THIS SPACE SHOULD BE USED FOR REVIEW COMMENTS: Signature--------------------------- ---------- Date-------------------- PRELIMINARY MASTER DEVELOPMENT PLAN #001-87 Fredericktowne Estates 116.45 acres, Zoned RP (Residential Performance) LOCATION: East side of Fredericktowne Subdivision MAGISTERIAL DISTRICT: Opequon ADJACENT LAND USE AND ZONING: Residences and vacant land zoned RP and agricultural and vacant land zoned A-2. PROPOSED USE AND IMPROVEMENTS: Single-family traditional development REVIEW EVALUATIONS: Highway Department - No objection to the preliminary master development plan. However, before we could make a review of this proposed development, we would need detailed plans in accordance with the subdivision policy. Sanitation Authority - The preliminary plan does not show the proposed location of utility systems as required in Section 21-6-4-3.1.8 of the County Code. Therefore, specific comments cannot be made at this time. It should be noted that, in my opinion, the existing sewerage transmission facilities in the Stephens Run Service Area do not have sufficient access capacity for this development. Additionally, the Stephens Run and,Lakeside Treatment Plants do not have capacity available at this time to serve the entire development. Stephens City Fire Company - Shall comply with Chapter 10 of the Frederick County Code as a minimum Planning and Zoning - The proposed development would include approximately 274 single-family traditional residences on lots averaging around 12,000 square feet. The requirement for 15% open space has been met with a strip of common area that runs diagonally through the development to an area directly adjacent to Sherando Park land. No bonus factors have been applied for. No recreational facilities are required. No buffers or screening are required. The site contains 19 acres of woodlands, no more than 80% of which can be disturbed. Requirements concerning steep slopes have been met. Detailed plans on street and utility design of the fire code will be required before subdivision approval. Page 2 MDP Fredericktowne Estates The proposed project will be accessed via two road connections with Section III of Fredericktowne. These primary connections will be to Wythe Avenue and Westmoreland Drive. It is the staff's understanding that the right-of-way connections through Fredericktowne III have been properly recorded and will be improved and dedicated by the applicants. The staff needs to insure that the connections to the existing streets are available. Also, the staff needs to insure that existing lots to the east of the site have access to dedicated or state -maintained streets. Confirmation of this will be done during subdivision review and approval. These access items should be clearly shown on the final master plan. The Sanitation Authority has stated that the existing sewerage (transmission line) facilities in Fredericktowne, Section II, do not have sufficient capacity to provide service to this area. Before this master plan is approved, information is needed on how the connections will be made with the existing sewer systems. In addition, the Sanitation Authority has stated that the Stephens Run and Lakeside Treatment Plants do not have the capacity to serve this entire area at this time. Policy decisions by the Sanitation Authority, the Planning Commission, and the Board of Supervisors are needed concerning how sewerage treatment will be provided to this area and the substantial areas zoned RP currently served by the Stephens Run and Lakeside treatment facilities. It is the staff's recommendation that no lots should be approved unless sewer service is provided. In this case, a master plan should not be approved until a plan for connecting with existing sewer systems has been provided and approved. In addition, approving the master plan will be problematic if sufficient treatment capacity will not be available in the near future. If the applicant plans to utilize the proposed Parkins Mill Sewage Treatment Plant for sewerage disposal, as part of their sewerage plans for this development, the sewage treatment plant must first be approved by the Sanitation Authority and County. The final plan needs to provide additional environmental detail, clarification on access, and proposals for sewage transmission. STAFF RECOMMENDATION: Table indefinitely until an adequate plan is provided by the applicant and approved by the Sanitation Authority for connecting with the existing sewage transmission systems. PRESENT: Frank Brumback, Chairman; James Golladay, Vice -Chairman; Carl M. McDonald; A. Lynn Myers; Manuel C. DeHaven; W. French Kirk; John T. P. Horne, secretary; Stephen M. Gyurisin, advisory ABSENT: Kenneth Y. Stiles; Marjorie H. Copenhaver; George L. Romine CALL TO ORDER Chairman Brumback called the meeting to order at 2:00 p.m. The first order of business was the approval of the minutes of February 2, 1985. Upon motion made by Mr. Golladay and seconded by Mr. Kirk, the minutes were unanimously approved as presented. MONTHLY AND BIMONTHLY REPORTS The Commission discussed pending applications with the staff. COMMITTEE REPORTS SANITATION AUTHORITY Mr. Kirk reported that the Sanitation Authority recently met and they have officially moved their meeting place into the old courthouse. Mr. Kirk stated that they also discussed an extension of water and sewer into the Route 522 South/Airport Road area. SITE PLANS Site Plan #003-85 of Wilmer Robert and Donna Norton Davis for a veterinary clinic and required parking in the Back Creek Magisterial District. ACTION - Approved Mr. Horne gave the background information. He said that the 60' x 30' building will be located at the intersection of Barley Drive and Route 11, north of Stephens City. He said the entrance will be off Barley Drive and not Route 11. Mr. Horne also noted that Mr. Michael Kehoe of the Stephens City Town Office has said that there has been a long