Dear Mr. Prelip:
I met with Mr. Charles DeHaven, Jr., on November 27, 2001 to review information pertaining to the
referenced site improvements for your project. The landscape plan addendum proposed by Mr.
DeHaven, Jr., is acceptable to our department and should be incorporated to meet the residential
separation buffer requirements for this project.
The primary addendum to the approved Subdivision and Site Development Plan includes the use of
existing mature vegetation along the northern property line, the use of different evergreen and
deciduous plant materials, and the relocation ofthe board -on -board fence to be placed approximately
fifteen (15) feet from the northern property line. Please find attached a color copy of the revisions
to Sheet 7 of 11 of the approved Subdivision and Site Development Plan for your records. Our
department will incorporate this addendum into the project file for a matter of public record.

Dear Tim:
Frederick County administratively approved the referenced plan on February 15, 2000. The
approved plan for Lexington Court Urban Lot and Townhouse Complex calls for the development
of the 4.8635-acre site as one phase consisting of three (3) single family detached urban lots and
twenty-six (26) townhouse units. The subject development will be accessible from Fairfax Pike via
Lexington Court, a cul-de-sac comprised of a 50-foot wide right-of-way . The approved plan calls
for the dedication of a 12-foot right-of-way for the future widening of Fairfax Pike, a tot lot
playground and common open space that will be accessible to residents of the entire development,
and perimeter single family separation buffers.
Please find enclosed three (3) copies of the approved master development plan with appropriate
signatures for distribution to all relevant parties. Please do not hesitate to contact me if you have any

I have completed my review of the revised copy of the referenced master development plan, which was
submitted to this department on October 15, 1999. The following comments are offered and should be
incorporated onto the plan through further revision:
1) Please provide a residential separation buffer adjacent to the north property boundary of the Axline
parcel (PIN 86-5-C) as required by Section 165-37A of the Zoning Ordinance. Such a feature
involves the provision of a distance buffer of 100 feet (75' inactive/25' active) as well as a full screen
(opaque element required). Please identify the components of this buffer area on the plan in a manner .
similar to that used to delineate the residential separation buffer located adjacent to the north boundary
of the subject parcel.
2) Please show the footprint ofthe existing dwelling located on the southernmost proposed urban lot. The
distance of the dwelling from the proposed right-of-way should be delineated on the plan. It has been
determined that the location of the Lexington Court right-of-way will result in an encroachment that
may appropriately be deemed a legal non -conformity. Therefore, a variance through the Board of
Zoning Appeals (BZA) would not be necessary should this MDP be approved.
Please revise your plan to reflect the comments specified in this letter. The approval of this master development
plan requires Planning Commission and Board of Supervisor action; therefore, you will need to obtain review
agency comments from VDOT, FCSA, the County Engineer, and the Fire Marshal. Once you have received
these comments, please submit them with 40 copies of the master development plan to our department and we
will place you on the next available Planning Commission agenda.

/4) It is important to note that the size of the subject parcel identified in County real estate
records is 5.12 acres, which does not correspond with the acreage stated on the plan. If the
provided parcel size was derived from a recent survey of the site, a copy of the recorded plat
should be submitted to ensure that County records include accurate property information.
In the Notes section of the plan, please ensure that the PIN for the subject parcel is stated
correctly (86-5-B) in note # 1. Furthermore, the text of note #3 should be modified to include
the word "survey" between the words "field" and "done." Please note also the duplicate use
of the word "land" in the name of the referenced survey firm.

