Frederick County administratively approved the above -referenced final master development plan on April 16,
2008. The master development plan is approved for the potential development of 22.5 acres in the RP
(Residential Performance) District for residential uses, 15.2 acres in the RP District for public uses and ten
acres in the B2 (Business General) Zoning District for commercial uses, as depicted on the plan. This
development is located within the Red Bud Magisterial District. The properties which would comprise this
development adjoin Senseny Road to the north and Charming Drive to the west, approximately 3,000 feet east
of Greenwood Road.
The Frederick County Board of Supervisors granted staff administrative approval authority on March 26, 2008.
All requirements of the Frederick County Zoning and Subdivision Ordinance have been addressed in the plan.
Please note that approval of a site plan is required prior to the subdivision or development of this parcel. I am
providing you with five (5) copies of the approved final master development plan. Please ensure that these

REVIEW EVALUATIONS:
Virginia Department of Transportation: The revised MDP received February 7, 2008 is acceptable to
VDOT.
Frederick County Fire Marshal: Plans approved as submitted.
Frederick County Public Works: Upon review of the revised MDP plan dated January 31, 2008, we
offer no comments at this time. Therefore, we recommend approval of the subject MDP. A
comprehensive review will occur at the time of site plan submission.
Frederick County Inspections Department: No additional comments at this time. Will comment on
site plan.
Frederick County Sanitation Authority: No comment. There should be sufficient water and sewer
capacity to serve this site.
GIS Department: No additional road names are required at this time. Structure numbering will be
assigned during the permit and construction phase of development.
Parks & Recreation: The new calculation provided for the proposed open space appears to meet
county requirements. Every effort should be made to create bicycle trails to improve non vehicular
access to the school site and throughout the development. Relative to the Parks and Recreation
amenities, please detail all changes or alterations included in the revised Master Development Plan.
These changes and/or alterations need to be presented in a summary, specifically addressing Parks and
Recreation amenities, clearly illustrating how the revisions are different from what was approved in the
Master Development Plan.
Winchester Regional Airport: The Master Development Plan was reviewed and it appears that the
proposed plan will not impede operations at the Winchester Regional Airport. This proposed site does
lie within airspace of the Winchester Regional Airport which could result in noise from over flights of
aircraft departing to and from the northeast.
Frederick County Public Schools: Frederick County Public Schools asks that Frederick County
approve the addition of a public use to the Lynnehaven Master Development Plan. This approval will
enable us to work towards opening a much needed elementary school in the Lynnehaven development.
This new school will help . FCPS manage elementary student population growth and the reduction in
elementary school program capacity resulting from implementation of full -day kindergarten. We think
that this elementary school as proposed is properly located within its community and will be an asset to
its community and Frederick County. The school will be located at the intersection of two collector
streets within a densely developed and .developing area. Many children will live within 1/4 mile of the
school and will be able to walk or bicycle to school. Placing this school within Lynnehaven will result
in general in a system -wide reduction in the distance elementary school children have to travel to school
and in specific in a reduction in the distance Lynnehaven, Sovereign Village, Fieldstone, Apple Ridge,
Senseny Glen, Twin Lakes, Glenmont Village, Lockhart and Burning Knolls children have to travel to

