This letter is to confirm the Frederick County Board of Supervisors' action at
their meeting of July 13, 1988:
Approval of Revised Final Master Development Plan #005-87 of Grove Heights for
211 single-family cluster lots. This version shows access to Purdue Drive and to
Route 781 and also shows a pump station pumping all sewage to the Sanitation
Authority System via a force main through the eastern portion of the project.
This property is located in the Shawnee Magisterial District.

Department's right-of-way.

PROPOSED USE AND IMPROVEMENTS: Single-family cluster housing
ALL PRELIMINARY MASTER DEVELOPMENT REQUIREMENTS HAVE BEEN INCLUDED IN THE FINAL
MASTER DEVELOPMENT PLAN
REVIEW EVALUATIONS:
VA Dept. of Transportation - No objection to the revised master development
plan. However, before we can make our final comments, it will be necessary
to submit a complete set of subdivision plans for our review. The proposed
utilities appear to be located beneath the roadway. If this is the case,
they should be relocated. It will be necessary to apply for a Land Use
Permit for the street connections onto the Department's right-of-way.
Sanitation Authority - 1. Show the tie in to existing manhole; 2. Show tie in
to existing waterline; 3. Bring waterline and blowoff to property corner (4
each); Show fire hydrant locations; 5. Move manhole to edge of pavement (6
each); 6. Take sewer lines to edge of construction; 7. Extend line so easy to
serve Lot 40; 8. Provide access road to pump station; 9. Check clearance
between sewer lines; 10. Sewer section too long (400 ft. max.); 11. If tie
into city water line must provide meter (4 each); 12. Water and sewer lines
to be kept to edge of road.
Greenwood Fire Company - The Greenwood Volunteer Fire Company has no problems
with this plan.
Parks & Recreation - This plan appears to be in order as it relates to open
space and environmental requirements.
Planning and Zoning - The proposal is for 211 single-family cluster lots on
74 acres. Under this proposal, there will be no access to Columbia Circle,

Blow offs needed [3 each]; 3) Show tie in to existing FCSA sewer line; 4)

July 21, 1987 - This will confirm that the Authority will have water and
sewer service available to the referenced subdivision on Route 50 upon
completion of our Airport Water and Sewer Project. This project is scheduled
to be completed in August 1988. Also, should the City not provide service to
that part of the subdivision which can be served by gravity flow to City
facilities, the Authority will.
August 17, 1987 - I have reviewed the preliminary master plan dated May 29,
1987, with latest revision June 26, 1987, for the referenced subdivision.
The Authority does not propose to have service available in the vicinity of
the subdivision until fall of 1988. The facilities available at that time
will provide gravity service to a part of the subdivision, specifically 39
lots numbered 127-153 and 199-210. Since the remainder of the subdivision
flows by gravity to existing City of Winchester sewer lines, accordingly, the
Authority recommends that portion be served by City utilities with the
aforementioned 39 lots served by the Authority.
Greenwood Fire Company - The Greenwood Volunteer Fire Company has no problems
with this plan.

Grove Heights
Planning and Zoning - The proposal is for 207 single-family cluster lots on
74 acres. The revisions primarily change the road layout and access to the
development from the previous proposal. Under this proposal, there will be
no access to Columbia Circle, Stanford Drive, or Harvard Circle. Access will
be to Purdue Drive and to Route 781.
The site contains woodlands and steep slopes and in both cases the
requirements concerning disturbance have been met. The requirements for open
space have been met with 18 acres of open space. No bonus provisions are
proposed and no buffers required. No recreation facilities are required.
All master plan and RP requirements have been met.
Access roads (stub roads) have been provided to serve property to the east.
This proposal emphasizes the need to determine the types of access needed to
serve large undeveloped RP areas in the County and to plan for that access.
STAFF RECOMMENDATIONS: Approval of the PMDP with final plans that will
incorporate access to Route 781 via the James H. Carroll property.

On Monday, August 10, 1987, I met with Mr. John Gregory and a
representative of the State Highway Department, to evuluate alternative
_ areas to better handle the traffic for the Grove Heights Subdivision.
It appears we can bring a road out of the Subdivision at the East Corner
and join it to Route 7�1, which intersects with Route 50 East at George
Washington Motors.
I believe this would relieve the traffic congestion and satisfy our
concern of heavy traffic in emergency situations for this Subdivision.
If this agreement can be reached we would be in favor of it.

