In accordance with your request dated January 19, 2001 you are given permission to
install a temporary construction entrance at the referenced location. This letter is to be
considered your permit to do so. The following provisions will be required:
• Work area protection signage is to be in accordance with the current Work Area
Protection Manua/while working on the right-of-way.
• All work on the right-of-way is to be confined to the temporary entrance location
only.
• A minimum 6" depth of VDOT #1 (2-3 inch stone) course aggregate by 30' in width
will be required. It is to be placed from the edge of pavement and extended back
onto private property far enough to prevent the carrying of mud onto the roadway.
• Positive drainage is to be maintained within the right-of-way at all times.
• A wash rack will be required.
• A 15" culvert will be required, if needed.
• Any disturbed areas of the right-of-way or damages to the pavement structure
adjacent to this entrance will be repaired by you to our satisfaction.
• This permit is being issued for sixty (60) days for heavy vehicle use, after that
personal vehicle use only will be permitted.
• All work is to be completed in accordance with the enclosed Virginia Erosion &
Sediment Control Handbook, Specification 3.02.

Perry Engineering Company, Inc. agrees to post surety of sufficient amount to cover
the costs of repairing any project specific damage on Routes 797, Tulane Drive;
Route 1246, Harvard Drive; and Route 1248, Price Drive, including overlaying all
three roadways from the project site to Route 50.
• This temporary construction entrance permit will become effective once all residents
of Price Drive have been notified.
• The attached letter dated January 29, 2001 addresses the University's agreement to
the terms and conditions of this permit.
The Department of Transportation will not be held liable for suit should such result from
this operation nor is it granting permission to grade on the property of others or disturb
underground utility lines. If the above listed items are not followed this permit may be
revoked.

Definition

Purpose
To reduce the amount of mud transported onto paved public roads by motor vehicles or
runoff.

Planning Considerations
3.02
Minimum Standard 7#17 (MS #17) requires that provisions be made to minimize the
transport of sediment by vehicular traffic onto a paved surface. Construction entrances
provide an area where a significant amount of mud can be removed from construction
vehicle. tires before they enter a public road and, just as important, the soil adjacent to the
paved surface can be kept intact. A filter fabric liner is used as a "separator" to * ' * e
the dissipation of aggregate into the underlying soil due to construction traffic loads. If the
action of the vehicles traveling over the gravel pad is not sufficient to remove the majority
of the mud or there exists an especially sensitive traffic situation on the adjacent paved road,
the tires must be washed before the vehicle enters the public road. If washing is necessary,
provisions must be made to intercept the wash water and trap the sediment so it can be
collected and stabilized. Construction entrances should be used in conjunction with the
stabilization of construction roads (see Std. & Spec. 3.03, CONSTRUCTION ROAD
STABILIZATION) to reduce the amount of mud picked up by construction vehicles and
to do a better job of mud removal. Other innovative techniques for accomplishing the same
purpose (such as a bituminous entrance) can be utilized, but only after specific plans and
details are submitted to and approved by the appropriate Plan -Approving Authority.
Design Criteria
Aoereizate Size
VDOT #1 Coarse Aggregate (2- to 3-inch stone) should be used.
Entrance Dimensions
The aggregate layer must be at least 6 inches thick; a minimum three inches of aggregate
should be placed in a cut section to give- the entrance added stability and to help sev-ure
filter cloth separator. It must extend the full width of the vehicular ingress and egress area
and have a minimum 12-foot width. The length of the entrance must be at least 70 feet (see
Plate 3.02-1).

If conditions on the site are such that the ' majority of the mud is not removed by the
vehicles traveling over the stone; then the tires of the vehicles must be washed before
entering the public road. Wash water must be carried away from the entrance to a
approved settling area to remove sediment. All sediment shall be prevented from entering
storm drains, ditches, or watercourses. A wash rack may also be used to make washing
more convenient and effective (see Plate 3.02-1).
Location
The entrance should be located to provide for maximum utilization by all construction
vehicles.

