Parks & Recreation: *NOTE* For final approval, the Planning
staff has requested that the Department of Parks and
Recreation review the proposed recreational facility to
determine if it is equivalent to two recreational areas.
Planning & zoning: Originally, a master development plan was
approved for 23 townhouse units on a 3.4113 acre site (6.74
units per acre) and a day care center on an adjoining 0.75
acre site. The applicant then revised this master development
plan to change the permitted housing type to garden
apartments. This plan called for 28 garden apartment units on
the same 3.4113 acre site (8.21 units per acre), and
maintained the 0.75 acre day care site. The Planning
Commission recommended approval of this revised master
development plan on April 20, 1994.
The applicant has revised this master plan once again to
increase the number of garden apartment units to 36. In order
to meet the overall gross density requirements, the applicant
has eliminated the proposed day care facility and plans to
combine the two tracts. Once this is accomplished, the
proposed master development plan will contain 36 apartment
units on 4.1613 acres. This creates an overall gross density
of 8.65 units per acre. This revision increases the density;
however, the allowable gross density for this site is 10 units
per acre.
The only comments that differ from the April 20, 1994 master
development plan presentation, pertain to recreational areas
and planning requirements. The Zoning Ordinance requires one
recreational area for thirty multi -family units. The number
of multi -family units has increased from 28 to 36; therefore,
the equivalence of two recreational areas needs to be
provided. Staff will ask the Department of Parks and
Recreation to work with the applicant and determine the
appropriate type of recreational amenities.
The proposed master development plan provides for a future
walkway that will be developed if a school is constructed on
the adjoining property. Staff believes that a walkway should
be provide along the entire western side of the parking lot
that will provide access to this future walkway connection.
Staff also believes that the applicant should consolidate the
two parcels .prior to final administrative approval of this
master development plan. This will ensure that the overall
gross density requirements are met.
STAFF RECOMMENDATIONS FOR 5118/94 PC MTG.: Approval, once the
applicant has adequately addressed all previous review agency
comments, and new staff comments, and all comments and concerns of
the Planning Commission and Board of Supervisors.

PLANNING COMMISSION ACTION SUMMARY OF' 5118194: The Planning
Commission expressed concern regarding the ability of Fire and
Rescue to access the proposed apartment buildings. The applicant
ensured the Commission that the final master plan and the final
site plan will provide a fire lane that will allow access from the
proposed parking lot to each apartment building. This fire lane
will have to be approved by Fire and Rescue.
The Planning Commission also asked that the applicant address all
staff concerns related to this development. This includes the
provision of recreational amenities that are equivalent to two
recreational areas, and the extension of pedestrian walkways along
the perimeter of the parking lot on the western side.
PLANNING COMMISSION RECOMMENDATION OF 5118194: Unanimous approval
with the stipulation that all staff, review agency, and Planning
Commission comments are adequately addressed. (Absent-B. Wilson and

hydrants within 300, of multi -dwelling structures. The hydrants
shown are at 300' from the front of the 12 unit condo. Also
distance from the traffic lane to the rear of the 12 unit condo
exceeds the length of preconnected hose lines. This will slow
and hamper firefighting efforts in case of fire 2) Burning of
construction debris on site is prohibited in Frederick County.

plan, we understand that Mr. Satian plans to construct three (3)
multi -family apartment complexes on the site previously approved for
townhouses. Development of this approximate four (4) acre site will
require the standard erosion and sediment control plan as well as an
on site stormwater management facility. These items will be reviewed
in detail at the time of site plan submittal if the revised-master
development plan is approved.

As requested we have reviewed the above referenced project's site plan dated
July 27, 1994. Our comments may be found on the enclosed plans marked in red and as
follows:
l . A half typical section with proposed pavement design will need to be added to the
plan.
2. The entrance radii should be increased to IS' and standard CG-12 handicap ramps
provided.
3. Caution should be taken when planting the evergreen buffer along Route 642 so not
to block sight distance from Route 1070. Review of the location prior to planting will
be required by the Department.
4. Other miscellaneous comments will need to be added to the plan as noted.
Please revise and resubmit three (3) copies for final approval. Should any changes be
deemed necessary, please design them to meet or exceed the above recommendations.

Dear Tom:
Based on our review of the proposed revised master development
plan, we understand that Mr. Satian plans to construct three (3)
multi -family apartment complexes on the site previously approved for
townhouses. Development of this approximate four (4) acre site will
require the standard erosion and sediment control plan as well as an
on site stormwater management facility. These items will be reviewed
in detail at the time of site plan submittal if the revised master
development plan is approved.
Based on the visual impact of the three (3) story condos on the
single family dwellings fronting Lakeside Drive, we suggest that
strong consideration be given to a dense screening along the south
side of the project.