school. The school will offer recreational opportunities to the community. There will be an area
designated for use by the Parks and Recreation Department in the school. This area will contain an
activity room, a demo lab and an all-purpose room. Community members will be able to use the paved
fire access lane around the school as a walking and jogging loop. Community members will also be able
to schedule activities and events on the ballfields at the school.
Planning & Zoning:
A) Master Development Plan Requirement
A master development plan is required prior to development of this property. Before a master
development plan can be approved, it must be reviewed by the Planning Commission, Board of
Supervisors and all relevant review agencies. Approval may only be granted if the master
development plan conforms to all requirements of the Frederick County Zoning and Subdivision
Ordinances. The purpose of the master development plan is to promote orderly and planned
development of property within Frederick County that suits the characteristics of the land, is
harmonious with adjoining property and is in the best interest of the general public.
B) Location
The subject properties adjoin Senseny Road to the north and Channing Drive to the west,
approximately 3,000 feet east of Greenwood Road.
C) Site History
The original Frederick County Zoning Map (U.S.G.S. Stephenson Quadrangle) identified the
zoning for the acreage within the master development plan as A-2 (Agricultural General)
District. This zoning classification was modified to RA (Rural Areas) District on February 14,
1990 during the comprehensive amendment to the county's Zoning Ordinance.
The Board of Supervisors approved Rezoning Application #15-99 for Channing Drive on
December 8, 1999. This action established 354.3 acres of land zoned RP (Residential
Performance) District, and 22.0 acres of land zoned B2 (Business General) District. This
property was originally Master Planned with MDP 408-2000 which was for the entire Charming
Land Bay. The Board of Supervisors also approved Rezoning #04-04 for the Bean Property on
May 12, 2004 which rezoned five acres from the RA District to the RP District with proffers.
The original MDP for the Charming Drive project included the developments now known as
Lynnhaven, Twin Lakes, and Sovereign Village. Separate master development plans for the
revised Twin Lakes and Sovereign Village developments have already been approved.
Staff Note: On March 23, 2004 the Frederick County Board of Supervisors adopted a
resolution which gave the individual property owners of the Channing Drive Rezoning the
ability to submit revised master development plan applications independent of one another.

D) Site Suitability & Proiect Scone
Comprehensive Policy Plan:
The Frederick County Comprehensive Policy Plan is an official public document that serves as
the community's guide for making decisions regarding development, preservation, public
facilities and other key components of community life. The primary goal of this plan is to
protect and improve the living environment within Frederick County. It is in essence a
composition of policies used to plan for the future physical development of Frederick County.

Land Use Compatibility:
The parcels comprising this MDP application are located within the County's Urban
Development .Area (UDA) and Sewer and Water Service Area (SWSA). The Urban
Development Area defines the general area in which more intensive forms of residential
development will occur. In addition, the Eastern Frederick County Long Range Land Use map
designates the general area in which the Lynnehaven Development is located for residential land
uses. The residential portion of the Lynnehaven project will develop with a density of 2 units per
acre which has decreased from 2.5 units per acre as shown on the original Channing Drive MDP.
The revised Lynnehaven Master Development Plan will consist of 135 residential lots, 10 acres
of commercially zoned land and 15.2 acres of land for public use which will be utilized for a new
elementary school. It is noted that the most significant chanl4e presented with this revised
Master Development Plan is the addition of the school site.
Transportation
Primary access into the Lynnehaven Development will be via Channing Drive. Currently this
roadway is not completed and is not within the state's secondary road system. It is noted that the
portion of Charming Drive between Senseny Road and Farmington Boulevard will not be
accepted by VDOT until the traffic signal at the intersection of Senseny Road and Channing
Drive has been installed. This revised MDP has a note that states that Channing Drive between
Senseny Road and Farmington Boulevard will be closed to the public until a signal is provided.
The signal at this intersection was proffered with Rezoning #15-99.
The internal roads as shown on this revised MDP reflect the network that has been approved with
the phased subdivision design plans for the development.
Proffers
The majority of the Lynnehaven Development proffers fall under Rezoning 915-99 (Channing
Drive), which are attached. The public use portion of the site which will be developed for the
proposed 12t" Elementary School will fall under the pending Rezoning #01-08 for the Frederick
County School Board.
STAFF CONCLUSIONS FOR THE 03/05/08 PLANNING COMMISSION MEETING:
The master development plan for Lynnehaven depicts appropriate land uses and appears to be consistent
with the requirements of Article XVII, Master Development Plan, of the Zoning Ordinance. The
preliminary master development plan is also in accordance with the proffers for Rezoning #15-99 and
pending rezoning #01-08 for the 121h Elementary School. All of the issues brought forth by the Planning