Construction Specifications
3.02
The area of the entrance must be excavated a minimum of 3 inches and must be cleared of
all vegetation, roots, and other objectionable material. The filter fabric underliner will then
be placed the full width and length of the entrance.
Following the installation of the filter cloth, the stone shall be placed to the specified
dimensions. If wash racks are used, they should be installed according to manufacturer's
specifications. Any drainage facilities required because of washing should be constructed
according to specifications. Conveyance of surface water under entrance, through culverts,
shall be provided as required. If such conveyance is impossible, the construction of a
"mountable" berm with 5:1 slopes will be- permitted.
The filter cloth utilized shall be a woven or nonwoven fabric consisting only of continuous
chain polymeric filaments or yarns of polyester. The fabric shall be inert to commonly
encountered chemicals and hydrocarbons, be mildew and rot resistant, and conform to the
physical properties noted in Table 3.02-A-
Maintenance
The entrance shall be maintained in a condition which will prevent tracking or flow of mud
onto public rights -of -way. This may require periodic top .dressing with additional stone or
the washing and reworking of existing stone as conditions demand and repair and/or
cleanout of any structures used to trap sediment. All materials spilled, dropped, washed,
or tracked from vehicles onto roadways or into storm drains must be removed immediately.
The use of water trucks to remove materials dropped, washed, or tracked onto roadways will
not be permitted under any circumstances.

SPECIAL PROVISIONS APPLICABLE TO LAND USE PERMIT NO.
- SPECIAL NOTICE OF PERMITTEE LIABILITY -
Any of the following provisions, which can apply, shall apply.
1. Permittee acceptance and use of a Virginia Department of Transportation (VDOT) Land Use Permit is prima facie evidence
that the Permittee has read and is fully cognizant of all required permit provisions, applicable traffic control plans and
associated construction standards to be employed. All applicants to whom permits are issued shall at all times indemnify
and save harmless the Commonwealth Transportation Board, members of the Board, the Commonwealth, and ALL
commonwealth employees, agents, and officers, from responsibility, damage, or liability arising from the exercise of the
privileges granted in such permit to the extent allowed by law.
2. The Permittee agrees to secure and carry insurance against liability for personal injury and property damage that may arise
from the work performed under permit and/or from the operation of permitted activity -up to one million dollars ($ 1,000,000)
each occurrence to protect the Board Members and Department's agents or employees; seventy-five thousand dollars
($75,000) each occurrence to protect the Board, the Department, or the Commonwealth in event of suit.
3. The Permittee assumes full responsibility for any and all (downstream, flooding, erosion, siltation, etc.) damages that may
occur as a result of the work performed under this permit. Furthermore, the Department will in no way be responsible for
any damage to the facility being placed as a result of future maintenance or construction activities performed by VDOT.
4. The Permittee agrees to move, remove, alter, or change any installation that interferes with the ultimate construction of the
highway in alignment or grade without cost to the Department unless otherwise stipulated and agreed to by the Department.
5. The Permittee shall immediately have corrected any situation which may arise as a result of these installations that the
Department's Resident Engineer or his/her representative deems hazardous to the traveling public, even though it may not
be specifically covered in the Land Use Permit, the Special Provisions and/or the Land Use Permit Manual.
6. Any and all highway signs, Right -of -Way markers, etc., disturbed as a result of work performed under this permit shall be
accurately reset by the Permittee immediately following the work in the vicinity of the disturbed facility. The services of a
certified land surveyor with experience in route surveying, may be required.
7. It shall be the Permittee's responsibility to obtain ANY and ALL necessary permits that may be required by any other
government agencies, i.e. Corp. of Engineers, Dept. of Environmental Quality, Soil Conservation Services, etc.
8. A copy of the permit to be kept on -site at all times.
9. The Permittee is required to notify the local VDOT Residency Office or Permit Office at least 48 hours in advance of ANY
proposed work commencing, and before the following operations take place. Failure to carry out this requirement may result
in this permit being revoked.
A. Placing Concrete or asphalt.
B. "Proof rolling" or nuclear testing taken of subgrade before stone is placed.
C. "Proof rolling" or nuclear testing taken of base stone.
D. Boring or jacking of pipes larger than 6" inches.
10. The Permittee is required to notify the local VDOT Residency Office or Permit Office, and District Traffic Engineering
Section when planned excavation is within 1,000 feet in the vicinity of a signalized intersection. Failure to carry out this
requirement may result in the permit being revoked.
11. The Permittee is required to notify "Miss Utility" or each operator of an underground utility where no notification center
exists of any planned excavation. This notification must be provided at least 48 hours - excluding weekends and holidays -
before the start of planned excavation. Failure to carry out this requirement may result in this permit being revoked.

