The above -referenced rezoning application was approved to rezone 169.924 acres from RA (Rural Areas) District to R4 (Residential Planned Community) District for the proposed mixed use development of 793 residential units and retail, restaurant, office and public uses, with proffers dated October 25, 2006. The property is located one mile west of Interstate 81, three quarters mile north of Tasker Road (Route 649), 150 feet north of Fair Lawn Court (Route 1 l 76) and west of Canter Estates Section V, Falabella Drive, and is identified with Property Identification Number 75-A-99A in the Shawnee Magisterial District. The October 25, 2006 proffer statement that was approved as a part of this rezoning application is unique to this property and is binding regardless of ownership. Master Development Plan #09-05, a proffered condition of the rezoning application, was also approved. This Master Development Plan identifies the layout, design, and details of the project. The rezoning application and Master Development Plan #09-05 were approved with three modifications as enabled by the R4 zoning classification; Modification #1 (Section 165-72.B.(2)) provided for modifications to the housing types permitted with this project. Appendix A of the Proffer Statement identifies the alternative dimensional requirement plan which is approved for this project. Modification #2 (Section 165-71 Mixture of Housing Types Required) provided that more than 40 percent of the total residential land area may be used for multifamily housing products. According to Greg: The VFD are volunteers and receive no compensation for their fire fighting, but they buy the equipment (engines, ambulances, etc) and house and maintain them while the Fire and Rescue get all the funds. The VFD have had no funds for 3 years while the F&R have had 3 raises and get the money in the proffers. They will have to refuse to cover the Artrip area, because without any funds they won't have the equipment needed to do so. They want an amount designated at a contribution for the VFD stated in the proffers. Dewberry & Davis 611 West Jubal Early Drive, Building B, Suite C Winchester, Virginia 22601 RE: Rezoning Application for The Villages at Artrip Frederick County, Virginia Dear Mr. Wiley: We have completed our review of the proposed rezoning request associated with The Villages at Artrip and offer the following comments: 1) Development Proposal, pages 27, 28 and 29: The proposed minimum side yard setbacks indicates a deviation from the existing requirement often (10) feet to five (5) feet. If this latter minimum setback is approved, it will be difficult, if not impossible, to establish drainage easements between the detached cluster dwellings. Our experience indicates that a minimum of 20 feet is required to accommodate equipment access. This minimum requirement should be considered during the design of the actual subdivision plan where drainage easements are required between dwellings. 2) Warrior Drive, page 38: We recognize the need to construct a bridge crossing at the southeast corner of the property over an unnamed tributary of Opequon Creek. We also understand that the initial traffic demands only dictate the need for a two (2) lane road for the entire length of Warrior Drive through the project. However, the bridge should be designed and constructed to accommodate a four (4) lane road even if only two (2) lanes are paved. 3) Project Background, page 43 : The introduction indicates that the applicant purchased Lot 121 in Lakewood Manor, Section VIII to provide access to the proposed project property. The use of this lot is not acceptable either as a short term temporary access or long term permanent access. The subject lot is platted as a residential building lot, not as a right-of-way to the Artrip property. We will not approve a temporary construction entrance which routes construction truck traffic through an established neighborhood. It is anticipated that the homeowner associations and/or land owners will be responsible for the maintenance of the BMPs. 9) Solid Waste Disposal Facilities, page 80: Table 6 indicates that the proposed development will generate refuse at the rate of 12 pounds per unit per day for residential dwellings and 100 pounds per day per 1,000 square foot of commercial development. Given the proposed development included under Option 1, this equates to approximately 5,200 tons per year. Based on our current waste flow at the regional landfill, this projected waste volume would equate to an approximate two and one-half percent increase. That amount of an increase will have a significant impact on the local long term capacity of the regional landfill. 10) Exhibit 32: The legend for the Gore convenience site is incorrect. This site is actually a container site rather than a compactor site as shown. 11) Phasing of the Development, page 106: The proffered development scheme proposes three (3) phases which includes 297 residential dwelling units in Phase I and 280 residential dwelling units in Phase II. A minimal amount of commercial development (10,000 square feet) is proposed in Phase II. This development scheme does not mitigate the impacts to services provided by Frederick County as intended in the R-4 zoning. 12) Creation of Homeowners' and Property Owners' Associations, page 109: Refer to item IV, 12.2 regarding the maintenance of street or road buffer areas. The creation of Homeowners' Associates should include the responsibilities for the care and maintenance of all private streets/roads not dedicated to the Virginia Department of Transportation. The language included in the proffer statement implies buffer areas only. 13) Environment 14.1, page 110: Indicate who will be responsible for the maintenance of BMP facilities. Operation and maintenance procedures shall be included with the subdivision design submission. 