MAGISTERIAL DISTRICT: Opequon ADJACENT LAND USE AND ZONING: Zoned RP; B-2 and A-2 uses are residential and vacant. PROPOSED USE AND IMPROVEMENTS: Garden apartments REVIEW EVALUATIONS: VA. Dept. of Transportation - No objections to the master development plan; however, before we can make our final comments, it will be necessary to submit a complete set of subdivision plans for our review. Sanitation Authority - We will have wastewater capacity at our Stephens Run Plant for the referenced development on or about June 1, 1989. This is the scheduled date for the completion of the Parkins Mill Plant. The completion of this plant will enable flows to be diverted from Stephens Run and cause the moratorium to be lifted. Stephens City Fire Company -We concur with comments made by Fire Inspector. Frederick County Fire Inspector - Hydrant locations as shown do not conform to Chapter 10 of the Frederick County Code. The requirement is for at least two hydrants within 300 feet of each building. Some of these buildings are in excess of 500 feet from a single hydrant. Also, please do not place hydrants adjacent to parking spaces as access is impaired during emergency situations. Place hydrants within three feet of the curb on traffic islands or at street access areas. Inspections Dept. - This request for a master development plan shall comply to Use Group R, Section 309.0 of the BOCA Basic National Building Code, 1984. Page 2 PMDP #020-87 of Stimpson Apartments Planning & Zoning - Property is zoned RP, in which garden apartments are a permitted use. Environmental requirements have been met. There is no phasing shown, so it is assumed none is proposed. It should be noted that this application was received prior to the December 1987 revisions to the RP regulations, as well as the master plan revisions. The plan was held up due to the moratorium placed on hook-ups to the Stephens Run Plant. The plan does not meet the present buffering or setback requirements and exceeds the gross density permitted under the revised regulations. Information which should be provided before final approval includes: which roads, if any, will be publically dedicated; information on the type of recreational facilities to be provided; information on how storm water will be handled and the location of any facilities. The basic soil group is Martinsburg Shale which is not highly erodible. The stormwater will be directed on site by curb and gutter around roads and parking areas. The entire project will be graded to direct all water toward the existing drainage ditch which traverses the site from north to south. Curb cuts and drop inlets will be employed to discharge the stormwater into this ditch. The site is less that 5% of the total drainage area so little impact is anticipated, however, a detention basin will be constructed in the common area at the south end of the site. The detention facility will be constructed in the early stages of development and will be used as a sediment basin during land disturbing activities. This basin, together with sediment barriers should be adequate to prevent sediment bearing runoff from entering Stephens Run. It is in response to the proposed "Stimpson Apartments" designed to be constructed on property adjacent to the Town's sewage treatment facility. When the Stephens City stablization pond was built in 1963, the area was considered remote from residential develop- ment. The property that is now proposed for one hundred forty (140) garden apartments was an orchard and hay field. Orchards and wastewater treatment facilities might be con- sidered compatible neighbors. There is certainly no way that the same can be said for housing and wastewater treatment fa- cilities. Just ask the neighbors in Ridgefield and Stephens Village subdivisions. The Stephens City wastewater treatment plant has met regu- lations every month since 1986 when the plant was upgraded to a secondary treatment plant. However, there are days when odors occur and numerous complaints are filed in this office. Even A. W. T. facilities cannot guarantee odorless evenings in mid- summer. As you are aware, a second sewage treatemnt plant, operated by the Frederick County Sanitation Authority, is also less than one -quarter (1) mile away. I am not sure what record it has in meeting regulations, but it too generates odors. Sewer plants, no matter how well they are operated, are going to emit odors. They also cost thousands of dollars and should not be relocated at the expense of the existing users. This additional acreage has been reserved for a number of years for expansion of the wastewater treatment fa- cility. There are other problems that maybe foreseen with the con- struction of one hundred forty (140) apartments adjacent to the wastewater plants. The sewage plant is enclosed by a woven wire fence. However, the fence can be easily crossed by anyone who so desires. Of course, the Town's property is posted, but it cannot be constantly guarded against trespassers; particularly young persons who.may visit the site out of curiousity. There are many hazards such as deep water, high voltage, chlorine and sulfur dioxide gas, etc. Chlorine and sulfur dioxide gases, as you well know, are very toxic. In the event of a major leask, it is possible that an evacuation of the homes in the vicinity may occur. There are many reasons why housing should not be built near sewage plants. Perhaps, the County Planners should reconsider the zoning of this area and permit more compatible uses such as warehousing. The quality of life of the persons who move into the new housing will be affected by the proximity of the sewer plants. The developer should be made aware of this.
