MAGISTERIAL DISTRICT: Shawnee PROPOSED USE AND IMPROVEMENTS: Amendment of Master Plan to reduce lots from 71 single-family cluster and 38 patio units to 71 single-family cluster and 30 patio units. REVIEW EVALUATIONS: Inspections Department - Proposed construction to be in accordance with the Virginia Industrialized Building and Mobile Home Safety Regulations and other applicable standards. Planning and Zoning - The amended plan removes lots from the northwest corner of the parcel, which is appropriate given the technical difficulties of designing a road into that area. However, the new plan also places new lots on the cul-de-sac in areas with excessively steep slopes. In particular, lots 96 and 97 have slopes in the buildable area averaging 30%. On portions of the lot, slopes exceed 40%. It is the staff's opinion that sufficient information has not been provided to show that the site is completely free of danger to health and safety as required on Section 3-2-2 of the Subdivision Ordinance. In addition, building sites on such steep slopes do not meet the intent of the RP District as described by Section 5-1-6 of the Zoning Ordinance. STAFF RECOMMENDATIONS: Disapproval. Virginia - 22601 • • FINAL MASTER DEVELOPMENT PLAN Country Park 71 Single -Family Cluster Lots & 38 Patio Lots LOCATION: Northwest corner of the intersection of Senseny Road and Greenwood Road. MAGISTERIAL DISTRICT: Shawnee PROPOSED USE AND IMPROVEMENTS: Develop and construct 71 single-family cluster units at approximately 8,000 square feet per lot and 38 patio units, 29 at less than 5,000 square feet per lot and 9 at greater than 5,000 square feet per lot. PLANNING & ZONING COMMENTS: The environmental features present on this site are woodlands and steep slopes. The southern portion of the site nearest to the corner of Greenwood and Senseny Roads is a relatively flat open grassland field which will be developed first. The northern portion of the site becomes heavily wooded and is traversed by two steep ravines which act as drainage areas for this site and a relatively large area to the southeast. This area will be developed at a later date. Housing will be centered in the southern field and on three ridges which extend in a north -south direction in the central and northern portions of the site. Open space areas. will be primarily centered around the steeper drainage areas on the northern and central areas of the site. Some open areas will also be included in the required buffers along Senseny and Greenwood Roads and between the units and the commercial area. The open space buffer areas between Section I and Section II, between the southernmost units and the commercial area and Senseny road, and between the units and Greenwood Road are within Grassland areas. The proposal is to leave those areas in their present vegetation which should require periodic mowing by the homeowners. The remaining open areas are within wooded areas and grasslands. Neither of these two open areas should become a burden to the homeowners association. It is the staff's understanding that Mr. Glass intends to retain ownership of the great majority of these units and therefore, maintenance of open areas should remain in Mr. Glass' hands for a considerable period.of time. • • Page 2 Country Park April 5, 1984 The most significant environmental limitation on development of the housing and open areas is the steep slopes. Approximately 23.43% of the steeped sloped areas are to be disturbed during development. This would meet the requirement of no more than 25% of the steeped sloped areas to be disturbed. The ordinance also restricts disturbance of the woodlands areas to' no more than 20%. The proposal would disturb approximately 19.56% of the woodland areas. I would refer the Commission to pages four and five of the environmental data for these calculations., This proposal includes one bonus factor which is to be used for the provision of a pedestrian or bike path serving the entire development and connecting with the adjacent business area. This bonus provision would allow a 20% increase in gross density and the Final Master Development Plan reflects this density. The plans show the location of the proposed bike and pedestrian path which will be constructed according to the provisions under the ordinance. The final design issue on this particular site is the existing private driveway which exists for access to two adjacent tracts and goes through the open areas to the north end of the site. This driveway is a private prescriptive drive for those two parcels only. Enclosed is a letter from Mr. Glass' attorney stating his opinion.as to the status of this right-of-way. Under the ordinance, roads are not allowed to be counted towards the open space provision and therefore, this drive does not count towards the open space provision. This would drop the open space calculations in the environmental data from approximately 9.64 acres to 9.44 acres and the open space percentage from 30.52% to 30%. The overall design of this site will meet the intent of the residential performance article of the zoning ordinance, with the 20% increase in gross density. The environmental requirements of the ordinance are being met and the open space included on the site will be useful and maintainable to the homeowners association. Sale or transfer of any Lot shall not affect the assessment lien. However, the sale or transfer of any Lot which is subject to any mortgage, purcuant to a decree of foreclosure under such mortgage or any proceeding in lien of foreclosure