Grove Heights

LOCATION: North of Route 50 East, near Interstate 81; north and east of the
existing College Park Subdivision.
MAGISTERIAL DISTRICT: Shawnee District
ADJACENT LAND USE AND ZONING: Developed and vacant residential land use and RP
(Residential Performance) zoning.
PROPOSED USE AND IMPROVEMENTS: Approximately 210 single-family cluster lots, open
space, VDOT streets, and required utilities.
REVIEW EVALUATIONS:
VA Dept. of Highways & Transportation - No objection to the master
development plan. It will be necessary for us to review the proposed
subdivision plans prior to making our final comment.
Sanitation Authority - This will confirm that the Authority will have water
and sewer service available to the referenced subdivision on Route 50 upon
completion of our Airport Water and Sewer Project. This project is scheduled
to be completed in August, 1988.
Also, should the City not provide service to that part of the subdivision
which can be served by gravity flow to City facilities, the Authority will.
Greenwood Fire Company - The only problem Greenwood Fire Company has with
this subdivision is traffic congestion. We now have problems with traffic in
this area, and problems getting fire apparatus through. If we can find a
solution to this, we have no further problems. Must meet. all County Fire
Codes, Chapter 10.
Planning and Zoning - The proposed site for this development is currently
woodland and vacant scrub and grassland. The amount of disturbance allowed
for woodlands has been exceeded on the plan. All other environmental
standards can be met. 15% open space is required for the single-family
cluster dwellings. This plan shows 22.8% open space in 17.5 acres. The open
space shown on this plan as "common area" is relatively evenly dispersed
throughout the development, with most being located along the northern
property line.

Grove Heights PMDP
No recreation facilities are required. No bonus regulations are being used.
Buffering and screening is not required. The development is extended from
the College Park Subdivision using existing stub streets. Along the eastern
property line, the developer proposes two stub streets to allow for future
development.
The proposed preliminary master development plan meets the intent and
standards of the Residential Performance Zoning District.
STAFF RECOMMENDATIONS: Approval, with changes to the final master development
plan to describe how the environmental protection requirements will be met
concerning woodlands.

74 acres. The revisions primarily change the road layout and access to the
development from the previous proposal. Under this proposal, there will be
no access to Columbia Circle, Stanford Drive, or Harvard Circle. Access will
be to Purdue Drive and to Route 781.
The site contains woodlands and steep slopes and in both cases the
requirements concerning disturbance have been met. The requirements for open
space have ,been met with 18 acres of open space. No bonus provisions are
proposed and no buffers required. No recreation facilities are required.
All master plan and RP requirements have been met.
Access roads (stub roads) have been provided to serve property to the east.
This proposal emphasizes the need to determine the types of access needed to
serve large undeveloped RP areas in the County and to plan .for that access.

Dear Mr. Walker:
On Monday, August 10, 1987, I met with Mr. John Gregory and a
representative of the State Highway Department; to evuluate alternative
areas to better handle the traffic for the Grove Heights Subdivision.
It appears we can bring a road out of the Subdivision at the East Corner
and join it to Route 781, which intersects with Route 50 East at George
Washington Motors. ,
I believe this would relieve the traffic congestion and satisfy our
concern of heavy traffic in emergency situations for this Subdivision.
If this agreement can be reached we would be in favor of it.

A G R E E M E N T
THIS AGREEMENT, made and dated this Zl/ day of
C'TUl3 [=2 , 1987, by and between EUGENE F . GROVE and
BARBARA A. GROVE, his wife, owners, and CARL BERNSTEIN,
contract purchaser, parties of the first part, hereinafter
referred to as Grove/Bernstein, and JAMES H. CARROLL, party
of the second part, hereinafter referred to as Carroll.
W I T N E S S E T H:
In consideration of the mutual exchange of property
hereinafter set forth and for other good and mutual
considerations, the parties agree as follows:
1. EXCHANGE OF PROPERTY:
(a) Carroll shall convey to Grove/Bernstein
the property described on Attachment A.
(b) Grove/Bernstein shall convey to Carroll
the property described on Attachment B.
2. WATER & SEWER LINES/STREET CONSTRUCTION:
Grove/Bernstein shall install the sewer line from the Grove
Heights Subdivision out to Route 781, and Carroll will be
responsible for the cost of installation of the sewer line
through his property. The cost to Carroll shall be agreed
upon by the parties prior to installation.
Grove/Bernstein shall install water lines to
Carroll's new property line and Carroll will have the
responsibility of the installation of the water lines on his
property.
Grove/Bernstein shall install the streets for
Grove Heights to Route 781 at their cost.

Grove/Bernstein shall install the water and sewer
lines as set forth above, and to construct the streets through
Carroll's new property to. Route 781, by September 30, 1988.

