The following items need to be addressed:1) Again, VDOT is requesting a 25' right-of-way dedication be given to VDOT along the Route 838 property frontage; 2) a proposed 4" force main will be required to be located behind the ditch line; 3) the bore under Route 11 at Route 837 will need to be performed at a 90 degree angle; 4) increase the radii at the road intersection that ties into Hayes Meadow Circle to a minimum of 3 5 ; 5) move utilities out from under the road prism; 6) any plantings within the VDOT roadway will need to be performed under a VDOT Planting Agreement between the Developer/Homeowher's Association and VDOT; 7) sidewalk dimensions within the VDOT right-of-way are now 5' in width; 8) CG-12-A's will be required at all intersections within the VDOT right-of-way; 9) the plan sheet depicts a sidewalk running parallel with Route 11, but passing downstream of the wingwalls ofthe existing box culvert. Is there some type of pedestrian bridge anticipated in being built there?;10) under the Traffic Impact Analysis, I believe this is a typo, as you show a traffic count between 4:00 a.m. and 6:00 a.m. generating approximately 50 trips per day; 11) is the entrance depicted approximately 225' north ofthe proposed new entrance to be eradicated? Fire Marshal: Plans meet the current code requirements; however, during the Site Plan process, we would propose that the proposed fire hydrant #3 be relocated to Lots 8, 22 or 41. Plan approval recommended. Sanitation Authority: No comment. Public Works: Upon review ofthe subject master plan, we offer the following comments: The proposed plan indicates that the following lots or portions thereof will be placed within the existing flood plain limits: 1, 2, 9,10,12,13,14 and 15. Consequently, it will be necessary to perform an evaluation to determine if construction within these limits will shift the flood plain limits south to the adjacent property. Additionally, it will be necessary to ensure that the proposed development will not create drainage that will impact off - site areas. Provide a copy of this evaluation at the time ofthe subdivision plan submittal. As construction ofthe proposed homes occurs, it will be necessary to address the above referenced flood plain limits. A comprehensive review ofthe stormwater drainage and overlot grading will be addressed at the time ofthe subdivision plan review. Geographic Information Systems: Hays Meadow Circle was previously approved for use in the Frederick County system. Any roadway that accesses more than three addressed structures requires a road name. Also, staff recommends that the proposed 10' linear Park Trail meet the minimum hard surface standards used by this department for trail construction. Winchester Regional Airport: The above referenced master plan has been reviewed and it appears that it should not have an impact on operations at the Winchester Regional Airport as the proposed site falls outside of the airport's Part 77 surface. However, the site does lie within the airport's airspace and residents could experience fly -over noise from aircraft arriving from and departing to the north. Frederick County Public Schools: No additional comments at this time. HRAB: See attached letter from Rebecca Ragsdale, dated September 17, 2003. Planning_& Zoning: A. Master Development Plan Requirement A master. development plan is required fqr: most subdivisions and development of property in Frederick County. Before a master development plan can be approved, it must be reviewed by the Planning Commission, Board of Supervisors and all relevant review agencies. Approval may:. . - only be granted if the master development plan conforms to all requirements of the Frederick County Zoning and Subdivision Ordinances. A master development plan is not intended to be a detailed drawing, but is rather a general schematic of a proposed development. The purpose of the master development plan is to promote orderly and plamled development of property within Frederick County that suits the characteristics of the land, is harmonious with adjoining property and is in the best interest of the general public. B) Location This property is located at the intersection of Martinsburg Pike (Route 11) and McCann Road (Route 83 8), south of the Stephenson area. The parcel consist of 10.325 acres. It is within the Stonewall Magisterial District. C) Site History The original Frederick County Zoning Map (U. S. G. S. Stephenson Quadrangle) depicts the zoning for the subj ect parcel as R-3 (Residential Limited) District. The zoning changed to RP (Residential General) District on September 28, 1983 when the Rl, R2, R3, and R6 zoning districts were reclassified. MDP #04-04, HIATT RUN ADULT COMMUNITY Page 4 May 6, 2004 D) Intended Use. The applicant intends to develop 47 single family small lot dwellings, each with 1 '/z stories, on lots between 4,000 and 6,000 square feet in area. The development is intended to be part of an age -restricted community with both a public and private roads. All streets shall have curb & gutter, sidewalks, and street signs. Extensive landscaping is proposed, including a landscape screen along the east property line which is in addition to the requirements of the Zoning Ordinance. E) Site Suitability Land Use Compatibility: The site of the proposed development is located in an area with a mixture of land uses. The dominant land use in the area is single-family residential. However, agriculture and business uses.: .';. call be found -within close proximity of the subject property. Historic Resources: 'The Study of Civil War Sites in the Shenandoah Valley, published by the National Park Service,'. 