12. If during or before construction it is deemed necessary for VDOT to assign an Inspector to the project, the Permittee is to
pay the Department an additional inspection fee in an amount that will cover the salary, expense allowance, and mileage
allowance for the inspection(s) assigned by the Department for handling work covered by this permit. Said inspection fee to
be paid promptly each month on bills rendered by the Department.
13. The absence of a State Inspector does NOT in any way relieve the Permittee of his/her responsibility to perform the work in
accordance with the approved plans and provisions of the attached permit and Road and Bridge Standards (current
edition) and Road and Bridge Specifications (current edition). No changes shall be made without approval of the
Department's Resident Engineer or his/her representative.
14. It is the duty of the Department's Resident Engineer or his/her representative to keep all roads maintained in a safe,
travelable condition at ALL times. Therefore, any permit may be denied, revoked or suspended, when in the opinion of
the Resident Engineer or his/her representative the safety, use or maintenance of the highway so requires.
15. The Permittee shall at ALL times give strict attention to the safety and rights of the traveling public, her/his employees and
herself/himself. VDOT reserves the right to stop work at anytime due to safety problems and/or noncompliance with the
terms of the permit. The Department may, at its discretion, complete any of the work covered in the permit or restore the
Right -of -Way to Department's Standards and bill the Permittee for the actual cost of such work. The Permittee may be
required to move, alter, change or remove from the Department's Right -of -Way, in a satisfactory manner, any installation
made on the Right -of -Way under this permit.
16. All work performed under this permit on VDOT's Right -of -Way shall in all respects, including location, alignment, elevation
and grade; manner of performing the; work; restoration of conditions, etc., be subject to VDOT's directions, Road and
Bridge Standards (current edition) and Road and Bridge Specifications (current edition) and shall be performed to the
satisfaction ofthe Department's Resident Engineer or his/her representative.
17. Design changes, specified material changes -and/or field changes from the approved plans need to be submitted to the
appropriate, local VDOT Residency Office or Permit Office, prior to proceeding with the work. A letter of explanation shall
accompany the revised design plans and/or engineering calculations, which must be submitted to VDOT for review and
approval by the Residency Office or Permit Office.
Traffic Control and Safety Procedures:
18. Traffic shall NOT be blocked or re-routed (detoured) without written permission from the Department's Resident Engineer or
his/her representative. Where one-way traffic is permitted to be maintained, it shall be properly flagged 24 hours per day by
a trained, certified flagperson. A certification card is required for any person flagging within VDOT's Right -of -Way.
19. During construction, the Permittee shall furnish ALL necessary signs, flagpersons and other protective devices (lights,
barricades, etc.) for protection of traffic and workers in accordance with the specifications of the Virginia Work Area
Protection Manual or as directed by the Resident Engineer or his/her representative. All signs shall be in accordance with
the current edition of the Manual of Uniform Traffic Control Devices (MUTCD). Trained, certified flagpersons shall be
provided in sufficient number and locations as necessary for control and protection of vehicular and pedestrian traffic in
accordance with MUTCD. Flagpersons shall use sign paddles to regulate traffic in accordance with MUTCD.
20. Hours and Days of Work: Permittee is authorized to work between the hours of 9:00 a.m. to 3:30 p.m. Monday through
Friday, and one half hour after sunrise until one-half hour before sunset on Saturday and Sunday. Any variance in times of
work must be obtained from the Resident Engineer, Permit Office or his representative.
21. Certification for flagperson will be awarded upon a candidate's satisfactory completion of an examination. Certification card
shall be carried by the flagperson while performing duties. A flagperson found not in possession of his/her certification card
shall be removed from the flagging site and the Resident Engineer or his/her representative will suspend operations
requiring flagpersons. Furthermore, flagpersons performing duties improperly shall have their certification revoked.
22. Long, open trenches will NOT be permitted. The maximum length at any time, including backfilled portion, which is not
suitable for traffic, shall NOT exceed 500 feet and shall be properly signed and delineated. Trenches are NOT to be left
open overnight unless approved by the Resident Engineer or his/her representative. No pre -blasting or pre -blowing will be
permitted without prior approval from the Resident Engineer.