standing drainage problem associated with this land. They believe that part is due to 2017 I • -2- i a spring that comes out on this land and drains toward the intersection. Mr. Horne said that he brought this to the attention of the Highway Department and they will do what they can to solve the problem during the construction of the entrance. Mr. Wilmer Robert Davis came forward and stated that Mr. Blaine Wilson will construct the building. Upon motion made by Mr. Golladay, seconded by Mr. Myers, and passed unanimously, BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Site Plan #003-85 of Wilmer Robert and Donna Norton Davis for a veterinary clinic and required parking at the intersection of Barley Drive and Route 11, north of Stephens City, in the Back Creek Magisterial District. Preliminary Master Development Plan #001-85 of Lakeside Estates to develop 256 acres for residential use in the Shawnee Magisterial District. ACTION - Approved Mr. Horne read the background material. Mr. Horne stated that in the open space area to the front of the property, along the intersection of Lakeside Drive and Route 642, there is an area designated for community services, fire and rescue, etc. Mr. Horne said that although fire and rescue areas are permitted in this area, the staff suggests that it be deleted at this time. He felt that this intersection may not be the most advantageous place to put a facility of this type because of the residences across the street. He added that deleting it off the plan would in no way preclude the possibility of it going into the area in the future. Mr. Horne stated that one change that has already been made on the plan is additional screening at the wooded ravine separating the single-family cluster units from the atrium and multiplex units. Mr. Horne stated that the applicants still need to indicate on the plan the exact phasing of construction by section. 2018 -3- Mr. David Holliday with Lakeside Development Company and Mr. Chuck Maddox, engineer with Gilbert Clifford Associates, came forward. Mr. Holliday stated that in the interest of long-range planning, they felt the fire and rescue area would be a good idea. He said that there will be a necessity for a facility such as this some time in the future. Mr. Holliday said that they could move the facility to another area or delete it altogether. Mr. Holliday next explained the phasing of development to the Commission. Mr. Golladay asked how many more homes the treatment plant could handle. Mr. Wellington Jones of the Sanitation Authority came forward and stated that currently the plant is rated at 120,000 gpd which could handle about 600 units. Mr. Jones said that about 220 units are on line now, which leaves the availability for about 400 units of expansion in the existing plant. Mr. Jones added that there is a problem with the existing plant, however, because they are getting a lot of extraneous flows, but they are entering into an agreement with the State Water Control Board to correct the problem and have made significant progress. Mr. Jones stated that the Authority realized that the Lakeside plant had limited capacity when they accepted it into their system. He said that although the Authority recognizes that the current plant cannot take care of all of this growth, it can handle close to half of it and the Authority will have to build new treatment capacity for all of it to be taken care of. Mr. Golladay said he was concerned about the impact of the multi -family residences on the single family residential units. Mr. Holliday said that they met with the homeowners of existing Lakeside last Monday night. He said a lot of people did not want government subsidized or 2019 i -4- multi -family residences built near them. Mr. Holliday stated that physical aspects of the site such as water flow, aesthetics, screening, and buffering were all taken into account in designing the housing layout. Mr. Holliday said they would be willing to move the multi -family units closer to the Agape property. Mr. Harrington Smith, homeowner in the existing Lakeside Estates, came forward to speak in opposition to this development. Mr. Smith first spoke about the community service area. He said that the Route 642 entrance is very dangerous because of poor visability and he recommended that nothing be built on that corner. He said that this area also has very poor drainage. He said that when it rains, water goes across Route 642 and floods the area where new housing is proposed. Mr. Smith was not in agreement with Mr. Jones' statements regarding the number of connections the treatment plan could handle. Mr. Smith,felt the plant was currently working at capacity. He said that he had a report from the State Corporation Commission, dated May 31, 1983, stating there was a 41% loss of water in the system. Mr. Smith stated that there are three different sets of pipes with plastics and copper connected together and there is a lot of breakage. He said that his sewer pipe was 4' out of the ground crossing a ditch. He added that his asphalt driveway has been dug up three times in order to correct a water problem. He also added that the streets are continually dug up and not repaired properly. Mr. Samuel Ensogna, representing Agape Christian Center, an adjoining property owner, stated that he was not in opposition to the development but would like to be kept informed of the development of Lakeside. 