Moh;,) anner II Subject: Satian Enterprises, Inc., Park Place Condominiums, Section II: Request for a Waiver of the Lot Access Requirement for Multi -family Housing Date: December 2, 1999 Nature of Request: The Planning Commission has received a request from Mr. Tim Painter, on behalf of the above - referenced development, for a waiver ofthe lot access requirement applicable to multi -family housing. The applicant has submitted a site plan for the development of nine (9) apartment buildings that will consist of eighty-eight (88) two -bedroom units. Access to the proposed development will occur solely via an entrance from Brookland Lane (Route 658), with circulation through the site facilitated by a system of driveway loops that connect to a central travelway. The site plan depicts the location of buildings " B" and "rat distances of 670' and 715' from the entrance to the development, respectively. The maximum allowable distance for multi -family housing from access to a state -maintained road is 500 feet. The applicant is seeking a waiver of this requirement to facilitate revision of the approved master development plan that would permit the layout proposed on the site plan. The proposed layout would involve the elimination of a second entrance to the site directly from Valley Mill Road (Route 659), which was included on the original master development plan. Planning Commission Authority: Pursuant to Section 144-24.C(2)(b) of the Subdivision Ordinance, the Planning Commission may allow multi -family lots to be located as much as 800 feet from a state -maintained road in cases where enhanced circulation is provided with a driveway loop. 107 North Kent Street • Winchester, Virginia 22601-5000 0 • Entrance Spacing Reduction Request Page 2 December 2, 1999 Staff Conclusion: The Planning Commission has the authority to extend the distance permitted between state -maintained roads and multi -family dwellings to a maximum of 800' when circulation is enhanced through the provision of a driveway loop. The applicant has proposed that two multi -family buildings be permitted at distances of 670' and 715' from the entrance to the development from Brookland Lane, respectively. The layout of the proposed development has been designed to include two driveway loops intended to facilitate circulation throughout the site. Furthermore, the elimination ofthe second entrance to the site will arguably improve the safety and efficiency of the traffic flow on Valley Mill Road as its intersection with Brookland Lane will be the focal point for access to both sections of the condominium complex. It is, therefore, evident that the applicant has incorporated design features into the proposed development that result in a desirable circulation pattern, which may satisfy the criteria for a waiver of the access standard applicable to multi -family housing as outlined in the Subdivision Ordinance. The ordinance permits an extended length of up to 800' for private roadways and aisles where looped circulation is provided, subject to approval of the Planning Commission. This project, as designed, provides a looped roadway and parking system around the multi -family dwelling units that exceed the 500 ft. limit. There are only two buildings, a total of 20 dwelling units, that exceed this 500 ft. limit. Please note, also, that the maximum length to these buildings is approximately 705 ft. which is less than the maximum limit of 800 ft. Please review this information and advise us as to your findings regarding support of this waiver and submission to the Planning Commission for final approval. Planning & Zoning: The proposed apartment and townhouse development is a permitted use in the RP (Residential Performance) Zoning District. The applicant plans to develop 76 apartment units and 86 townhouse units on an 18.68 acre parcel. This creates a gross density of 8.67 units per acre. Any Master Development Plan (MDP) containing less than twenty- five (25) acres is permitted to have a maximum gross density of ten (10) units per acre. The original Master Development Plan (MDP) associated with this project was scheduled for Planning Commission review on December 16, 1992. The staff report expressed concerns with seven (7) specific issues at that time. The following staff report relates how those issues have been addressed at this time: 1) Multifamily Lot Requirements - The original MDP had three (3) townhouse rows that exceeded the requirement of all multifamily lots being within five hundred ( 500 ) feet of a state -maintained road as measured along the access route. The revised MDP meets this requirement. 2) Road Efficiency Buffers - The applicant has provided a continuous landscaped road efficiency buffer of eighty (80) feet along Route 659 (Valley Mill Road). Staff will ask VDOT to verify that the road efficiency buffer is designed correctly to insure that it will not be disturbed when Route 659 is improved. 3) Transportation Issues - The applicant has provided a twenty-five (25) foot strip to be dedicated for improvements to Route 659 (Valley Mill Road). Staff will ask VDOT to determine if this is adequate. The applicant has indicated that Route 658 (Brookland Lane) will be improved to the end of the property. The sixty (60) foot undeveloped right-of-way indicated on the MDP is for the purpose of providing a connection between Little River Drive and Route 658. According to VDOT, Little River Drive was not developed into a cul-de-sac to allow for this connection. 4) Steep Slopes - The original MDP proposed thirty-four (340) percent disturbance of areas defined as steep slope. The applicant has redesigned the entire layout of this plan and has indicated that twenty-one (21a) percent of the steep slope area will be disturbed. The applicant needs to include the amount of steep slope area on the townhouse portion that will be disturbed as a result of extending sanitary sewer through this area. 5) Phasing - The revised MDP indicates phasing for the development. 6) Total Development Specifications - The proposed Master Plan needs to indicate information regarding the total development. This information needs to include the proposed number of dwelling units, the approximate acreage in common open space, housing type, right-of-way, and environmentally sensitive land, as well as the amount and percentage of environmentally sensitive land that will be disturbed. 7) Review Agency Comments - Comments made by the Virginia Department of Transportation, Parks and Recreation, and the County Engineer need to be addressed at the Master Plan stage. The original Master Development Plan (MDP) associated with this project was scheduled for Planning Commission review on December 16, 1992.
