Should you desire additional information regarding the development proposal, please contact Robert I. Gould, Reilly Mortgage Group, 2000 Corporate Ridge, Suite 925, McLean, VA 22102. If your governing body desires to disapprove the proposed development, it may do so by certifying to the Authority in writing within sixty days of the date hereof. A certified copy of any resolution disapproving the development proposal should accompany the above certification. We would ask that any such certification be in the form attached hereto. Please note that Section 36-55.39.B requires that, in order to disapprove the proposed development, your governing body must make a finding that the new construction or substantial rehabilitation of the proposed development is not consistent with current zoning or other applicable land use regulations. Any resolution disapproving the Authority's financing of the development proposal should include the finding of your governing body required by Section 36-55.39.13; if such finding is not included in the resolution, the Authority may require that your governing body provide documentary evidence that such finding was made, and any failure to provide such documentary evidence may result in the Authority's finding that your governing body has not, within the above described sixty day period, certified in writing its disapproval of the proposed development in accordance with Section 36-55.39.B. In the event of failure to send such notice, the executive director of the Authority shall, for the purposes of making the finding required by Section 36-55.39.13, disregard the certification of disapproval. Your governing body may take no action on the proposed development within the above described sixty-day period; however, if no such action is taken, the Authority may make the finding set forth in Section 36-55.39.13 upon the expiration of such sixty-day period and may thereafter proceed with the financing of the proposed development. Procedure prior to financing of housing developments undertaken by housing sponsors. — A. Notwithstanding, any other provi- sion of this chapter, HDA is not empowered to finance any housing develop- ment undertaken by a housing sponsor pursuant to §§ 36=55.31, 36-55.33:1 and 36-55.34:1 of this chapter unless, prior to the financing of any housing development hereunder, the commissioners of HDA find: 1. That there exists a shortage of decent, safe and sanitary housing at rentals cr prices which persons and families of low income or moderate income can afford within the general housing market area to be served by the proposed housing development. 2. That private enterprise and investment have been unable. without assistance. to provide the needed decent, safe and sanitary housing at rentals or prices which persons or families of low and moderate income can afford or to provide sufficient mortgage financing for residential housing for occupancy by such persons or families. 3. That the housing sponsor or sponsors undertaking the proposed housing development in the Commonwealth will supply well -planned. well -designed housing for persons or fan -Lilies of low and moderate income and that such sponsors are financially responsible. �. That the housing development, to be assisted pursuant to the provisions of this chapter, will be of public use and will provide a public benefit. . 5. That the housing development will be undertaken within the authonty conferred by this chapter upon HDA and the housing sponsor or sponsors. B. The executive director of HDA shall find, in connection with the anancing of the new construction or substantial rehabilitation of any proposed multi- family residential housing development, that the governing body of the locality in which such housing development is to be located has not, within sixty days after written notification of the proposed financing has been sent the governing bodv by HDA. certified to HDA in writing its disapproval of the proposed mufti -family residential housing development. Wyatt, Planner II„ RE: Revised Master Development Plan for Preston Place DATE: June 5, 1996 An application was presented to the Board of Supervisors for the above referenced master development plan during the March 13, 1996 meeting. The applicant requested that the Board approve a revision to the approved master development plan that would change the housing type from townhouses to garden apartments. The Board of Supervisors considered several concerns that were presented by adjoining property owners and tabled the application until the April 10, 1996 meeting. The Board directed the applicant to have the owner and the property manager present to address the concerns of the citizens and to present a plan that would reduce the amount of response calls that were being made to the Frederick County Sheriff's Department. The application was brought back to the Board of Supervisors during the April 10, 1996 meeting. The applicant informed the Board that the owner was out of the country and unable to attend the scheduled meeting, and introduced Ms. Tara Hollerman to address issues associated with on -site property management. Ms. Hollerman discussed the different types of calls that were made to the Frederick County Sheriff's Department and suggested that the majority of these calls were not uncommon for this type of residential density. Ms. Hollerman and the applicant informed the Board that the citizen concerns pertaining to lighting, fencing, and