Based on this inspection, there are several locations on Hill Valley Drive where guardrail shall be installed behind the sidewalk in the right-of-way. It was noted conflicts with underground utilities may prohibit guardrail being installed in this manner. If the developer conveys an easement for the installation of guardrail, it may be possible to delete the proposed guardrail terminals, Standard GR-9, and extend the guardrail to the entrance and install a section of radial guardrail, Standard GR-2. Enclosed for your use are sketches indicating guardrail types and approximate lengths needed on Hill Valley Drive. I will be happy to discuss any of these requirements. The affect of the proposed Virginia Department of Transportation (VDOT) road improvements should also be included in your stormwater analysis especially the backwater created during the 100 year storm event. 2. Refer to Sheet 3 of 12 We recommend deleting lots one (1) through nine (9) and lots 46 through 48 unless it can be demonstrated via a detailed site plan that the following items will not create a problem: a. The dwelling can be readily accessed via a driveway with a reasonable slope. b. Stable fills can be constructed within the property boundaries without impacting the 100 year storm event. C. The dwellings (lowest floor level including basement) can be constructed above the 100 year flood level. This flood level should be established using the new VDOT road alignment. d. Provide a lot that can be easily maintained. Slopes much steeper than 3h:lv cannot be easily mowed. 3. Extend the proposed drainage pipe (i.e., provide a paved channel) between lots 43 and 44 to the existing drainage channel. This same comment should also be applied to the proposed 48 inch culvert adjacent to lot number one (1). 4. In addition to the previously referenced problem lots, we recommend detailed site plans for lots ten through 16, 21, 22, 23, 27, 28, 31 and 32. Lot ten (10) should be included in the same category as lots one (1) through nine (9) because of the magnitude of the drainage structure and impact on the overall lot. It should be noted that it may be difficult to establish drainage behind the lots located in deep cuts because of the possibility of encountering rock. 5. Include the ten (10) year storm flows with the culvert designs tabulated on sheet 3 of 12. Also, indicate the outfall velocities for each pipe which daylights to the existing stream. Please contact me if you have any questions regarding the above comments. Lawrence, Planner I Current Zoning The land parcel that comprises the proposed Hill Valley Preliminary Master Development Plan is zoned RP, Residential Performance. Preliminary Master Development Plan Comments The preliminary master development plan calls for the development of 54 single family detached cluster homes on an 11.62 acre portion of the 26.123 acre site. The remaining 14.50 acres will consist of 12 acres of open space, and 2.5 acres of street right-of-way. The parcel is zoned Residential Performance (RP), permitting the proposed development. This development would create an overall gross density of approximately 2.067 dwelling units per acre which complies with the requirements of the Zoning Ordinance and meets the intent of the Comprehensive Plan. The MDP indicates that the minimum lot size within the proposed development is 8,000 square feet; therefore, recreational facilities are not required. Technical Plan Requirements The preliminary master development plan incorporates the property identified by Property Identification Number 55-A-56F, consisting of 26.123 acres. The site consists of 8 acres (31 percent) of woodlands and 3 acres (12 percent) of steep slopes. The proposed development would disturb 2 acres (25 percent) of the woodlands. One-half acre (17 percent) of the steep slopes would be disturbed. This complies with the Zoning Ordinance requirements that no more than 25 percent of the woodlands and steep slopes be disturbed. Open space requirements state that no more than 50% of the required open space shall consist of environmental features such as steep slopes and wetlands. As submitted, the preliminary MDP does not clearly indicate the total acreage consisting of environmental features included in open space. This issue will need attention before its conformity may be determined. All symbols that are used in the MDP should be defined in the legend. L� E Page 3 Hill Valley MDP #001-96 Site Layout The MDP application indicates that construction for this project will be conducted in one phase. This should be noted on the submitted preliminary MDP. Access to the proposed development will be via an entrance on Greenwood Road, and the creation of a new road which would transverse the property in an east -west manner providing for internal circulation. This proposed development's circulation system should be revised to coincide with the proposed improvements for the Greenwood Road and Valley Mill Road intersection. The MDP should provide a permanent entrance onto a state maintained road, not a temporary entrance that will require additional funding relocation fiom the Frederick County Secondary Road Plan funds when the intersection improvements are conducted. Based on the proposed internal road layout, Brandywine Lane should be considered the primary entrance for the development and be constructed rather than a temporary entrance. The use of road circulations involving interconnected parcels is encouraged by Frederick County. Previous connection was intended via Blossom Drive on the northwest of the property. Due to private ownership o£.this adjacent property, this connection may not be possible. An appropriate stormwater management plan should also be included on the master development plan. As necessary, on -site stormwater