Commission should be appropriately addressed prior to a recommendation to the Board of Supervisors.
PLANNING COMMISSION SUMMARY AND ACTION OF THE 03/05/08 MEETING:
The Planning Commission received the staff summary and had discussion on both the Rezoning
Application #01-08 for Frederick County School Board and the MDP #01-08 for the Revised Lynnhaven
Development together, since both applications concerned the same project.
The representative for the School Board stated the existing zoning designation on the property is not
being changed; however, a modification to the previously -approved proffers is requested to: 1) eliminate
the residential condition placed upon the five acres and 2) to establish a proffer for the entirel5-acre
property which states the parcel can only be used for public use.
One area resident spoke during the public comment portion of the hearing. He was in favor of the
school construction, but was interested in knowing if any limitations were going to be placed on the
commercial development in light of the vicinity of the school. In addition he was also concerned about
the opening of Channing Drive.
Staff responded that VDOT has identified sight issues on the southern section of Channing Drive, where
it intersects with Senseny Road, which makes it unsafe until a traffic signal is installed. The developers
of the existing B2 property have the proffer which commits them to install the traffic signal with the first
commercial use. Staff noted that the County is working with VDOT to get the remainder of the roads
into the State System and has set a target date of the school's opening a year and a half out. Staff also
noted there are a number of ways for the traffic to get through safely and to get to the school site safely.
Regarding the restrictions on the commercial uses adjacent to the school, staff commented there were
provisions within the zoning code on appropriate uses and requirements for buffering between uses. In
addition, staff will work with the developers of the commercial areas to ensure compatible uses are
established.
Two separate actions were taken by the Planning Commission. The Commission unanimously
recommended approval of the rezoning application by the Frederick County School Board with
modified proffers for the County's 12th elementary school. The Planning Commission unanimously
recommended approval of the MDP for the Revised Lynnhaven Development for the elementary school,
along with residential and commercial uses. (Note: Commissioner Kerr was absent from the meeting.)
STAFF CONCLUSIONS FOR THE 03/26/08 BOARD OF SUPERVISORS MEETING:
The master development plan for the Revised Lynnehaven Development depicts appropriate land uses
and appears to be consistent with the requirements of Article XVII, Master Development Plan, of the
Zoning Ordinance. Therefore, the preliminary Master Development Plan for the Revised Lynnehaven
Development is in a form that is administratively approvable. All of the issues brought forth by the
Board of Supervisors should be appropriately addressed by the applicant.
The applicant is seeking authorization of the preliminary master development plan by the Board of
Supervisors The Board's authorization will grant staff with administrative approval authority for the
rinal master development plan.

Dear Mrs. Perkins:
We are in receipt of the comments dated September 2, 2005, and offer the following responses:
Comments from Frederick County Department of Planning and Development
Comment 1: Proffer Statement. Provide a scan of the actual signed proffers from the rezoning on the
MDP.
Response: Sheet 2 has been added to the plan set and the scanned images of the approved proffers of the
rezoning have been added to this new sheet.
Comment 2: Surveyed Boundaries. The surveyed boundaries of the parcel need to be shown along with
the boundaries of the B2 Parcel.
Response: The bearings and distances of the recorded boundaries have been added to sheet 4 of the plan
set. The boundaries of the B2 parcel will be provided during the submission of the corresponding
subdivision plan.
Comment 3: General Notes. On Sheet I under general notes, provide a statement that new utilities will be
underground.
Response: Note number 24 stating that all utilities will be located underground has been added under the
general note area on sheet 1 of the plan set.
Comment 4: Road Detail. On the cover sheet, provide the ROW width.
Response: The typical section shown on sheet 1 of the plan set has a table below it that represents all of the
possible ROW dimensions that could be utilized throughout the project.
Comment 5: Channing Drive. The note provided on the coversheet of the MDP does not adequately
ensure the construction of Channing Drive. Notes need to be provided on the MDP that Channing Drive
from Farmington Drive to Woodrow Road needs to be bonded prior to any lots being platted within Phase
2 of Lynnehaven Drive and constructed within 12 months of platting. Another note needs to be provided
that states Channing Drive from Woodrow Road to the Arcadia Development Company (Fieldstone
Subdivision) property needs to be bonded prior to any additional lots in Phase 1 being platted and built
within 18 months.