•/5) Please state the zoning district applicable to the adjacent lots located within the Georgetown
Court and Village at Sherando subdivisions. Furthermore, the type of residential use
established on the adjoining parcels in the Village at Sherando, as well as on the Axline
property (PIN 86-5-C), must be identified on the plan. Research of County records indicate
an improvement value for the Shiflett parcel (PIN 86-5-E), which suggests that the property
is not vacant in nature. Please ensure that the appropriate use associated with this parcel is
noted on the plan.
/6) Please clarify the text indicating areas of open space to include the term common.
7) Please provide a residential separation buffer adjacent to the north property boundary of the
Axline parcel (PIN 86-5-C) as required by Section 165-37A of the Zoning Ordinance. Such
a feature involves the provision of a distance buffer of 100 feet (75' inactive/25' active) as well
as a full screen. Furthermore, please modify the layout of the proposed landscaping within
the full screen component of the residential separation buffer located adjacent to the north
boundary of the subject parcel. Specifically, to ensure that a year-round natural screen is
provided, it is recommended that the proposed evergreen plantings be relocated to extend
along the length of the landscaped easement. The present clustering of such vegetation at the
extreme ends of the easement will result in a significant gap in the landscape screen during
seasonal periods of deciduous foliage loss. Additionally, it may be advisable to increase the
width of the landscaped easement and provide a point of access at either end of the fence to
facilitate maintenance of the proposed landscaping.
/8) Please provide a table outlining the dimensional requirements applicable to each proposed
housing type.
9) It is noted that the existing dwelling shown on the southernmost urban lot will encroach
within the required front setback yard. Prior to Planning Commission consideration of this
plan, the subject encroachment must be addressed either through modification or removal of
the dwelling or attainment of a variance from the Board of Zoning Appeals (BZA). Such
resolution is necessary to ensure that subsequent legislative action would not result in the
creation of a non -conformity with regard to applicable dimensional standards.
10) Please clarify the total number of units associated with the proposed urban lots. Specifically,
the provided information should be changed from "3 EA." to either "3" or "3 (1 unit per lot)."
11) Please delineate the location and arrangement of electric and gas utilities intended to serve
the proposed development. Furthermore, a note must be added to the plan confirming the
underground placement of all utilities on the site.

12) Due to the classification of Route 277 as a minor arterial road, a road efficiency buffer is
required between the right-of-way and the residential development. However, it is
acknowledged that the location of the existing dwelling precludes conformance with the
distance standard associated with either the full or reduced buffer. To facilitate compliance
with the intent of this requirement, a permanent landscaped easement must be provided to
mitigate the noise and visual impacts associated with traffic on Route 277.
13) Please provide the location and description of the area that is to be dedicated right-of-way for
the Route 277 improvement project.
14) Please identify the name proposed for the planned street shown on the plan. Verification of
road name approval must also be provided.
15) Please delineate the location of the sidewalks required to serve the proposed urban lots. Such
walkways must be provided in accordance with the requirements of Section 144-18 of the
Frederick County Subdivision Ordinance. Furthermore, the location of all proposed street
lights should be identified on the plan.
Please revise your plan to reflect the comments specified in this letter. The approval of this master
development plan requires Planning Commission and Board of Supervisor action; therefore, you will
need to obtain review agency comments from VDOT, FCSA, the County Engineer, and the Fire

recreational unit requirements.
County Engineer: Upon review of the subject master plan, we offer no comments at this
time. We will offer all comments at the subdivision plan submittal. Therefore, we
recommend approval of the subject master plan.
Planning Department:
Site History:
The original Zoning Map for Frederick County depicts the parcel as R-1, Residential Limited
District (U. S. G. S. Stephens City Quadrangle). The zoning classification for these properties
was amended on September 28, 1983 when the RP (Residential Performance) District
replaced the R-1, R-2, R-3, and R-6 Districts.
Project Scope:
The applicant proposes to develop a 4.8635-acre parcel with three (3) single family detached
urban lots and twenty-six (26) townhouse units, which will involve minimum lot sizes of
12,000 square feet and 2,000 square feet, respectively. This creates an overall gross density
of 5.96 units per acre, which is below the permitted density of ten (10) units per acre.
The twenty-nine (29) lots proposed through this master development plan will be developed
as one phase with each lot having curb, gutter, and sidewalks. The applicant has set aside
32%, or 1.3640 acres.for common open space, which exceeds the minimum required by
ordinance. Furthermore, the recreational unit requirement for a development of this scale will
be addressed through the provision of a tot lot. The applicant has indicated that residents of
the single-family lots would be permitted access and use of the common open space and
recreational amenities provided with the development.
Issues:
1) Transportation:
The widening of Route 277 is ranked as the second -highest priority on the list of
major road improvement projects included in the 1999 Primary Road Improvement
Plan for Frederick County. The subject parcel is located on the segment of Route 277
that will be improved as Phase I of the project. The applicant has provided a 12-foot
dedicated strip of land intended to accommodate the right-of-way requirements ofthis