management facilities should be designated and supported by stormwater calculations. Residential separation buffers and zoning district buffering are not required for this site. As required, a road efficiency buffer has been proposed along the eastern portion of the site; this buffer would lessen the impact Greenwood Road traffic would have on the development. Deeds of Dedication Section 144-32 of the Frederick County Subdivision Ordinance requires the creation of a property owners association for the continuous maintenance and management of all common open areas, easements, storm water management facilities, and dedicated facilities associated within an approved subdivision. Staff believes that it is important to understand this requirement at this phase of the planning process. Maintenance must be provided by the residents of the proposed subdivision, not by Frederick County. STAFF RECOMMENDATIONS: Staff recommends approval of this development proposal. The proposed housing type is consistent with the RP Zoning District requirements, adequate area exists Page 4 Hill Valley MDP #001-96 to satisfy open space requirements, and the proposed master development plan indicates appropriate buffer and screening to lessen the impacts that Greenwood Road would have on the proposed single family dwellings. Staff asks that the Planning Commission recommendation include the need to ensure that all review agency comments are adequately addressed. Staff believes that the Planning Commission should consider the following items during consideration of the master development plan: The development of single family detached cluster homes complies with the present zoning of the property and is compatible with the surrounding residential developments; The Greenwood Road and Valley Mill Road intersection will be realigned and improved in the near future. This proposed master development plan should establish an internal circulation system and entrance that compliments the planned intersection improvements. No additional costs should be levied on the County and State to accomplish the intersection improvements, as a result of this proposed master development plan; * The overall concept and design of the proposed master development plan conforms with the requirements of Article XVII, Master Development Plan of the Frederick County Zoning Ordinance. SUIVEVIARY OF PLANNING COMMISSION MEETING OF 3/6/96: The applicant presented a modified master development plan for Hill Valley to the Planning Commission. The modifications involved the road network and the development's entrance connection with Greenwood Road; this modified plan was not the same as reviewed by the review agencies. The Planning Commission felt that the modified Preliminary Master Development Plan for Hill Valley, as presented by the applicant, appeared to comply with the intent of the Zoning Ordinance. There was concern for the entrance onto Greenwood Road in anticipation of the Greenwood and Valley Mill Roads intersection improvements. The applicant stated that this entrance location was the result of discussions with the Virginia Department of Transportation. Two adjoining property owners spoke stating their concern with the proposed development's impact on traffic and degregation of environmental features. (See attached letter from VDOT dated 3/6/96.) The Commission did not look favorably upon the applicant for presenting a plan that differed from that reviewed by the review agencies and made available to the public; similar actions in the future are not advisable. • Page 5 Hill Valley MDP #001-96 PLANNING COMMISSION ACTION OF 3/6/96: The Planning Commission unanimously recommended administrative approval of the revised Master Development Plan contingent on the following: 1. The applicant will secure approval of the preliminary master development plan dated February 6, 1996, from the Fire Marshall and the County Engineer, and; 2. Applicant will absorb all and any costs associated with the development entrance onto Greenwood Road as a result of the Greenwood and Valley Mill Roads intersection improvements. Subsequent to the submission to the Board of Supervisors for their review, the applicant recirculated the revised master development plan, and addressed the corresponding review agency comments. Most agencies were satisfied with the revised master development plan. Two review agencies that continue to have concerns with the proposed development are the County Engineer and the Planning Department. County Engineer: See attached letter dated April 23,1996, from Harvey E. Strawsnyder, Jr., P.E., Director of Public Works The County Engineer is concerned with the delineation of the 100 year flood plain and the steepness of the building lots. The flood plain should be delineated on the master development plan for Hill Valley. The steepness of the building lots concern will be addressed with the requirement of a detailed site plan for the entire subdivision. Planning and Zoning: See attached letter dated March 21, 1996, from Eric R. Lawrence, Planner I Staff is concerned with the proposed entrance on Greenwood Road. This entrance should be developed in a manner that avoids any additional costs that may be associated with the Greenwood and Valley Mill Roads intersection improvements. The County and State should not be held fiscally responsible for the intersection improvements as they pertain to the Hill Valley entrance. A second concern is the quantity of environmental features (steep slopes, woodlands, flood plains) that exist on site. Many of these features are either proposed for disturbance or for inclusion in the required open space. The large percentage of steep slopes to be included in the required open space exceeds the Ordinance maximum; no more than 50 percent of the