23. No excavated material is to be placed or tracked on the pavement, without written permission of the Department's Resident
Engineer or his/her representative. When so permitted, the pavement shall be satisfactorily cleaned by an approved
method. No cleated (track -mounted) equipment is to be used on the pavement, without proper protection to the pavement.
24. Excavations:
• OSHA requires shoring for any excavation 4' or more in depth.
• When not utilizing shoring, excavations are to be sloped accordingly.
• Shoring or trenching boxes need to be approved by an Engineer with P. E.
Restoration Procedures:
25. All backfilling and compaction of disturbed areas shall be in accordance with the specifications outlined in VDOT's Road and
Bridge Specifications (current edition). All compaction tests result shall be maintained on site for inspection. The Permittee
will be held responsible for correcting any settlement of backfill or pavement for a period of three (3) years after completion
of work. All trenches shall be maintained to the satisfaction of the Resident Engineer or his/her representative.
• 100% required for top 6" of subgrade
• 95% required between ditch to ditch, and from sidewalk to sidewalk
• Fill materials to be places in 6" layers.
26. Where pavement exists, all crossings shall be bored, pushed or jacked from back -of -ditch line to back -of -ditch line or toe -of -fill
to toe -of -fill. The pavement shall NOT be cut unless otherwise approved by Resident Engineer and then only if justifiable
circumstances prevail or proof is shown that a thorough attempt has been made to push, bore or jack.
27. Whenever the pavement is permitted to be cut, not over one-half of the roadway width shall be disturbed at one time; the
first opening shall be completely restored to satisfactory, travelable condition before the second half can be opened. The
Permittee shall mill and resurface ALL (asphalt) concrete roadway; and resurface all other roadway with like material that is
existing, for a distance of 25 feet on each side of the disturbed area from edge -of -pavement to edge -of -pavement.
ALL backfill material within the roadway shall be crushed stone. Whenever the pavement is permitted to be cut, the
provisions of MP-71 shall be adhered to. Where the pavement is disturbed or deemed weakened, in its entirety or such
portions of it as deemed desirable by the Department, shall be restored or replaced in a manner, which is satisfactory to the
Department's Resident Engineer or his/her representative.
28. The appropriate, local VDOT Resident Engineer shall determine working hours on ALL state routes.
29. Environmental Issues:
A. The applicant is responsible for pursuing and obtaining any and all environmental permits which may be required to
pursue the proposed activity prior to any work beginning within VDOT right of way.
B. In the event the applicant encounters hazardous materials or underground storage tanks within the right of way in the
pursuit of his activities, the applicant is responsible for ceasing all work within the site and notifying the Residency and
other responsible groups, i.e. local fire department, emergency services, Department of Environmental Quality, etc. The
applicant is responsible for coordinating and completing all remedial/removal activities required in order to properly
complete the proposed activities within VDOT right of way.
C. In the event the applicant encounters cultures resources, archaeological, paleontological, and rare minerals, within the
right of way in the pursuit of his activities, the applicant shall act immediately to suspend work at the site of the discovery
and notify the Residency. The applicant is responsible for notifying the proper state authority charged with the
responsibility for investigating and evaluating such finds. The applicant will meet all necessary requirements for
resolving any conflicts prior to continuing with the proposed activities within VDOT right of way and shall provide
evidence of such compliance to the Residency.

