Planning Department: Pro 'ec� t Scope: The proposed Commonwealth Business Center Master Development Plan is comprised of two parcels which total 37.2 acres. This acreage will be developed for Industrial and Commercial uses. The property is abutted by Route 11 (Valley Pike) to the west and Interstate 81, to the east. Access to the development will be via Commonwealth Drive which provides controlled access to Route 11. The future lot that will front on both Route 11 and Commonwealth Drive will have one additional entrance onto Route 11. This development is directly south of the H. P. Hood site currently under development. Issues: 1) Transportation The preliminary Master Plan shows that the applicant is dedicating additional right- of-way along Route 11 (Valley Pike). The amount provided is consistent with the amount requested by VDOT to accommodate future improvements to this section of Route 11 as identified in Frederick County's Primary Road Plan. In addition, the plan limits the number of entrances along Route 11 and notes that the Interstate 81 expansion and improvement plans may possibly impact this site in the future. 2) Subdivision Street Design Requirements With regards to the proposed cul-de-sac, the applicant is requesting a waiver of the subdivision ordinance which requires that cul-de-sacs shall not exceed one thousand (1,000) feet in length. The Planning Commission may waive this requirement in cases where extreme topography or other factors make it impractical. The proposed Commonwealth Drive is 1,285 feet in length. The Planning Commission should determine if they believe the applicant has demonstrated that the 1,000-foot Commonwealth Business Center, MDP #03-99 Page 3 July 8, 1999 requirement is impractical in this case. A letter from the applicant requesting this waiver is included with your information. 3) Zoning District Buffer A "B" Category buffer is required when developing B3-zoned property adjacent to property that is zoned B2. The Preliminary Master Development Plan correctly details the provision of a buffer adjacent to the commercially zoned property across the Route 11 right-of-way 4) Environmental Features and Historical Landmarks This site contains no identified environmental features. The Frederick County Rural Landmarks Survey identified Site #34-984, Village Auto Sales, as being located on this property. However, this site did not make the list of potentially significant properties. STAFF CONCLUSIONS FOR 07/07/99 PLANNING COMMISSION MEETING: Staff concludes that the overall concept of this Master Development Plan is consistent with the Comprehensive Plan and the requirements of Article XVII, Master Development Plan, of the Zoning Ordinance. Staff would ask the Planning Commission to ensure that all review agency comments are. addressed prior to final approval of this plan. In addition, that the Planning Commission determines whether a waiver of the cul-de-sac distance requirement is appropriate in this case. PLANNING COMMISSION SUMMARY & ACTION FOR 07/07/99 MEETING: Two adjoining property owners were present to speak regarding the master plan. One of the concerns expressed was traffic congestion and that too many entrances were being proposed along a section of road where traffic is backed up on a daily basis. It was suggested that a collector road be constructed with a single traffic light. Another concern was that this site was a part of the Kernstown Battlefield and many people have found artifacts on both this site and the Hood site. The applicant's representative stated that a potential user is available for the southwest corner parcel and subdivision plans have been completed with VDOT, Sanitation Authority, and Public Works approvals. The applicant's only issue was the length of the cul-de-sac, and he requested a waiver to exceed the 1,000 feet -maximum limit required by the zoning ordinance. He stated that the • Commonwealth Business Center, MDP #03-99 Page 4 July 8, 1999 approval of the waiver request would not increase the number of lots and would improve driveway spacing. The Planning Commission discussed the traffic situation here and believed that relief of the problems would only occur after Route 37 is built and the WATS is implemented. Consideration was also given to the adjoining Winchester L.L.C. parcel and how access will be provided. The applicant's representative had noted that improvements to I-81 and Route 37, along with VDOT's entrance spacing requirements, would potentially landlock this parcel. The applicant, Mr. David Holliday, stated that it was his intention at this time to reserve sufficient right-of-way through his development to provide an alternative access to this parcel. The Commission believed that a waiver of the cul-de-sac distance requirement was appropriate in this case and they unanimously recommended approval of the master plan with this waiver. (Note: Mr. Wilson and Mr. Marker were absent from the meeting.) s • • Maral S. Kent Street Winchester, VA 22601 June 23, 1999 Dear Kris: Enclosed, please find photographs I took on 19 June 1999 of the historic structure at Village Auto Sales (VDHR # 34-984). When I surveyed the building for the Rural Landmarks Survey in 1990, I thought it was significant as one of the few buildings in the county that uses details typical of the Shingle Style. Although it is architecturally interesting, I do not believe it meets any of the criteria for eligibility to the National Register of Historical Places. The Shingle Style, which was popular in coastal New England during the last two decades of the nineteenth century, combined elements from the Queen Anne, Colonial Revival, and Romanesque Revival styles. It never gained the wide popularity of other styles and is fairly uncommon in this region. Although the building at Village Auto Sales is not a pure example of the style, its decorative elements and overall appearance borrow from it. These features include wall cladding of wooden shingles, a gable -end roof, an asymmetrical facade, and a protruding bay window. When I surveyed the property in 1990, the building was abandoned and I could not examine the interior. The photographs I recently took show the interior contained original wooden sawn lathe with plaster, original wooden floors, and plain window and door trim. The building at Village Auto Sales was probably built as a dwelling and was later converted into a relay station for a trucking company. First, in failing to get approval through the County's Building Department for demolition, there are obvious concerns regarding the safety of workers involved in the demolition, or anyone who might have wandered onto the unsecured site while the structure remained standing but