14) Wetlands and Waters of the U.S., page 53: The discussion indicates that the applicant plans to re -use or possibly retrofit the existing farm pond as a focal point The Village at Artrip Rezoning Comments Page 2 December 20, 2004 the proposed project property should be removed from the impact analysis and replaced with a more realistic approach for a construction entrance. Alternative construction entrances should be included in the impact analysis. 4) Project Background, page 46: This discussion centers on the proposed phasing and the fact that the phasing does not achieve the balance of residential and commercial as specified in the R-4 zoning requirements. This issue was adequately addressed in the July 22, 2004, comments (Comment #1, Section 3, page 41) provided by the planning and development department. The proposed phasing needs to mitigate the impact to services in Frederick County not create an economic hardship. 5) Other Environmental Conditions Surrounding Properties, page 63: The statement is made that "the. applicant is unaware of any nuisance impacts that will be created as the result of this development." The most common nuisance that we have experienced in Frederick County are erosion and dust during the early construction phases. These issues can be addressed during design. The erosion and sediment control ordinance will be strictly enforced during construction by Frederick County. 6) Sewage Conveyance and Treatment, Pages 67, 70: The reference to Buffalo Lick Run is incorrect. Buffalo Lick Run is actually located several miles to the north of Opequon Creek. Verify that the referenced 15-inch gravity interceptor is actually paralleling the unnamed tributary of Opequon Creek along the south property line. Also, verify that the 15-inch interceptor has sufficient capacity for this project. It appears that the Parkins Mill Wastewater Treatment plant does not have sufficient capacity to accommodate the proposed Crosspointe Center and the Artrip Project. It also appears that a proposed upgrade to 3.0 MGD will not be completed until 2008. Therefore, we cannot grant our final approval of any subdivision and/or site plans until we receive confirmation from the Frederick County Sanitation Authority (F.C.S.A.) that sufficient capacity exists at the Parkins Mill facility. 7) Water Supply, page 74: The discussion. indicates that the 500,000 gallon Route 642 elevated water storage tank is located on property rezoned for Crosspointe Center. In actuality, this elevated water storage tank is located on property owned by the F.C.S.A. 8) Drainage Exhibit 25: We concur with the use of BMP facilities to achieve stormwater management within the proposed project area. The farm pond and several feeder swales have been identified as legitimate wetlands. Indicate if the applicant plans to preserve these features in their current state or totally destroy these habitats and create a more sterile geometric water feature. The master development plan implies the latter design will be implemented; whereas, the narrative is somewhat vague and implies there is some hope for combining the preservation of the natural flora and fauna of the wetlands with a SWM feature. As you are aware, the Frederick County Zoning Ordinance (Section 165-72.D) requires that a minimum of 10% of the gross area of a project in the R4 District shall be used for business and industrial uses. In section 3 (Impact Analysis Statement), page 102 of your draft rezoning application, you state that commercial areas on the property total approximately 20 acres or about 12% of the total area and, therefore, meet the minimum area requirements. However, in Section 3, page 41 of your submittal, the table only lists 9.2 acres of retail development and 1.38 acres of office development. The draft master development plan with your submittal lists a total of 9.2 acres of commercial/retail/office/apartment development. The amount of business land in the project needs to be clearly and consistently shown if you intend to demonstrate that the project meets the minimum commercial requirement - The Frederick County Planning Department is currently experiencing a staff shortage, and I am unable at this time to fully explore this issue with you. Specifically, the areas of RP and B2 zoning associated with the recently approved Crosspointe Center project are not shown on the map, nor does the map include the RP zoning associated with the Southern Hills subdivision. Moreover, the map does not include an accurate layout of the road system. Notably, Tasker Road is not shown on the map, which instead depicts the pre-Tasker alignment of Macedonia Church Road. Also, Warrior Drive is not shown to its current terminus at Tasker Road. It is recommended that this map be updated to accurately reflect both -current zoning and the existing transportation network in the vicinity of the subject tract. 