A VDOT review has been completed on the final plat dated May 9, 2005 for the referenced project.
The plat appears to reflect the information shown on the approved project plans and is therefore
approved by this letter.
The application for subdivision of this property appears to have significant measurable impact on
Route 277, Fairfax Pike, the VDOT facility which would provide access to the property. This section
of street is currently not in the State's Secondary Road System. All entrance design and drainage
features must meet State requirements if the street is to be eligible for acceptance. A complete set of
construction plans will be required for review.
We are returning five (5) signed copies of the plat to your office, one copy is being retained for our
work file. Please provide one copy of the plat of dedication fully signed and recorded at the
appropriate County Clerk's Office prior to the issuance of any land use permit from VDOT.

In accordance with your request dated February 10, 2005 you are given permission to install a temporary
construction entrance at the referenced location. This letter is to be considered your permit to do so. The following
provisions will be required:
• Work area protection signage is to be in accordance with the current Work Area Protection Manual while
working on the right-of-way.
• All work on the right-of-way is to be confined to the temporary entrance location only. A land use permit
will need to be applied for and issued prior to any additional work on the right-of-way. This permit requires
a fee and surety bond coverage.
• A minimum 6" depth of VDOT #1 (2-3 inch stone) at a minimum width of 12' is to be placed from the edge of
pavement and extended a minimum of 70' with a filter fabric underliner.
• All materials spilled, dropped, washed or tracked from vehicles onto the roadway or into storm drains must be
removed immediately.
• Positive drainage is to be maintained within the right-of-way at all times.
• A wash rack will be required.
• Any disturbed areas of the right-of-way or damages to the pavement structure adjacent to this entrance vgill be
repaired by you to our satisfaction.
• This permit is being issued for 180 days.
• All work is to be completed in accordance with VA Erosion & Sediment Control Handbook, Specification 3.02.
• The entrance is to be installed at the location shown on the site plan prepared by Painter -Lewis, PLC dated
February 1, 2005.
The Department of Transportation will not be held liable for suit should such result from this operation nor is it
granting permission to grade on the property of others or disturb underground utility lines. isted_ite �s

REVIEW EVALUATIONS:
Virginia Department of Transportation: The master development plan for this property appears to
have a measurable impact on Route 277, the VDOT facility which would provide access to the property.
It appears all comments as detailed in the May 11, 2004 letter appear to have been addressed. Before
making any final comments, this office will require a complete set of site plans, drainage calculations
and traffic flow data from the I.T.E. Trip Generation Manual, Seventh Edition for review. VDOT
reserves the right to comment on all right-of-way needs, including right-of-way dedications, traffic
signalization, and off -site roadway improvements and drainage. Prior to construction on the State's
right-of-way, the developer will need to apply to this office for issuance of appropriate permits to cover
said work.
Frederick County Fire Marshal: Bollards and chain required at the emergency vehicle turnaround,
as well as fir lane signs. Plan approval recommended.
Frederick County Public Works: We grant our approval of the MDP for the subject project as
submitted. The proposed project will help alleviate an existing storm drainage, pipeline and standing
water condition between Lexington Court and Georgetowne Court.
Frederick County Inspections Department: Demolition permit required to remove existing structures.
No additional comment required at this time.
Frederick County Sanitation Authority: Vt review - approved.
Department of GIS: The Hamilton Court street name is approved and reserved as presented in the
Hamilton Court Master Development Plan dated 4/8/04. (Preliminary structure numbering has been
assigned.)
Frederick County Department of Parks & Recreation: There appears to be an appropriate amount of
open space provided; however, the open space dedicated along Rt. 277 would serve only as a buffer and
has no apparent open space value for the residents. Also, when Rt. 277 is widened, this space may no
longer exist. Plan appears to provide an appropriate recreational unit to meet county requirements.
Bicycle trail section meets this department's standards for trail construction.
Historic Resources Advisory Board: Upon review of this Master Development Plan, it appears that the
proposal does not significantly impact historic properties and it is not necessary to schedule a formal
review of the proposal by the HRAB. According to the Rural Landmarks Survey, there are no significant
historic structures located on the property. The National Park Service Study of Civil War Sites in the
Shenandoah Valley does not identify any core battlefields that this proposed rezoning would impact.

