This letter is to notify you that the revised Master Development Plan for the above referenced
project was administratively approved by Frederick County on December 15, 1994. This
approved Master Development Plan includes two tracts of land. The first tract contains 16.296
acres, is zoned RP (Residential Performance District), and is identified as tax map number 55-A-
195. The second tract contains 3.151 acres, is zoned RP (Residential Performance District), and
is identified as tax map number 54-A-125A. Saratoga'Meadows is approved for 42 single family
detached traditional lots.

Virginia Dept. of Transportation: No objection to preliminary
master plan. Before making any final comments, this office
will require a complete set of site plans, drainage
calculations and traffic flow data from the I.T.E. Trip
Generation Manual, Fourth Edition for review. Before starting
any construction on the State's right-of-way the developer
will need to apply to this office for issuance of appropriate
permits to cover said work. To accommodate future
improvements to Route 657, we recommend a minimum 10' wide
right-of-way dedication be provided along the entire property
frontage.
Sanitation Authority:' No Comment.
Inspections Dept.: Building shall comply with the Virginia
Uniform Statewide Building Code and Section 310 Use Group R
(Residential) of the BOCA National Building Code/1993.

Fire Marshal: 1) Post temporary street signs when
construction begins. 2) Post temporary street addresses when
home construction begins. 3) Maintain access for emergency
vehicles at all times during construction. 4) Burning of
construction debris on site is prohibited.
County Engineer: The preliminary master development plan for
the proposed Saratoga Meadows is approved as submitted
(October 21, 1994 plan). A detailed review will be performed
on the subdivision plan. It is anticipated that 2 storm water
detention facilities will be required to accommodate the
increases in storm runoff. These facilities shall be designed
to contain the post 10 year storm and release only the 2 year
predevelopment storm.
Planning & Zoninc. The proposed preliminary master
development plan calls for the development of 42 single family
detached traditional lots on 19.447 acres. This creates an
overall gross density of 2.16 dwelling units per acre which
complies with the requirements of the Zoning Ordinance and
meets the intent of the Comprehensive Plan. The minimum lot
size within the proposed development is 15,000 square feet;
therefore, common open space and recreational facilities are
not required. The topography of the site is gently rolling
and does not contain steep slopes, flood plains, sink holes,
ponds, or woodlands. There is an existing vegetative area
that separates the rear of this property from the existing
Greenwood Heights Section III subdivision; however, the mature
hardwoods and cedars do not meet the definition of woodlands
as specified in the Zoning Ordinance.
Staff has identified specific issues that warrant discussion.
These issues regard the existing dwelling, road efficiency
buffers, storm water management areas, the extension of
sanitary sewer, and future deeds of dedication:
1) Existing Dwelling: A single family detached dwelling unit
exists on parcel number 54-A-125A. The applicant plans to
include this house within Saratoga Meadows; therefore, this
unit will be one of the 42 proposed lots. The lot that will
be created for the existing unit will need to meet the
required setbacks specified in the RP Zoning District.
2) Road Efficiency Buffer: The Functional Classification
Plan and the Eastern Road Plan designate Senseny Road (Route
657) as a major collector. The Zoning Ordinance requires all
residential structures to be separated from this type of road
by a road efficiency buffer. These requirements permit access
roads that will serve other properties to traverse the buffer
area. Therefore, the proposed location of Saratoga Drive does
not create a problem. The applicant needs to identify the
type of road efficiency buffer that will be used (full or
reduced), as well as provide the location and description on
the final master development plan and all final subdivision
plats.
3) Storm Water Management Areas: The proposed plan indicates
that there will be two areas designated for storm water
management. These areas appear to currently function as
natural retention areas. Natural retention areas are
permitted to be replaced by artificial storm water facilities
provided that the total storage capacity of the site and the
drainageways are maintained. Staff believes that the location
of the proposed storm water management facilities needs to be
indicated and described on all subdivision plats that will
adjoin these areas.
Off -site improvements to the Riggleman property will have to
occur in order to create a functional storm water management
system in the southern portion of this site. This is
necessary to ensure that the storm water will be able to reach
the corrugated metal pipe that goes under Greenwood Road
(Route 656) . Staff believes that a note needs to be placed on
the plan that describes the off -site improvement. Staff also
believes that the applicant needs to provide Frederick County
with a signed, legal agreement between the two property owners
that documents this improvement.
4) Sanitary Sewer Extension: The proposed plan indicates
that an 8" sanitary sewer line will be extended off -site and
will intercept a manhole along Greenwood Road (Route 656).
Statements need to be placed on the final master development
plan concerning the connection with and the availability of
the existing facility. Staff believes that similar notes and
legal agreements as described under issue #3 need to be
provided for this off -site improvement.
5) Deeds of Dedication: Section 144-32 of the Frederick
County Subdivision Ordinance requires the creation of a
property owners association for the continuous maintenance and
management of all common areas, easements, storm water
management facilities, and dedicated facilities associated
within an approved subdivision. Staff believes that it is
important to understand this requirement at this phase of the
planning process. Subdivisions that do not have common open
space or recreational facilities still contain drainage
easements and storm water management facilities that require
maintenance. This is accomplished by the residents of the
proposed subdivision; not by Frederick County.
STAFF RECOMMENDATIONS: Approval provided that the pending rezoning
application is approved by the Board of Supervisors and that the
applicant adequately address all Issues presented by staff, as well
as all comments and concerns of the Planning Commission and the
Board of Supervisors.
PLANNING COMMISSION ACTION SUMMARY OF 1217194: Two citizens spoke
in opposition to the master plan. One of the persons wanted to see
a halt to the rezoning of rural land to residential in the Shawnee
District. She felt that community facilities and services were no
longer adequate to handle the people that live in this district.
The other person said that Greenwood Road needed to be
straightened, he was concerned about increasing traffic, and he
felt that the east side of Winchester did not get the community
facilities and services that other areas of the county have.
The applicant stated that he would be able to carry out the staff s
recommendations on stormwater management. It was noted that a
homeowners association would be required for the maintenance of
retention facilities and possibly, the areas with buffers and
screening. No other issues were raised by the Commission.
PLANNING COMMISSION ACTION OF 1217194: By a majority vote,
recommended approval contingent on the Board approving the pending
rezoning application and that the. applicant adequately address all
issues presented by the staff, the Planning Commission, and the
Board.