extremely unstable. In this instance, the fact that the demolition activities commenced prior to electrical power to the structure being shut off emphasizes the reason for concern. Second, the structures on the site had been identified in the County's architectural survey of historic structures as having some unique characteristics. The development of this property for industry is a permitted use and will no doubt proceed. However, the development cou?d have, and in fact should have, proceeded along with the appropriate architectural investigation and documentation of the structures prior to their demolition. The County attempts to work with the development community in an effort to expedite the review and approval processes required prior to development. In doing so, we try to be flexible and work to individual needs associated with particular projects. Our acceptance and review of a site plan for this property in advance of a Master Development Plan being submitted is a case in point. There are, however; certain standards and requirements which cannot be avoided. As the applicant, you are ultimately responsible for the actions of those acting on your behalf. It is our sincere hope that whatever misunderstanding may have occurred between yourself, your engineer and your field crew that led to the destruction of these buildings without the required review and permits being obtained, will not be repeated in the future. We understand the transitional nature of the designated B-3 zoning. However, considerable differences exist as to traffic volumes gathered through the ITE Sixth Edition when you research business center and industrial park which you choose for the traffic analysis for pavement design. Please provide clarification by providing to the extent possible the proposed usage of lots within the master development plan. See letter dated 05/12/99 on Carquest for additional data. 2. The proposed entrance should not be shown on the master development plan since approval by VDOT has been granted on a specific site plan (Carquest). 3. Additional right-of-way along existing Route 11 right-of-way and easement for potential signal loop maintenance should be dedicated as shown on the plan sheet. See Carquest review plans for larger scale of right-of-way needs. 4. Signalization, including an agreement to participate in the installation costs at Commonwealth Drive and Route 11 (Valley Pike) intersection, should be included in consideration. I have also enclosed a marked copy of the plan for your use. 1) Please make note of the original Cooley MDP and its number in the title block. 2) Please ensure that the engineer's certificate is signed and dated prior to submission to the Planning Commission for review. 3) Please adjust the location map to show the boundary of the Commonwealth Business Center development along with the intersection of Routes 37 and 11, and Interstate 81. 4) Please de-emphasize the boundaries of adjoining properties to be consistent with your legend. In addition, please show the existing lot line that splits this development and identify the existing lots, PIN's, zoning, and uses as noted on the marked plan. 5) Please include elevations with the contours shown on the plan. 6) Please accurately show the location of the properties situated directly across the Route 11 right- of-way. It is important to pinpoint the actual property lines in order to accurately determine the necessity of any zoning district buffers. I do not believe that there is any residentially zoned land in that location. However, a zoning district buffer would be required between B3 and B2 zoned land. As always, in accommodating any zoning district buffer, the road right-of-way may be considered when determining the type of buffer to implement. In this situation, you may have the ability to implement a landscaped screen only within the front parking lot setback area of the lot fronting on Route 11, the Carquest lot. Please provide a detail of the proposed screening. 7) Please adjust the note pertaining to historical structures and sites. The approved name should be included on the final MDP. 10) The proposed Commonwealth Drive exceeds the maximum length for cul-de-sacs which is 1,000% please revise the MDP accordingly. 11) Please provide a statement on the MDP regarding access to and from the site. With the exception of the proposed entrance directly onto Route 11 that is to be used by the Carquest facility, it would be appropriate to limit access from the site to Route 11 to Commonwealth Drive only. The additional entrance should be clearly identified as for the purposes of the Carquest lot only. While recognizing that this entrance meets Frederick County's minimum spacing requirements, you may wish to consider separating future truck and car traffic at this location. In addition, please ensure that the existing entrances will be eliminated with the development of this site. 12) Please show any right-of-way dedicated for the future improvement of Route 11 on the final MDP. In addition, notation should be included on the MDP regarding the potential for the proposed Interstate 81 improvement plans to impact this site. This notation should be carried through to the final subdivision plats. Kent Street Winchester, VA 22601 June 23, 1999 Dear Kris: Enclosed, please find photographs I took on 19 June 1999 of the historic structure at Village Auto Sales (VDHR # 34-984). When I surveyed. the building for the Rural Landmarks Survey in 1990, I thought it was significant as one of the few buildings in the county that uses details typical of the Shingle Style. Although it is architecturally interesting, I do not believe it meets any of the criteria for eligibility to the National Register of Historical Places. The Shingle Style, which was popular in coastal New England during the last two decades of the nineteenth century, combined elements from the Queen Anne, Colonial Revival, and Romanesque Revival styles. It never gained the wide popularity of other styles and is fairly uncommon in this region. Although the building at Village Auto Sales is not a pure example of the style, its decorative elements and overall appearance borrow from it. These features include wall cladding of wooden shingles, a gable -end roof, an asymmetrical facade, and a protruding bay window. When I surveyed the property in 1990, the building was abandoned and I could not examine the interior. The photographs I recently took show the interior contained original wooden sawn lathe with plaster, original wooden floors, and plain window and door trim. The building at Village Auto Sales was probably built as a dwelling and was later converted into a relay station for a trucking company.
