All VDOT comments have been addressed. Before making any final comments this office will require a complete set of site plans, drainage calculations and traffic flow data from the I.T.E. Trip Generation Manual, Seventh Edition for review. VDOT reserves the right to comment on all right-of-way needs, including right-of-way dedications, traffic signalization, and off -site roadway improvements and drainage. Prior to construction on the State's right-of-way, the developer will need to apply to this office for issuance of appropriate permits to cover said work. Frederick County Fire Marshal: Plans approved as submitted. Frederick County Public Works: As stated in your notes, the entire subdivision shall drain through the stoi7nwater management pond, unless a comprehensive study indicates no import shall occur on adjacent properties. A comprehensive review shall occur at the subdivision plan submission. Frederick County Inspections Department: Demolition permit is required to remove the existing structures on lot #2 and #3. No additional comment required at this time. Frederick County Sanitation Authority: 2" a review. Approved Department of GIS: Burlington Court has been accepted and is reserved in the Road Naming System. Frederick County Department of Parks & Recreation: Plan appears to meet recreational unit and open space requirements. However, from a recreational use perspective, the area offered as open space is less than desirable. Historic Resources Advisory Board: Upon review of the proposed rezoning, it appears that the proposal does not significantly impact historic properties and it is not necessary to schedule a formal review of the rezoning application by the HRAB. According to the Rural Landmarks Survey, there are no significant historic structures located on the properties nor are there any possible historic districts in the vicinity. It was noted that the National Park Service Study of Civil War Sites in the Shenandoah Valley identifies this property as being part of the core battlefield for the First and Second Battle of Kernstown; however, due to the abundance of commercial and residential development surrounding this area it has been classified as having lost its integrity. Winchester Regional Airport: The above referenced proposal has been reviewed and it appears that the proposed Master Development Plan should not have an impact on operations at the Winchester Regional Airport. 9 0 MDP #10-04, Hilda Maye Meadows January 18, 2005 Page 3 Planning & Zoning: A) Master Development Plan Requirement A master development plan is required for most subdivisions and development of property in Frederick County. Before a master development plan can be approved, it must be reviewed by the Planning Commission, Board of Supervisors and all relevant review agencies. Approval may only be granted if the master development plan conforms to all requirements of the Frederick County Zoning and Subdivision Ordinances. The purpose of the master development plan is to promote orderly and planned development of property within Frederick County that suits the characteristics of the land, is harmonious with adjoining property and is in the best interest of the general public. B) Location This property is located on the north side of Route 652, 0.25 miles west of the Route 11 and Route 652 intersection. C) Site History The original Frederick County zoning map (U.S.G.S. Winchester Quadrangle) identifies the subject parcels as being zoned R-2 (Residential Limited). The zoning changed to RP (Residential General) District on September 28, 1983 when the R1, R2, R3, and R6 zoning districts were reclassified. D) Intended Use 20 age restricted single family small lots (min. 3,750 square feet) including a community center to be built by the developer. E) Site Suitability & Project Scope Land Use Compatibility: The 4.67-acre site is located adjacent to existing residential land uses in an area of Frederick County which is predominately residential in nature. To the north is Plainfield Heights subdivision, which consists of single family detached traditional dwellings. To the east is Cross Creek Village, which consists of single family small lot dwellings. To the south and west are older existing RP single family detached dwellings. Comprehensive Policy Plan: The proposed 4.67-acre parcel is zoned RP (Residential Performance) and is within the UDA (Urban Development Area). The property is within the outer limits of the Southern Frederick Land Use Plan (SFLUP), which was initially adopted by the Board of Supervisors in 1999. The SFLUP shows this property as having an existing residential zoning and does not address any future land use changes for the subject parcel. The Comprehensive Policy Plan states that suburban residential development should occur within the UDA. 0 0 MDP #10-04, Hilda Maye Meadows January 18, 2005 Page 4 Environment: The subject site does not contain any known areas of environmental features. Environmental features include areas of floodplains, lakes or ponds, wetlands, natural waterways, riparian buffers, sinkholes, natural stormwater retention areas, and steep slopes. Transportation: Access to the site is proposed via an entrance on Apple Valley Road (Route 652) which is a minor collector road. As required for all minor collector roads, a minimum entrance separation of 70' is required for all new entrances [Section 165-29.A (4)]. Per VDOT requirements, a new right turn lane shall be provided for the proposed entrance. The entrance to the subdivision will be a public road with a cul-de-sac with a private road extending off of the public road; all roads within this subdivision will have curb, gutter and sidewalks. Landscaping, Buffers: The proposed preliminary master development plan shall provide a 25' residential separation buffer adjacent to the north, south and east property lines. These buffers are in addition to the landscaping requirements of the Frederick County Zoning Ordinance, both 165-36 and 165-27.E (11). Recreational Units: In accordance with § 165-64A of the Frederick County Zoning Ordinance, housing types with lot sizes of less than 5,000 square feet must provide one recreational unit or equivalent recreational facilities for each 30 dwelling units. In addition, developments containing single-family small lot housing must provide a community center that provides for the equivalent of three age -appropriate recreational units for each 30 dwellings. Hilda Maye Meadows is a proposed age restricted single family small lot development and therefore is required to construct a community center as well as one additional recreational unit. The applicant is proposing