This is to acknowledge receipt of your revised plans dated February 28, 1995 to the above
referenced project. The plans appear satisfactory and are approved. Please advise the
developer accordingly.
I offer the following comments:
A preconst'ruction conference be held by the engineer and/or developer with the
attendance of the contractor, various County agencies and VDOT shall be conducted
prior to initiation of work.
Materials used and method of construction shall apply to current observed VDOT
Road & Bridge Specifications applicable during construction of this development.
Our review and comments are general in nature. Should conditions in the field exist
such that additional measures are warranted, such measures shall be completed to
the satisfaction of the Department prior to inclusion into the Secondary Road System.
Attached is a copy of the minimum requirements and information needed prior to
acceptance of subdivision streets into the Secondary System. This is the
responsibility of the developer.
All drainage is to be carried within the right-of-way in ditch lines or gutters along the
street to a pipe or drainage easement.
The contractor shall notify VDOT when work is to begin or cease for any
undetermined length of time. VDOT will also require 48 hours notice for inspections.
The appropriate land use permits shall be obtained before any work is performed on

TRANSPORTATION FOR THE 21ST CEN FURY
If mailboxes are to be placed along the roadway fronting lots, a minimum of four (4')
feet shall be between the edge of pavement and the front of mailbox as shown on the
enclosed placement detail.
Private entrances will be installed in accordance with our Standard PE-1
Specifications. This is the developer's responsibility.
Any signs to be installed will be in accordance with attachments.
I suggest any utilities and/or storm sewer placed within the proposed right-of-way be
backfilled completely with C.R. Type 21-A Stone. This will greatly reduce the
possibility of any pavement settlement.

