Dear Mr. Jones,
During the beginning of June 2000, Judy Construction began construction on the
extension of a sewer line from the Carlisle Heights Subdivision connecting to the Briarwood
Estates subdivision which is under development in Eastern Frederick County. This work was
being done at the intersection of Woodrow Road and Dot's Way in an area listed on the
subdivision plats as a 50' R/W Reserved For Future Street. This area is boarded on each side by
completed residential homes, both of which have children of various ages. This property has been
also maintained by these residents and is often utilized by their children for playing.
One afternoon, several pieces of heavy construction equipment arrived on this lot and was
left there overnight. As President of the Homeowners Association, I immediately starting
receiving phone calls and inquiries in reference to this construction equipment. All of the calls
and inquiries went without an explanation as to what was about to take place. During the next
couple of days, and still proceeding today, construction began by excavating this area and
removing many trees for the installation of the sewer line. Immediately upon learning of this
sewer line extension project, I contacted Mr. John Whitacre as to the work being done and why
the Carlisle Heights Homeowners Association and the adjoining residents were not notified of this
extensive construction project. I also contacted the Sanitation Department Engineering Section,
the Frederick County Public Works Department and the Frederick County Department of
Planning and Development in order to find out whose responsibility it was to notify the
Homeowners Association and these adjoining residents. Well as of this date, I still do not have an
answer as to .this responsibility. Every County Agency including the Sanitation Authority has
passed the responsibility to someone else. I found the Frederick County Planning Department to
be most helpful in answering several of my concerns and questions regarding this project.
The purpose of this letter is to express the dissatisfaction of the Carlisle Heights Board of
Directors as well as the surrounding homeowners concerning the Frederick County Sanitation
Authorities lack of notification regarding this approved project. We feel that the Sanitation
Authority at some point approved these plans and even maintained an inspector on site and it is
the job and responsibility of the Sanitation Authority to make the appropriate notifications. I am
asking you to put yourself in the shoes of the adjoining homeowners when this heavy equipment
starting operating for an unknown reason.

I also brought to the attention of Mr. Whitacre on June 29, of several unsafe conditions at
this work site. These conditions included an approximate 12' deep trench left unattended and
partly surrounded only by a thin piece of red tape that was partially lying on the ground on one
side and held up by a tree stick on the other side (see photo enclosed). No fencing or other
barriers was erected to keep residents, especially children from entering or falling into this trench.
As previously stated, this is a residential community consisting of 358 lots and many young
curious children. My concerns immediately focused on the safety of these children. The response
of Mr. Whitacre was that the Sanitation Authority has no jurisdiction concerning the enforcement
or correction of these unsafe conditions. With little of no direction as to who to report these
violations to, a report was made to the Virginia Occupational, Safety & Health Administration. I
was hoping that these safety concerns could have been handled on a more local level through a
local inspection or phone call to the construction company performing the work. I believe that
this was a total disregard for the residents of Carlisle Heights and citizens of Frederick County.
I hope that I have provided you with information concerning this ongoing construction
project and have made you aware of the Carlisle Heights Homeowners perspective regarding this
project. I hope that in the future, other subdivisions and homeowners can receive a better flow of
information and be informed of any potential construction projects within our local communities
concerning the Frederick County Sanitation Authority.

PROPOSED USE AND IMPROVEMENTS: Single-family traditional and townhouses
ALL PRELIMINARY MASTER DEVELOPMENT PLAN COMMENTS HAVE BEEN INCORPORATED IN THE
FINAL MASTER DEVELOPMENT PLAN.
REVIEW EVALUATIONS:
VA Dept. of Transportation - See attached memo dated December 11, 1987. The
developer must be advised that before any work is done on the department's
right-of-way, a land use permit for the street connection on Route 656 must
be applied for and approved.
Sanitation Authority - 1. Need sampling and metering stations with access
road; 2. Need Gate Valves. 3. Man hole runs too long. 4. Want easement for
future line. 5. Line under bldg? 6. See drawing for remarks.
Greenwood Fire Company - Rearrangement of fire hydrants to allow better fire
department access, as we have shown on site plan, would be the only problem
we have with this plan. However, the widening of Route 656 (Greenwood Road)
may need"to be moved ahead to handle this traffic.
Inspections Department - This request for master development plan shall
comply to Use Group "R" (Residential), Section 308.0, of the BOCA Basic
National Building Code 1984..
Planning and Zoning - The proposal is a final master plan for approximately
96 townhouses and 267 single family traditional lots with open space,
streets, and utilities on 153 acres. The plan was submitted before the
recent RP amendments were adopted. The proposed uses are allowed.

Carlisle Estates II MDP
There are ten acres of floodplains, 48 acres of steep slopes, and 60.5 acres
of woodlands. All environmental disturbance requirements have been met and
most of those environmental areas have been placed in open space. Open space
requirements have been met with 56 acres, or 36% of the total area, in common
open space.
At least three units of recreation facilities must be provided in relation to
the townhouses. The location of these facilities is shown. Details on these
will be required on the final site plan which will be reviewed by the
Planning Commission and staff.
On the plan, the townhouses are separated from single family areas by large
areas of common open space, meeting buffer requirements. A single family
home is located across Greenwood Road from the entrance to this project.
Additional buffers may be needed in relation to that dwelling. A 70' buffer
is shown along Greenwood Road, This represents an allowed reduction,
requiring partial screening. No bonus provisions are requested.
The plan shows a single main entrance on Greenwood Road with proposed future
stub connections to the south and east. The Sanitation Authority facilities
are located in the center of this facility, but will close operation in the
near future.
The plan meets all RP standards and preliminary master plan requirements.
It should be noted that the lots along Valley Mill Road have been deleted, as
requested, and these lots have been incorporated into one three -acre tract
with the existing dwelling.
STAFF RECOMMENDATIONS: Approval.