screening would be addressed during the construction of Phase III. The Board stated that they did not feel that the applicant provided a plan that would reduce the amount of response calls that were being made to the Frederick County Sheriffs Department. The Board of Supervisors tabled the application for an unspecified period of time and directed staff to bring the application forward when a mitigation plan was submitted. Included with this memorandum is information provided by Charles S. McCandlish, legal counsel to the owner. This information includes a property and tenant management plan, an account of the number and type of calls made to the Sheriffs Department, a resident selection plan, an airport authority notice, and an addendum to the current management policies. From my conversations with you and several Board Members, I believe that this plan meets directly the concerns raised by the Supervisors regarding Sheriff's calls to the development. Those concerns are certainly valid and appropriate to address at this juncture. The best approach is obviously more careful selection of tenants. Unfortunately, it is not so simple as that. Laws and regulations interfere with a landlord's free selection of tenants. Nonetheless, I believe that we have tightened the process as best we can, and certainly intend to stick to these tighter selection procedures. Thereafter, our emphasis will be filtering calls to the Sheriff's Department. We expect the manager and her on -site assistants to be the first line of defense on such matters as parking violations, noise, parties, lost and found property. We would hope that the whole community can provide a first line of defense for simple juvenile problems. I believe that Preston Place has made a diligent effort to answer the Board's concerns and to improve the quality of life for its residents. The approved Master Development Plan permits the construction oL 45 rental townhouse units on the site. The Partnership has requested that the County revise the approved use to 44 rental apartment units. This Phase III project will be managed and operated by local managers, in. coordination with the existing Phase I and. Phase II of the project. Castle Development Corporation is the managing general partner of the partnerships that own all three phases, and, in conjunction with the manager, submits the following as its action plan to address various issues that have been raised regarding the project. 1. Where has been concern over the number of calls placed to the local Sheriff's Department from the project. A copy of a current revised list of such calls is attached. Management takes this concern very seriously, and is taking various steps to address this situation. +r First, an assistant manager, the maintenance superintendent and the groundskeeper live on site, and they and the manager are available 24 hours a day to respond to problems. The list of. calls that the maintenance superintendent is to cover immediately has been expanded in the last month, to include, among other things, calls regarding excessive noise, and calls regarding non-violent situations, such as suspicious cars and stray dogs. Quarterly meetings will be held with the tenants to discuss resident concerns, neighborhood watch programs, and education on how to properly handle problems before contacting * Sheriff's Department, A as calling one of the four management personnel listed above. • The tenants have been asked to refer all criminal calls to 911, but the managers have been and will continue to be active in responding to the concerns of the tenants to reduce the number of calls to the Sheriff's Department. The Sheriff will continue to serve debt warrants, for which the Sheriff's Department is paid. If requested by the Sheriff, we will look into the use of private process servers for our own debt warrants for delinquent rent. It is not passible to reduce debt warrants instigated by ether oreditors, as, statutorily, other creditors can ask that the warrants be served by the Sheriff. 2. management will be more careful on screening the tenants who rent in the project. All. tenants.must be qualified under the income limitations. (As a note, 10OW of the units must be rented to tenants at or below 60!k of the area median income. In Phase II, 2OW of the units are rented to residents who fall below 5OW of the median income, but that 5OW limitation will not apply to Phase III.) A oopy of the current income limitations is attached.. In addition to the income limitations, management has in place a Resident Selection plan for screening all tenants, a copy of which is attached. This Resident Selection Plan has been approved by the Virginia. Housing Development, Authority, and is enforceable by VHDA. In addition, management will take all legal actions to keep undesirable tenants from renting in the project. 3. Management will take all legal actions to remove undesirable tenants from the project, including, but not limited to, not renewing their leases. Management has in place a list of management policies, which are the rules for the project, a copy of which is attached. The policies have been approved, by VHDA, and are attached to each lease. If any tenant breaks any of the rules, then management can choose to act to remove the tenant pursuant to the Virginia Landlord and Tenant Act. Pursuant to that Act, management must give the tenant 21 days written notice of any remediable default, and if the tenant does not remediate it within 21 days, the tenant can be removed from the premises after' a total of 30 days. If any default is not remediable, the tenant, can and will be removed after 30 days. If the default is criminal, the tenant can be removed immediately. 