In accordance with your request of February 9, 1995 you are given permission to install
a temporary construction entrance at the reference location. This letter is to be considered
your permit to do so.
The following provisions will be required:
• Work area protection signage in accordance with the attached while working on the
right-of-way will be required.
• All work on the right-of-way is to be confined to the temporary entrance location only.
• A minimum 6" depth of VDOT #1 (2-3 inch stone) course aggregate by 30' in width will
be required. It is to be placed from the edge of pavement and extended back onto
private property far enough to prevent the carrying of mud onto the roadway-
• A minimum 18" C.M.P. culvert will be required.
• Any disturbed areas of the right-of-way or damages to the pavement structure adjacent
to this entrance will be repaired by you to our satisfaction.
• This permit is being issued for 180 days. A land use permit must be applied for within
180 days.
• All work is to be completed in accordance with the enclosed Virginia Erosion &
Sediment Control Handbook, Specification 3.02.
• The entrance is to be installed at the location shown on the site plan prepared by
Greenway, Inc. dated October 31, 1994.

This is to follow-up on our telephone conversation yesterday concerning the referenced
development.
You indicated your client was extremely anxious to begin construction. As you know we
have yet to approved the project's site plan and do not anticipate doing so for several more
weeks. If your client does begin construction within the street rights -of -way, please inform
them they do so at their own risk. Until we approve the site we will not provide inspection
services nor will we accept any right-of-way construction unless certified by a licensed
professional engineer with test results to support his conclusions.
Failure to meet minimum VDOT design/construction standards may have an impact on
future acceptability of the streets into our Secondary Maintenance System.

As requested we have reviewed the above referenced project's site plan dated
October 30, 1994. Our recommendations may be found on the enclosed plans marked in
red and as follows:
1. Center line stations will need to be shown on Plan Sheet #1.
2. All intersection radii should be a minimum 50'.
3. The 162' radius center line curve on Steeplechase Lane will need to be increased to
a minimum 260' by shifting the road toward Lot 18.
4. A minimum 30' vertical curve is needed at the sag of Saratoga Drive at
Station 00+38+.
5. A ditch with 20' straight drainage easement is needed through the Riggleman Lot.
The i 8" pipe under Route 656 may need to be upgraded depending on pre and post -
development flows to this pipe. The stormwater management calculations discuss a
17.95 acre pre and post -drainage area. It appears however areas such as Lots 30
through 33 are being diverted to Stormwater Management Basin "B" and then to the
18" pipe. Therefore, calculations need to discuss these smaller subareas. Additional
information will need to be shown on the plans and discussed in the drainage
calculations. We recommend ditch "B" be eliminated if possible to reduce the amount
of acres diverted.
6. Ditch "B" and "G" and ditch "A" and "E" should be adjusted and additional easements
provided to ease the transitions.
7. We suggest you explore eliminating ditch "A" and keep drainage flowing through
Lot 12 and merge with ditch "C" at Lot 24/25, As shown, ditch "A" reroutes water
around the back of Lots 25 through 27- and results in a flat bottom ditch with future
houses down slope from the ditch.