I have had an opportunity to review the above referenced site plan. The final master development plan should be revised to reflect the
following comments:
GENERAL COMMENTS:
1) Please provide a signature on the Registered Professional Engineer Certificate.
2) Please revise the Tax ID Number to read 75B-A-80C.
3) Please revise the scale on the Vicinity Map to read 1" = 24,000'.
4) Please change the word "Condo" to read Garden Apartments wherever it appears on this plan. This will keep the primary use
consistent with the language in the Zoning Ordinance
5) Please revise the Total Number of Garden Apartments allowed to read 34.
6) Please revise the Proposed Site Impervious Ratio to be consistent with the information provided under the Housing Schedule.
7) Please provide a note under Project Summary that states that all units will be 2 bedrooms.
8) Please provide a phase schedule for the Day Care Facility tract and the Garden Apartment tract.
SUGGESTIONS:
1) The Frederick County School Board may construct a public school on the adjoining tract in the future. It would be beneficial
to establish a future walkway to the property boundary line to provide future access to the site.
2) The location of the tot lot area is similar to the existing garden apartment project. This location has caused problems, as the
residents on the bottom floor have children playing outside of their window. It would be better to relocate this area to the
southwest portion of this site. Also, the recreational equipment could be better served and require less room if it was developed
similar to that in Franklin Mobile Home Park.
I have provided you with a copy of the plan that I reviewed. Hopefully, this plan and the comments in this letter will be beneficial to your

Planning & Zoning: The revised master development plan calls
for the construction of 28 apartment units on 3.4113 acres.
This creates an overall gross density of 8.21 units per acre.
The original master development plan was approved for 23
townhouse units, or 6.74 units per acre. This revision
increases the density; however, the allowable gross density
for this site is 10 units per acre.
The revised master development plan depicts two parcels.
These parcels will contain the proposed garden apartments and
a future day care center. The proposed entrance off of
Chinkapin Drive meets the minimum driveway spacing
requirements. Care should be taken to ensure that the
proposed entrance is aligned with the existing entrance that
serves the townhomes on the north side of Chinkapin Drive.
The preliminary master development plan indicates that a road
efficiency buffer will be created along Macedonia Church Road
(Route 642). The proposed road efficiency buffer meets the
intent and requirements of the Zoning Ordinance. The
adjoining property to the south (currently owned by the
Frederick County School Board) is vacant; therefore, a
residential separation buffer is not required. Staff has
suggested that the applicant provide for a future pedestrian
walkway to the school property. This will provide future
access if a public school is constructed on the adjoining
parcel. Staff has also suggested that the recreational
amenities be relocated to the southwestern portion of this
site. The placement of recreational amenities between and
near apartment buildings has created a conflict with residents
who occupy the bottom level in other projects.
Comments made by the County Engineer and the Fire Marshal
should be discussed with the applicant. These comments
pertain to fire protection and access for the proposed 12 unit
apartment building and storm water management, as both of the
8 unit apartment buildings are located in the existing
drainage swale.
STAFF RECOMMENDATIONS FOR 4120194 PC MTG.: Approval, once the
applicant has adequately addressed all review agency comments, and
all comments or concerns of the Planning Commission and Board of
Supervisors.

Action - Recommend Approval
Mr. Charles Maddox, Jr., with G.W. Clifford & Associates,
the Project Engineers, was representing this MDP. Mr. Maddox said
that the revised MDP calls for the construction of 28 apartment
units on 3.4113 acres. He said that this -,creates an overall gross
density of 8.21 units per acre. It was noted that the original MDP
was approved for 23 townhouse units, or 6.74 units per acre. This
revision increases the density; however, the allowable gross
density for this site is 10 units per acre.
The Commissioners were concerned about the adequacy of
the entrance to Lakeside at Chinkapin, especially as development
increases. Elevations of living areas and parking lots were
discussed in relation to the 100 year storm. The Commissioners
also discussed the buffer between Rt. 642 and the proposed units.
They felt a birm with trees would act as a noise barrier and would
also keep children away from the highway. Overall they felt the
concept was good, provided all review agency comments were
addressed.
Mr. Maddox said that this plan calls for two buildings
with eight units and one building with 12 units. Mr. Maddox said
that the owner has been given the opportunity to purchase the 7/10
acre that was proposed for a day care center. He said that
feasibility to construct the day care center has not come about.
Mr. Maddox said that the owner would like to purchase the 7/10
acre, consolidate the properties, and construct three structures
with 12 units as an alternate proposal.
Commissioners commented that the existing complex
established by this owner was aesthetically appealing and looked to
be well-built. They also liked the idea of consolidating the
vacant day care parcel because of the uncertainty of its future use
if it remained as a separate parcel, owned by another party.
Commissioners were concerned about the increase in density, but the
majority of members still felt the second option presented was a
good one.
Upon motion made by Mr. Morris and seconded by Mr. Shenk,
BE IT RESOLVED, That the Frederick County Planning Commission does
hereby unanimously recommend approval of MDP 0002-94 of Lake Front
Apartments for 29 apartment units within three structures on
property zoned RP (Residential Performance) and located at the
southeast corner of the intersection of Macedonia Church Road (Rt.
642) and Chinkapin Drive (Lakeside Estates).