2. Development Proposal p 27 The development proposal describes several elements that will require modifications of applicable Zoning Ordinance standards. Applicants for the R4 zoning designation may propose such modifications pursuant to the provisions of Section 165-72.0. In particular, the rezoning application seeks a gross residential density of 5.3 dwelling units per acre, which exceeds the maximum density allowed by ordinance of 4.0 dwelling units per acre. Moreover, the application provides for other elements or features requiring modification approval, to include: multi -family housing types comprising more than 40% of the total residential land area for the project, reductions in required parking within the town center area, and reduced road efficiency buffers between residential land bays and the primary roadways within the project (i.e. Warrior Drive). It is recommended that the description of the development proposal identify the needed modifications and refer the reader to the justification for each that should be provided - in the proposed proffer statement. It is further recommended that the development proposal provide anintroduction to the new housing types that will be included in the Villages at Artrip. Specifically, attention should be drawn to the "stacked flats" housing type as well as the apartments over retail type that is planned within the town center area. It should also be noted in the description that the applicant is proposing alternative dimensional standards for many of the housing types permitted by ordinance in order to implement a neo-traditional development concept. The submission of such. alternative standards is allowed by Section 165-72.B. of the Zoning Ordinance. In cases where new housing types are being proposed, it may be advisable to provide illustrative examples of building elevations to ensure that innovative approaches to housing and design are fully appreciated by the Planning Commission, Board of Supervisors, and general public. Tables outlining alternative dimensional standards as well as plans and profiles governing road design and alternative buffering and screening should be included with the proposed proffer statement. Furthermore, all modification requests, to include all supporting materials and justification, should be included with the proposed proffer statement. Indeed, all such alternative provisions are intended to govern the physical development of the site in lieu of standard ordinance requirements, thereby serving as a regulatory scheme unique to the Villages at Artrip project. If adopted by the Board of .Supervisors through approval of the requested rezoning, the proposed proffer statement will constitute an amendment to the Zoning Ordinance applicable solely to the land subject to the rezoning action. As such, the proposed proffer statement is the appropriate document within which all alternative design and development provisions should be articulated. 3. Warrior Drive p 34 The completion of Warrior Drive as a four lane divided major collector roadway is a critical component of the county's long range transportation plan, and is clearly articulated as such by the South Frederick Land Use .Plan (SFLUP), which is the small area plan applicable to the site. Although traffic generation may not warrant the complete four lane section of Warrior Drive through the project, it may be appropriate to consider construction of the full section within portions, if not all, of the development. Indeed, this application seeks a gross residential density that significantly exceeds that which has been either proposed or realized in Frederick County to date. Regardless of the myriad design related arguments that favor the proposed . density, it is reasonable to expect that the community's willingness to experiment with higher densities will depend to some degree on the capacity of this application to provide for the full - implementation of this fundamental regional transportation improvement. At a minimum, this application should provide the estimated costs of the road improvements proffered by the applicant. Section 3 I. Phasing Schedule b 41 The proposed phasing schedule does not provide for commercial/non-residential development within each phase of development thereby precluding a "balance" of uses throughout the development cycle. Moreover, the phasing schedule does not provide an estimated completion date for each phase. Both of these elements are required with a request for R4 zoning pursuant to Section 165-72.M. of the Frederick County Zoning Ordinance. Although modifications can be pursued* for either of these requirements, it is strongly recommended that the proposed phasing schedule be amended to include commercial uses with each phase of development. In the absence of the concurrent development of residential and non-residential uses, realization of a mixed use community that is indeed walkable will be delayed to the latter stages of the project following substantial residential development (at least 653 units). 0 The essence of the mixed use concept of the Comprehensive Policy Plan as well as the phasing provisions of the R4 District is to ensure a balance of uses and a walkable environment for all residents, regardless of whether they are the first or last to buy into the community. Moreover, delaying non-residential development to the final phase of development increases the risk to the county that the project may stall with minimal or non-existent non-residential uses, thereby negating the project's anticipated fiscal advantages. 2. Steen Slopes Exhibit 14 p 50 Please note that the Frederick County Zoning Ordinance defines steep slopes as "land areas where the slope exceeds 50%." It is recommended that an additional data layer be included on the steep slope map that delineates 50% or greater slopes. 