Response: On sheet 1 of the plan set, the note for Channing Drive found in the Project Information area
has been modified to state that Channing Drive will be constructed as per the approved proffers that are
shown on sheet 2 of the plan set. This guideline for the construction can be found in Article II; Section C;
Line 1 a. The note for the timeline of the construction of Charming Drive has also been added to reflect the
approved proffers shown on sheet 2 of the plan set. This timeline for construction can be found in Article
II; Section C; Line 1 c.
Comment 6: Development Tabulations. The tabulations provided on sheet 1 do not add up. The numbers
in the first row (approved MDP) add up to 83.7 not 81.4. 1t appears that this discrepancy was also on the
original MDP and needs to be resolved.
Response: On sheet 1, the development tabulations for the approved Channing Drive Master Development
Plan, showed in error a "lots" area of 60.1 AC, and a "R/W" area of 14.2AC. These areas have been
corrected on sheet 1 of this Revised MDP. The proper total acreage of 81 AAC was correct on the approved
MDP, and remains the approved total on sheet 1 of this plane set. The new total shown on sheet 1 of this
Revised MDP correctly shows the addition of TM parcels 55-((A))-208, 65-((A))-32, and 65-((A))-33,
which were acquired for the completion of Charming Drive.
Comment 7: Trail. The trail shown on the Channing Drive detail should be revised to shoo, an asphalt
trail.
Response: The detail shown on sheet 4 of the plan set shows the approved mulch or wood chip trail, as set
forth within the approved proffers Article II; Section A; Line 3.
Comment 8: Common Shared Buffer. The zoning district buffer needs to be a total of 100' in width. The
B2 portion against the RP requires a minimum of 50' full screen and the RP portion against the B2
requires a 50' distance screen. This buffer can only be reduced if existing vegetation achieves the
functions of a fudl screen.
Response: The buffer shown on sheet 4 of the plan set, is not a reduced 50' distance of a required 100'. In
a January 17, 2006 meeting between Eric Lawrence with the Frederick County Planning Department, and
Evan Wyatt of our office, it was determined that no distance was required for the RP portion against the B2
with a full landscape screen.. It was also determined that the common shared buffer distance of 50' with a
full landscape screen, as shown on sheet 4 of the plan set, was adequate enough to resolve the buffer
requirements of both the B2 and the RP portions. Please see Eric Lawrence for any questions regarding
this meeting.

Hi Kurt -
In reference to item #2 from the letter dated January 29, 2004 from the
Planning Department to Greenway Engineering: As noted in your January 14,
2004 letter, we agreed that the layout of the area west of Lynnhaven Drive,
and south of Woodrow Drive, were in general conformance with the approved
MDP. Therefore, it would be appropriate to proceed with the effort to
protect the identified wetlands by eliminating the proposed road crossing,
and implementing Nescliff and Pangborne Courts.
Any other deviations from the approved MDP will require a revised MDP prior
to subdivision.

plan for the proposed development referred to as Lynnehaven. Staffs review comments are

1. Owners Blocks. Clarify on the coversheet of the MDP which party owns each property.
2. Property Ownership. The MDP shows that there are two parties with ownership in the
development. The commercial portion of the property is not owned by Taylor -Grace, it is
owned by Lynnehaven, LC, and they need to be included in the MDP.
3. Transportation Narrative. The traffic signalization for Channing/Senseny should not
be the requirement of the Frederick County Public Schools. The notation should be
revised to state: "Until such time as a traffic signal is installed at the intersection of
Channing Drive and Senseny Road, the portion of Channing Drive between the
intersection of Channing Drive and Farmington Boulevard, and Channing Drive and
Senseny Road will not be part of the State secondary system and, therefore, will be
barricaded and closed to public travel. Frederick County Public Schools may not utilize
this roadway for ingress/egress until the signal is installed at the intersection of
Channing Drive and Senseny Road".
4. Adjoining Properties. The 132 property is referenced on the coversheet but is shown as
an adjoining property on sheet 3. This property needs to be a part of this MDP.
5. Existing Lots. All existing lots should be delineated on sheet 4.
6. Phase 2. Provide more labeling as indicated on sheet 4 for the phasing and label the B2
as phase 2 on the coversheet.
7. Notes. On sheet 4, provide a note that states the sidewalks and curb and gutter along
Woodrow Road and Lynnehaven Drive will be revised to remove all residential
driveways along the school property.