'identifies the site asb`eing part ofthe Second and Third Battles of Winchester core'battlefield area.: r r: 'Specifically, the site is part. of the area of Stephenson's Depot. The Frederick County Battlefield Network Plan encourages the strategy of working with developers and landowners to preserve key areas of historical significance. The Historic Resources Advisory Board (HRAB) reviewed the proposed application for Hiatt Run Condominiums on September 16, 2003. The HRAB had great concern over the loss of core battlefield land, and did not believe that the proposed use was compatible with the surrounding land uses. However, the HRAB understood that the parcel is zoned appropriately for the proposed development. Therefore, they recommended various measures that could be taken to reduce the potential impact the development would have on the surrounding properties and historical resources. These recommendations included: changing the builduig layoutto minimize visibility from Stephenson's Depot; reducing the height of all buildings; committing to an architectural design complementary to the area; increasing landscaping along Martinsburg Pike (Route 11); preserving the stone wall that currently exists along McCann Lane; adding a farm fence along Martinsburg Pike (Route 11); and allowing for the possibility of linking the proposed trail with a fiiture trail leading to the battlefield property to the south. Environment: Hiatt Run, a tributary to Opequon Creek, flows through the southern portion of the 10-acre parcel. There is a zoning ordiriance requirement for a riparian buffer along natural waterways in Frederick County. No development or land disturbance is permitted in a riparian buffer, other than for public 0 MDP #04-04, HIATT RUN ADULT COMMUNITY Page 5 May 6, 2004 facilities, roads, and utilities. Thus, a riparian buffer is required as part of this development. Floodplains also exist on the property and will be surveyed by the applicant prior to approval of the site plan or subdivision design plan. No disturbance of the floodway is proposed by this development. No lakes, ponds, steep slopes, or other environmental features are known to exist on the parcel. The General Soil Map ofthe Soil Survey of Frederick County, Virginia indicates that the soils comprising the subj ect parcels fall under the Frederick-Poplimento soil association, which are common soil types found immediately west of Interstate 81, and in some areas east of Interstate 81. These soils are moderately good agricultural soils. Limestone rock outcrops are the mail limitation to use of these soils for community development. Transportcition: The site has road frontage along Martinsburg Pike (Route l IN) and McCann Road (Route 83 8). , , 'Martinsburg Pike is a maj or collector road. The Frederick County Primary.Road Improvement Plan (priority 2b) depicts"this segment of Martinsburg Pike to be improved to an urban four,lane system in the future. Furthermore, the Comprehensive Policy Plan delineates Martinsburg Pike as a possible location for a future bicycle trail. McCanns Road is a local road, without plans for improvement at this time. (Comprehensive Policy Plan, page 7-9 and 7-16) Access to the 10-acre site is proposed via one new entrances off of Martinsburg Pike, a proposed public road (Hays Meadow Circle), and a private road network. The entrance off of Martinsburg Pike meets the requirements ofthe Frederick County Zoning Ordinance, and has been reviewed by VDOT. The private road network also meets the requirements ofthe Frederick County Zoning Ordinance for a small lot development, which includes the following: a minimum road width of 20 feet, a minimum of 8 inches of aggregate base material, an asphalt surface material, curb & gutter, and sidewalks. Comprehensive Policy Plan: The Frederick County Northeast Land Use Plan (NELUP) identifies the area ofthe subj ect parcel as "developmentally sensitive". The Developmentally Sensitive Areas (DSAs) were recommended along Martinsburg Pike with the aim of protecting existing residential land uses, historical features, and maintaining open space. The 10-acre site is within the County's Urban Development Area (UDA). (Comprehensive Policy Plan, page 6-33) Density: The preliminary master development plan