4. Construction of Phase III will be handled. by Clancy & Theys Construction Co., based in Raleigh, North Carolina and. Newport News, Virginia. The subcontractor on the siding is SLD, Inc., from Richmond, Virginia.. Resident using the parking spaces do so at their own risk. Management reserves the right in his absolute judgment to limit or restrict the use of same at any time. Resident agrees not to park or place or let stand in the parking areas any vehicle that is wrecked, has a flat tire(s), does not have a valid license plate, inspection sticker or city license, or any vehicle with a kickstand that does not have proper support under the kickstand to prevent damage to the parking surface. It is also agreed that the parking areas are for automobiles, trucks, motorcycles, jeeps. Campers boats trailers or any other recreational vehicle must be parked in designed areas. I hope that this letter does not fall upon deaf ears or hold no validity because I cannot reveal my name. However, my not revealing my name should serve as an example of the fear I live with due to being a resident at Preston Place. I have lived at Preston Place for almost two years. When I first moved to the area, I -needed an affordable place to live. At the time, I believed that Preston Place was the answer. It is not by choice that I continue to reside here, but rather due to financial restraints. And lately, quite frankly, it is with embarrassment that I reside here. When I first moved into my apartment, I was pleased with the cleanliness of the building itself and the surrounding grounds. These things continue to be maintained. The environment, however, is not at all pleasing. That is why I am writing to you. The articles in the Winchester Star are factual in many instances. The concern of the board members is commendable. There are many days when the Sheriff's department responds to or makes calls to either side of the Preston Place complex. This is disturbing and frightening. Preston Place apartments caters to many different people. There are your college students, people who are financially strapped, new couples just starting out, people with new jobs in the area, etc.. These people are generally not the problem. The problems are brought about by the "undesirable" occupants. These are the people who bring with them drugs, excessive drinking, and abusive and/or irrational behaviors. Almost every building in Preston Place has an "undesirable" occupant. Unfortunately, the "undesirable" occupants bring undesirable friends who plague the complex. Many a drug transaction takes place here on a regular basis. Also, the number of people who drink and drive while in the parking lots is astounding. The management/staff here at Preston Place is wonderful, but they are fighting a powerful battle with little success. Because there is not a member of management on -site at all times(as a resident) , there are so many reckless and dangerous behaviors of which they are unaware. Not uncommon is the vandalism of cars, loud, lewd, obnoxious behaviors, and unsecure actions (drug dealing & drunk driving). Now, as with the past summer, with the weather becoming warmer, these actions are increasing. Many of my neighbors and I have discussed how the problems might be solved A security guard (or guards) is one suggestion. On -site management is another. BUT, expansion- - a new complex --is not a solution. Recently, the management held a meeting, trying to get the residents to band together to form a unified position asking for expansion. The flier for this meeting is enclosed. I did not attend this meeting because I, unfortunately, am one of the many residents who allows things to go on around me. Preston Place residents who allow things to happen around them do so out of the fear of what may happen to them if they do get involved. A good example of this is the stabbing that took place on the newer side of the complex last year. The point of my letter is to let you know that there are residents of Preston Place who feel expansion would be a grave mistake. I believe that the situation(s) in the existing complexes need to be dealt with before the board complies. Please, please continue to deny the expansion. It would be both beneficial to the board and the residents of Preston Place if everyone involved were forced to own up to their responsibilities. Thank you for listening. Several of you have called to express you anger to me concerning the Frederick County Board of Supervisors view of our community. Let me assure their view is clouded and we need to make them aware of how community life really is here at Preston Place. on Wednesday,. April 17th at 6:30PM f there will be a community meeting at the Clubhouse to discuss this matter. We need to pull together as a community to get the job done! Some of you may ask "Why should I get involved?" or "My being there won't matter." The development of Phase III means a great deal to all the residents. It will mean a new pool (we all know how crowded the current one gets) and it means more money coming into our budget so we can provide more things for all the residents and your input means a great deal. We ask this street be designated as private on this Master