open space may be environmental features. The re -configuration of the streets, and the changes in the proposed road width have corrected the issues I had with the original version of this plan. However, with the new plan, there is a defeciency in hydrant coverage. It is approximately 600' from the intersection at Greenwood Road, and the first hydrant on Hill Valley Drive. An additional hydrant will be needed near this intersection to maintain coverage at a maximum of 400' intervals. This spacing is the standard in Frederick County for single family dwellings. If any hydrants are to be relocated, due to VDOT plans for this intersection, that would help you meet the distance requirements, please indicate this on the plans. The re -configuration of the streets, and the changes in the proposed road width have corrected the issues I had with the original version of this plan. However, with the new plan, there is a defeciency in hydrant coverage. It is approximately 600' from the intersection at Greenwood Road, and the first hydrant on Hill Valley Drive. An additional hydrant will be needed near this intersection to maintain coverage at a maximum of 400' intervals. This spacing is the standard in Frederick County for single family dwellings. If any hydrants are to be relocated, due to VDOT plans for this intersection, that would help you meet the distance requirements, please indicate this on the plans. Lawrence, Planner I f�l l� SUBJECT: Hill Valley Master Development Plan; Open Space Requirements DATE: May 22, 1996 Staff has received a request from Steve Gyurisin of G.W. Clifford & Associates, to permit more than the maximum percentage of environmental features in the required open space. The Zoning Ordinance states that no more than 50 percent of the required open space should consist of environmental areas. The Hill Valley Preliminary Master Development Plan contains open space that consists of 82 percent environmental areas, exceeding the 50 percent limit. Staff was made aware of this large percentage of environmental features, i.e.. steep slopes, located in the open space following the applicant's environmental features delineation. These actions occurred following the April 8, 1996, Hill Valley Preliminary Master Development Plan review by the Planning Commission. The Board of 'Supervisors reviewed the plan on May 13, 1996, and approved it contingent upon numerous items; the open space issue was one of the concerns. Attached are the open space calculations and explanations for Hill Valley, as submitted by Mr. Gyurisin. These calculations state that the percentage of steep slopes within the open space may be reduced by removing 2.18 acres of steep slope/open space and placing it within the single- family detached cluster lots. This action reduces the percentage of steep slopes in open space to 52 percent. The Planning Commission is asked to determine if it would be acceptable to permit steep slopes on more than 50 percent of the open space. If this is acceptable, is the Commission's preference to have 9.62 acres of open space (82 percent of which contains steep slopes), or 7.44 acres of open space (52 percent of which contains steep slopes)? The applicant would be required to demonstrate that all open space requirements are met during the subdivision review process. The Zoning Ordinance open space requirement states that "the Administrator, upon recommendation by the Planning Commission, may allow a larger amount of steep slopes to be utilized where the developer can demonstrate a viable plan to make these areas useful." Mr. Gyurisin requests that the Planning Commission exercise this action and make a recommendation to the' Administrator. For each lot that is less than 10,000 square feet, by given square footage, an equivalent square footage shall be added to the common required open space. If each lot was 10,000 square feet or greater in size, the required open space is 6.53 acres or 25%. This meets the required minimum open space area of 25% or one forth of the site. This is 2.18 acres of additional open space above the required amount. Lots are clustered to reduce environmental impacts and open space is enlarged to protect environmental features. Additionally, the enlarged open space area provided for the following features planned as part of Hill Valley overall master plan: Hill Valley - con't. • An emergency access point to Blossom Drive • A storm water management facility • Buffers along Greenwood Road • Continuation of open area connecting with Shenandoah Hills. Open Space and Steep Slopes Currently steep slopes account for 12.99 acres of the site. A majority of the steep slopes are in the valley area that follows Valley Mill Road. The amount of open space with steep slopes is 82%. Since disturbance of steep slopes is limited, to reduce the amount of open space in steep slopes, cluster lots may be enlarged placing the steep slopes in home lots rather than open space. We have staked this intersection in the field and have cleared a line -of -sight horizontally in order that you can verify a full 350' sight distance in both directions. We have worked with Potomac Edison and Bell Atlantic regarding the utility relocations that will be required; and, these are feasible. We have engineered a road into this site and verified adequate landing and sight distance requirements are met on that road. Finally, we have taken a look at a possible centerline profile for Greenwood Road and conclude, in preliminary fashion of course, that there will be no major issues connecting this road with a future Greenwood Road elevation. If anything, your final design may be lower than our assumption which would tend to help the situation. This property is located in the northwest corner of Valley Mill Road and Greenwood Road and is