a community center on the site as well as a picnic shelter and trail. F) Waivers: The applicants are requesting a waiver from the Board of Supervisors to allow two residential lots to be less than 35 feet from a state road to accommodate a new state road (Burlington Court) to enable the 20 lot age restricted development. The Zoning Ordinance requires that all RP (Residential Performance) lots be at least 35' from a state road. The applicant is requesting the Board of Supervisors to grant a waiver of § 165-65B of the Frederick County Zoning Ordinance to allow the Harless property to be 25' from the state road and the Grim property to be 8' from the state road. 0 MDP #10-04, Hilda Maye Meadows January 18, 2005 Page 5 PLANNING COMMISSION SUMMARY & ACTION OF THE 11/17/04 MEETING: Two adjoining property owners in the Plainfield Heights subdivision spoke at the meeting. One had questions concerning surface run-off water, the size of the proposed lots, and questions regarding buffering details involving the landscaping and the repair and maintenance of the existing fence. The other property owner inquired about the possibility of connecting into the sanitary sewer line. Commissioners questioned the applicant and the engineer about whether or not there was any reason to believe there might be a problem acquiring the easements for the entrance from the property owners on either side and further, if those property owners were aware that a waiver was required for the two lots that would be created with non -conforming setbacks for their primary structures. The engineer said that verbal agreements granting the easement were received and a written agreement for the easements would be available at the Board of Supervisors' meeting. The applicant said that he advised the affected property owners that if they had any issues or objections to come to the Planning Commission's meeting; however, neither of those property owners were present. Commissioners asked the applicant and engineer if they would agree to place a statement on the master development plan indicating that the existing fence would be repaired and maintained. The applicant and engineer agreed to add the statement. By a majority vote, the Planning Commission recommended approval of the master plan with the stipulation that a statement would be included on the master development plan agreeing to repair and maintain the existing fence. In addition, the Commission recommended that the waivers be granted. The vote was as follows: YES (TO APPROVE): Watt, Unger, Morris, Thomas, Kriz, Triplett, DeHaven NO: Straub, Gochenour (Note: Commissioner Ours was not present for this vote; Commissioners Rosenberry and Light were absent from the meeting.) Entrance Spacing Waiver - Approved On November 29, 2004, by a majority vote, the Planning Commission approved an entrance spacing waiver to allow the proposed entrance (Burlington Court) to be less than 70 feet from the private driveway entrance on the Harless property. STAFF CONCLUSIONS FOR 01/26/05 BOARD OF SUPERVISORS MEETING: This preliminary master development plan proposes up to 20 age restricted single-family small lot age restricted dwellings on 4.67 acres of land, currently zoned RP (Residential Performance) District. In order for the Board of Supervisors to grant administrative approval of this Master Development Plan, a waiver for a setback reduction from two of the adjoining properties is necessary. Other than the necessary waiver, this Master Development Plan is consistent with the MDP # 10-04, Hilda Maye Meadows January 18, 2005 Page 5 requirements of Article XVII, Master Development Plan, of the Zoning Ordinance. All of the issues identified by the Board of Supervisors should be appropriately addressed by the applicant. The Planning Commission recommended that administrative approval be authorized on November 17, 2004. The applicant is seeking approval of a setback waiver and authorization of the preliminary master development plan by the Board of Supervisors. Mills, Planner II -YU RE: Public Meeting - Request of Exception — Hilda Maye Meadows DATE: November 29, 2004 On November 17, 2004 the Planning Commission recommended approval of a Master Development for Hilda Maye Meadows; however, staff has noticed that this project does not meet the minimum entrance spacing for Apple Valley Road. Staff has received a waiver request from Bowman Consulting to allow for the reduction in the entrance spacing for new driveways on minor collector roads. The request is to allow a new public road to be placed less than 70 feet from an existing residential driveway. A copy of the new road and the existing driveway has been included for your information; the circled area denotes the areas that will be affected by this waiver. The zoning ordinance §165-29A(6) specifies that: `The minimum spacing for access on minor collector roads shall be 70 feet between driveways and between driveways and intersections." In accordance with Section 165-2913(1), the Planning Commission may allow other means of motor vehicle access which do not meet the requirements set forth in 165-29. The single family small lot development in Hilda Maye Meadows is situated on the northern side of Apple Valley Road in Winchester. The approval of this waiver will allow this development to be built in conformance with the Master Development Plan submitted to the Planning Commission on November 17, 2004. One recreation unit is required in addition [to] the community center. Please show the location of the community center and speck what recreation unit will be and where it is located. " Response: A community center has been shown on Lot 2 by converting 20' of the existing 30' wide building in a community center. Parking has been shown for the 2000 building along the street at a parking ration of 1 space per every 150 sq feet or 4 spaces. Additionally a picnic area has been shown at the rear of lot 17 with a trail connection to the public street. �2. "Sidewalks. Sidewalks are required along the right-of-way and adjacent to the boundary of the right-of-way of all proposed streets and shall contain adequate handicapped ramps at all intersections. There also needs to be a grass border strip between the edge of the sidewalk and the curb face; on this plan, the sidewalks are flush with the edge of the curb. The sidewalks in this proposed development need to be extended to the end of the private street and along both sides of the public road to Apple Valley Road. " Response: The sidewalks within the community have all been moved to the right-of-way line providing at least a 1.5' grass strip between the back of curb and the sidewalk.