Development Plan. Prior to making any final comments, this office will require a complete set of construction site plans, drainage calculations, and traffic flow data from the ITE Manual, 5th Edition for review. Any work within the Route 645 right-of- way must be covered under a land use permit. • Preston Place MDP Page -2- Sanitation Authority: No comment. Inspections DWt.: Building shall comply with Virginia Uniform Statewide Building Code and Section 310, Use Group R (residential) of the BOCA National Building Code/1993. Other codes that apply are title 24 Code of Federal Regulation. NOTE: USBC requirement for sprinkling of R-2 Buildings -- Fire Protection; Chapter 1 - Fair Housing Accessibility guidelines, Section 2 through 56, F.R. 9499-9515. Fire Marshal: I did a cursory review of this plan with planner Evan Wyatt last week. The overall layout of the MDP is approved; however, our department reserves the right to have the applicant address all fire and rescue issues during the review of the engineered site plan. Issues will include but are not limited to the distance of the apartment buildings from the parking lot, the location of fire hydrants and fire lanes, and the ability to access the rear of all apartment buildings. Parks and Recreation: The previous master plan was approved for the provision of a volleyball court and a '/2 basketball court within Phase II. The applicant is proposing to provide a swimming pool with a small bathhouse in lieu of the previously approved recreational amenities. This revision is acceptable to Parks and Recreation. Detailed review of this facility will occur during review of the site plan. County Engineer: The property on the north side of Airport Road has been engineered to collect storm water and retain it within the pond located on the south side of Airport Road. The general layout of Phase II appears to conform with this concept, and is therefore approved by our department. Drainage calculations, proposed grading plans and erosion and sedimentation control measures will be addressed during review of the site plan. Winchester Regional Airport: See attached sheets. Planning & Zoning: A) Project Scope: The applicant is proposing to revise an approved master development plan to change the housing type from townhouses to garden apartments. This revision calls for the development of four garden apartment buildings which will contain a total of 44 units. This creates an overall gross density of three units per acre on the 14.59 acre tract which conforms with the previous master development plan and requirements of the Zoning Ordinance. 0 C Preston Place MDP Page -3- B) Project History: The property that is proposed to be development under Phase II has a fairly substantial history, as depicted in the following time line: 11 /2/90 A master development plan was approved to allow the development of 117 townhouse units on 22 acres, located on the north side of Airport Road (Route 645). No site plan was submitted for this project to allow construction to commence. 1/6/93 The applicant acquired 20 acres on the south side of Airport Road directly across from the 22 acre tract. A revised master development plan was approved by Frederick County which called for the development of 117 townhouse units on the north side of Airport Road and 120 garden apartments on the south side of Airport Road. A site plan was developed for the garden apartments on the south side of Airport Road. That phase of the development was built -out. 11 /21 /94 A revised master development was approved by Frederick County which changed the housing type on the north side of Airport Road to permit the development of garden apartments and townhouses. This plan proposed the development of 72 garden apartments in phase one and 45 townhouses in phase two. The revised master development plan maintained the same density as was originally approved for 117 townhouses. A site plan was developed for the garden apartments within phase one. This phase has been built -out. 2/21/96 A revised master development plan is proposed to once again change the housing type from townhouses to garden apartments. The Planning Commission discussed this proposal with the applicant during an informal discussion and indicated that this change was consistent with previous development patterns. C) General Comments: The primary concern of Planning and Development regards the delineation of the required residential separation buffer areas. Residential separation buffers are required when single family dwelling units are adjacent to other housing types. A minimum of a 100' buffer is required with full landscaping. The applicant will need to better define the location for this buffer area and provide information that describes how this buffer area will be developed. 