I have a meeting with Mark Cheran tomorrow at 10:30 AM which should take about 20-30
minutes and was wondering if we could get together following that to go through the
Proffer Statement and MDP for the school project. I met with Pat Taylor, Al Orndorff
and Steve Kapocsi on Friday and they cannot agree to the narrative that VDOT
proposed. Eric had offered a compromise that moved us in the right direction. It would
be helpful if Eric could join us so we can finalize the traffic signal narrative for the MDP. I
would also be available in the afternoon or on Thursday if you have a conflict tomorrow
morning.

As part of the requirements for VDOT's support of the approval of this MDP will be the
installation of a traffic signal at the intersection of Senseny Road and Channing Drive.
FCPS will be responsible for the providing a design meeting VDOT approval as well as
the installation of the signal prior to the opening of the proposed school. The design,
as well as the signal equipment, should include features to allow for the future extension
of Channing Drive to the south of Senseny Road. FCPS will also be responsible for any
turn lane improvements required. A warrant study will not be required prior to the
installation.

Hi Lloyd,
I am trying to get everything wrapped up on the MDP revisions for the new elementary school site and
need to craft a narrative for the traffic signal at Senseny/Channing, which was discussed during the TRC
meeting. Please give me your thoughts on the following language:
Traffic Signalization Narrative - Senseny Road/Channing Drive Intersection
Frederick County Public Schools will enter into a traffic signalization agreement with
VDOT that will fully fund new traffic signalization at the intersection of Senseny Road and
Channing Drive. Frederick County Public Schools (FCPS) will coordinate a schedule for
the engineering and installation of the traffic signalization at Senseny Road and Channing
Drive that is mutually agreeable with FCPS and VDOT.
I am meeting with the School Superintendent tomorrow at 2:00 PM to go through various matters on the
project; therefore, it would be extremely helpful if you could give me any initial feedback before then.

REVIEW EVALUATIONS:
Virginia Department of Transportation: The revised MDP received February 7, 2008 is acceptable to
VDOT.
Frederick County Fire Marshal: Plans approved as submitted.
Frederick County Public Works: Upon review of the revised MDP plan dated January 31, 2008, we
offer no comments at this time. Therefore, we recommend approval of the subject MDP. A
comprehensive review will occur at the time of site plan submission.
Frederick County Inspections Department: No additional comments at this time. Will comment on
site plan. __
Frederick County Sanitation Authority: No comment. There should be sufficient water and sewer
capacity to serve this site.
GIS Department: No additional road names are required at this time. Structure numbering will be
assigned during the permit and construction phase of development.
Parks, & Recreation: The new calculation provided for the proposed open space appears to meet
county requirements. Every effort should be made to create bicycle trails to improve non vehicular
access to the school site and throughout the development. Relative to the Parks and Recreation
amenities, please detail all changes or alterations included in the revised Master Development Plan.
These changes and/or alterations need to be presented in a summary, specifically addressing Parks and
Recreation amenities, clearly illustrating how the revisions are different from what was approved in the
Master Development Plan.
Winchester Regional Airport: The Master Development Plan was reviewed and it appears that the
proposed plan will not impede operations at the Winchester Regional Airport. This proposed site does
lie within airspace of the Winchester Regional Airport which could result in noise from over flights of
aircraft departing to and from the northeast.
Frederick County Public Schools: Frederick County Public Schools asks that Frederick County
approve the addition of a public use to the Lynnehaven Master Development Plan. This approval will
enable us to work towards opening a much needed elementary school in the Lynnehaven development.
This new school will help FCPS manage elementary student population growth and the reduction in
elementary school program capacity resulting from implementation of full -day kindergarten. We think
that this elementary school as proposed is properly located within its community and will be an asset to
its community and Frederick County. The school will be located at the intersection of two collector
streets within a densely developed and developing area. Many children will live within '/a mile of the
school and will be able to walk or bicycle to school. Placing this school within Lynnehaven will result
in general in a system -wide reduction in the distance elementary school children have to travel to school
and in specific in a reduction in the distance Lynnehaven, Sovereign Village, Fieldstone, Apple Ridge,
Senseny Glen, Twin Lakes, Glenmont Village, Lockhart and Burning Knolls children have to travel to

