson Village and
Fredericktowne Estates. In order to add any internal streets on a dedicated right-of-way,

the permanent Warrior Road connection would need to be completed. The only other
possible alternative would be if access through the temporary entrance to Route 277 is
prohibited. In other words a barricade at the intersection of Ivory Drive and Warrior Road
or other appropriate location could be installed to allow access through Jefferson Village
only. Of course the streets in Jefferson Village would need to be added to the Secondary
System first and Frederick County would need to approve of this plan.

As discussed with Mr. Ron Mislowsky at the project's recent preconstruction conference, we
believe the sanitary sewer main on the west end of Ian Court can easily be redesigned to
eliminate so much parallel main under the roadway pavement. I have marked what I believe to
be two (2) viable options on the enclosed plan sheets. Either alternative would eliminate
approximately 150' of main from under the pavement, thus reducing the possibility of future
maintenance excavations within the street's pavement structure.
If these alternatives are not feasible, perhaps you can suggest something else. Regardless, we
would appreciate the opportunity to review your final design once available.

The revised Village at Sherando Master Development Plan was considered and approved
during the March 18, 1992 regular -meeting of the Frederick County Planning Commission.
It was discovered after that meeting that the revised plan exceeded the number of units
originally proffered by the applicant. The Master Plan brought before you tonight has been
revised to meet staff and Planning Commission comments, as well as stay within the limits
of the proffers.
Planning staff is working with the applicant, representatives of G.W. Clifford and Associates,
and the Frederick County Parks and Recreation Department in an effort to examine the
feasibility of relocating 'the section of Warrior Road, currently passing through
Fredericktowne, slightly to the east onto part of the land encompassing Sherando Park.
Approximately five (5) acres of land would be involved.
Staff hopes to present a more detailed report to the Frederick County Planning Commission
at their May 6, 1992 meeting regarding this matter.

paralleling the steep slope area will adequately tie into pre
existing 15" sanitary sewer without conflicting with the
improved Wrights Run Channel. No other comments at this time.
Parks & Recreation: See attached comments, dated February 20,
1992, from Jim Doran, Director of Parks & Recreation.
Planning and Zoning: The revised Master Development Plan
submitted would amend the approved Master Development Plan of
11/15/90 to include patio homes. This amendment will modify
what was originally 17 single family cluster lots to 32 patio
home lots. Modifications in this area, as well as the single
family cluster area will increase the overall units in the
proposed development from 164 to 183, or 4.4 units per acre.
The applicant has shown additional pedestrian walkways
throughout the proposed development. One I of the three
required recreational units in the townhouse area is not shown
on the revised Master Development Plan.
A temporary patio home sales model with customer parking and
signage has been permitted in the B-2 (Business General)
Zoning.District. An affidavit for temporary commercial uses
has been provided by the applicant. This states that the
temporary patio home will be removed from the property by
November 1, 1992.
The modification from 17 single family cluster lots to 32
patio homes has increased the length of the northern cul-de-
sac from 270 feet to approximately 600 feet.
The primary concern of staff regards required open space.
Section 5-4-1 of the Frederick County Zoning Ordinance
requires a minimum percentage of the gross area of any
proposed development to be designated as common open space.
This development contains 51% townhouse lots, 31% single
family cluster lots, and 18% patio home lots; therefore, the
minimum open space requirement is 30%. The total gross area
of the RP (Residential Performance) Zoning District is 38.65
acres, which would require 11.60 acres of open space. The
applicant is providing 9.73 acres of open space.
Minor project summary information on the revised Master
Development Plan, such as total acreage, original Master
Development Plan approval date, and total open space required
by RP use needs to be modified on the revised plan.

Master Development Plan — The Village at Sherando
This Master Development Plan provides for approximately 25% open space while
being required 30% open space.
I would recommend that credit be given for the 5% open space that is lacking ifthe developer is agreeable to completing a bicycle/pedestrian travelway which
would extend from Georgetown Court to the Frederick County Park property line.
I would also suggest that the planned pedestrian travelway be redesigned to
conform with a comprehensive bicycle/pedestrian plan for the entire
development. If such a travelway could be created, which would provide
controlled access to Sherando Park and Sherando High School, I would also
recommend that only one tot lot be required for this development.
Please note that detailed specifications for all recreational units will be
required during the site plan review stage of this project.

not be on the April 8, 1992 agenda for the Board of Super-
visors. The master plan is currently working its way through
the Frederick County Transportation Committee and Planning
Commission, both of which will allow for public comment.
However, if you would still care to address the Board of
Supervisors on this matter we would be happy to place you on
the Board's agenda.

Frederick County Board of Supervisors on Wednesday, April 8, 1992. Of particular interest to my
family and many residents of the Fredericktowne Estates subdivision is the proposed plan for
"Warrior Drive" and any alternative plans which may be possible. I'm sure that I don't need to
express to you our concern that this will create not only a traffic hazard through our neighborhood,
but will create a major threat to the safety of our children and to the integrity of this community. I
hope that together the residents of Fredericktowne Estates and the Frederick County government
may reach a reasonable solution to this very distressing situation.

RE: Procedure for Amending Proffers
Dear Ron:
I am writing in response to your inquiry as to what you would need to do to amend the
proffer on maximum single family density associated with the Village at Sherando. As we
discussed briefly over the phone, it will be necessary to go back through the rezoning
process.
The Code of Virginia states in 15.1-491.2 that, "Once proffered and accepted as part of an
amendment to the zoning ordinance, such conditions shall continue in effect until a subsequent
amendment changes the zoning on the property covered by such conditions... " This section
leaves little room for interpretation. The initial amendment was achieved throughthe
rezoning process and therefore, to modify or amend the amendment would require a second
rezoning.
Since the change that you are seeking to implement involves an increase in the permitted
density of the parcel involved as well as a change to the housing type, comments will be
required from all pertinent review agencies. Comments from the agencies listed below
should be obtained:

Frederick County Sanitation Authority
Frederick County Fire Marshal
Frederick County Parks and Recreation Department
Superintendent of Frederick County Schools

As for the fee that would accompany the application, fees for all County Applications are
set by the Board of Supervisors. Unless specifically delegated the authority, no other body
or department can waive or alter those fees. At this point in time the County has not
established a separate fee for a rezoning initiated solely for the purpose of amending a
proffer, therefore, the existing rezoning fee would apply.