0 Preston Place MDP Page 4- Staff Recommendations For February 21, 1996 Planning Commission Meeting: Staff recommends approval of this development proposal. The proposed housing type is consistent with previous development phases, and adequate area exists to create appropriate buffers and screening to protect the adjoining properties that contain single family dwellings. Staff asks that the Planning Commission recommendation include the need to ensure that all review agency comments are adequately addressed. Staff believes that the Planning Commission should consider the following items during consideration of the revised master development plan: The development of garden apartment or townhouses will complete the build -out of the Preston Place project. The Planning Commission has consistently required the developer to insure that the location of the Winchester Regional Airport is completely disclosed in all sales literature,, deeds, and lease contracts. The overall concept and design of the proposed master development plan conforms with the requirements of Article XVII, Master Development Plan of the Frederick County Zoning Ordinance. PLANNING COMMISSION SUMMARY & ACTION - FEBRUARY 21,1996: Three citizens addressed the Planning Commission regarding this application. Mr. Paul Davis requested that a solid wooden fence be placed around the perimeter of the property to prevent trespassing and littering onto adjoining properties. Mrs. Hope Reagan requested that existing and proposed building mounted and parking lot lighting be reflected downward to prevent spill -over onto adjoining properties, that existing staggered fencing be joined and new fencing be required that is continuous to prevent trespassing, and that a garden easement associated with her property be maintained. Mrs. Katie Wisecarver spoke in opposition to the application based on concerns ranging from increased service costs to the county, negative impacts to adjoining property values and security concerns based on the type of residents that this development is attracting. Mrs. Wisecarver also stated that the Board of Supervisors required a six foot high fence to be installed when the project received approval for townhomes. Ms. Hollerman discussed the different types of calls that were made to the Frederick County Sheriff's Department and suggested that the majority of these calls were not uncommon for this type of residential density. Ms. Hollerman and the applicant informed the Board that the citizen concerns pertaining to lighting, fencing, and screening would be addressed during the construction of Phase III. The Board of Supervisors stated that they did not feel that the applicant provided a plan that would reduce the amount of response calls that were being made to the Frederick County Sheriff's Department. Mr. Richard Tremblay, Vice President for Planning and Development, Silver Companies, addressed the Board at this time and explained what was planned by his company for this area. Mr. Tremblay explained that this property was purchased last year and at that time no concern was expressed by any group or the Airport with reference to noise. He further stated that his company did want buyers made aware of the close proximity of the Airport to this development. Mr. Mark Flynn, Attorney for the Airport Authority, appeared before the Board to explain that the Authority is interested in obtaining an easement for the protection of the Authority. I Mr. Paul Anderson, Chairman of the Airport Authority, addressed the Board and noted that the question had been raised earlier as to whether or not the Airport is in the LDN area and explained that it is out of the LDN area. Mr: Stiles stated that in 1985 this property was rezoned and he wanted to know where the Airport Authority was then if they had all these concerns. Mr. Anderson replied that it was his fault that the Authority did not come forward at that time, as tie was not on top of the situation as he should have been. Mr. Sam Leinbach, City resident, appeared before the Board to addresss the noise profile that will come from the Airport and felt that due to flight patterns this will either have to go North or South. Mrs. Katie Pierce, resident of Bufflick Road, stated they had been told earlier that this would only be single family and now they are being told townhouses will be built, she therefore was requesting that a fence, six to seven feet, be erected on the property line, and further that this be put in writing as part of the conditions. Mr. Rinker stated that some of the present Board members were not serving on the Board when this property was rezoned and he for one felt the easement should be made a part of the agree- ment at this time. This creates an overall gross density of three units per acre on the 14.59 acre tract which conforms with the previous master development plan and requirements of the Zoning Ordinance. • • Preston Place MDP Page -3- B) Project History: The property that is proposed to be development under Phase II has a fairly substantial history, as depicted in the following time line: 11/2/90 A master development plan was approved to allow the development of 117 townhouse units on 22 acres, located on the north side of Airport Road (Route 645). No site plan was submitted for this project to allow construction to commence. 