school. The school will offer recreational opportunities to the community. There will be an area
designated for use by the Parks and Recreation Department in the school. This area will contain an
activity room, a demo lab and an all-purpose room. Community members will be able to use the paved
fire access lane around the school as a walking and jogging loop. Community members will also be able
to schedule activities and events on the ballfields at the school.
Planning & Zoning:
A) Master Development Plan Requirement
A master development plan is required prior to development of this property. Before a master
development plan can be approved, it must be reviewed by the Planning Commission, Board of
Supervisors and all relevant review agencies. Approval may only be granted if the master
development plan conforms to all requirements of the Frederick County Zoning and Subdivision
Ordinances. The purpose of the master development plan is to promote orderly and planned
development of property. within Frederick County that suits the characteristics of the land, is
harmonious with adjoining property and is in the best interest of the general public.
B) Location
The subject properties adjoin Senseny Road to the north and Channing Drive to the west,
approximately 3,000 feet east of Greenwood Road.
C) Site History
The original Frederick County Zoning Map (U.S.G.S. Stephenson Quadrangle) identified the
zoning for the acreage within the master development plan as A-2 (Agricultural General)
District. This zoning classification was modified to RA (Rural Areas) District on February 14,
1990 during the comprehensive amendment to the county's Zoning Ordinance.
The Board of Supervisors approved Rezoning Application #15-99 for Channing Drive on
December 8, 1999. This action established 354.3 acres of land zoned RP (Residential
Performance) District, and 22.0 acres of land zoned B2 (Business General) District. This
property was originally Master Planned with MDP #08-2000 which was for the entire Channing
Land Bay. The Board of Supervisors also approved Rezoning #04-04 for the Bean Property on
May 12, 2004 which rezoned five acres from the RA District to the RP District with proffers.
The original MDP for the Charming Drive project included the developments now known as
Lynnhaven, Twin Lakes, and Sovereign Village. Separate master development plans for the
revised Twin Lakes and Sovereign Village developments have already been approved.
Staff Note: On March 23, 2004 the Frederick County Board of Supervisors adopted a
resolution which gave the individual property owners of the Channing Drive Rezoning the
ability to submit revised master development plan applications independent of one another.

D) Site Suitability & Project Scope
Comprehensive Policy Plan:
The Frederick County Comprehensive Policy Plan is an official public document that serves as
the community's guide -for making decisions regarding development, preservation, public
facilities and other key components of community life. The primary goal of this plan is to
protect and improve the living environment within Frederick County. It is in essence a
composition of policies used to plan for the future physical development of Frederick County.

Land Use Compatibility:
The parcels comprising this MDP application are located within the County's Urban
Development Area (UDA) and Sewer and Water Service Area (SWSA). The Urban
Development Area defines the general area in which more intensive forms of residential
development will occur. In addition, the Eastern Frederick County Long Range Land Use map
designates the general area in which the Lynnehaven Development is located for residential land
uses. The residential portion of the Lynnehaven project will develop with a density of 2 units per
acre which has decreased from 2.5 units per acre as shown on the original Channing Drive MDP.
The revised Lynnehaven Master Development Plan will consist of 135 residential lots, 10 acres
of commercially zoned land and 15.2 acres of land for public use which will be utilized for a new
elementary school. It is noted that the most significant change presented with this revised
Master Development Plan is the addition of the school site.
Transportation
Primary access into the Lynnehaven Development will be via Channing Drive. Currently this
roadway is not completed and is not within the state's secondary road system. It is noted that the
portion of Charming Drive between Senseny Road and Farmington Boulevard will not be
accepted by VDOT until the traffic signal at the intersection of Senseny Road and Channing
Drive has been installed. This revised MDP has a note that states that Charming Drive between
Senseny Road and Farmington Boulevard will be barricaded and closed to the public until a
signal is provided. The signal at this intersection was proffered with Rezoning #15-99 and will
be installed with the first commercial development within the project.
The internal roads as shown on this revised MDP reflect the network that has been approved with
the phased subdivision design plans for the development.
Pro ers
The majority of the Lynnehaven Development proffers fall under Rezoning #15-99 (Channing
Drive), which are attached. The public use portion of the site which will be developed for the
proposed 121h Elementary School will fall under the pending Rezoning #01-08 for the Frederick
County School Board.