3. Traffic, p. 60 Although the intersections in closest proximity to the subject site maintain overall LOS C conditions at peak hour, it is noted that A Traffic Impact Analysis of the Villages at Artrip projects the Interstate 81 interchange at Route 37/Route 11 (Kernstown) with LOS F conditions at project build -out (2012). It is recommended that the Impact Analysis Statement address this build -out scenario, with particular emphasis on the extent to which the project's anticipated traffic contributes to the failing conditions. 4. Sewage Conveyance and Treatment p 61 69 Please specify the current operating capacity of the Parkins Mill Wastewater Treatment Plan as well as an accounting of available capacity, both current and projected based upon planned/pending development activity. 5. Water Supply p 69 — 73 Please provide an accounting of available water capacity at the James H. Diehl Water Filtration Plant, both current and projected based upon planned/pending development activity. 6. Historic Sites and Structure p 79 — 83 Please note that this application must be scheduled for review and comment by the Historic Resources Advisory Board (HRAB). The staff contact responsible for scheduling items for HRAB consideration is Candice Mills in the Department of Planning and Development. 7. Impact on Community Facilities -p 83 — 95 The projected fiscal impacts of the development program proffered with this application must be determined through employment of the Frederick County Fiscal Impact Model. At the request of the applicant, staff will conduct the requisite model run for inclusion in the application packet. 8. Analysis of Article VII R4 District p 103 and 106 Please note that the Zoning Ordinance requires that a road efficiency buffer be provided adjacent to major collector roadways when abutted by residential uses. Thus, a road efficiency buffer will be required along Warrior Drive where it adjoins residential land bays, the design of which must conform to the provisions of Section 165-37. A 35 foot - wide road buffer is encouraged where a road efficiency buffer is not otherwise required, such as adjacent to commercial/non-residential land bays. A detail illustratingthe composition of the proposed 35 foot wide buffer should be provided to guide future implementation. The correct version of Section 165-72.0. is not stated in the Impact Analysis Statement. This is a critical provision as it enables the applicant to seek modifications to Code requirements governing physical development. The full language of this section must be provided, and an overview of the modifications being sought should also be included. As noted previously, the full materials and justification associated with each modification request should be provided as components of the proposed proffer statement. Section 5 I. Land Use, Paragraph 1.4., p 114 It is recommended that the alternative dimensional standards for residential uses be stated through an independent paragraph. In this new paragraph, the housing types planned for the project should be stated, and new housing types identified. The paragraph should then proceed to introduce the dimensional standards proposed for each type, as currently proposed. 2. Land Use Paragraph 1.5., p 117 Note that the ability to develop to the proposed maximum of 900 dwelling units is dependant upon approval of a modification of the density limit of the R4 district. A statement to this effect would be appropriate in the subject paragraph. Moreover, as stated previously in this document, all proposed modifications should be delineated in the proffer statement and accompanied by the supporting materials outlined by the Zoning Ordinance [Section 165-72.0.(2)]. 3. However, no such plan is provided for preliminary review. It is requested that the proposed compxeherisive sign plan be provided to planning staff for comment prior to formal submission of the application. Furthermore, it is recommended that the plan be included as a component of the proposed proffer statement, as it will serve as the sign ordinance for the project. 7. Architecture Signaae and Landscaping Paragraph 5.3.. p 119 Note that a road efficiency buffer will be required when residential land bays are located adjacent to Warrior Drive and Parkins Mill Road, as per Section 165-37.E. of the Zoning Ordinance. Should it be necessary to modify the dimensional standards of the road .efficiency buffer, a modification may be requested. Significant residential growth in Frederick County has resulted in the schools serving this area having student enrollments nearing or exceeding the practical capacity for a school. The cumulative impact of this project and others of similar nature, coupled with the number of approved, undeveloped residential lots in the area, will necessitate the future construction of new school facilities to accommodate increased student enrollments. The resubmitting of this rezoning application with its proffer statement provides approximately I 1 acres to be dedicated for a future elementary school site (minimum acreage needed for an elementary site would be 15 acres). It is imperative with the above number of units included with this project that an elementary school be located in this area. With current building trends, future considerations need to given to additional middle and high school facilities. Also because of the continued growth in Frederick County, the replacement of certain administrative facilities such as the transportation and administration, which currently have exceeded their capacity, will need to be replaced or expanded. This proffer helps to address the impact of a future elementary school; however, the impact of this type of application on other current and future school division needs should be considered during the approval process.