D. Drainage - Road drainage shall NOT be blocked. The shoulders, ditches, roadside and drainage facilities, as well as the
pavement, shall be kept in an operable condition satisfactory to the Department. Necessary precautions shall be taken
by the Permittee to insure against siltation of adjacent properties, streams, etc. in accordance with VDOT's current
standard practices or as prescribed by the Department's Environmental Manual " Erosion and Sediment Control" and
Resident Engineer or his/her representative.
30. Entrances - Road and street connections, private entrances, and construction entrances are to be kept in satisfactory
condition. Entrances shall NOT be blocked. Ample provision must be made for safe ingress and egress to adjacent
property at all times. Where entrances are disturbed they shall be restored to the satisfaction of the property owner and the
Department's Resident Engineer or his/her representative. The Permittee shall submit to the local VDOT Residency Office
or Permit Office engineering calculations, etc. showing determination of appropriate size of entrance pipe.
31. When building a turning lane adjacent to an existing VDOT roadway, it is the responsibility of the Permittee/Agent to meet or
exceed the existing pavement and sub -base typical section. Before any work is performed, the typical section must be
reviewed and approved by the Resident Engineer or his/her representative.
32. No trees or shrubs shall be cut or trimmed and no tree roots over 3" in diameter are to be cut without written permission of
the Department's Resident Engineer or the District Environmental Manager and covered by a properly executed. Tree
Trimming Permit. All roots under 3" in diameter are to be clean cut with an ax or saw. Particular attention shall be given not
to splinter the roots next to the tree. No trees or shrubs are to be planted without prior review and written approval of the
District Environmental Manager and Resident Engineer.
Utilities Guidelines:
33. Prior to any excavation, the Permittee shall comply with the terms of Underground Utility Damage Prevention Act, Title 56,
Chapter 10.3, Section 56-265.14 through 56-265.2 Code of Virginia, as amended. This permit does NOT grant permission
to grade on property of others, grade near, adjust or disturb in anyway, existing utility poles or underground facilities in
permitted area. Permission to do so must be obtained from the proper utility company and any expense involved must be
borne by the Permittee. Any conflicts with existing utility facilities shall be resolved between the Permittee and the utility
owner(s) involved.
34. All crossing and parallel installations allowed in the shoulders or ditchlines shall have a cover of 36 inches. All underground
Cable TV and telephone cables placed adjacent to the Right -of -Way and back of ditchline shall have a minimum of 30
inches cover. All other facilities shall have a minimum of 36 inches of cover.
35. Where feasible, all aboveground installations (such as fire hydrants, telephone pedestals, markers, etc.) shall be located
adjacent to the Right -of -Way line. All manhole covers, valve box, etc., shall be installed two inches below existing ground
line and shall conform to existing contours.
36. No poles, guys, anchors, etc., are to be placed on the Department's Right -of -Way unless so indicated and approved on this
permit. At no time will any such facilities be allowed between the ditchline and the traveled roadway.
37. ALL overhead crossing(s) shall conform to the latest requirements of the National Electrical Safety Code; and the vertical
clearance of the lowest wire or cable crossing the roadway or entrance, shall not be less than 21 feet for Interstate and
Limited Access Highways, and 18 feet for all Primary and Secondary roads.
Final Inspection and Completion of Permit:
38. Upon completion of the work covered by this permit, all disturbed areas within VDOT's Right -of -Way shall be topsoiled,
seeded, and restored to their original condition as found, prior to starting such work.
39. Completion of this permit is contingent to the fact that the Permittee is in compliance with ALL governing bodies involved in
the total completion of work on VDOT's Right -of -Way.
40. The Permittee is required to notify the local VDOT Residency Office or Permit Office upon completion of work covered by
the attached Land Use Permit. The Permittee is responsible for requesting a Final Inspection.

Subject: Construction Access to Football Stadium Site
Dear Evan,
We will need to access University property by means of Price Drive for construction access to the
stadium site until such time as the causeway across Abrams Creek can be constructed. Perry

We estimate the causeway will be completed within 60 days or sooner after accessing the site. At that
time all daily traffic will access the site by using the University's right of way under the I-81 bridge.
This should minimize the use of Price Drive. During road construction under the I-81 bridge, there
will be times Price Drive will need to be used by Perry Engineering as explained above.
A graveled parking area will be provided on the site for Perry's employees and a graveled road from
Price Drive to the parking site to minimize tracking dirt on Price Drive. Perry Engineering has been
instructed that the road must be kept clean and swept or cleaned as needed.
Perry Engineering will be obtaining a permit from VDOT for construction access to the stadium site.
I will distribute a copy of this letter to all residents on Price Drive and the President of the Pembridge
Heights Homeowners Association. My office phone number is at the bottom of this Ietter to provide a
means for the residents to ask any questions they may have.

prior to Perry Engineering's limited use for mobilization and service activities. For the
purposes of establishing a maintenance bond amount, we requested an estimate to install
a 1" asphalt overlay starting from the intersection of Tulane Drive and Rt. 50 and ending
at the cul-de-sac on Price Drive. The estimate from Stuart Perry dated Feb. 2, 2001 is
also enclosed.
On a different subject, the value of the road construction for that section of the work for
the new Access Road which is within the I-81 future R/W limits is $75,000. This
information should accompany the Land Use Application No. 48446.

with the University grounds, go through the gatehouse to the top of the hill and turn left. Office is on
the left with parking on the right. Specific site reviews will be conducted if necessary following our
progress meetings. We would appreciate your attendance at these meetings especially during periods of
construction when your utility may be involved or you have issues or questions which need to be
resolved or discussed.

Planning & Development: The proposed uses are normally
associated with a university and are therefore, in the opinion
of the staff, considered permitted uses in the HE zone.
SCALE
The scale of the plan is 1" : 150' , our ordinance requires a
scale of no less than 111:1001. This smaller scale is not
adequate to depict the development at an appropriate level of
detail and is not conducive to a thorough review of the
proposal.
FUTURE DEVELOPMENT
The site consists of approximately 14.5 acres a portion of
which is indicated as "future development". The acreage of
this area along with some indication of the potential use
needs to be indicated. This is necessary in order to
adequately evaluate the possible future impacts of the
development in terms of traffic and stormwater runoff.
PLAN ERRORS
A statement on the plan indicates that there are no
environmental areas requiring protection, and yet areas are
designated as steep slope, floodplain and woodland. This
statement should be removed and the location of disturbed
areas needs to be indicated.
The plan also indicates the disturbance of over one half acre
of flood plain (or 11% of the total site) the Ordinance
permits no disturbance of floodplain areas other than for the
purpose of recreation, conservation, utilities, or stormwater
management, and then only with the consent of the Planning
Commission. The type or purpose of the disturbance is not
indicated on this plan. A,floodplain study may be required
in order to determine the impacts of any proposed alteration
of the flood plain.