for Hiatt Run Condominiums consists of up to 47 single- MDP #04-04, HIATT RUN ADULT COMMUNITY Page 6 May 6, 2004 family small lot dwelling Louts on 10.325 acres. This is in comparison to the previously submitted preliminary master development plan for Hiatt Run Condominiums, which proposed up to 96 garden apartments (condominiums) on 10.0 acres. Hiatt Run Adult Community, the proposed preliminary master development plan, calls for a gross density of up to 4.55 residential Louts per acre. This is less than the 5.5 residential gross density allowed by the zoning ordinance for this type of development. Furthermore, the proposed gross residential density is less than the 9.6 residential units per acre proposed with the previous submission of Hiatt Run Condominiums on December 3, 2003. The typical residential density in this area of the County is less than 1 residential unit per 3 acres. Recreational Facilities, Landscaping, Buffers, and Open Space The development intends to utilize the ornamental landscaping option of the County's landscaping ordinance. Landscaping is also required for the proposedparking areas, and as necessary for the required residential separation and road efficiency buffers. A trail is proposed in,the open space area south of Hiatt Run. This trail will link with aproposed sidewalk along Martinsburg Pike (Route 11 N), and,Will be stubbed at the southern property line ao.allow for the possibility of . connection with a future trail. The applicant has indicatedto staffthat this trail will be constructed and maintained by the property owners association:, PLANNING COMMISSION SUMMARY & ACTION OF 05/05/04 MEETING: Members of the Planning Commission were pleased the applicant had redesigned the plan and they believed the revised development was far more compatible with the surrounding area than the previous proposal. They commended the applicant and the design engineer for their efforts. A member of the Commission voiced concern that some of the lots may be impacted by the flood plain. The applicant replied that a flood survey analysis will be conducted at the subdivision design and plat phase and the flood plain boundary will need to be identified in more detail. There were no citizen comments. The Planning Commission unanimously recommended approval ofthe master development plan as presented. (Please note: Commissioners Rosenberry and Ours were absent from the meeting.) STAFF CONCLUSIONS FOR 05/12/04 BOARD OF SUPERVISORS MEETING: This preliminary master development plan proposes up to 47 single-family small lot dwellings on 10.325 acres of land, currently zoned RP (Residential Performance) District. It is a revision of the Hiatt Run Condominiums Preliminary Master Development Plan; recommended for denial by the Planning Commission during their meeting on December 3, 2003 . The proposed revision, was submitted by the 0 MDP #04-04, HIATT RUN ADULT COMMUNITY Page 7 May 6, 2004 applicant with the aim of providing an alternative type of development which would be more compatible with the surrounding area. The most significant changes associated with the revision include the reduction in density, the reduction in building height, elimination of one entrance off of Martinsburg Pike, a reduction in the number of vehicle trips per day, and the addition of a landscape screen along the eastern property line. This Master Development Plan is consistent with the requirements of Article XVII, Master Development Plan, of the Zoning Ordinance. All of the issues identified by the Board of Supervisors should be appropriately addressed by the applicant. The Planning Commission recommended that administrative approval be authorized on May 5, 2004. Historic Resources Advisory Board Concerns The vacant parcel proposed to be developed with eight condominium buildings is located within the limits of the Second Battle of Winchester and the Third Battle of Winchester (Opequon) core battlefield areas, as delineated by the National Park Service. In particular, the site proposed for development is adjacent to Stephenson Depot. Therefore, the HRAB has expressed concern for loss of core historic battlefields and believes the proposed use is incompatible with surrounding land uses. Specifically, the HRAB has concerns about loss of battlefield viewsheds, the proposed density of the development and its impacts on Stephenson's Depot. Based on the above concerns, the HRAB was- not in favor of the proposed development. However, the HRAB recognizes that the property is already zoned for residential uses and should the property develop, suggests the following be considered to mitigate impacts on historic resources: Building layout: Given the topography of the property and the adjoining battlefields, consider an alternate grouping of buildings to minimize visibility from Stephenson's Depot. Height of buildings: Consider a building height that is more compatible with surrounding land uses, such as one story instead of three. However, if the current zoning allows for such a development the plan should be modified to reflect the rural character of the surrounding area and establish a high quality standard for its development. Several planning and architeetnral-eonsiderations must be incorporated in this plan before approval: 1. Buildings should be lowered/terraced/dormered in order to give an appearance of a low scale development with heights of +/- 20 ft. above parking grades vs. 30' to 40'. 