8. The proposed detention basins will need to be totally enclosed within easements.
Also, additional detail will need to be provided on the berm designs.
9. To remain consistent, all storm sewer and cross pipes within the development will
need to be reinforced concrete.
10. Additional information is needed for Structure #F-1 and its downstream pipe.
11. Toe ditches with details are needed around Stirrup Cup Circle.
12. A 10' drainage easement is needed along Lot 1.
13. The existing shoulder and ditch along the south side of Route 657 from Saratoga
Drive to the east end of the subdivision (SWM Basin "A") will need to be
reconstructed. A minimum 8' shoulder and minimum 4' ditch will be required. As
shown, the 18" pipe under Saratoga Drive has insufficient cover. The pipe and outfall
ditch need to be lowered. A typical section of the proposed shoulder and ditch tieing
into the existing Route 657 pavement edge needs to be shown. Also, a detail is
needed of the two pipes in relation to the right-of-way line at the outfall of basin "A".
14. The typical section ditch slope will need to be revised to 3:1.
15. Underdrains will need to be provided at all sags in grade.
16. The pavement design for all internal streets will need to be a minimum 8" 21-B
Aggregate with a prime and double seal surface treatment. The pavement design of
the Route 657 right turn lane and taper and Saratoga Drive connection to approximate
Station 0+70 should match the existing Route 657 pavement design with a minimum
8" of 21-B Aggregate and 2" of Type SM-2A Asphalt Concrete provided. A typical
sec+ion of the proposed right turn lane and taper will be required.
17. Access to Lots 38 and 42 will be required from internal streets rather than directly from
Route 657. Also, the entrance serving the existing dwelling on Lot 1 will need to be
upgraded to Standard PE-1 Specifications or an entrance provided onto Saratoga
Drive.
18. Additional detail of the proposed waterline crossing within the Route 657 right-of-way
will need to be provided.
19. Standard VDOT stop signs will be required at all appropriate locations.

20. Sight distance, reference and speed limit along Route 657 will need to be incorporated
into the plan.

(a) Lots described by § 165-54B, Family division lots; and
§ 165-54C, Agricultural lots, of Chapter 165, Zoning, of the
Frederick County Code.
(b) Lots described in § 165-54A, Traditional five -acre lots, and
§ 165-54D, Rural preservation lots, provided that a total of no
more than three (3) such lots may be created from any one
(1) parcel under these regulations.
(2) Shared private driveways. Vehicular access to minor rural
subdivisions may be provided by means. of shared private
driveways. The owners of lots provided with access via such
driveways shall be responsible for the improvement and
maintenance of said driveways. When shared driveways are
used, the Subdivision Administrator shall be provided with copies
of the deeds of transfer. Such deeds shall contain the following
language:
The proposed shared private driveway is not built according to
street standards of and will not be maintained by the Virginia
Department of Transportation or the County of Frederick. The
improvement and maintenance of said driveway shall be the sole
responsibility of the owners of lots which are. provided with
access via the driveway. Said shared private driveways will not be
considered for inclusion into the state secondary system until
they meet the applicable construction standards of the Virginia
Department of Transportation. The cost of bringing said
driveways to acceptable standards shall not be borne by the
Virginia Department of Transportation nor by Frederick County.
(3) Minimum width for shared private driveway. The minimum right-
of-way width for a shared private driveway shall be fifty (50) feet.
§ 144-32. Property owners' associations.
A. Intent. The intent of this section is to require the establishment of a
nonprofit organization to be known as the "property owners'
association." The property owners' association shall be created by the
subdivider. The property owners' association shall be financially
responsible for its own operations and shall be charged with the
continuous maintenance and management of all common areas,

easements, stormwater management facilities and dedicated facilities
associated within an approved subdivision.
B. Establishment. The subdivider shall file legal documents that establish
procedures for the establishment of a nonprofit property owners'
association prior to the sale of any lot in an approved subdivision.
These legal documents shall be submitted to the Subdivision
Administrator and the Commonwealth's Attorney for review and
approval prior to the approval of the final subdivision plats. These
documents shall include but not be limited to provisions for dedication
of common properties, declarations of covenants, conditions and
restrictions, articles of incorporation, bylaws and deed clauses for
common areas. All final contracts between the subdivider and all lot
purchasers shall include a consumer disclosure statement listing the
property owners' association's annual assessments and the copy of
the final approved property owners' association bylaws. Membership
in the property owners' association shall be mandatory for each
original purchaser and each successive purchaser of a lot in any
approved subdivision. A liability insurance policy of one million dollars
($1,000,000.) shall be mandatory for any property owners' association
containing twenty (20) or more lots.
C. Management. The subdivider shall be responsible for the management
and maintenance of all private common areas, easements and
improvements in the.approved subdivision until the improvements are
taken over by the property owners' association. The subdivider shall
exercise all powers and duties of the property owners' association,
including assessment and collection of charges. Prior to the sale of the