Winchester Regional Airport: This Master Plan has been reviewed and it appears that it should not
impede operations at the Winchester Regional Airport as the proposed site falls outside of the airport's
Part 77 surfaces. However, the site does lie within the airport's airspace and residents could experience
fly -over noise from aircraft arriving from the south into Winchester.
PlanninI4 & Zonina:
A) Master Development Plan Requirement
A master development plan is required for most subdivisions and development of property in
Frederick County. Before a master development plan can be approved, it must be reviewed by
the Planning Commission, Board of Supervisors and all relevant review agencies. Approval may
only be granted if the master development plan conforms to all requirements of the Frederick
County Zoning and Subdivision Ordinances. The purpose of the master development plan is to
promote orderly and planned development of property within Frederick County that suits the
characteristics of the land, is harmonious with adjoining property and is in the best interest of the
general public.
B) Location
This property is located on the north side of Fairfax Pike (Route 277), east of its' intersection
with Double Church Road. The Georgetowne Court and Lexington Court townhouse
developments are on either side of the subject properties. The subject parcel consists of 6.461
acres.
C) Site History
The original Frederick County zoning map (U.S.G.S. Stephens City Quadrangle) identifies the
subject parcels as being zoned R-1 (Residential Limited). The zoning changed to RP (Residential
General) District on September 28, 1983 when the R1, R2, R3, and R6 zoning districts were
reclassified.
D) Intended Use
45 townhouses and one single family detached traditional residential lot
E) Site Suitability & Project Scope
Land Use Compatibility:
The 6 1/2 acre site is located adjacent to existing residential land uses in an area of Frederick
County which is predominately residential in nature. To the north is Jefferson Village, which
consists of single family detached traditional dwellings. To the east and west are townhouse
developments. Immediately south, across Fairfax Pike (Route 277) is an office use.
Comprehensive Policy Plan:
The site of Hamilton Court is not within the study limits of any small area land use plan found in

the 2003 Comprehensive Policy Plan. However, the site is zoned RP (Residential Performance)
District, and is within the UDA (Urban Development Area), The Comprehensive Policy Plan
states that suburban residential development may be appropriate within the UDA.
Historic Resources:
The Frederick County Rural Landmarks SurveX does not identify any potentially significant
historic resources on the site of the proposed master development plan. Furthermore, according
to the National Park Service's Study of Civil War Sites in the Shenandoah Valley of Virginia, the
subject site is not included in any battlefield study area and does not contain any core battlefield
resources.
Environment:
The subject site does not contain any known areas of environmental features. Environmental
features include areas of floodplains, lakes or ponds, wetlands, natural waterways, riparian
buffers, sinkholes, natural stormwater retention areas, and steep slopes.
Transportation:
Access to the site is proposed via an entrance off of Fairfax Pike (Route 277). Fairfax Pike is a
minor arterial road and is planned for future improvement, as shown on the Frederick County
Eastern Road Plan [2003 Comprehensive Policy Plan, page 7-1 SJ. As required for all minor
arterial roads, a minimum entrance separation of 150' is required for all new entrances [Section
165-29.A (4)]. Per VDOT requirements, a new right turn lane consisting of a 150' taper and a
100' deceleration lane, as well as a left turn center lane, shall be provided for the proposed
entrance.
Landscaping, Buffers & Trails:
The proposed preliminary master development plan shall provide an 80' road efficiency buffer
along Fairfax Pike (Route 277), a 100' residential separation buffer adjacent to the north
(Jefferson Village) and the east property lines. These buffers are in addition to the landscaping
requirements of the Frederick County Zoning Ordinance, both 165-36 and 165-27.E (11).
A 10 foot wide bicycle trail has been provided on the north end of the property, connecting the
Hamilton Court development with the Georgetown Court development to the west. Staff would
encourage the applicant to consider proving an eastern trail connection to the Lexington Court
development.
The proposed development shall provide a ten foot bike path along Fairfax Pike (Route 277) as
planned by the Frederick County Bicycle Plan, found in the 2003 Comprehensive Policy Plan,
page 7-16. This trail along Fairfax Pike has not been provided on the MDP.