3. CONVEYANCE OF LOTS TO CARROLL: Lots A, B, C, D, E, i
F, G, H, and I shall be conveyed to Carroll after Grove/
Bernstein has recorded a Deed of Dedication for Grove Heights
which includes said lots. Any restrictive covenants
applicable to said lots shall be approved in writing by
Carroll prior to recordation.
4. SETTLEMENT: Settlement shall be at the offices of
Hall, Monahan, Engle, Mahan & Mitchell, Attorneys at Law, 9
East Boscawen Street, Winchester, Virginia, on or before the
30th day of January, 1988. At settlement the parties shall
convey the properties by general warranty deed, free and
clear from all liens and encumbrances, but subject to the
ordinary'.and usual utilities easements and rights of way and
duly recorded restrictive covenants.
5. CLOSING COSTS: The grantor in each conveyance will
pay for the costs of preparing the deed and the grantor's
transfer tax for recording said deed. The grantee in each
conveyance shall pay all other closing costs in connection
with the conveyance of that property.
6. PRORATION OF EXPENSES: All taxes, insurance,
interest, rent, escrow deposits, and all other charges
against the properties will be prorated as'of the date of
settlement.

7. CONTINGENCIES: This Agreement is contingent upon
Grove/Bernstein obtaining Master Plan approval, and any other
necessary approvals, from Frederick County for the approval
of Grove Heights Subdivision and the recordation of a

8. ENTIRE AGREEMENT: This Agreement constitutes the
entire agreement among the parties and may not be amended
except by written instruments executed by all of the parties.
9. SURVIVE SETTLEMENT: This Agreement shall survive
settlement.
10. CONSTRUCTION OF THE AGREEMENT: This Agreement
shall be construed and interpreted according to the laws of
the Commonwealth of Virginia and shall be binding upon and
shall inure to the benefit of the heirs, personal'
representatives, successors, and assigns of the parties.

This is. in response to your letter to Mr. W. H. Bushman,, Resident Engineer,
dated October 23, 1987 to the above referenced. The preliminary site plans have
been reviewed with the following comments:
The layout of the streets apppear satisfactory; however, we note one (1) inter-
section will -tie into Secondary Route 781 which intersects with Route 50 east of
our present project or. Route 50. The other intersection will intersect with
Purdue Drive or Route 796. A signal light is being provided at the Intersection
of Route 797 and Route 50; however, a signal light at Route 796 is not anticipated
since traffic generated by the subdivision could use the Route 797 intersection.
The Traffic Engineering & Safety Section reviewed the plans and have the follc7..-ying
comments listed below.
The development of the rather large subdivision will likely produce a need for
right turn lanes on Route 50 at some of the secondary intersections serving the
subdivision. However, until traffic patterns have been established, these needs
will be difficult to determine.
To answer your question concerning the impact of the subdivision on the proposed

The Authority does not propose to have service available in the

199-210. Since the remainder of the subdivision flows by'gravity

Through Mr. and Mrs. Marshall Crisman you indicated an interest in
the concern among.a group in Fairway Estates regarding land devel-
opment.
That concern is exemplified by the proposed plan under consideration
for College Park II otherwise known as Grove Estates.
The attached area layout shows four long established tax supporting
residential areas, of moderate density, within a large area planned
for development.
Article (6) para (6.1) of the MDP ---* "Statement of Intent" states in
part, "to insure that such development occurs in a manner that is har-
monious with adjoining property". .
The Grove Estates plan would seem to run counter to Article (6) par (6.1)
by nearly surrounding the existing Moderate Density established area with
such High Density land development.**
Additionally, approval of this plan would establish a precedent for the
remaining undeveloped land areas.
We are aware of the limitations in certain aspects of the existing MDP
and RP Zoning plans and invite you to meet with us on this matter.
In the meantime, our group believes it would not be in the best interest
of this area of Shawnee District to approve the Grove Estates plan as
currently presented.

representative of the State Highway Department; to evuluate alternative

It appears we can bring a road out of the Subdivision at the East Corner
and join it to Route 781, which intersects with Route 50 East at George
Washington Motors.
I believe this would relieve the traffic congestion and satisfy our
concern of heavy traffic in emergency situations for this Subdivision.
If this agreement can be reached we would be in favor of it.

Dear Sir,
As you may know, a real estate developer has proposed to build
a high -density, 210-unit cluster development next door to our
existing College Park Subdivision. This development, named Grove
Heights, will not have any direct access to any existing roads and
thus will have to use the existing roads of College Park for ingress
and egress to Route 50. The County Planning Administrator has
informed me that this will increase the traffic on our streets by an
estimated 2,100 cars a day, threatening to turn our neighborhood's
streets into main thoroughfares.
The Frederick County Department of Planning and Development has
recommended to the Frederick County Planning Commission that the
preliminary development plan for Grove Heights be approved, despite
a written statement of concern from the Greenwood Fire Company of
the problems presently existing in getting fire apparatus through
the existing subdivision due to traffic congestion. Moreover, the
Department of Planning has recommended approval of the development
despite the fact there is presently no existing sewer and water
service to serve the development. In addition, the Department of
Planning and Development has apparently overlooked the fact that
this development will cause increased noise and light pollution from
the hundreds of new residents. Despite this fact, the Administrator
stated that there is no need for a buffer zone between our homes and
the new development.