2. Buildings need to be moved to the South closer to McCann Lane due to the sloping topography where building roof elevations will be much lower - therefore helping to ,keep the view shed from Old Charles 'Town Road and the Stephenson Depot Ridge to a minimum (Buildings 6, 7, & 8 definitely need to be moved). 3. Parking needs to be clustered with stands and groups of trees in order to hide the paving vs. the continuous linear pattern now planned. One entrance should be designed to avoid double left turns along Rt.11. y 4. The key to the acceptance of this development is "What will the units look like?, how tall are they?, will they affect the preservation of the 2nd & 3rd Winchester Battlefields, Milburn historic area and helms Fort Site?" Camp, Planner II �- DATE: December 12, 2003 RE: Historical Zoning Information Property Identification Number (PIN) 44-A-17 Staff has researched the historic zoning information for the above -referenced parcel to determine why the parcel is presently zoned RP (Residential Performance) District. The findings of this research indicate that the current zoning of the subject parcel is in fact RP District; however, there is evidence which suggests that the parcel may not have been intended for this zoning designation. The following historical information was found in reference to the subject parcel: Original Zoning Map Of Frederick County Virginia. The first zoning map of Frederick County depicts the parcel as R-3 (Residential Limited) District (U.S.G.S. Stephenson Quadrangle). Zoning was first established in Frederick County on March 13, 1967. [Exhibit AJ 1980 Frederick Coun1y Comprehensive Downzoning_ Appendix C, of the 1980 Frederick County Comprehensive Downzoning, as well as the 1980 Downzoning Map itself, depict the subject parcel as part of a downzoning process which would have changed the zoning from R-3 to A-2 (Agricultural). This suggests that the parcel may not have been intended for urban use, such as condominium units. However, the official documents which were approved by the Board of Supervisors on October 8, 1980 did not include the subj ect parcel as part of the County's downzoning. The reason the subj ect parcel was not part of the official list of parcels to be downzoned in 1980 is unknown. [See Exhibit B, C, and DJ 1983 Frederick County Comprehensive Zoning Reclassification. All parcels zoned R-1,R-2,R-3, or R-6 were reclassified to the RP (Residential Performance) Zoning District on September 28, 1983. Since the subject parcel was not officially changed from the R-3 District to the A-2 District, it was added to the RP (Residential Performance) District as part of the 1983 Comprehensive Rezoning. If the parcel was intended to be changed to the A-2 District in 1980, the parcel would not have changed to the RP District in 1983, but would have changed to the RA (Rural Areas) Zoning District instead. The RA (Rural Areas) Zoning District only permits single-family detached housing types. Method of payment will be through the Frederick County Sanitation Authority as the actual costs are incurred. 4. Funds will come from unallocated surplus and estimated costs as provided by the Hospital's Consultant/Engineer will not exceed $82,000. 5. Cost recovery will be accomplished by having the Frederick County Sanitation Authority connect to the line through a meter and the City will wholesale wastewater to the Frederick County Sanitaion Authority. The Authority will then provide service to any development occurring in the County and repay the County from connector's fees that are collected due to that development. Other methods of cost recovery agreed to by the Authority may be used. 6. It is understood that connections in this proposed service area will be County customers and that this proposed service area will have impact on the County's capacity in the new Regional Wastewater Treatment Plant. JOINT PUBLIC HEARING The following Planning Commission members were present for the Joint Public Hearing: Mr. French Kirk, Col. Lynn Myers, Mr. Jim Golladay, Mr. Frank Brumback, Mrs. Marjorie Copenhaver and Mr. Manuel DeHaven. Mr. Horne stated that the Board had scheduled a public hearing with the Frederick County Planning Commission for adoption of the Residential Performance Zoning Districts on September 28, 1983, and in order to accomplish the objectives of this ordinance it was necessary to amend both the Zoning and Subdivision Ordinances. AN ORDINANCE TO AMEND THE FREDERICK COUNTY CODE, CHAPTER 