The plan indicates that 15% open space is required and some
areas are labeled as such, though their limits are not clearly
shown. While the open space is desireable, there is no open
space requirement for the HE zone.
BUFFERS
A 20' buffer is indicated along the eastern boundary of the
property. There is no indication as to the type of buffer.
The type of buffer to be provided is at the discretion of the
Planning Commission, the staff recommends that a full screen
or its equivalent be provided.
ACCESS
The MDP shows access to the development through Price Drive,
a future access which extends Tulane Drive is also indicated.
The future access would be more direct and would also
eliminate the need to use what is now a small residential cul-
de-sac to carry the heavy traffic which will be generated by
the event center. The staff recommends that every effort be
made to install the "future access" up front and eliminate the
access through Price Drive.
STORMWATER MANAGEMENT
The plan indicates that due to the small size of the site to
be developed relative to the overall watershed, no stormwater
retention is required for the site. Some plan for stormwater
management will need to be shown. Any future development of
the site would also require stormwater management. The
applicant should indicate a proposed method for handling this
need.
STAFF RECOMMENDATIONS FOR P/C MTG. OF 6105191: Approval,
contingent -upon all review agency comments and staff comments
listed above being met prior to final approval.

We have reviewed the above referenced project's preliminary master development
plan dated January, 1991. Our comments are as follows:
1. The proposed access roadway under the I-81 bridges can be allowed and its
installation covered under a land use permit. However, the University should
fully understand our approval of such an access roadway is contingent upon
their ownership of the facility and it could never become part of the State's
Secondary Road System. Furthermore, if this area is ever annexed by the City
of Winchester the street would not be eligible to receive maintenance payments
from this Department.
2. Trip generation rates for field houses (sports arena) are not contained in the
I.T.E. Trip Generation Manual. Therefore, no attempt has been made to fully
check the volumes you supplied other than to verify rates from your source.
It should be noted the 1125 trip ends during major events are outbound at the
conclusion of the event and a capacity analysis at the intersection of Routes
50 & 797 should be performed to include this volume. We understand our
District Traffic Engineering Section has furnished you a copy of the
directional turning movements and the signal plans for this intersection for
your use in preparing a site impact analysis.
3. Access to this complex through Price Drive appears very undesirable because of
the residential surroundings. Therefore, we feel your client, as well as
Frederick County, should aggressively pursue the possibility of access through
the adjoining Beck property at this time.
We hope the above comments are helpful and look forward to reviewing the site
impact analysis when it is available. Should you have any questions, please give

Please consider the following comments when reviewing this
Request for Master Development Plan:
The Developer should be familiar with and be required to
comply with the provisions of the Frederick County Airport Zoning
District (AP-1) and Airport Support Area (ASA) described in the
Frederick County Comprehensive Policy Plan. The developer should
also be familiar with the provisions and requirements of the
following codes:
Title 15.1 Code of Virginia, Section 489 (Purpose of Zoning
Ordinances) and Section 491.02 (Airport Safety Zoning).
Title 5.1-25.1 Code of Virginia (Permits Required for Erection of
Certain structures.)
As Winchester Regional Airport expands services and
operations, noise associated with such expansion is very likely
to increase. The Airport Support Area established by the
Frederick County Comprehensive Policy Plan is designed to
discourage residential development in the vicinity of the airport
to preclude citizen concerns for noise created by aircraft
operating on, to and from Winchester Regional Airport.
If the developer is planning residential development
adjacent to the ASA or under a commonly used flight path used by
aircraft outside the ASA as they arrive or depart the Airport, he
should be encouraged to insulate all habitable structures for
noise and be required to specifically address, in the property
Covenants and Easements, existing airport related noise and the
probability of increased noise as airport operations expand.