STAFF CONCLUSIONS FOR THE 03/05/08 PLANNING COMMISSION MEETING:
The master development plan for Lynnehaven depicts appropriate land uses and appears to be consistent
with the requirements of Article XVII, Master Development Plan, of the Zoning Ordinance. The
preliminary master development plan is also in accordance with the proffers for Rezoning #15-99 and
pending rezoning 401-08 for the 12th Elementary. School. All of the issues brought forth by the Planning
Commission should be appropriately addressed prior to a recommendation to the Board of Supervisors.
Following the Planning Commission discussion, it would be appropriate to forward a
recommendation to the Board of Supervisors regarding this MVP conformance with County codes
and review agency comments. All issues and concerns raised by the Planning Commission will be
forwarded to the Board of Supervisors for their consideration. Staff is ultimately seeking
administrative approval authority of the Master Development Plan.

Response: The ownership of the properties has been revised on Sheet 1,

the MDP, and is provided on Sheets 1 and 4.

Response: The transportation narrative has been revised to reflect the VDOT
comment received on February 6, 2008, This revised narrative is provided on

4. Comment.- Adjoining Properties
Response: The B2 property referenced on the coversheet has been included in the
MDP on Sheet 3 and has been eliminated as an adjoining property on the map and
table associated with this plan sheet.
S. Comment: Existing Lots
Response: All existing lots have been delineated on Sheet 4.
6. Comment: Phase 2
Response: Additional labeling for the phasing has been provided on Sheet 4,
which identifies the Phase 1 and Phase 2 areas associated with all of the

7. Comment. Notes
Response: A note has been provided on Sheet 4 to state that all sidewalks and
curb .and gutter will be revised along Woodrow Road and Lynnehaven Drive
through the removal of all existing residential driveway cuts along these streets.
8. Comment: School Site
Response: The property ownership for ,parcel 55-A-206B has been revised on
Sheets 1 and 4. Additionally, Sheet 4 has been revised to identify this parcel as
public use only.
9, Comment: Sidewalk/Trail
Response: The County School Administration has discussed the comment
pertaining to a sidewalk or trail along the Charming Drive frontage and is
considering a 5-foot sidewalk improvement at this time. The implementation of a
5-foot sidewalk along approximately 1,200 linear feet of frontage will require
installation on the school site side of the existing ditch section; therefore, this will
entail grading work to place the sidewalk in a 2:1 slope fill section, constructing a
retaining wall that is estimated to be between 3-4 feet in height with safety
fencing along the entire frontage and the potential revision of the stormwater
management facility at the Channing Drive and Woodrow Road intersection.
This improvement represents an additional cost to the project; therefore, the
County School Administration has requested a cost estimate for this improvement
to enable theirs to discuss this matter with the Board of Supervisors before this
comment can be formally committed to on the Master Development Plan.
10. Comment: Future Entrance
Response: The future commercial entrance shown on Sheet 4 for Sovereign
Village has been removed as requested.

Thank you for providing me with the opportunity to review the preliminary master development
plan for the proposed development referred to as Lynnehaven. Staff s review comments are
listed below for your consideration.
1. Owners Blocks. Clarify on the coversheet of the MDP which party owns each property.
2. Property Ownership. The MDP shows that there are two parties with ownership in the
development. The commercial portion of the property is not owned by Taylor -Grace, it is
owned by Lynnehaven, LC, and they need to be included in the MDP.
3. Transportation Narrative. The traffic signalization for Channing/Senseny should not
be the requirement of the Frederick County Public Schools. The notation should be
revised to state: "Until such time as a traffic signal is installed at the intersection of
Channing Drive and Senseny Road the portion of Channing Drive between the
intersection of Channing Drive and Farmington Boulevard, and Channing Drive and
Senseny Road will not be part of the State secondary system and, therefore, will be
barricaded and closed to public travel. Frederick County Public Schools may not utilize
this roadway for ingress/egress until the signal is installed at the intersection of
Channing Drive and Senseny Road".
4. Adjoining Properties. The B2 property is referenced on the coversheet but is shown as
an adjoining property on sheet 3. This property needs to be a part of this N1 DP.
5. Existing Lots. All existing lots should be delineated on sheet 4.
6. Phase 2. Provide more labeling as indicated on sheet 4 for the phasing and label the 132
as phase 2 on the coversheet.
7. Notes. On sheet 4, provide a note that states the sidewalks and curb and gutter along
Woodrow Road and Lynnehaven Drive will be revised to remove all residential
driveways along the school property.