21, ZONING, TO AMEND ARTICLE I, SECTION 21-1; DELETE ARTICLES V, VI, VII AND X: AMEND ARTICLE XVIII, SECTION 21-145: AND REPLACE ARTICLES V AND VI WITH RESIDENTIAL PERFORMANCE DISTRICT AND MASTER DEVELOPMENT PLAN REGULATIONS. THIS ORDINANCE WILL REPLACE THE EXISTING R-1, R-2, R-3 AND R-6 ZONING REGULATIONS WITH THE RESIDENTIAL PERFORMANCE DISTRICT REGULATIONS: INSTITUTE MASTER DEVELOPMENT PLAN REGULATIONS; AND REQUIRE A SITE DEVELOPMENT PLAN FOR CERTAIN LAND USES WITHIN THE RESIDENTIAL PERFORMANCE ZONING DISTRICT. Mr. Brumback stated that a lot of work had gone into these ordinance amendments and he would like to thank everyone who had given so much of their time on this project and especially the Planning Department staff. Mr. Joe Massie, local Attorney, appeared before the Board and stated that he was Executor of an Estate that owned property on Senseny Road and that the 100 foot buffer that was part of this ordinance concerned him with reference to this property. Mr. Horne stated that this could be appealed to the Board of Zoning peals. Mr. Kit Molden, President of the Top of Virginia Builders Association, peared before the Board and stated that he would like to thank the BOS MINUTE BOOR NO. 18 BOARD OF SUPERVISORS 14TG: SEPTEMBER 28, 1983 o 269 Mr. Crosen stated that his position on mobile hom• is that he is opposed to any more mobile home parks in Frederick County and while he will support this amendment, that did not mean that he will vote in favor of any mobile home park replacements in the future, but he did not say, and did not hold the position that Frederick County should not have mobile homes, period, and he was not out to tell someone in the County that has land that they cannot put a home on it and he just wanted this clarified. Upon motion made by W. Harrington Smith, Jr., seconded by Dudley H. Rinker and passed unanimously, the above ordinance amendment was approved. AN AMENDMENT TO CHAPTER 21 OF THE FREDERICK COUNTY CODE, ZONING ORDINANCE; COMBINING THE A-1 AGRICULTURAL LIMITED AND THE A- AGRICULTURAL GENERAL ZONING DISTRICTS TO FORM THE RA RURAL AREAS ZONING DISTRICT AND PROVIDING GENERAL REVISIONS TO THAT DISTRICT - APPROVED It was noted that this ordinance amendment will be making one district out of two. Mr. Crosen asked about the conditional use section and what a conditional use permit is needed for, hog farming, fish hatch- eries, etc. and is this currently in the A-1 or A-2. Mr. Watkins stated that he believed they are currently allowed in A-1 with a conditional use permit, not A-2. Mr. Rinker asked if this had any affect on the Agricultural District. Mr. Watkins replied no. Upon motion made by Robert M. Rhodes, seconded by Dudley H. Rinker and passed unanimously, the above ordinance amendment was approved. Historic Resources Advisory Board Concerns The vacant parcel proposed to be developed with eight condominium buildings is located within the limits of the Second Battle of Winchester and the Third Battle of Winchester (Opequon) core battlefield areas, as delineated by the National Park Service. In particular, the site proposed for development is adjacent to Stephenson Depot. Therefore, the HRAB has expressed concern for loss of core historic battlefields and believes the proposed use is incompatible with surrounding land uses. Specifically, the HRAB has concerns about loss of battlefield viewsheds, the proposed density of the development and its impacts on Stephenson's Depot. Based on the above concerns, the HRAB was not in favor of the proposed development. However, the HRAB recognizes that the property is already zoned for residential uses and should the property develop, suggests the following be considered to mitigate impacts on historic resources: Building layout: Given the topography of the property and the adjoining battlefields, consider an alternate grouping of buildings to minimize visibility from Stephenson's Depot. Height of buildings: Consider a building height that is more compatible with surrounding land uses, such as one story instead of three. The applicant has added a landscape screen along the east property line, which adjoins the core battlefield area of Stephenson's Depot. This is in addition to the required road efficiency buffer along Martinsburg Pike and the required residential separation buffer from the north property line. List any outbuildings and their approximate ages, cemeteries, etc.) Hilandale appears to have been built in three phases. -The earliest portion of the house is the central portion, now the rear wing. It is constructed of coursed limestone and is two stories. It has an'interior end stone chimney. It was built c.1780-1800 by a member of the Chipley family. The second phase -of building was done from c.1875-1890. This is when what is now -the front portion of the house was added. It is a three -bay, symmetrical, two story, random rubble (limestone) wing with a gable roof and a central front gable. The roofing materi is