identified with PIN 55-A-56F in the Shawnee Magisterial District. Action - Recommended Approval Mr. Charles W. Maddox, Jr., engineering consultant with G. W. Clifford & Associates, was representing the owner, Vera V. Dove. Mr. Maddox said that they have spent a considerable amount of time with VDOT in determining a suitable entrance to the site, in light of the proposed improvements scheduled for Greenwood Road. He said the entrance they are proposing, which has been approved by VDOT's Design Section in Staunton, is not only useable today (by site distance and state standards), but is also useable later, after Greenwood Road has been relocated. Mr. Maddox presented VDOT's approval letter, along with a copy of the revised master development plan (to substitute previously submitted plans). He then described various features of the site, including storm water management, roads, utility lines, etc. Mr. Maddox said that they were proposing to keep a 3± acre section of the parcel, located at the southeast corner, out of the open space to be conveyed to the property owners association because it is a potential area for road construction impacts to occur. Members of the Commission pointed out the concerns raised by the County Engineer. There were concerns regarding the feasibility of proposed roads due to elevation differentials and a request for grading plans for the entire subdivision, due to steep topographical conditions. • 0 11 Mr. Maddox stated that all roads within the subdivision would be state -maintained and all requirements of the County Engineer would be satisfied. Members of the Commission asked how far the proposed entrance would be from the proposed Valley Mill relocation. Mr. Maddox replied that it would be approximately 350' to 400', noting that the distance is much further at the present time. Mr. Lawrence came forward to present staff review comments. He said that the master plan reviewed by staff and the reviewing agencies was not the same plan that was just submitted by Mr. Maddox. He said that there were debates early on about where the entrance onto Greenwood Road should be; and, apparently, VDOT and the applicant have decided upon an appropriate entrance, but it has changed the master plan as previously submitted. Mr. Lawrence raised the question of whether or not it was appropriate for the Commission to act on the revised plan before the reviewing agencies had an opportunity to review it. Chairman DeHaven called for citizen comments and the following persons came forward to speak: Mr. Mark E. Bozar, adjoining property owner at 457 Valley Mill Road, had questions about the adequacy of the treatment facility to handle additional dwellings and where elevation changes and property disturbances would take place. Mr. Ralph Simmons, resident on Valley Mill Road, said that he was one of the directors of the homeowners association. Mr. Simmons was opposed to approval of the master plan because of the traffic on Valley Mill Road. Mr. Simmons said that the traffic on Valley Mill Road is terribly congested. He added that his homeowners association was not notified of this proposal. Members of the Commission were well aware of the trathc congestion in this area, but noted that Greenwood Road was the number one priority project designated for county road improvements. They felt that the development of single-family detached cluster homes was compatible with existing residential development and that the proposal complied with zoning requirements. Member of the Commission also felt the revised entrance location was compatible with the planned realignment and improvements to the Greenwood Road and Valley NO Road intersection, however, the applicant would need comply with all review agency concerns. Upon motion made by Mr. Thomas and seconded by Mr. Romine, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously recommend approval of Master Development Plan #001-96 of I -Fill Valley to develop 26.123 acres of residential land for 54 single-family detached cluster homes and does also hereby grant the staff administrative approval authority to approve the revised master development plan, with particular attention that the County Engineer's requirements are satisfied. 12 In closing, Chairman DeHaven felt it was not particularly fair to adjoining property owners, who may have been shown a plan or been told about a plan, and then have a different, revised plan presented and discussed at the public hearing by the applicant. 1996 PLANNING COMMISSION RETREAT RESULTS No Action Mr. Watkins presented a list of issues and strategies discussed at the 1996 Planning Commission Retreat. Members of the Commission brought up the subject of staff recommendations for application review. They suggested that the words "meets all specifications" or "does not meet the following specifications..." be used instead of the phrases "approval" or "disapproval." Members of the Commission felt this subject was worthy of further discussion. Members of the Commission asked about the status of the Stephens City Well -head ordinance. Mr. Watkins said that a reply was sent to Stephens City stating that the County can not legally enforce or support the ordinance as it would apply outside of the Town boundaries. It was noted that dialogue is continuing on this subject. 1995 ANNUAL REPORT OF THE DEPARTMENT OF PLANNING & DEVELOPMENT Action - Approved Mr. Ruddy presented the 1995 Annual Report of the Department of Planning and Development and stated that the report was intended to provide the Commission and others with information to evaluate the previous year's planning activities and to aide in comprehensive planning for the upcoming year. Members of the Commission felt this was an informative and excellent report and made a good quick -reference guide.