Dear Evan,
Frederick County Public Schools asks that Frederick County approve the addition of a public use to the
Lynnehaven Master Development Plan. This approval will enable us to work towards opening it much -
needed elementary school in the Lynnehaven development. This new school will help FCPS manage
elementary student population growth and the reduction in elementary school program capacity resulting
from implementation of full -day kindergarten.
We think that this elamantary school as proposed is properly located within its community and will be an
asset to its community and F'rc4er" County. The school will be located at the intersection of two
collector streets within a densely developed and developing area. Many children will live within '/. mile
of the school and will be able to walk or bicycle to school, Placing this school within Lynnehaven will
result in general in a system -wide reduction in the distance elementwy school children have to travel to
school and in specific in a reduction in the distance Lynnchaven, Sovereign Village, Fieldstone, Apple
Ridge, Senseny Glen, Twin Lakes, Glenmont Village, Lockhart, and Burning Knolls children have to
travel to school.
The school will offer recreational opportunities to the community. There will be an area designated for
use by the Parks and Recreation Deparunent in the school. This area will contain an activity room, a
demo lab, and an all-purpose room. Community members will be able to use the paved fire access land
around the school as a walking and jogging loop, Community members will also be able to schedule
activities and events on the balifields at the school.

hereinafter called the Grantor, and COUNTY SCHOOL BOARD OF FREDERICK
COUNTY, VIRGINIA, party of the second part, hereinafter called the Grantee.
WITNESSETH: That for and in consideration of the sum of Ten ($10.00) Dollars,
cash in hand paid, and other good and valuable consideration, the receipt of which is hereby
acknowledged, the Grantor does hereby grant and convey with general warranty and English
Covenants of title unto the Grantees, in fee simple absolute, as tenants by the entirety with
common law right of survivorship, all of the following described tract or parcel of land:
All that certain tract or parcel of land, together with all improvements
thereon and appurtenances thereunto belonging, lying and being situate in
Red Bud Magisterial District, Frederick County, Virginia, containing
15.2426 acres, and being designated as "NEW TM 55-A-206B" as shown
on that certain "Final Consolidation and Subdivision Plat of the Land of
Taylor -Grace, LLC" dated September 25, 2007 drawn by Greenway
Engineering, Inc., which plat is attached hereto and by this reference made
a part hereof.
AND BEING a portion of the property conveyed to QR Development,
LLC, a Virginia limited liability company, by Deed dated March 29, 2005,
of record in the Clerk's Office of the Circuit Court of Frederick County,
Virginia, as Instrument No. 05-0007270 (as to Tax Map No. 55-(A)-206)
and a portion of the property conveyed to QR Development, LLC, a
Virginia limited liability company, from Helen R. Bean and Dwayne M.
Bean, Co -Trustees of the Helen R. Bean Trust, under Agreement dated July
21, 2001, by Deed dated March 26, 2004, of record in the aforesaid Clerk's
Office as Instrument No. 04-0005596 (as to Tax Map No. 55-A-208).
QR Development, LLC, a Virginia limited liability company, was merged
into Taylor -Grace, LLC, a Virginia limited liability company, on March 29,
2007 by Certificate of Merger issued by the Virginia State Corporation
Commission and title to the aforesaid property was merged into Taylor -
Grace, LLC, pursuant to § 13.1-1073(2), Code of Virginia, as amended.
