HENRY, party of the first part, hereinafter called the Grantor, and THE COUNTY OF FREDERICK, party of the second part, hereinafter called the Grantee. WHEREAS, the Grantor is the owner of all that certain parcel of land lying and being situate in Stonewall Magisterial District, Frederick County, Virginia, containing 2.3387 acres, more particularly described by survey drawn by Edward W. Dove, L.S., dated October 19, 1992, attached hereto and by this reference xc,ade .a part hereof as if set out in full; and being a portion of the same land conveyed to Kimerly G. Henry and Paula O. Henry by deeds dated January 28, 1988 and January 23, 1989, from J. P. WHEREAS, it is the desire of the Grantor to subdivide the same into lots to be known as Henry Business Park, Lots 39, 40, 41 and 42; and WHEREAS, the Grantee has approved the subject subdivision as evidenced by its agent's signature on the aforesaid attached survey. The Grantors do hereby dedicate and convey unto the Grantee, in fee simple absolute, with general warranty of title, all of that tract of land containing .0480 acre, and which is set apart for the public access known as Fort Collier Road, all as is more particularly set forth on the survey of Edward W. Dove,,L.S., dated October 19, 1992, attached hereto and by this reference made a part hereof as if set out'in full. The Grantors do further grant and convey unto the County of Frederick, a certain additional 5' slope and drainage easement parallel to the existing 20' slope and drainage easement, all as is shown on the survey drawn by Edward W. Dove as aforesaid and by this reference made a part hereof as if set out in full. Pursuant to §144-38, Code of the County of Frederick, Virginia, the maintenance of the aforesaid slope and drainage easements shall be the sole obligation of the Grantor, their successors and assigns, and they do hereby agree to indemnify the County of Frederick from all costs of maintenance of the same - The lots herein dedicated are subject to the building restriction lines as set forth on the aforesaid attached plat. There are various setback distances required for these buffers depending on the type of screening to be provided. The. plan needs to clearly show where buffers will be provided, what type of buffers, and the location of the active and inactive buffer areas. The requirements of the buffers can be found in the Zoning Ordinance beginning on page 21-3-27. A type "A" buffer is required on the B-2 property where it adjoins the B-3 zoned property. A type 'B" buffer is required on the B-3 property where it adjoins the B-2 zoned property. A'B" buffer is also required on the B-2 property adjoining RP zoned property. Planning & Development: The use proposed conforms to the B-2 zoning of the property. INFORMATION LACKING A note on the cover page indicates that no buffers are required, this note should be removed. The zoning ordinance requires that buffers be placed between B-2 zoned property and M-1 property, as well as between B-2 and RP zoning. This will involve the entire northern and eastern edges of the property and at least a portion of the western boundary. The application indicates that there will be three phases of development for the property. These phases should be indicated on the MDP. The plan should include a legend indicating the meaning of all symbols. Clarification is needed as to whether or not the indicated 29+ acres -includes the acreage of the individual parcels situated along the western portion of the property. The vicinity map seems to indicate that these parcels are included in the planned acreage, where as the application does not list these parcels. GENERAL DESIGN Lot location and dimensions are not required to be shown at the MDP stage, however since they are shown on the plan, staff would note that they appear to be quite small for B-2 business lots. A design which would accommodate shared entrances on Baker - Knight Street would be preferred from a transportation perspective. The County Engineer has noted that there may be potential problems with the suitability of the site for foundations. Therefore, a detailed traffic impact/capacity analysis will need to be prepared and furnished before we can make any final comments on this proposal. We have made some preliminary observations which are as follows: 1. With commercial development planned a 12' wide turn lane with curb and gutter (14' to face of curb) should be constructed on the southwest side of Baker Knight Street from the intersection of Routes 1200 and 1322 to the street connection just north of the Winchester City Limits and also on the northeast side of the roadway from Stratford Drive to the intersection with Route 1200. This may necessitate an additional dedication of right-of-way in this area to accortiodate the ultimate typical section. 2. Curb and gutter will need to be extended across the front of the Henry lots fronting Route 1200. 3. A 12' wide turn lane will need to be provided north bound on Route 1200 at the intersection with. Baker Knight Street. The double line of 73"x55" C.M.P.A. under Route 1200 will have to be extended to cover the turn lane and flare. Preferably, -these pipes should be extended to connect with the existing two (2) 73"x55" C.M.P.A. pipe under Baker Knight Street at Lots Nos. 41 & 42. If this is not done then guardrail will be required in this area. Sufficient shoulder width behind the curb and gutter will need to be provided to permit installation of this guardrail. 4. Dove and Associates 3078 Shawnee Drive Winchester, Virginia 22601 COMMENTS We have reviewed the proposed preliminary master development plan and offer the following comments: 1. The proposed development is located within an abandoned borrow area that was once mined for the manufacture of bricks. Since that time, the site has been indiscriminately filled with materials ranging from sawdust to construction debris. Pockets of isolated perched groundwater have also developed throughout the site. Prior to developing this property, a detailed geotechnical study will be required to delineate the pockets of unsatisfactory fill and provide satisfactory foundation design recommendations. This study should encompass road alignments, building lots and critical utility lines. 2. Geologically, the site is underlain by the Martinsburg Shale. As previously indicated, a majority of the overburden was removed for use in the production of bricks. Consequently, rock removal may have an adverse impact on the site development especially along utility lines. 3. A majority of the site storm runoff generally flows toward the north end of the site where it is intercepted by a defined drainage channel and diverted to the east where it crosses Huntington Meadows. Existing wetlands surround this existing drainage channel which cross proposed lots 40, 39,38, 37 and the area designated as stormwater management.