I urge you not to approve the preliminary development plan for
Grove Heights unless the density of this development is decreased
dramatically and the traffic patterns of its roads are modified to
direct traffic around, rather than through, the existing College
Park Subdivision. More than 50% of the homeowners in College Park
appeared on August 5th at a meeting of the Planning Commission to
voice their disapproval of this development. At that time, many
objections were made to "the configuration of Grove Heights" and
constructive suggestions were made by the present residents.
In this regard, I would like to recommend that you please
examine the possibility of reconfiguration of the streets of the
subdivision, eliminating all stub streets connecting to the College
Park Subdivision, so that traffic will be directed around the
existing homes. Moreover, the development is much too dense for
this area. Its density should be decreased perhaps to around 100
rather than 210 homes. Moreover, adequate fire protection and sewer
service should be guaranteed, not simply promised or proffered,
before this plan is approved. The present developer has admitted
that the property is under contract, and upon approval of the
development plan the property will be sold to another developer.
The owner of this land, therefore, has little concern for the
existing residents and apparently only wants to turn a fast buck and
leave the scene, leaving the existing residents with his mess 'to
deal with. I hope you will not allow this to happen. The
Comprehensive Plan of Frederick County stresses that new develop-
ments should be approved only if they do not interfere with existing
adjacent uses. I urge you to follow the goals of the Comprehensive
Plan and require changes in the preliminary and master development
plans to protect current residents.

Although the City has not received a formal request to provide
water and sewer to the subject subdivision, same has been the focus of
concern because of citizens interest, and notification of State
Regulatory Agencies of Infiltration/Inflow problems in the area.
Based upon these factors, the City's Utilities Committee has
discussed the provision of water and sewer service to Grove Heights.
Because of existing Infiltration/Inflow problems, and because the
Frederick County Sanitation Authority has indicated they can provide
service, the City is not comfortable with the prospect of City water
and sewer being provided. You are advised that you should look for
alternative means for providing water and sewer service, prior to
making any formal request of the City.

keep in satisfactory condition that property which will be
devoted to open space. There have been numbers of develop-
ments in Frederick County and elsewhere in which adequate
provision was not made and the developer walked away from
the problem, leaving the individual owners to wrestle the
matter out between themselves.
2. Without going into the final plan details, it
seems to me that the Planning Commission is also entitled
to an analysis of how traffic will be handled not only within
the subdivision but more importantly as it enters Route 50
West or enters and travels over Merriman's Lane. A heavily
traveled subdivision exit which bottlenecked into a two
lane country road certainly would not be justified and would
throw an additional burden for road construction on the
state and the county to the west on Merriman's Lane and the
city to the east. An exit onto Route 50 in the face of
eastbound traffic requires safety precautions.
3. It is my understanding that the School Board is
charged with the responsibility for development of school bus
routes.- Without knowing the final details of the plan, it
still would appear that the plan must adequately provide for
either school bus access to the development or access of the
children to school buses.
The environmental impact, and a number of other factors
are spelled out as the concern of the Planning Commission. I
submit that the,. various aspects of development encompass not
.only the development itself but with respect to these concerns as
spelled out in the ordinance, extend to the manner in which
the subdivision will fit into the community as a whole.
The developer owes a full explanation at this stage in regard
to these factors.
I am not at all certain that answers do not exist. I
simply feel that they should be made available at this stage.

I was present at the presentation of the Preliminary
Master Development Plan for the 48 single-family detached
cluster lots tentatively referred to as Westside Station.
The matter was carried over from September 16, 1987, to
the next meeting of the Frederick County Planning Commission
for further study.
Among the concerns expressed by the Planning Staff
were the pipestem designs contained within the preliminary
plat. This is of course a matter of major concern and
deserves the full consideration of the Planning Staff and
the Planning Commission.
However, I would suggest to you other matters of concern
which I believe should properly be considered at this time.
While a master plan at the preliminary stage is not as detailed
in terms of its internal lot lines, setbacks, and other matters
as will be the final development plan, nevertheless before
preliminary approval is given, I think that the following
questions certainly should be resolved:
1. It seems to me that, without knowing the details
necessary to a final plan, the Planning Commission not only
is entitled to but owes an obligation to future purchasers of
lots to find out how the developer intends to maintain and
