However, before we can make any further comments, it will be necessary to submit a complete set of subdivision plans for our review. Sanitation Authority - Development should be served by the City of Winchester as the Authority has no facilities available to the site. City of Winchester - See attached letter. Planning and Zoning - The Master Plan proposes 48 single-family detached cluster lots with 3.76 acres of open space, road rights -of -way, and easements. RP requirements will not apply to portions of the development in the City. The environmental requirements have generally been met.' There are some steep slopes located in the southwest portions of the site. The applicant has not specified their exact location, but from the contours, the areas of steep slopes appears to be limited and the disturbance limitations will be met. The open space requirements have been met. No bonus provisions are requested. The buffer requirements have been met. Sewer and water service will involve extension of City lines and will require City/County approval. Concern should be expressed for the impacts of connecting Wayland Drive to Route 50 in the vicinity of the new hospital. It is possible that such a connection will increase through traffic on Wayland Drive which could have a significant impact on the existing neighborhood to the south of this site. The applicant is not required to show lot lines at this point in the process. However, the applicant has shown lot lines and proposed lots which use "pipestem driveways" as access to public streets. In one case, as many as PRELMINARY MASTER DEVELOPMENT PLAN #008-87 Westside Station five lots are connected to public streets only via such driveways. Technically, such an approach does not violate the ordinance. In addition, pipestem or flag lots are useful in some situations. However, in this case, it appears that such an approach is being used strictly to avoid street construction. The County Code is not clear on this issue, but it is the staff's opinion that it is not the intent of the Subdivision Ordinance, as expressed in Section 3-4-8, to use flag lots to avoid street construction. This is for the protection.of the proposed homes from flooding should a storm occur greater than the storm sewer will handle. Item 5 The two (2) short cul de sac streets, Kathy Court and Colin Court, appear to be of fixed traffic generation and should not be extended: therefore, the typical section showing 26' pavement and 30' face to face of the curb would be acceptable in accordance with subdivision policy. Widening to 36' pavement would require redesign of the street right of way from 40' to 50' width. This has been discussed and concurred with Mr. E. C. Cochran, Jr. There are two (2) vertical curves at station 8+42 and station 16+40 which should be increased to 150' length as noted. We understand that a cul de sac is to be provided at the end of Wayland Drive in lieu of connecting to.the existing street. First, 5 lots are shown in the City at the east end of Kathy Court. These lots are approximately 450 feet away from the connecting street in the City, Wayland Drive. These lots will have to be provided City service in terms of garbage pick up, snow removal, emergency response (police, fire, and rescue) as well as school bus transportation. The residents of the County lots on Kathy Court will not be provided these services. This will most likely cause confusion on the part of these residents. More importantly, if the County portion of Kathy Court is blocked either with snow or some other obstruction, the City will be unable to serve its 5 lots. The City recommends that direct access be provided -these city lots from Merrimans Lane or proposed Wayland Drive. The second concern stems from the twin cul de sacs which prevent Wayland Drive from being a through street. Emergency services to the residents in Merrimans Estates are usually provided by the City as it is the closest service provider. Currently, access to Merrimans Estates is made difficult by the narrowness of Merrimans Lane. As this area develops, access to Merrimans Estates will be increasingly congested. Without a through street of adequate size and design, adequate future emergency services cannot be provided by the City for Merrimans Estates. More importantly, by keeping the same name for existing Wayland Drive and. proposed Wayland Drive, confusion is likely and will further delay the emergency services that can be provided. The matter was carried over from September 16, 1987, to the next meeting of the Frederick County Planning Commission for further study. Among the concerns expressed by the Planning Staff were the pipestem designs contained within the preliminary plat. This is of course a matter of major concern and deserves the full consideration of the Planning Staff and the Planning Commission. However, I would suggest to you other matters of concern which I believe should properly be considered at this time. While a master plan at the preliminary stage is not as detailed in terms of its internal lot lines, setbacks, and other matters as will be the final development plan, nevertheless before preliminary approval is given, I think that the following questions certainly should be resolved: 1. It seems to me that, without knowing the details necessary to a final plan, the Planning Commission not only is entitled to but owes an obligation to future purchasers of lots to find out how the developer intends to maintain and A MEMBER OF COMMONWEALTH LAW GROUP, LTD. • HALL, MONAHAN, ENGLE, MAHAN & MITCHELL Mr. Robert W. Watkins October 5, 1987 Page 2 keep in satisfactory condition that property which will be devoted to open space. There have been numbers of develop- ments in Frederick County and elsewhere in which adequate provision was not made and the developer walked away from the problem, leaving the individual owners to wrestle the matter out between themselves. 2.. Without going into the final plan details, it seems to me that the Planning Commission is also entitled to an analysis of how traffic will be handled not only within the subdivision but more importantly as it enters Route 50 West or enters and travels over Merriman's Lane. A heavily traveled subdivision exit which bottlenecked into a two lane country road certainly would not be justified and would throw an additional burden for road construction on the state and the county to the west on Merriman's Lane and the city to the east. An exit onto Route 50 in the face of eastbound traffic requires safety precautions. 3. It is my understanding that the School Board is charged with the responsibility for.development of school bus routes.- Without knowing the final details of the plan, it still would appear that the plan must adequately provide for either school bus access to the development or access of the children to school buses. The environmental impact, and a number of other factors are spelled out as the concern of the Planning Commission. I submit that the various aspects of development encompass not only the development itself but with respect to these concerns as spelled out in the ordinance, extend to the manner in which the subdivision will fit into the community as a whole. The developer owes a full explanation at this stage in regard to these factors. I am not at all certain that answers do not exist. I simply feel that they should be made available at this stage. This approval is contingent upon final approval of water and sewer main extension plans and specifications; approval of the subdivision by Frederick County, which must include Board of Supervisors approval for main extensions into Frederick County; and finally, the approval of main extension contracts by the Winchester City Council. For your information, enclosed is a copy of the procedure resolution which City Council adopted on August 11, 1987. At this time, we are at Step 3 in the process.