thereof, shall extinguish the lien of such assessments as to payments thereof which become due prior to such sale or transfer. No sale or transfers shall relieve such Lot from liability for any assessments thereafter becoming due from the lien thereof. Section 10. Exempt Property. This right of way is not a dedicated right of way, but is a right of way which has come about through use in excess of twenty years, which is known in the law as a prescriptive right of way. As a prescriptive right of way, the ownership of the lands over which the right of way exists vests in Thomas C. Glass; however, Fletcher would have the right of ingress and egress over the same, which Glass could not block. It should be noted that there is no duty upon Glass or any of his successors in interest to improve the right of way at any time, regardless of the disrepair the road might fall into. It should also be noted that this prescriptive right of way is for the Fletcher lands only and Fletcher could not grant rights of way over the roadway for lands adjoining his land. It should be further noted that Thomas C. Glass and his successors in interest would also have right to use the right of way for ingress and egress so long as their action taken would not be in conflict with the use by Fletcher and his successors in interest. In other words, parking on the right of way would not be allowed because that might impede Fletcher's ingress and egress. MAGISTERIAL DISTRICT: Shawnee PROPOSED USE AND IMPROVEMENTS: Develop and construct 71 single-family cluster units at approximately 8,000 square feet per lot and 38 patio units, 29 at less than 5,000 square feet per lot and 9 at greater than 5,000 square feet per lot. PLANNING & ZONING COMMENTS: The environmental features present on this site are woodlands and steep slopes. The southern portion of the site nearest to the corner of Greenwood and Senseny Roads is a relatively flat open grassland field which will be developed first. The northern portion of the site becomes heavily wooded and is traversed by two steep ravines which act as drainage areas for this site and a relatively large area to the southeast. This area will be developed at a later date. Housing will be centered in the southern field and on three ridges which extend in a north -south direction in.the central and northern portions of the site. Open space areas will be primarily centered around the steeper drainage areas on the northern and central areas of the site. Some .open areas will also be included in the required buffers along Senseny and Greenwood Roads and between the units and the commercial area. The open space buffer areas between Section I and Section II,_ between the southernmost units and the commercial area and Senseny road, and between the units and Greenwood Road are within Grassland areas. The proposal is to leave those areas in their present vegetation which should require periodic mowing by the homeowners. The remaining open areas are within wooded areas and grasslands. Neither of these two open areas should become a burden to the homeowners association. It is the staff's understanding that Mr. Glass intends to retain ownership of the great majority of these units and therefore, maintenance of open areas should remain in Mr. Glass' hands for a considerable period of time. Page 2 Country Park The most significant environmental limitation on development of the housing and open areas is the steep slopes. Approximately 23.43% of the steeped sloped areas are to be disturbed during development. This would meet the requirement of no more than 25% of the steeped sloped areas to be disturbed. The ordinance also restricts disturbance of the woodlands areas to no more than 20%. The proposal would disturb approximately 19.56% of the woodland areas. I would refer the Commission to pages four and five of the environmental data for these calculations. This proposal includes one bonus factor which is to be used for the provision of a pedestrian or bike path serving the entire development and connecting with the adjacent business area. This bonus provision, if the Commission should choose to allow the full 20% bonus, would allow for the development of the proposal as presented. The plans show the location of the proposed bike and pedestrian path which will be constructed according to the provisions under the ordinance. The staff would request that the Commission make the decision as to whether the connection of this bike path to the vacant commercially zoned area would qualify for the additional 10% bonus over and above the basic 10% bonus for the provisions of a bike and pedestrian path for the development. Mr. Glass has stated that his intent is to develop this commercial area in the future, but there are no existing commercial establishments in this zone at this time. The final design issue on this particular site is the existing private driveway which exists for access to two adjacent tracts and goes through the open areas to the north end of the site. This driveway is a private prescriptive drive for those two parcels only. Enclosed is a letter from Mr. Glass' attorney stating his opinion as to the status of this right-of-way. Under the ordinance, roads are not allowed to be counted towards the open space provision and therefore, this drive does not count towards the open space provision. This would drop the open space calculations in the environmental data from approximately 9.64 acres to 9.44 acres and the open space percentage from 30.52% to 30%. The overall design of this site