recreation facilities on the northwest side of Route 647 in the Opequon
Magisterial District.

PROPOSED USE AND IMPROVEMENTS: Develop 98.8 acres for residential use with 270

roads, and bonus recreation facilities.
REVIEW EVALUATIONS:
Highway Department - Generally satisfactory. It does appear however that a
number of the sewer and water facilities are located in the pavement of the
proposed roadways. These will need to be relocated on the final plans in
accordance with the current design manual.
Sanitation Authority - Generally satisfactory; minor changes in easement
location, hydrant location, and line sizes may be necessary on final plans.
Stephens City Fire Company - No comment.
Planning and Zoning - The Final Master Development Plan is drawn in
conformance with the approved Preliminary Plan. The approved Preliminary
Plan included all Master Plan requirements; therefore, no changes are needed
for the Final Master Development Plan.

Planning and Zoning - This is a Preliminary Master Development Plan for the
remaining portion of Greenbrier Village. Section I of Greenbrier Village was
developed under the previous R-3 Zoning regulations and no approval was
obtained for development of the remaining portion of this tract; therefore,
the remaining portions, being Sections II through IV, require the submission
of a Preliminary and Final Master Development Plan under the current
Residential Performance Zoning requirements.
The staff has reviewed the design of the Master Development Plan and the plan
is in conformance' with the requirements of the Zoning Ordinance. The
proposal is to develop 270 single-family detached traditional lots in a very
traditional suburban single-family design pattern. The applicant wishes to
decrease the amount of required open space from approximately 14.82 acres to
10.374 acres. In order to do that, he is proposing to develop one "bonus

recreation facility" to be placed in the major open area located in the
central portion of the site. The final details of this design will be worked
out prior to installation. Installation will begin when 50% of the total
lots are occupied and will be completed when 60% of the total lots are
occupied.
Drainage on this site is indicated in the darkened drainage easements which
converge on a location at the northern end of the site adjacent to the sewage
pump station and from there, travels northward across the Hack property to
Route 642 and thence through Lakeside Estates to the Opequon Creek. The
applicant proposes a detention basin adjacent to Blue Bird Drive which would
slow the rate of runoff from this site to approximately predevelopment rates.
The final design of this detention facility will be done at the subdivision
stage.
The other area of open space is located along the boundary of Interstate
Route 81 which should provide a buffer between those lots and that highway.
Maintenance of these open areas should be minimal and should not cause a
burden on the Homeowners Association given that a large number of members
will be involved in that association.
Environmental factors on this site are limited to very small areas of steep
slopes. Approximately 50% of these areas would be disturbed during
construction which would exceed the requirements of the ordinance. The
administrator does, however, have the ability to allow a greater percentage
of the environmental areas to be disturbed if this disturbance does not
significantly denigrate the overall environmental quality of the site. The
administrator would propose to use this code provision on this Master
Development Plan in that the steep -sloped areas involved are extremely minor
and would be improved by regrading in this case.
STAFF RECOMMENDATIONS: Approval.
PLANNING COMMISSION RECOMMENDATIONS: Unanimous for approval.

with the right of ingress and egress to and from same.
i It is agreed that the gas line to be laid under this grant shall be constructed and mr.-�necTr
below cultivation, so that Grantors may fully use and enjoy the premises, subject to the rights of cJ
the Grantee to maintain and ouerate said lines_
The interest of the Grantee in the property covered hereby is to be held subject to the lien and
in accordance with the provisions of the Indenture from the Grantee to State Planters Ratak &
Trust Company, Richinond, Virginia, Trustee, which has been or will be recordecl in :lie jurisdic-
tion in which the property covered hereby is situated.
The Grantee is further granted the right at anytime within ten (10) years from the dat•, hereof
to lay additional pine lines approximately parallel with the first pipe line laid hereunder and. the
right to maintain, operate and remove such additional pipe lines, upon the payment of the price
above mentioned for each additional pipe line to be laid. Also where necessary and convenient, ,0
Grantee may haul over the above described lands such pipe and material needed in the construction 15
of the lines on adjoining lands. .�
Grantee further agrees to pay for any damages that may arise from the construction, mainte-
nance, operation and removal of said lines.
As a part consideration herefor, Grantor shall be permitted to purchase gas from said gas line
for domestic purposes to be used exclusively upon the herein described premises, said sale and use
to be subject to the rules and regulations of the State Corporation Commission of Virginia. Grantor
shall furnish all equipment and assume all liability for the maintenance and operation of said equip-
ment from the line tap to and including the premises where said gas is used.
The Grantor covenants that Grantor has the right to convey the said easement; that the Grantee 41
shall have quiet and peaceable possession, use and enjoyment of the aforesaid easement of right- ti
of -way, rights and privileges, and that the Grantor will execute such further assurances thereof .C.;
as may be requisite.

tions or statements, verbal or written, have been made modifying, adding to, or changing the terms
of this agreement.