2020 • -5- i Mr. James Silvester came forward and stated that he was an adjoining property owner and was currently building a house on Lot 26, Section A. Mr. Silvester stated that he had submitted a letter to the Commission regarding his concerns on the proposed fire and rescue building across the street from his lot. Mr. Silvester stated that he has three small children and he felt that a fire station across the street could adversely affect his children. Mr. Golladay asked if Mr. Silvester would object to a community service building at that location. Mr. Silvester stated that it would depend on the noise generated. Mr. Robert Kinser, Lot 6, Section C, of the existing Lakeside came forward. Mr. Kinser stated that Lakeside Drive and Route 642 is a dangerous intersection. Mr. Kinser felt that Route 642 could not handle another 400-600 dwellings with 1 1/2 cars per dwelling. He also said that the water is a terrible problem. Mr. Kinser was also concerned about depreciation of the existing homes if government subsidized housing is built nearby. Mr. Chuck Maddox came forward and stated that all the subjects that J have been discussed were considered by the developer. Mr. Maddox said that it is not their intention to build any houses that would be flooded or to increase the flood problem where it exists. Mr. Maddox said that State Law prohibits them from increasing any drainage problem that exists now. Mr. Maddox said that with regard to water and sewer, the plan is subject to review and approval by the,,Virginia State Health Department and the State Water Control Board to insure the capability of the system. Mr. Golladay moved to make the letter from Mr. James Silvester a part of the official record. This motion was seconded by Mr. DeHaven and 7 passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby include the letter from Mr. James L. Silvester, lot owner at Lakeside 2021 • i Estates, to the Frederick County Planning Commission as part of the official record as follows: February 19, 1985 To the Frederick County Planning Commission c/o John Horne I am a lot owner at Lakeside Estates and currently building a house on Lot 26 of Section A (also referred to as Section 1). It is my understanding that it is proposed that a fire and rescue station be constructed at the corner of Lakeside Drive and Route 642. Let it be known that I am opposed to such a structure at this location for four reasons. First, the proposed structure would be directly across the street from existing houses (Lots 26 and 27 of Section A). The couples residing on these lots have small children that might be disturbed at night when alarms are sounded This would have a negative impact on the health of these children. Second, the proposed building may constrict the flow of water down the creek running parallel with Lakeside Drive and force the flow, during heavy rains, onto Lakeside Drive and threaten housing on the south of the drive. Thirdly, most fire and rescue stations in the county are located at a reasonable distance from family housing units. Why should this be the exception? Fourth, the aforementioned would most likely have a negative impact on the property values of the two lots in question. I write this letter realizing the need for expanding adequate fire and rescue protection in any community preparing itself for growth. At the same time I respectfully request that due diligence and responsibility be exercised when individual and family interests are at stake. Sincerley, James L. Silvester JLS/clp Chairman Brumback asked for each of the Commissioners' feelings on this plan and although there was concern on the sewer and water they felt the plan followed the adopted ordinance very well and that it gave the Commission a long-range plan of what they could expect for this area in years to come. Mr. Kirk then moved to accept this preliminary plan with the provision that the corner lot at the intersection of 642 and Lakeside Drive be designated as 2022 • -7- open space and not 'a community service building. This motion was seconded by Mr. McDonald and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Preliminary Master Development Plan #001-85 of Lakeside Estates to develop 256 acres for residential use with a combination of single-family detached cluster, traditional, atrium, quadplex, triplex, townhouse, and garden apartment units at the northeast side of Route 642, northeast of Stephens City, Shawnee Magisterial District, with the provision that the corner lot at the intersection of Route 642 and Lakeside Drive be designated as open space and not for community services. Mr. Christopher Molden, Vice President of Valley Mortgage and Investment Corporation, and Mr. Chuck Maddox of Gilbert Clifford Association came forward to answer any questions. Mr. Golladay inquired if the subdivided lots were the same size as proposed on the master plan and Mr. Horne replied that they were. Mr..Golladay,asked about the Highway requirements and Mr. Maddox replied that they met with the Highway Department and all the requirements will be met. Upon motion made by Mr. Golladay, seconded by Mr. DeHaven, and passed unanimously, BE IT RESOLVED, That the Frederick County Planning Commission does hereby give approval to Albin Village to subdivide 47 single-family detached cluster lots, state -maintained roads, and required open space on Route 647 in the Opequeon Magisterial District. EXTENSION OF SEWER AND WATER FACILITIES Mr. Horne stated that the staff has been in contact with the Virginia Department of Housing and Community Development about the possible 2023 i use of Community Development Block Grant funding for the extension of sewer and water facilities into the Route 522 South/Airport Road area. Mr. Horne said the basis for application for funding under the program would be to serve low and moderate income housing. Mr. Horne said that the staff would like to do an income survey on the area immediately adjacent to Bufflick Road on Route 522, south of Smith's Transfer and the Bufflick Road area itself. After some discussion on the design.of the project, Mr. Kirk moved for approval. This motion was seconded by Mr. McDonald and passed unanimously, BE IT RESOLVED, That the Frederick County Planning Commission does hereby authorize the staff to proceed with the income survey and design of a grant application to the Virginia Department of Housing and Urban Development.
