Commonwealth of Virginia recorded immediately prior hereto,
and designated as Waterline Easement per the Legend on said
survey is hereby dedicated to the Frederick County Sanitation
Authority. The permanent easements conveyed herein grant to
the Grantee the perpetual right to install, lay and maintain a
sewer line, including the right to go on, over and upon the

said permanent easements for the purpose of installing,
laying, maintaining, repairing and replacing the same as
needed. Grantors, their successors and assigns, shall retain
the right to use this land which is subject to the easement
acquired herein in a manner which shall not interfere with the

rights, rights of way and easements of record, if any,
affecting the aforesaid property.

Dear Ron:
The purpose of this letter is to provide you with the information needed on the Final Master
Development Plan for the Garber Estate. Please provide our department with six copies of the
Final Master Development Plan that includes the following:
1,� Please provide an approval signature block for the County Administrator and the Director
of Planning.
2) Please provide a note specifying an "A Category Buffer" along the 407.06' Flying
Angles, Inc. property boundary line.
3) Please delineate the wetlands areas on this site and indicate the amount of wetlands that
will be disturbed. The original plan indicated wetlands near the retail entrance off of
Costello Drive, as well as in the southeastern portion of this property.
4) Please provide an inset location snap for this site.
5) Please provide a signature 'on the Professional Engineer's seal.
6) Please provide a note that designates the proposed northern entrance from Front Royal
Pike as a Right-In/Right-Out Only.
7) Please extend the segment of Costello Drive to the Frederick Group property line and
provide a development phase line that depicts the portion of the property and Costello
Drive that will be developed under each phase.
8) Please provide notes that address the VDOT comments specified in the July 25, 1994
letter. These include a note stating that the developer is responsible for temporary
entrance improvements including right and left turn lanes and a note stating that the
developer is responsible for all costs associated with the design and installation of a
traffic signal at the intersection of Front Royal Pike and Costello Drive.
9) Please provide a note that states the developer or subsequent owners of Phase I will

Dear Ron:
This is to follow-up on our meeting of July 21, 1994 to review the proposed 135,000+ sq. ft.
retail facility planned for the referenced location. After review of the project's
preliminary concept plan presented at the meeting, we offer the following comments:
1. Our planned improvements to this section of Route 522 are not scheduled to begin until
the spring of 1996. You indicated an opening date of February, 1995 was desired. The
developer will be required to construct temporary entrance improvements which include but
are not limited to right and left turn lanes to accommodate the site's traffic until such
time our project improvements have been completed. To avoid unnecessary future costs,
you will need to consider our proposed design for this portion of Route 522 when
designing your project.
2. when considering the size of this retail facility and the future extension of the
property's access road onto Prince Frederick Drive, a traffic signal at the access road
intersection with Route 522 will be required. You will need to provide us with a
detailed traffic analysis of what the retail facility will generate and of what impacts
the future access road extension will have on the Route 522 intersection. Whether
installation of a traffic signal is needed prior to the operation of the retail facility
or at a later date, the developer will be responsible for 100% of the design and
installation costs.
3. Any work performed within the Route 522 right-of-way must be covered under a land use
permit issued by the Department. A permit fee, surety bond coverage and the salary and
expenses of State assigned personnel will be required.
4. Although this comment is not directly related to this parcel, to prevent future turning
movement problems, we suggest the proposed access road extension to Prince Frederick
Drive be shifted southward slightly to align directly with the Corp of Ennineer's
entrance.

approved by the Director of Planning and Development. If the
MDP is prepared on more than one (1) sheet, match lines shall
clearly indicate where the sheets join.

and certified by a certified Virginia surveyor, architect or engineer,
with all dimensions in feet and decimals of feet, is required for all

(6) The topography shall be shown at contour intervals acceptable to
the Director.
/7) The title of the proposed project: the date, month, year the plan
was prepared or revised: the name of the applicant(s), owner(s)
and contract owner(s); and the names of the individuals or firms
preparing the plan shall be clearly specified.
(8) A schedule of phases, with the approximate location of phase
boundaries and the order in which the phases are to be
developed, shall be provided.
✓(9) The use of all adjoining properties shall be clearly designated on
the MDP.
10) An inset map shall be provided showing the location of the
project along with the location of all existing or approved public
roads, streets or rights -of -way within two thousand (2,000) feet of
the boundaries of the project.