1/6/93 The applicant acquired 20 acres on the south side of Airport Road directly across from the 22 acre tract. A revised master development plan was approved by Frederick County which called for the development of 117 townhouse units on the north side of Airport Road and 120 garden apartments on the south side of Airport Road. A site plan was developed for the garden apartments on the south side of Airport Road. That phase of the development was built -out. 11/21/94 A revised master development was approved by Frederick County which changed the housing type on the north side of Airport Road to permit the development of garden apartments and townhouses. This plan proposed the development of 72 garden apartments in phase one .and 45 townhouses in phase two. The revised master development plan maintained the same density as was originally approved for 117 townhouses. A site plan was developed for the garden apartments within phase one. This phase has been built -out. 2/21/96 A revised master development plan is proposed to once again change the housing type from townhouses to garden apartments. The Planning Commission discussed this proposal with the applicant during an informal discussion and indicated that this change was consistent with previous development patterns. C) General Comments: The primary concern of Planning and Development regards the delineation of the required residential separation buffer areas. Residential separation buffers are required when single family dwelling units are adjacent to other housing types. A minimum of a 100' buffer is required with full landscaping. The applicant will need to better define the location for this buffer area and provide information that describes how this buffer area will be developed. • • Preston Place MDP Page -4- Staff Recommendations For February 21, 1996 Planning Commission Meeting: Staff recommends approval of this development proposal. The proposed housing type is consistent with previous development phases, and adequate area exists to create appropriate buffers and screening to protect the adjoining properties that contain single family dwellings. Staff asks that the Planning Commission recommendation include the need to ensure that all review agency comments are adequately addressed. Staff believes that the Planning Commission should consider the following items during consideration of the revised master development plan: The development of garden apartment or townhouses will complete the build -out of the Preston Place project. The Planning Commission has consistently required the developer to insure that the location of the Winchester Regional Airport is completely disclosed in all sales literature, deeds, and lease contracts. The overall concept and design of the proposed master development plan conforms with the requirements of Article XVII, Master Development Plan of the Frederick County Zoning Ordinance. PLANNING COMMISSION SUMMARY & ACTION - FEBRUARY 21,1996: Three citizens addressed the Planning Commission regarding this application. Mr. Paul Davis requested that a solid wooden fence be placed around the perimeter of the property to prevent trespassing and littering onto adjoining properties. Mrs. Hope Reagan requested that existing and proposed building mounted and parking lot lighting be reflected downward to prevent spill -over onto adjoining properties, that existing staggered fencing be joined and new fencing be required that is continuous to prevent trespassing, and that a garden easement associated with her property be maintained. Mrs. Katie Wisecarver spoke in opposition to the application based on concerns ranging from increased service costs to the county, negative impacts to adjoining property values and security concerns based on the type of residents that this development is attracting. Mrs. Wisecarver also stated that the Board of Supervisors required a six foot high fence to be installed when the project received approval for townhomes. I understand her concerns with the increased traffic on Airport Rd as well as the vandalism and trespassing happening at the airport. Please remember that because of the major construction delays on Rt 522 South many people including residents of Preston Place use Airport Rd. as a detour to Rt 50 East. Signs have been posted in the past several months stating that drivers should use this route to avoid delays. In the past, Preston Place Apartments has been labeled as a "low-income" community by a few uneducated citizens of Frederick County. Preston Place Apartments is not a "low-income" community. Yes, Preston Place is governed by the Section 42 Tax Credit Program which requires initial income restrictions. that are based on the median income of Frederick County. Initially, the residents must not make more than 60% of the median income of the county which is adjusted for family size however, after the initial certification their income is no longer a factor. This program is not designed to hinder people from making a decent living for themselves. Preston Place is here to provide a clean, safe and affordable environment where people can be proud to live and raise their children. It is common for our residents to continuously improve and excel in their careers and incomes without fear of having to move due to their change of financial status, thus allowing them to meet their financial goals. Our demographics mostly consist of young couples who are just starting out, single parents and elderly residents. For the most part this community is close knit. The prior recommendations that were agreed upon by Mike McNamara in the letter dated September 16,1992 from Mr. Evan Wyatt have been carried out since the property has been in existence. For your convenience please find attached a copy of the Airport Authority Notice which is sighted by every resident of our community as part of their lease. Also a copy of the marketing brochure is enclosed. As you can see, it states very clearly that Preston Place Apartments is located 112 mile from the airport. There is also a map that shows the proximity of the airport to Preston Place Apartments. All buildings have been built in compliance with the Virginia Power Energy Efficiency Standards which include extra insulation, double glazed windows, insulated