will meet the intent of the residential performance article of the zoning ordinance, if the Commission should determine that the proposed pedestrian and bikeway would make the site eligible for a 20% increase in density. The environmental requirements of the ordinance are being met and the open space included on the site will be useful and maintainable to the homeowners association. Williamson Assistant Commonwealth's Attorney Office of the Commonwealth's Attorney Of Frederick County 321 South Loundon Street Winchester, VA 22601 RE: Homeowners' Associations Dear Glenn: I reviewed your correspondence of May 2, 1984 and the following comments deal with your opinion of Article 5, Chapter 21 of the Frederick County Code: I agree that the county may require the provision of common elements and their maintenance (15.1-489, Purpose of Zoning Ordinances), and failure to maintain such areas or elements shall be punishable as any other zoning code violation (15.1-491 (e)). My first question references your suggestion that the county may perform maintenance of common elements if those responsible fail to do so. I am unaware of any authority in Title 15.1, Chapter 11, Article 8, Zoning, of the Code of Virginia, which provides for such actions by the county without the appropriate court process. It is my understanding that for any such zoning code violation, ie. failure to maintain a jungle jim set or a common area as our ordinance requires presently, those responsible would be charged with a misdemeanor. If the court determines that those responsible were violating the Frederick County Zoning Ordinance, they then could be fined up'to $1,000 per day and charged with a misdemeanor violation. This is the only reference to penalties for conviction of any violation of the zoning ordinance that I can find. I agree that the county or zoning administrator may bring legal action to insure compliance with the ordinance, but not without first the appropriate court process. Again, I cannot find the authority where the county can step in and perform maintainence and charge owners respectfully without the appropriate court injunctive or abatement proceedings. I would like to point out for your consideration that Article 5, Section 5-8, Homeowners' Associations, does not require the developer or owner to provide for a homeowner=association unless lots or units are sold. If lots or units are sold, then the county code requires a homeowners' association to fulfill the intent of the article. The authority which allows the county to require homeowners'. associations may be found in Title 15.1, Chapter 11, Article 8, of the Code of Virginia, under two areas: 9 Court Square - P.O. Box 601 - Winchester, Virginia - 22601 • • May 17, 1984 Page 2 First, 15.1-489, Purpose of Zoning Ordinances, allows the county to require homeowners' associations to fulfill the general purpose of promoting health, safety, and general welfare. Article 5 of Chapter 21, Zoning Requiring Home- owners' Associations, is designed to accomplish the objectives of 15.1-489 and 15.1-486. 15.1-486, Zoning Ordinance Generally; Jurisdiction of Counties and Municipalities Respectfully, states the county is allowed to classify into districts, such as the RP (Residential Performance District) and is given the authority to regulate the use of land. I would suggest that the requirement of a homeowners' association is designed to fulfill the purpose of zoning and is implied in the authority to regulate. Secondly, to insure that all the owners of lots or units in residential performance developments are treated equally, and that the zoning administrator's decisions are not arbitrary in nature, the county must provide standards for the guidance of administrating and enforcing the provisions of the ordinance. 15.1-491, Permitted Provisions in Ordinance; Amendments, states that a zoning ordinance may include among other things reasonable regulations and provisions for administrating and enforcement and for the imposition of penalities (misdemeanors). I would suggest that the requirement of a homeowners' association is a reasonable regulation considering the requirements of the residential performance zoning district. Additionally, review by the zoning administrator of the deed of dedication to ensure that a homeowners' association will be created is a reasonable and equitable administrative and enforcement provision and ensures that the county is not responsible for the maintenance of common elements which is the intent of the residential performance ordinance unless those common elements are dedicated to the county. Further is the intent of the ordinance that those common elements not only be maintained by the lot or unit owners, but that they are to be used by those owners and not by the citizenry of the county generally. I would suggest that the authority does exist allowing the county to require homeowners' associations and that if such associations fail to perform common element maintenance or fail to exist as an association of lot or unit owners, either the association or the IME individual lot owners or the developer/owner would be in violation of r the zoning ordinance. Because of the number of larger jurisdictions in Virginia that require homeowners' associations and because of the changing trends in zoning regulations, I would again suggest that our ordinance fulfills the purpose of zoning as is outlined in the Code of Virginia. • • May 17, 1984 Page 3 I believe there is an organization called The Local Government Attorneys Association.