County Engineer: We do not have any comments regarding the
proposed Master Development Plan. However, we do reserve the
right to review and comment on the proposed site plan.
Planning & Zoning: The Preliminary Master Development Plan
proposes retail and commercial development on a 28.86 acre
parcel. The proposed uses are permitted in the B-2, Business
General District, and would be consistent with the existing
and planned land use within this area.
The site does not contain woodlands, steep slopes, or streams;
however, a small area located in the southeastern portion of
this site is defined as wetlands. The project designer will
create an on -site storm water management area at this
location, which is consistent with the comments made by the
County Engineer. The proposed road is an extension of
Costello Drive from the Prince Frederick Office Park. This
connection was planned when the Prince Frederick Office Park
Master Development Plan was designed, and is consistent with
the approved plans.
The project designer has met with the review staff on -site,
and has had an opportunity to receive comments from the
Technical Review Committee. Comments that are noteworthy
include those made by VDOT and the Planning Department. These
comments reflect the proposed entrances off of Front Royal
Pike (Route 522 South). The VDOT comments address the need
for turn lanes, traffic signalization, and design consistency
with the planned widening of Front Royal Pike. The Planning
Department comments regard the proposed entrance that is
located just south of the F & M Bank property. The F & M
Bank property has an existing entrance that is within 150 feet
of the proposed entrance. Therefore, the entrance spacing
requirements for arterial roads can not be met unless the
project designer reaches an agreement with F & M Bank that is
consistent with the proposed design, or if a design is created
which restricts left turning movements onto Front Royal Pike
and is approved by the Planning Commission. Staff recommends
that the project designer include a note on the Final Master
Development Plan that describes these two options. One of
these options will have to be achieved prior to the approval
of the site development plan for this project.
STAFF RECOMMENDATIONS OF 9/7194: Approval, provided the Final
Master Development Plan addresses all review agency comments and
all comments and concerns of the Planning Commission and Board of
Supervisors.
PLANNING COMMISSION ACTION SUMMARY OF 917194: The Commissioners
felt that in order to provide for a continuous road network between
sites, Costello Drive should be extended to the easternmost
property line of the proposed subdivision. They also felt that
-access should be provided to the adjoining F&M Bank site and the
Delco Plaza site to minimize entrances on Route 522.
PLANNING COMMISSION ACTION OF 917194: Unanimously recommended
approval with the stipulation that Costello Drive be built to the
easternmost property line of the proposed subdivision or an
irrevocable bond be provided for the construction cost, including
inflation, for the entire length of road; and with the stipulation
that the plan address all review agency comments and all comments
and concerns of the Planning Commission and Board of Supervisors.

preliminary concept plan presented at the meeting, we offer the following comments:
1. Our planned improvements to this section of Route 522 are not scheduled to begin until
the spring of 1996. You indicated an opening date of February, 1995 was desired. The
developer will be required to construct temporary entrance improvements which include but
are not limited to right and left turn lanes to accommodate the site's traffic until such
time our project improvements have been completed. To avoid unnecessary future costs,
you will need to consider our proposed design for this portion of Route 522 when
designing your project.
2. when considering the size of this retail facility and the future extension of the
property's access road onto Prince Frederick Drive, a traffic signal at the access road
intersection with Route 522 will be required. You will need to provide us with a
detailed traffic analysis of what the retail facility will generate and of what impacts
the future access road extension will have on the Route 522 intersection. Whether
installation of a traffic signal is needed prior to the operation of the retail facility
or at a later date, the developer will be responsible for 100% of the design and
installation costs.
3. Any work performed within the Route 522 right-of-way must be covered under a land use
permit issued by the Department. A permit fee, surety bond coverage and the salary and
expenses of State assigned personnel will be required.
4. Although this comment is not directly related to this parcel, to prevent future turning
movement problems, we suggest the proposed access road extension to Prince Frederick
Drive be shifted southward slightly to align directly with the Corp of Engineer's
entrance.