project. Staff has been advised by Mr. Steve Melnikoffof VDOT that such dedicated
area adequately ;satisfies the project's right-of-way needs along the frontage of the
development.
2) Non -Conforming Structure:
The southernmost urban lot proposed through this master development plan will
contain the single-family dwelling that currently exists on the parcel. The applicant
has indicated that this dwelling will remain upon development of the remainder of the
parcel. It is important to note that this dwelling will encroach within the required
front yard setback area of the proposed lot as a result of the location of the Lexington
Court right-of-way. In essence, approval of this master development plan will
facilitate the creation of a non -conforming structure. Staff has determined that the
origination of an encroachment in such a manner may appropriately be considered a
legal non -conformity, thereby precluding the need to alter or remove the existing
dwelling.
3) Road Efficiency Buffer:
Fairfax Pike (Route 277) is identified as a minor arterial road in the Comprehensive
Policy Plan. The Zoning Ordinance requires the development of a full or reduced
road efficiency buffer between arterial roads and residential land uses. The proposed
lot subject to this requirement will contain the aforementioned existing dwelling,
which will be located 52' from the dedicated right-of-way of Route 277. Such
separation would not satisfy the setback distance associated with either a full or
reduced road efficiency buffer. However, as the existing dwelling was developed on
the parcel prior to the adoption of this development standard, staff has determined
that its full implementation may be inappropriate in this case. The applicant has agreed
to provide the landscaping that would otherwise have been required via "the road
efficiency buffer within the common open space area of the development. The
location and nature of such landscaping must be delineated on the final master
development plan.
STAFF CONCLUSIONS FOR 12/15/99 PLANNING COMMISSION MEETING:
Although approval of the proposed master development plan will result in the aforementioned non-
conformity, it is otherwise consistent with the requirements of the Zoning Ordinance. Approval of
this plan should be contingent upon the applicant's ability to adequately address all comments or
concerns of the Planning Commission and the Board of Supervisors, as well as the technical
comments of all review agencies.

PLANNING COMMISSION SUMMARY & ACTION FOR 12/15/99 MEETING: The
applicant believed that placing the road efficiency buffer in front of the existing dwelling would
detract from its appearance and the subsequent development. Members of the Commission inquired
why Hammer Court was not extended all the way through to Route 277. The applicant responded
that VDOT preferred not to extend Hammer Court because it could result in the creation of a
thoroughfare. Members of the Commission noted that a state -maintained road was not possible
through this area anyway, because of the parking areas coming out onto the street.
There were no public comments.
The Planning Commission unanimously approved the Lexington Court Master Development Plan
contingent on the applicant adequately addressing all review agency comments.

A VDOT review has been completed on the preliminary site plan dated July 7, 1999 for the
referenced project. Our comments are as follows and as shown on the enclosed plan sheets:
Plan Sheet 3 of 11
1. The traffic volume on the VDOT facility (Route 227, Fairfax Pike) should be shown on the
plan. This is Item 7 on the Entrance Permit Plan Check List. I've enclosed a blank copy for
your information and use.
2. The designation for CG-11 entrance should be used on Route 277 and at parking lot entry
to the proposed street.
3. The CG-12 notation should be provided.
4. The proposed 8" water main crossing of Route 277 should be installed by jack/bore method.
A note should be used to show this on the plan sheet.
5. Site generated traffic should be provided on the plan.
6. Additional VDOT detail sketches should be shown on the plan: CG-6; CG-11; and CG-12.
When all the above comments have been addressed please provide one set of revised plans for
VDOT review. If there are any questions, please feel free to call.

Board of Supervisors meetings. For the purpose of this application, adjoining property is any
property abutting the requested property on the side or rear or any property directly
