Paragraph 2 of Mr. Childress's December 19, 1994, letter to Brownell, Inc., (enclosed) refers to a drainage easement on Lot 117, Pembridge Heights, Phase II. A copy of a portion of the plat of Phase II is enclosed which shows the location of this property. A deed of easement was signed by the owner of Lot 117 and was recorded today in the Frederick County land records in book 833 at page 1686. Copies of the deed are enclosed for each of you. Additional materials called for in Mr. Childress's letter will be submitted later. Thanks for your help in this matter. Phases I, II & III 201 North 23rd Street Route 50 East Purcellviiie, VA 22132 Frederick County Dear Mr. Brownell: Mr. Wayne Miller, Frederick County Subdivision Administrator, forwarded to me your letter of November 28th and package of information requesting the addition of streets in the referenced development to our Secondary Maintenance System. Upon review of the information I offer the following comments: 1. As -Built Plans: The plans appear acceptable as submitted. 2. Mr. Eric Zicht's letter of November 21, 1994: The letter is acceptable as submitted. However, we did not receive a copy of the drainage easement plat across the lot of #117 as indicated. 3. Plat from the Owner of Lot #205, Section III: I question the need for this plat since the drainage easement already exists at the same location on this property as evident by Sheet No. 4 of 4 of the project's final subdivision plat. It appears through field review the additional easement is needed on the adjacent Lot #206. 4. FINAL SUBDIVISION PLAT, PHASE 1 Cad • Sheet No. 8 of 11: The drainage easement across Parcel "B" and the adjacent Carroll Property does not correspond with the revised site plan dated May 4, 1989 (see attached VDOT letter dated 7/13/89). ��� • Sheet No. 9 of 11: The drainage easement between Lots No. 5 and No. 6 is not shown as detailed on the revised site plan dated 5/4/89 (see attached VDOT letter dated 7/13/89). PHASE II �,c • Sheet No. 2 & 11 of 19 are missing. 1 • The existing 10' drainage easement shown on Sheets No. 9, 10, 15 and 16 of 19 across Pembridge Drive will need to be quitclaimed and/or vacated. TRANSPORTATION FOR THE 21 ST CENTURY Mr. Bruce M. Brownell Ref: Pembridge Heights Subdivision - Phases I, II & III December 19, 1994 Page 2 PHASE III C`o\ • The plats with VDOT signature of 6/27/90 which detail a 50' right-of-way beyond the Price & Carl properties are acceptable as submitted. However, we signed a later plat on 12/12/90 which dedicates a 60' right-of-way. Which right-of-way width is correct? 5. Quitclaim Permits: • Fred. Co. Sanitation Authority: The permit application is acceptable as submitted. • Bell Atlantic Telephone: The permit application is acceptable as submitted. • Adelphia Cable T.V.: The permit application is acceptable as submitted. • Shenandoah Gas Company: The permit application does not reflect facilities within the Price Drive right-of-way. We have contacted the gas company to submit the missing information directly to us. • The Potomac Edison Company: The quitclaim deed refers to Huntington Meadows Subdivision. The permit application also does not reflect electric facilities within the Purdue, Yale and Price Drive rights -of -way. We have contacted Potomac Edison about this missing information for submission directly to us. • City of Winchester: A permit application (enclosed) and plans will be required to \ cover the City's water and sewer facilities within all three phases of the project. In addition a quitclaim deed (example enclosed) will be needed from the City to cover their existing easements within the Pembridge Drive and Purdue Drive rights -of -way. (c) In addition to the above, we requested a copy of a recorded turn around easement (see attached letter dated August 26, 1991) at the end of Ludlow Drive and have never received i� tt Also I noticed in your deed of dedication the street rights -of -way were dedicated to the Virginia Department of Transportation. This is incorrect. The rights -of -way should be dedicated to the County of Frederick. Once the above items have been addressed, we can resume the addition process. As we have discussed on numerous occasions we are still interested in obtaining water and sewer service for eight lots of the subdivision from the City of Winchester. We have discovered that its is feasible to sewer the eight lots at the terminous of Yale Drive through an extension of the Sanitation Authority lines. However, the eight lots on Devon Drive (adjacent to the Holiday Inn) must be served from the City. The Winchester City Council approved the extension of water and sewer lines for eight lots on Yale Drive provided that the Sanitation Authority would debit these services against their capacity at the Opequen Regional Waste Water Treatment Facility. Next week the City Council would like these services on Devon Drive. At the next Sanitation Authority Board meeting (March 20, 1989), I will request that the Sanitation Authority debit the eight services described above. Without your support, it is unlikely that such a proposal will be favorably received. I am hoping that you might attend this meeting. The Pembridge Heights property is encumbered by a drainage easement established at the time the College Park Subdivision was approved. We have provided storm drainage structures, ditches and easements to accommodate all off -site storm water run off. Our storm water drainage system replaces the natural storm drain system depicted on the College Park subdivision plats. The Virginia Department of Transportation and the Sanitation Authority have been advised that the former storm drainage easements will be vacated. Pages 8 - 11 of the final plat includes notes that indicate that these easements are to be vacated. Our legal counsel has advised that it will be necessary to have a Deed of Vacation signed by the appropriate county official to vacate Mr. John Riley, Jr. Page 2 February 29, 1989 this easement. I have enclosed copies of the final plat and the drainage easement. Since the appropriate county review agencies have signed the plat and the Board of Supervisors has approved the same, I am hoping that formal action by the Board of Supervisors will not be necessary. Bushman SUBJECT: Pembridge Heights Subdivision Phase I - Frederick County We are returning one set of revised plans with our comments as follows: 1. The 18" pipe on Clarendon Court to be increased to a 21" size. 2. The existing 60" X 36" pipe arch will have to be extended due to the radius flare and additional shoulder at the intersection of Pembridge Drive and Route 781. -3. On profile sheet 4 of 10, the grade on Pembridge Drive intersection with Route 781 is to be adjusted as noted to provide a safer design for traffic having to stop as they approach the intersection. .4. On profile sheet 6 of 10, the vertical curve at station 14 + 75, Etnam Street, to be increased to 300, to obtain a minimum 200, vertical sight distance. 5. The typical section is to be revised to show 12" depth of aggregate base course No. 21-A for Pembridge Drive. This is in accordance with the subdivision pavement design chart and anticipated traffic. generated. Since the connection of Purdue Drive with Pembridge Drive has been eliminated, traffic entering or exiting Route 50 from Purdue Drive will be considerably less than previously anticipated.