Dear Bob,
I am enclosing the Trip Generation information for the proposed retail use
on U.S. Route 522 for VDOT's use. I have not provided any directional information.
The turn ratios used in the design of the new signal 800 ft. north of this area should
be used on this design. If this is not satisfactory, I can obtain turning movements
from the shopping center to establish an approach ratio on U.S. Route 522.
One key question which remains unanswered is when will Costello Drive be
extended through to Ryco or Prince Frederick. Since this cannot be estimated at this
time, it seems a design based on only the Garber Development would be
appropriate.
I expect to have a first draft of construction drawings for review within a day
or two and will forward them directly.

RE: Preliminary Master Development Plan Review of Biggs/Garber Tract
Dear Ron:
I have had an opportunity to review the above referenced master development plan. The final
master development plan should be revised to reflect the following comments:
1) Please provide a signature on the Registered Professional Engineer Certificate.
2) Please provide the road names (Front Royal Pike & Costello Drive) on the final plan,
and the speed limit for Front Royal Pike.
3) Please provide a table which depicts conditions for the total site, and conditions for the
proposed ,phases for each site. This table should include information ' regarding acreage
and environmental features.
4) Please update the legend to include the symbols for curb and gutter, proposed water,
proposed sewer, and what appears to be wetland areas.
5) Please provide development phase boundary lines for this tract.
6) Please provide the location of the storm water management area and a description of the
type of facility that is planned.
7) Our tax maps indicate that the 407.06 foot property boundary line described as N 84
degrees, 26 minutes, 38 seconds W, is owned by Flying Angles, Inc., and is zoned B-3.
Please provide information that lists the owner, zoning and use for this tract, as well as
a note specifying an "A Category Buffer" along this property line.
8) Please provide a signature and date block for the County Administrator and the Director
of Planning.
9) The proposed entrance from Front Royal Pike into this site just south of the F & M Bank
property does not meet the minimum entrance spacing requirements. One of the existing
entrances into the F & M Bank property would need to be closed to meet this
requirement, or a design would have to be created which eliminated left turning
movements at this entrance. The Planning Commission would have to approve any
reduction in the minimum entrance spacing requirements. Please resolve this issue prior
to the submittal of final master development plans for this project.

RE: Final Master Development Plan For Garber Estate
Dear Ron:
The purpose of this letter is to provide you with the information needed on the Final Master
Development Plan for the Garber Estate. Please provide our department with six copies of the
Final Master Development Plan that includes the following:
1) Please provide an approval signature block for the County Administrator and the Director
of Planning.
2) Please provide a note specifying an "A Category Buffer" along the 407.06' Flying
Angles, Inc. property boundary line.
3) Please delineate the wetlands areas on this site and indicate the amount of wetlands that
will be disturbed. The original plan indicated wetlands near the retail entrance off of
Costello Drive, as well as in the southeastern portion of this property.
4) Please provide an inset location map for this site.
5) Please provide a signature on the Professional Engineer's seal.
6) Please provide a note that designates the proposed northern entrance from Front Royal
Pike as a Right-In/Right-Out Only.
7) Please extend the segment of Costello Drive to the Frederick Group property line and
provide a development phase line that depicts the portion of the property and Costello
Drive that will be developed under each phase.
8) Please provide notes that address the VDOT comments specified in the July 25, 1994
letter. These include a note stating that the developer is responsible for temporary
entrance improvements including right and left turn lanes and a note -stating that the
developer is responsible for all costs associated with the design and installation of a
traffic signal at the intersection of Front Royal Pike and Costello Drive.
9) Please provide a note that states the developer or subsequent owners of Phase I will
provide and construct access to the property line of the F & M property and the Delco
Plaza property at such a time when Frederick County determines that complete access
can be accomplished
