Perkins, AICP, Senior Planner This report is prepared by the Frederick County Planning Staff to provide information to the Planning Commission and the Board of Supervisors to assist in the review of this application. It may also be useful to others interested in this zoning matter. The submitted MDP appears acceptable to VDOT. Before making any final comments, this office will require a complete set of site plans, drainage calculations and traffic flow data from the I.T.E. Trip Generation Manual, Seventh Edition for review. VDOT reserves the right to comment on all right-of-way needs, including right-of-way dedications, traffic signalization, and off -site roadway improvements and drainage. Prior to construction on the State's right-of-way, the developer will need to apply to this office for issuance of appropriate permits to cover said work. Frederick County Fire Marshal: Plans approved as submitted. Frederick County Public Works: Refer to Sheet 3 of 4: Complete the number of disturbed acres under wetlands included in the tabulations of environmental features. The reference to the permitting process of the Army Corps of Engineers is not adequate in defining the amount of disturbed acreage. Also the number of acres included in the designated stormwater management facility should be defined under the total and disturbed columns. It is apparent that these areas can be easily quantified for the 100-year storm flows. Refer to Sheet 4 of 4: A demolition permit will be required to remove the existing building located within Land Bay I. Frederick County Inspections Department: Demolition permit shall be required to remove the existing structure. No additional comments required at this time. Department of Parks and Recreation: No comment Planning & Zoning: A) Master Development Plan Requirement A master development plan is required prior to development of this property. Before a master development plan can be approved, it must be reviewed by the Planning Commission, Board of Supervisors and all relevant review agencies. Approval may only be granted if the master development plan conforms to all requirements of the Frederick County Zoning and Subdivision Ordinances. The purpose of the master development plan is to promote orderly and planned development of property within Frederick County that suits the characteristics of the land, is harmonious with adjoining property and is in the best interest of the general public. MDP #08-07, Shockey Brot* September 5, 2007 Page 3 B) Location The subject property is located on North Frederick Pike (Route 522) north and adjacent to the City of Winchester. C) Site History The original Frederick County Zoning Map (U.S.G.S. Winchester Quadrangle) identified this parcel as being zoned B2 (Business General). D) Site Suitability & Proiect Scoae Comprehensive Policy Plan: The Frederick County Comprehensive Policy Plan is an official public document that serves as the community's guide for making decisions regarding development, preservation, public facilities and other key components of community life. The primary goal of this plan is to protect and improve the living environment within Frederick County. It is in essence a composition of policies used to plan for the future physical development of Frederick County. [Comprehensive Policy Plan, p. 1-1] Land Use Compatibility: The properties are located within the Urban Development Area (UDA) and the Sewer and Water Service Area (SWSA); and are not within the limits of any small area land use plan. The Eastern Frederick County Long Range Land Use Plan reflects the existing B2 zoning of the property. Transportation The site will be accessed off of one entrance on North Frederick Pike (Route 522) as indicated on the MDP. The Eastern Road Plan of the Comprehensive Policy Plan shows the extension of Fort Collier Road (new minor collector) running through this property. This Master Development Plan accounts for the 80' right-of-way for the road extension as shown on the plan. Proffers — There are no proffers associated with this property. Waiver This development is proposing to utilize private roads for access. The subdivision ordinance states that all lots must have state road frontage to be subdivided. In order for the proposed commercial lots on the Orrick Common property to be subdivided utilizing private roads, the Board of Supervisors would need to grant a waiver of § 144-24C of the Frederick County Subdivision Ordinance. At the Planning Commission's August 15, 2007 meeting, a unanimous recommendation was forwarded to the Board of Supervisors for approval of this waiver request with the condition that only one other exit onto Route 522 be allowed, which must be strictly an "exit only"; no other entrances will be allowed STAFF CONCLUSIONS FOR THE 08/15/07 PLANNING COMMISSION MEETING: The master development plan for the Shockey Brothers depicts appropriate land uses and appears to be consistent with the requirements of Article XVII, Master Development Plan, of the Zoning MDP #08-07, Shockey Broth September 5, 2007 Page 4 Ordinance. All of the issues brought forth by the Planning Commission should be appropriately addressed prior to a recommendation to the Board of Supervisors. PLANNING COMMISSION SUMMARY AND ACTION OF THE 08/15/07 MEETING: The staff reported no associated proffers; this property was shown with B2 zoning on the original County zoning maps. Staff reported that the Eastern Road Plan of the Comprehensive Policy Plan shows the extension of Fort Collier Road running through the property and this MDP provides an 80-foot reservation for the extension. Staff noted that the site is adjacent to existing Shockey industrial facilities and will be accessed with one entrance off North Frederick Pike (Route 522). Staff further noted that the applicant is requesting a waiver of Section 144-24C of the Frederick County Subdivision Ordinance; the waiver would allow the property to be subdivided with private roads. The applicant's representative stated the owner has no intention of subdividing the property at this time and the property is in compliance with the requirements of Section 144-24C because it abuts and has direct access to a state -maintained road. However, in light of the staff's preference to have waivers addressed at the MDP stage, rather than at the subdivision stage, the applicant thought it prudent to request the waiver at this time because the owner is using an internal private street system. This waiver will set the stage for the future, if subdivision is desired. The applicant's representative added that a public improvement plan was reviewed and approved by VDOT, the County Engineer, and the County Sanitation Authority, which is why the entrance is located at the proposed location. The public improvement plan provides a turn -taper into the entrance and utilizes striping to create a left -turn stacking lane on the Route 522 approach into Winchester. A member of the Commission asked the County's Transportation Planner for comments on the transportation aspects of the application and whether a TIA had been provided for the MDP. The County's Transportation Planner believed the proposed entrance location was the only area an entrance could be accommodated along this portion of Route 522. However, he believed it was worthwhile to monitor the intensity of development through the TIA process as site plans are submitted, primarily from a safety perspective. There were no public comments. A motion was made, seconded, and unanimously passed to recommend approval of the waiver of Section 144-24C of the subdivision ordinance with the condition that only one other exit onto Route 522 be allowed, which must be strictly an "exit only"; no other entrances will be allowed. Another motion was made, seconded, and unanimously passed to recommend approval of MDP #08-07 of Shockey Brothers, Inc. with the stipulation that upon request by staff, a TIA shall accompany future site plans as needed. (Note: Commissioners Watt, Thomas, Kriz, and Kerr were absent from the meeting.) MDP #08-07, Shockey Broth September 5, 2007 Page 5 STAFF CONCLUSIONS FOR THE 09/12/07 BOARD OF SUPERVISORS MEETING: The master development plan for the Shockey Brothers depicts appropriate land uses and appears to be consistent with the requirements of Article XVII, Master Development Plan, of the Zoning Ordinance. Therefore, the preliminary Master Development Plan for the Shockey Brothers is in a form that is administratively approvable. All of the issues brought forth by the Board of Supervisors should be appropriately addressed by the applicant. Staff would note that two actions are required for this application, one for the waiver and the other for the MDP. The applicant is seeking authorization of the preliminary master development plan by the Board of Supervisor as well as approval of a waiver to enable the property to be subdivided using private streets.