REVIEW EVALUATIONS:
VA Dept. of Transportation - See attached memo dated December 11, 1987. The
developer must be advised that before any work is done on the department's
right-of-way, a land use permit for the street connection on Route 656 must
be applied for and approved.
Sanitation Authority - 1. Need sampling and metering stations with access
road; 2. Need Gate Valves. 3. Man hole runs too long. 4. Want -,easement for
future line. 5. Line under bldg? 6. See drawing for remarks:
Greenwood Fire Company - Rearrangement of fire hydrants to allow better fire
department access, as we have shown on site plan, would be the only problem
we have with this plan. However, the widening of Route 656 (Greenwood Road)
may need to be moved ahead to handle this traffic.
Inspections Department - This request for master development plan shall
comply to Use Group "R" (Residential), Section 308.0, of the BOCA Basic
National Building Code 1984.
Planning and Zoning - The proposal is a final master plan for approximately
96 townhouses and 267 single family traditional lots with open space,
streets, and utilities on 153 acres. The plan was submitted before the
recent RP amendments were adopted. The proposed uses are allowed.

Carlisle Estates II MDP
There are ten acres of floodplains, 48 acres of steep slopes, and 60.5 acres
of woodlands. All environmental disturbance requirements have been met and
most of those environmental areas have been placed in open space. Open space
requirements have been met with 56 acres, or 36% of the total area, in common
open space.
At least three units of recreation facilities must be provided in relation to
the townhouses. The location of these facilities is shown. Details on these
will be required on the final site plan which will be reviewed by the
Planning Commission and staff.
On the plan, the townhouses are separated from single family areas by large
areas of common open space, meeting buffer requirements. A single family
home is located across Greenwood Road from the entrance to this project.
Additional buffers may be needed in relation to that dwelling. A 70' buffer
is shown along Greenwood Road, This represents an allowed reduction,
requiring partial screening. No bonus provisions are requested.
The plan shows a single main entrance on Greenwood Road with proposed future
stub connections to the south and east. The Sanitation Authority facilities
are located in the center of this facility, but will close operation in the
near future.
The plan meets all RP standards and preliminary master plan requirements.
It should be noted that the lots along Valley Mill Road have been deleted, as
requested, and these lots have been incorporated into one three -acre tract
with the existing dwelling.

Carlisle Estates, Section 2, Final Master Plan was tabled at the last Planning
Commission meeting because of concerns with street connections to Valley Mill Road,
Route 6159. Mr. Bill Bushman, Resident Engineer of the Virginia Department of
Transporation, will be present at the March 16th Planning Commission meeting to
discuss VDOT's plans for improving Greenwood Road and VDOT's policies for future
street connection needs in areas where subdivisions have been approved or are
pending.
The following is the staff's understanding of the current status of the Greenwood
Road improvement plans:
1. Greenwood Road (Route 656) is currently listed in the County's Secondary Road
Improvement Plan for improvements from Senseny Road (Route 657) to Valley Mill
Road (Route 659). This project includes improvements at the intersection of
Valley Mill Road and Greenwood Road. Completion is expected in about three to
four years.
2. The bridge on Valley Mill Road near Route 820 is scheduled for replacement.
Replacement of the bridge is expected in about three years.
3. Currently the Winchester City Thoroughfare Plan is scheduled for updating by
the Virginia Department of Transportation. Consultants are currently being
reviewed by VDOT to complete this plan. The staff intends to provide VDOT with
all the County's plans and concerns for road improvements between Route 7 and
Route 50 East and Route 522 South.
4. Frederick County Transportation Committee will be meeting in the near future to
recommend alternatives to VDOT for inclusion in the Winchester City
Thoroughfare Plan.

Dear Mr. Bushman,
I am writing in reference to Carlisle Estates I, in
Frederick County, Virginia. In a letter dated July 23, 1988, I
agreed not to build on Lots 1,2, and 3, and to temporarily
construct the street, until July 31, 1988, to give your
department the opportunity to plan for the changes in the
intersection of Routes 656 and 659.
As a followup to that agreement, and our phone conversation
of this morning, I will temporarily construct that section of the
street, and will post a bond of $5000. in favor of the County of
Frederick, Department of Planning and Building, until such time
as the Department of Highways makes their decision. If the lots
are not needed for the changes in the reconstruction of the
intersection, the street will be completed to state
specifications.

This office along with representatives from the Staunton District Traffic and
Safety Engineering Division have reviewed aie proposed entrance into the Carlisle
Estate II from Route 656 and found the location to be acceptable contingemt upon
the removal of several large trees to the west side of Route 656 which Lrpaired
the sight distance to the north of the proposed connection. Approval of the
proposed entrance will be contingent upon the removal of said trees which may ne
incorporated as part of the land use permit for the standard secondary road
connection.
At your earliest opportunity, please sUxrit three sets of roadway plans and
applicable drainage computations for the proposed subdivision in accordance witr,
the Frederick County Subdivision Ordinance.