We have reviewed the above referenced preliminary Master Development Plan and
have the following comments or suggestions:
A. ACCESS ISSUES
1. Traffic at the connection of Tulane Drive and Route 50 needs to be
considered. A traffic study should be prepared outlining the traffic
loading based on the proposed uses and exiting background traffic.
2. The impact that the additional traffic will have on the irregular
intersection of Tulane and Prince should be considered and discussed.
B. DRAINAGE & STORMWATER MANAGEMENT
1. Since the proposed 50 foot Right of way and part of the dormitory lie
in the approximate 100 year flood zone, a detailed study will be
required. Flood plain channelization would be required with the plan
as proposed. This should look at potential impact to existing (if
l
any) wetlands through this area to verify if federal regulations are
being violated. Based on wetland mapping from the US Department of
the Interior Fish and Wildlife Service, it does not appear that any
wetlands are present in this area.
2. Stormwater management will be required with the further development
of this project. To help mitigate the impact to the flood plain
discussed above, a regional type stormwater facility could be
considered somewhere upstream on the college property to reduce flows
through this crossing. This approach could help resolve the impact
causing flooding conditions downstream of this property. t_%.,

At the request of Chuck Maddox, G. W. Clifford and
Associates, I accompanied him and Ron Mislowsky to the site
proposed for the development of Shenandoah University "The
Center" (PMDP). Specifically, Chuck wanted my opinion on the
location of the 100 year flood plain as depicted on their
proposed Master Plan.
Based on a brief review of the proposed Master Plan
documents prepared by G. W. Clifford and Associates, I
understand that Shenandoah University plans to develop an
approximate 18.5 acre parcel located adjacent to and
immediately east of I-81 on the south side of Abrams Creek.
The proposed development will include an events or civic
center, a dormitory and an academic building. Proposed
access will. be achieved from Shenandoah University under I-81
and from Route 50 East adjacent to the Holiday Inn.
Our site inspection revealed that a majority of the
proposed site has been filled to variable depths with a
maximum fill depth of approximately 15 feet exposed along
Abrams Creek. This fill was most probably deposited during
the construction of I-81 which occurred during the period
from 1962 to 1965. A majority of the fill appeared to be
weathered shale.
Previous review comments prepared by Donohue in January
1991 indicated that the proposed dormitory lies within the
approximate 100 year flood plain. They recommended that a
detailed study be performed to evaluate the impact of the 100
year flood plain. Based on our review of available flood

plain information studies, it appears that the topographic
conditions depicted for this area do not reflect the existing
man made fill depths. In my opinion, the actual limits of
the 100 year flood al-e not accurately depicted in the
available flood information studies.
I have reviewed the 100 year flood boundaries shown on
the Master Plan prepared by G. W. Clifford. I consider this
boundary relatively conservative knowing the actual site
conditions. Consequently, I do not believe that a detailed
study would be required during the Master Plan phase of the
project. However, a detailed analysis should be performed
during the design phase to establish road profiles and bridge
elevations. A bridge will be required only if the access
road under I-81 parallels the north side of Abrams Creek
following the existing unimproved maintenance road.

Parking Study
The Center is a proposed development which includes a Field
House/Auditorium, student housing and academic buildings. As part of the
preliminary master development plan, the County requested that a parking study
be conducted to determine the actual amount of parking which is necessary to serve
these uses. We have attached calculations made to estimate the required parking
spaces.
Two methods were used to determine parking requirements. The first,
"Method A", was based on existing building use and associated parking on the
Shenandoah University campus. As these numbers are based on actual data we
believe "Method A" to be most reflective of the actual parking needs of the
proposed development. The second "Method B" is based on the Frederick County
ordinance requirements. The ordinance is general in nature, and applicable to any
educational center from a Junior High School to a University. For this reason we
feel it to be less accurate than "Method A."
G.W. Clifford and Assoc., Inc. recommends that a minimum of 600 parking
spaces be required for "The Center."

Dear Kris,
I am enclosing a copy of the 150 scale plan which has been revised per your comments at our
meeting with Dr. Davis and Mr. Shickle at the University. Also attached is a 100 scale plan
which shows the site in a little more detail.
Chuck Maddox and I met at the site with Ed Strawsnyder to review the flood plain issues.
Ed agrees that the flood plain boundaries shown on our plan depict the worst case. That is, the
actual 100 year flood plain boundary, on the south side of Abrams Creek, is actually closer to
Abrams Creek than we depict. Ed also agreed that the time to evaluate the actual flood plain
limits would be at site plan submittal.
At our last meeting you requested we contact other universities, which had relatively new
event center type facilities, to get an idea of what the required parking might be. I have attached
a memorandum which discusses the results of this survey. Also attached is a preliminary sketch
parking layout. This plan allows for over 700 spaces. The actual number may change when the site
plan is prepared. I am also attaching the analysis done previously which looks only at
Shenandoah University and the ordinance requirements. It would appear that if we were to
provide 550-600 spaces on the site plan we would maintain the existing parking ratio, and exceed
the number of spaces which have been provided for similar facilities.