steel exterior doors and heat pumps for air conditioning. And to our delight no resident has ever complained to the Management of excessive noise from the airport. As I am sure you are aware, Preston Place Apartments is beneficial to Frederick County in many ways such as the revenue received from personal property taxes, water and sewer moneys, and real estate taxes just to name a few. Preston Place Apartments continues to be an attractive community which provides affordable housing. The management company emphasizes exceptional curb appeal and will continue to do so. Also, Management does a very thorough credit check as well as reference checks on all applicants. I understand her concerns with the increased traffic on Airport Rd as well as the vandalism and trespassing happening at the airport. Please remember that because of the major construction delays on Rt 522 South many people including residents of Preston Place use Airport Rd. as a detour to Rt 50 East. Signs have been posted in the past several months stating that drivers should use this route to avoid delays. In the past, Preston Place Apartments has been labeled as a "low-income" community by a few uneducated citizens of Frederick County. Preston Place Apartments is not a "low-income' community. Yes, Preston Place is governed by the Section 42 Tax Credit Program which requires initial income restrictions that are based on the median income of Frederick County. Initially, the residents must not make more than 60% of the median income of the county which is adjusted for family size however, after the initial certification their income is no longer a factor. This program is not designed to hinder people from making a decent living for themselves. Preston Place is here to provide a clean, safe and affordable environment where people can be proud to live and raise their children. It is common for our residents to continuously improve and excel in their careers and incomes without fear of having to move due to their change of financial status, thus allowing them to meet their financial goals. Our demographics mostly consist of young couples who are just starting out, single parents and elderly residents. For the most part this community is close knit. The prior recommendations that were agreed upon by Mike McNamara in the letter dated September 16,1992 from Mr. Evan Wyatt have been carried out since the property has been in existence. For your convenience please find attached a copy of the Airport Authority Notice which is signed by every resident of our community as part of their lease. Also a copy of the marketing brochure is enclosed. As you can see, it states very clearly that Preston Place Apartments is located 112 mile from the airport. There is also a map that shows the proximity of the airport to Preston Place Apartments. All buildings have been built in compliance with the Virginia Power Energy Efficiency Standards which include extra insulation, double glazed windows, insulated steel exterior doors and heat pumps for air conditioning. And to our delight no resident has ever complained to the Management of excessive noise from the airport. As I am sure you are aware, Preston Place Apartments is beneficial to Frederick County in many ways such as the revenue received from personal property taxes, water and sewer moneys, and real estate taxes just to name a few. Preston Place Apartments continues to be an attractive community which provides affordable housing. The management company emphasizes exceptional curb appeal and will continue to do so. Also, Management does a very thorough credit check as well as reference checks on all applicants. We work very closely with the Frederick County Sheriff's Department in hopes of keeping Preston Place crime free. Mr. Richard Tremblay, Vice President for Planning and Development, Silver Companies, addressed the Board at this time and explained what was planned by his company for this area. Mr. Tremblay explained that this property was purchased last year and at that time no concern was expressed by any group or the Airport with reference to noise. He further stated that his company did want buyers made aware of the close proximity of the Airport to this development. Mr. Mark Flynn, Attorney for the Airport Authority, appeared before the Board to explain that the•Authority is interested in obtaining an easement for the protection of the Authority. Mr. Paul Anderson, Chairman of the Airport Authority, addressed the Board and noted that the question had been raised earlier as to whether or not the Airport is in the LDN area and explained that it is out of the LDN area. Mr. Stiles stated that in 1985 this property was rezoned and he wanted to know where the Airport Authority was then if they had all these concerns. Mr. Anderson replied that it was his fault that the Authority did not come forward at,that time, as he was not on top of the situation as he should have been. Mr. Sam Leinbach, City resident, appeared before the Board to addresss the noise profile that will come from the Airport and felt that due to flight patterns this will either have to go North or South. Mrs. Katie Pierce, resident of Bufflick Road, stated they had been told earlier that this would only be single family and now they are being told townhouses will be built, she therefore was requesting that a fence, six to seven feet, be erected on the property line, and further that this be put in writing as part of the conditions.