Association of State Highway and Transportation Officials guidelines. The applicant should
consider providing such a trail along Fairfax Pike within the road efficiency buffer.
F) Non -Conforming- Structure:
The southeastern -most lot proposed through this master development plan will contain a single-
family dwelling that currently exists on the parcel. The applicant has indicated that this dwelling
will remain upon development of the remainder of the parcel. It is important to note that this
dwelling would encroach within the required front yard setback area of the proposed lot as a
result of the location of the Hamilton Court right-of-way. It is noted that the applicant has
elected to locate Hamilton Court at its' present location in an effort to maximize the development
potential for the site. Therefore, staff would suggest that the design of this project has created
the right-of-way encroachment. Staff has determined that the origination of an encroachment in
such a manner may be inappropriate to be considered a legal non -conformity. Accordingly, the
applicant has noted on the master development plan that the existing structure will be removed
and/or modified as necessary to meet the 35-foot setback requirement.
STAFF CONCLUSIONS FOR 09/01/04 PLANNING COMMISSION MEETING:
This preliminary master development plan proposes up to 45 townhouses and a single family lot on
approximately 6.461 acres of land zoned RP (Residential Performance) District. Prior to administrative
approval it may be appropriate for the applicant to provide a ten -foot wide bike trail along Fairfax Pike,
as well as a trail connection with the Lexington Court development to the east. All of the issues
identified by staff, review agencies, as well as those issues brought forth by the Planning Commission,
should be appropriately addressed prior to a recommendation to the Board of Supervisors.
PLANNING COMMISSION SUMMARY & ACTION OF THE 09/01/04 MEETING: The
applicant described the details of the proposed underground storm water management system for the
project. The 20-foot space reserved around the perimeter of the project was proposed to collect, control,
and to convey storm water coming onto the site. The transfer of water through the site into the
underground storage system, where it would be released at a controlled rate, was described. The
applicant explained how they were working with the adjoining property owners to re -grade and install
culverts in order to redirect water into their storm water management system to alleviate wet -weather
ponds.
Two Lexington Court homeowners were present to talk about the existing drainage problems in
Lexington Court. They were hopeful that the applicant's storm water management proposal would help
to alleviate the water run-off problems they were experiencing and not worsen them
Commission members asked the applicant if he would commit to connecting the existing single-family
dwelling to County water and sewer, if it wasn't already connected, and the applicant agreed to do so.

Commissioners had numerous questions for the applicant concerning the storm water management plan,
but believed it would result in an improved drainage situation for the area. They also discussed the
emergency vehicle turn -around area, as well as the single entrance into the site. Concern was also voiced
regarding the lack of a bike path/sidewalk across Route 277.
By a majority vote, the Planning Commission recommended approval of the master development plan as
follows:

This letter is intended to inform you that the preliminary master development plan application for
Hamilton Court is incomplete as of today's date because there are no agency comments from VDOT
or the Fire Marshal. Staff s review letter, dated June 14, 2004, specifies that these agency comments
are required for this application. The cut-off date for the September 1, 2004 Planning Commission
meeting was yesterday, Monday, August 9, 2004. Since a complete application was not submitted
by this date, the preliminary master development plan for Hamilton Court cannot be scheduled for
this meeting. The next available Planning Commission meeting is September 15, 2004. Please
provide staff with agency comments from the Fire Marshal and VDOT by September 1, 2004 to meet
the cut-off for this meeting.

Upon review of the referenced Master Development Plan, it appears that the proposal does not
significantly impact historic properties and it is not necessary to schedule a formal review of the
proposal by the HRAB. According to the Rural Landmarks Survey, there are no significant historic
structures located on the property. The National Park Service Study of Civil War Sites in the
Shenandoah Valley does not identify any core battlefields that this proposed rezoning would impact.

