Approval was granted for the rezoning application, #005-91, and the preliminary master development plan, #005-91, for Westminster Canterbury. The rezoning application requested 2.9375 be rezoned from B-2 (Business General) to RP (Residential Performance) for an addition to the existing retirement housing. Following the approval of the rezoning, the preliminary master development plan was approved for twenty (20) duplex units. This property is located off of Route 522 north on Westminster Canterbury Drive in the Gainesboro District and is identified as parcels 63A, 63B, 52B and J on tax map 53. The rezoned property is parcel J on tax map 53. Please submit, to this department for administrative approval, the final master development plan after you have addressed the staff and agency comments. PROPOSED USES: Residential REVIEW EVALUATIONS: Va. Dept. of Transportation: Since the proposed development will be accessed from a private street and all planned streets are to remain private, this agency has no comment. Fire Marshal: Fire lanes will be required at all hydrants per Frederick County Chapter 10. Since the City of Winchester Fire and.Rescue Dept. is the service provider to this site, a copy of this application has been forwarded to Capt. Eddie Lillis'for his review. (These comments are attached.) Airport Authority: See attached comments. Parks & Recreation: Master Development Plan appears to meet open space requirements and existing recreation facilities are adequate to serve the additional 20 duplex units. Inspections Dept.: Buildings shall comply with the Virginia Uniform Statewide Building Code and Section 309.0 Sue Group R (Residential) of the BOCA National Building Code, 1990. Sanitation Authority: 1st review -- 3 items, correct and resubmit. Construction drawings to show calculations that 2" FM is sized correctly. Health Dept.: Public water and sewer to be provided by County Sanitation Authority. No further comments. County Engineer: See attached letter dated July 11, 1991 from Donohue. Planning & Development: The application proposes 20 duplex units to be occupied by senior citizens. A portion of the property on the MDP is pending rezoning approval from the Board of Supervisors from B-2 to RP. The Commission recommended approval of the rezoning application at your July 17 meeting. Assuming the rezoning is approved, the proposed duplex units would be a permitted use of the property. OPEN SPACE The original Westminster -Canterbury facility was approved prior to our current MDP requirements, therefore no open space or areas for future development were designated. Our ordinance requires 30% open space for a development of this nature. This would amount to 14.3 acres for this site. The current proposal indicates,40 of the 47 acres within the County as open space (84.9%), the plan needs to show the location of this area. The plan should also state that any future expansion of the facilities will preserve the 14.3 acres of minimum open space required. LOT AREA PER UNIT The Zoning Ordinance contains various square footage requirements for duplex units based on the number of bedrooms in each unit. Although the applicant indicates that they do not intend to subdivide, some information needs to be provided to show that these square footage requirements are being met. BUFFERS TO BE PROVIDED The MDP indicates no buffers from adjoining uses. It appears that a buffer will be required along a portion of the northern edge of the property adjacent to the existing Canterbury Square patio homes. If so, the location of,the buffer along with a detail showing its makeup should be given on the MDP. Adequate distance buffers appear to exist elsewhere, however they need to be indicated on the plan. ACCESS The applicants are proposing private roads. As no subdivision is proposed, this would be permitted. Staff feels that some form of turn -around should be provided at the eastern terminus of the entrance road. The staff is also opposed to the location of the connection to the existing Westminster - Canterbury parking lot. The curve where the road is shown intersecting the parking lot appears to be the least desirable location for such a connection. The staff suggests that, if the connection is to be made, it be relocated on the eastern edge of the parking area where a "T" intersection could be constructed. MISCELLANEOUS The following items need to be present on the plan: 1) A legend indicating all symbols used. 2) The width of all right-of-ways 3) The location of all environmental features within open space areas, and areas to be disturbed. 4) The names of adjoining property owners. 5) Existing structures should be labeled as such. STAFF RECOMMENDATIONS FOR P/C MTG. OF 8107/91: Approval, contingent upon Board of Supervisors approval of the pending rezoning and all staff and review agency comments being met. No response is required at this time to the comments by VDOT, Fire Marshal, Airport Authority, Parks and Recreation, Inspections Department, and Health Department. 2. County Engineer's comments. The comments from Donohue & Associates, Inc. deal primarily with requirements for the site plan, or with additional further development, which is not contemplated at this time. Other comments are addressed by the enclosed Plan. \N'�3. Sanitation Authority comments. The Sanitation Authority's comments have been addressed by the enclosed Plan. Refer to the enclosed comment sheet. Engineers. Surveyors.' Planners &`-� 4 . Planning & Development comments. Landscape a) Rezoning of a portion of the site has been Architects approved. At this time we do not feel that it is practicable to designate a specific location for open space. s c) The project is not a subdivision and, therefore, there are no lot lines. However, for purposes of responding to your comment, we have prepared the attached sketch which indicates "site limits" for each proposed unit. Please note that the smallest site is approximately 6270 SF in size, and the average size is approximately 8810 SF. The required "lot size" for a 2 bedroom duplex is 5000 SF minimum and 5500 SF average. d) From our earlier discussions, we understand that a buffer is required at the northern end of the development. The Planning Commission has subsequently approved a waiver which will allow a 50' woodland strip as a full screen. This woodland strip is shown on the enclosed Final MDP. e) A modified "T" turnaround will be provided at the eastern terminus of the entrance road. At the connection of the project road to the existing parking lot, modifications will be made at the Site Plan stage to minimize potential conflicts between parking lot traffic and roadway traffic. f) A legend has been added to the enclosed MDP. g) The proj ect streets, as well as Westminster (w�j5 Canterbury Drive at the entrance, are private and have no right-of-ways. h) The location of all environmental features, open space, etc. are shown on the enclosed work sheets. i) As discussed, names of adjoining property owners are not a requirement of the MDP. Planning & Development: The application proposes 20 duplex units to be occupied by senior citizens. A portion of the property on the MDP is pending rezoning approval from the Board of Supervisors from B-2 to RP. The Commission recommended approval of the rezoning application at your July 17 meeting. Assuming the rezoning is approved, the proposed duplex units would be a permitted use of the property. OPEN SPACE The original Westminster -Canterbury facility was approved prior to our current MDP requirements, therefore no open space or areas for future development were designated. Our ordinance requires 30% open space for a development of this nature. This would amount to 14.3 acres for this site. The current proposal indicates 40 of the 47 acres within the County as open space (84.9%), the plan needs to show the location of this area. The plan should also state that any future expansion of the facilities will preserve the 14.3 acres of minimum open space required. LOT AREA PER UNIT The Zoning Ordinance contains various square footage requirements for duplex units based on the number of bedrooms in each unit. Although the applicant indicates that. they do not intend to subdivide, some 'information needs to be provided to show that these square footage requirements are being met. BUFFERS TO BE PROVIDED The MDP indicates no buffers from adjoining uses. It appears that, a buffer will be required along a portion of the northern edge of the property adjacent to the existing Canterbury Square patio homes. If so, the location of the buffer along with a detail showing its makeup should be given on the MDP. Adequate distance buffers appear to exist elsewhere, however they need to be indicated on the plan. 0 ACCESS The applicants are .proposing private roads. As no subdivision is proposed, this.would be permitted. Staff feels that some form of turn -around should be .provided at the eastern terminus of the entrance road. The staff is also opposed to the location of the connectionto the existing Westminster - Canterbury parking lot. The curve where the road is shown intersecting the parking lot appears to be the least desirable location for such a connection. The staff suggests that, if the connection is to be made, it be relocated_on the eastern edge of the parking area where a 'IT" intersection could be constructed. MISCELLANEOUS.