University and Clifford and Associates, the County requested that in order to
better determine the amount of parking required for the Event Center, a survey of
similar facilities be made. We have contacted four Universities all of which
have completed Event Center type facilities within the last 5-10 years. They are:
- James Madison University, Harrisonburg, VA
- Radford University, Radford, VA
- Virginia Military Institute, Lexington, VA
- Whittenberg University, Springfield, OH
We have summarized below the particulars on the schools and their
respective centers. We have also provided, the number of spaces which would be
required for each of these universities under the Frederick County Ordinance
Standards, and estimates of the spaces required for Shenandoah University's site.

SHENANDOAH UNIVERSITY CENTER, STAFF COMMENTS

The proposed uses are normally associated with a university
and are therefore, in the opinion of the staff, considered
permitted uses in the HE zone.
SCALE
The scale of the plan is 111:15011 our ordinance requires a
scale of no less than 111:1001. This smaller scale is not
adequate to depict the development at an appropriate level of
detail and is not conducive to a thorough review of the
proposal.
FUTURE DEVELOPMENT
The site consists of approximately 14.5 acres a portion of
which is indicated as "future development". The acreage of
this area along with some indication of the potential use
needs to be indicated. This is necessary in order to
adequately evaluate the possible future impacts of the
development in terms of traffic and storm water runoff.
PLAN ERRORS
A statement on the plan indicates that there are no
environmental areas requiring protection, and yet areas are
designated as steep slope, flood plain and woodland. This
statement should be removed and the location of disturbed
areas needs to be indicated.
The plan also indicates the disturbance of over one half acre
of flood plain (or 11% of the total site) the Ordinance
permits no disturbance of flood plain areas other than for the
purpose of recreation, conservation, utilities, or stormwater
management, and then only with the consent of the Planning
commission. The type or purpose of the disturbance is not
indicated on this plan. A flood plain study may be required
in order to determine the impacts of any proposed alteration
of the flood plain.
The plan indicates that 15% open space is required and some
areas are labeled as such, though there limits are not clearly
shown. While the open space is desireable, there.is no open
space requirement for the HE zone.
BUFFERS
A 20' buffer is indicated along the eastern boundary of the
property. There is no indication as to the type of buffer.
The type of buffer to be provided is at the discretion of the
Planning Commission, the staff recommends that a full screen
or its equivalent be provided.
ACCESS
The MDP shows access to the development through Price Drive,
a future access which extends Tulane Drive is also indicated.
The future access would be more direct and would also
eliminate the need to use what is now a small residential cul-
de-sac to carry the heavy traffic which will be generated by
the event center. The staff recommends that every effort be
made to install the "future access" up front and eliminate the
access through Price Drive.
STORMWATER MANAGEMENT
The plan indicates that due to the small size of the site to
be developed relative to the overall watershed, no stormwater
retention is required for the site. Some plan for stormwater
management will need to be shown. Any future development of
the site would also require stormwater management. The
applicant should indicate a proposed method for handling this
need.

We have reviewed the above referenced preliminary Master Development Plan and
have the following comments or suggestions:
A. ACCESS ISSUES
1. Traffic at the connection of Tulane Drive and Route 50 needs to be
considered. A traffic study should be prepared outlining the traffic
loading based on the proposed uses and exiting background traffic.
2. The impact that the additional traffic will have on the irregular
intersection of Tulane and Prince should be considered and discussed.
B. DRAINAGE & STORMWATER MANAGEMENT
1. Since the proposed 50 foot Right of way and part of the dormitory lie
in the approximate 100 year flood zone, a detailed study will be
required. Flood plain channelization would be required with the plan
as proposed. This should look at potential impact to existing (if
any) wetlands through this area to verify if federal regulations are
being violated. Based on wetland mapping from the US Department of
the Interior Fish and Wildlife Service, it does not appear that any
wetlands are present in this area.
2. Stormwater management will be required with the further development
of this project. To help mitigate the impact to the flood plain
discussed above, a regional type stormwater facility could be
considered somewhere upstream on the college property to reduce flows
through this crossing. This approach could help resolve the impact
causing flooding conditions downstream of this property.