RE: Preliminary MDP Hamilton Court Townhouse Complex
Dear Jeremy:
I have sent you two sets of revised plans for the proposed Preliminary .MDP Hamilton
Court Townhouse Complex. The plans have been revised to address the comments
made by the Frederick County Department Of Planning and Development reviewing
staff. The comments that were made concerning the Preliminary MDP have been
addressed as follows:
1. To make the MDP more of a general schematic of the layout of infrastructure
to facilitate future development, The precise location, number, and species of trees
were removed. The building footprint, the individual lot lines and averages, the number
of bedrooms per individual unit, total number of parking spaces proposed were also
removed per the request of the staff.
2. The proposed lot type one proposed single family lot will be a single family
detached traditional lot.
3. The single family detached traditional lot setbacks are 35' front setback, 10'
side setback, and 25' rear setback. Front setback from the proposed Hamilton Court
and Fairfax Pike are annotated on MDP. Existing building shall be removed to meet
BRL annotated on MDP.
4. In the notes the proposed use was changed from multi-famil to single-family.
5. Site location map has been changes to reflect Georgetowne Court
Townhouses and the lot layout in the correct location.
6. Typical details of buffers has been added and trees and shrubs location,
number, species, and planting schedules.
7. Typical Road Detail has been added for proposed public road.
8. Rear Residential Separarion buffer has been provided between the individual
lots of Jefferson Village and the Village at Sherando. Buffer boundary lines for active
and inactive buffers were added to MDP.
9. Hamilton Court will be a public road, note was added to MDP. Department of
GIS reviewed name and approved, private road/parking lot road names not required per
Department of GIS.
10. Phasing for construction of this development will be all in one phase.

11. General note #6 has been combined with General Note #10. For correct
minimum building separarion setbacks.
12. Street trees in R-O-W have' been removed from proposed V-DOT
right-of-way.
13. Road Efficiency Buffer Screening provided a minimum of a single row of
evergreen trees that are a minimum of four feet in height at planting and an earth berm
that is six feet in height above average road grade has been annotated on MDP.
14. Inter -parcel connector was not recommended by Fire Marshall, so connector
will not be proposed, however, Georgetowne Court and Hamilton Court may discuss
connector for future construction.

This letter details Staff s preliminary review comments for the above -referenced preliminary master
development plan. The preliminary Hamilton. Court MDP is a proposal to develop 5.723 acres with
44 townhouses and one single family lot. The subject property is located between Lexington Court
Townhomes and Georgetown Court Townhomes, and is on the north side of Fairfax Pike. Prior to
formal submission of this MDP application, please adequately address each of the preliminary
review comments listed below. These comments are as follows:
I) Complete Application. Please submit a complete application upon formal submission. A
complete application shall include: a completed and signed application form; all agency
review comments; a completed, signed, and notarized special limited power of attorney form;
signed copies of the MDP; and an application fee. The application fee for this project is
$1,823.05 [$1500 base fee + $50 per acre (6.461 x 50 = 323.05)]. Review comments are
required from the following agencies/departments: the Frederick County Department of
Public Works, Frederick County Department of Building Inspections, Frederick County
Department of Parks & Recreation, Frederick County Fire Marshal., .Frederick County
Sanitation Authority, the Frederick County GIS Department, and the Virginia Department
o f Transportation (VDQT).
2) MDP Information. The MDP is intended to be a general schematic of the layout of

12) Townhouse Setback Information- General note 46 replicates the townhouse setback info
summarized under general note 411, General note 46 inaccurately states the required rear
arid side setbacks. These setbacks should actually be termed minimum building separation.
The rear building separation is 50, the side building separation is 30', and the front building
separation is 50'. Please correct as necessary. This information is correctly stated in General
note #11..
1.3) Street Frees In R-O-W. Please remove the proposed street trees from the proposed VDOT
right-of-way without an approved landscaping maintenance agreement.
14) Road Efficiency Buffer Screening. For the proposed 801redueed-distance road efficiency
buffer please provide a minimum of a single .row of evergreen trees that are a mvarnum of
four feet in height at planting and an earth berm that is six feet in height above average road
grade. A full -distance road efficiency buffer would require a double row of evergreen trees
that are a minimum of four feet in height when planted with. a 50' active and 50' inactive
buffer area. Please modify as necessary to meet or exceed the Zoning Ordinance's
requirements for road efficiency buffers.
15) Inter -parcel Connector. Consideration for an inter -parcel connector for emergency
purposes should be discussed with the Fire Marshal. It appears that emergency access can
be provided'via an emergency route from GeorgeTowne Court and the proposed Hamilton
Court.
Once these comments have been addressed, Staff will schedule the MOP for :review with the