pressed tin shingles. There is a square attic window in the central front gable as well as in the side gables. It has two central brick chimneys and decorative brackets and pendant in the eaves. The front porch is of the Vernacular Colonial Revival Style. It is three bays with square doric columns and a plain handrail and balusters. The windows are 6/6 with louvered shutters. This portion of the house was built by the Crawford family, who had acquired it around 1860. The stone for this portion of the house is said to have come from the stone cook fireplaces that were constructed by the Union soldiers in the area around Hilandale. The third phase of construction of Hilandale ' was during the 20th century. This 1s:- the rear frame portion of the house (north end). It is a two story wing on a split-level stone basement. It is cladded with weatherboard. Although the interior was not inspected, the surveyor has been informed that one of the mantles is originally from Vaucluse (34-138) and was then in Springdale (34-127). Also a lot of the hardware is supposedly from Vaucluse. Hilandale has a fine collection of outbuildings. These include a stone springhouse, a frame (log?) meathouse, several frame sheds, a frame barn, carriage house, machine shed, fine frame bank barn with an unusual wood stave silo and a frame tenant house about i mile NW of the main house. The house and the outbuildings stand together as a fine example of a late 18th century house that has evolved through many periods. The property is XDmWac9GpaxM further enhanced by the fine Civil. List any outbuildings and their approximate ages, cemeteries, etc.) The Hilandale earthwork is an impressive example of one of the several Union earthworks built in this part of the Shenandoah Valley during this period. It appears to be in very good condition and covers an area of about for so square miles. It is located about 1 mile east of the house known as Hill and Dale (34-126). During the Fall of 1864, the Union forces were occupying this area. There were about 40,000 or 50,000 Union troops in this area during this period. Many of them camped in this specific area. There are several redoubts and earthworks still surviving from this period but this one appears to be the largest. This property should be further investigated as it is quite an important site. List any outbuildings and their approximate ages, cemeteries, etc.) Carysbroolc is a mid-19th century dwelling made up of a central section and two side wings. The central section of the house is two stories constructed of frame on a laid stone foundation It is three bays on the front side, with a door and two windows next to it. It is thus asymmetrical. It has a gable roof of standing seam metal and an interior end brick chimney. The siding was originally weatherboard although most of it has been removed. The house has basically been gutted. The windows, doors, siding and mantlepiece are all missing. The windows were probably 6/6 sashes. The surveyor found architrave trim and corner blocks around several of the window openings. This central portion of the house is flanked by two one story wings which were probably built very soon after the main portion of the house. These wings are of frame construction with brick nogging. For the most part the siding has been removed and the nogging exposed. Some of the original siding, board and batten, still can be found in the gable ends of the wings. The wings both have interior end brick chimneys. As with the main portion of the house, the wings have been stripped of all their woodwork, mantlepieces, windows and doors. It appears that a frame wing had been added to the south one story wing sometime in the 20th century. An outline of a mantlepiece can be seen on the exterior wall of the south one story wing which would have been an interior wall for the 20th century wing. On the end of the north one story wing is the entrance to the cellar. The cellar is lined with coursed rubble and appears to have occupied the area under the entire wing. Carysbrook is in very poor condition because it has been stripped of so many of its architec- tural elements. INFORMATION ON OUTBUILDINGS: None of the outbuildings at Carysbroolc remain. Just to the north of the house are the ruins of what was probably the meathouse. There are also some ruins NE of the house which were most probably farm -related outbuildings such as barns, chicken coops and corn cribs. It appears that it is in its complete form. The Carysbrook_ redoubt was probably built during the fall of 1864 after Sheridan had fi secured this portion of the Valley. It was built by Union soldiers and is just one of several entrenchments and fortifications built of earth in the area. It appears to I be one of the best preserved ones. One can assume that the Union army camped in this area and occupied it during this period in B 1864. This means that there is the potential for quite a bit of archaeological investigation.
