This letter is to be considered your permit to do so. The following provisions will be required: • Work area protection signage is to be in accordance with the current Work Area Protection Manual while working on the right-of-way. • All work on the right-of-way is to be confined to the temporary entrance location only. • A minimum 6" depth of VDOT #1 (2-3 inch stone) course aggregate by 30' in width will be required. It is to be placed from the edge of pavement and extended back onto private property far enough to prevent the carrying of mud onto the roadway. • Positive drainage is to be maintained within the right-of-way at all times. • A wash rack will be required. • Any disturbed areas of the right-of-way or damages to the pavement structure adjacent to this entrance will be repaired by you to our satisfaction. • This permit is being issued for 180 days. • All work is to be completed in accordance with the enclosed Virginia Erosion & Sediment Control Handbook, Specification 3.02. • The entrance is to be installed at the location designated by the VDOT Inspector. The Department of Transportation will not be held liable for suit should such result from this operation nor is it granting permission to grade on the property of others or disturb underground utility lines. The revised stormwater calculations indicate that you are draining 7.51 acres along the east side of the site to a storm sewer network which will discharge the stormwater along Route 11. There are discrepancies in the calculations as to the actual size of the pipes being used for this storm sewer storm network as well as the calculated drainage flows. Also, the culvert located under Route 11 needs to be analyzed using the total amount of stormwater run-off flowing to this point. 2. There are discrepancies in the stormwater/sediment basins details. You have included two different riser details and conflicting outlet pipe sizes. Provide a detail indicating which structure your are recommending and the calculations used to determine the sediment loading, clean -out elevations, etc. 3. The erosion and sediment control plan needs to include a detailed narrative as stated in previous comments. The construction entrance detail shall indicate that a washrack is required. Provide outlet protection calculations for all culvert outfalls as well as provide outlet protection at the outfall of the culverts along Route 11. review. The stormwater management narrative indicates that you are proposing to use infiltration basins for ponds number 2 and 3. We do not recommend the use of infiltration basins for the following reasons: A. The site is within the upper Beekmantown geologic formation which is prone to the creation of sinkholes. Currently, there is a line of sinkholes that lie due south of the site. By draining concentrated stormwater run-off into an infiltration basin within this site, there is a strong possibility that sinkhole development may occur. B. If sinkholes are not created, another condition that could occur is no infiltration into the subsoils. Due to the high plasticity of the silty -clay soil conditions, the fine clays could completely seal the bottom of the basin and the stormwater runoff will not percolate into the soil. Therefore, a swampy condition would develop. Consequently, we recommend that the basins be redesigned as detention basins or have the stormwater rerouted to the main detention basin. 2. Sheet 5 of 18 Indicate the need for the proposed 36 inch RCP culvert along Route 652 and provide supporting calculations. 107 North Kent Street . Include calculations to verify the adequacy of the twin culverts under Route 651 as stated in comment number 7 in our previous letter dated June 24, 1998. Will address fire lanes on site plan. • Central Coca-Cola Bottling Facility, MDP #002-98 Page 2 May 7, 1998 County Engineer: The regional stormwater management facility will need to be constructed during the development of the first phase of this site. Stormwater easements need to be provided on the master development plan. An upgrade to the 12-inch CMP may be necessary to protect down -gradient residential areas. See attached letter from Harvey E. Strawsnyder, Jr., dated March 13, 1998. Planning and Zoning: Site History The Frederick County Board of Supervisors approved Rezoning Application #004-98 for the 63.5-acre tract on April 22, 1998. This action changed the zoning of this property from RA (Rural Areas) District to MI (Light Industrial) District. A proffer statement was approved for the rezoning application which offers various road improvements and right-of-way dedications, maximum heights for primary and .accessory structures, various buffer and screening measures, and a monetary contribution for fire and rescue services. Project Scope The applicant proposes to develop the 63.5-acre tract in two phases. The first phase accounts for 24.8 acres and is intended to be developed as a new bottling facility for the Central Coca- Cola Bottling Company, Inc. The facility will also provide a warehouse and distribution operation, as well as office space. The second phase accounts for the remaining acreage. This phase is proposed to be developed in three lots totaling 34.3 acres. An additional 4.3 acres is being dedicated as right-of-way for improvements to Apple Valley Road (Route 652) and Shady Elm Road (Route 651). The applicant will construct a regional detention basin for the 63.5-acre site which will be utilized by the Central Coca-Cola Bottling Company, Inc., and future developers of the proposed lots within the second phase. The applicant will construct an earth berm along the entire frontage of Apple Valley Road. The earth berm will be six feet in height above the grade of the toad and will contain a mixture of evergreen and deciduous plantings. Four entrances into this site will be constructed along Apple Valley Road which will require breaks in this berm at various intervals. Issues 1) Steep Slope Disturbance: The applicant has proposed to disturb the entire 0.06 acres of man-made steep slope on this property to accommodate the construction of the regional stormwater management facility and the earth berm along Apple Valley Road. Section 165-3113(6) of the Zoning Ordinance 0 9 Central Coca-Cola Bottling Facility, MDP #002-98 Page 3 May 7, 1998 permits the Board of Supervisors to waive the maximum disturbance requirement in industrial and office parks. It is the opinion of staff that the disturbance of this area of steep slope is necessary and will provide a benefit to this site and adjoining properties through enhanced stormwater management. Staff would encourage the Planning Commission to forward a favorable recommendation to the Board of Supervisors regarding this matter. 2) Stormwater Management: The County Engineer has commented that the applicant should provide for stormwater management easements to accommodate the lots within the second phase during the master development plan process. Staff believes that it would be appropriate to provide that information as a part of the master development plan approval process. This information could be demonstrated on the drawing or provided in narrative form if locations for these easements are not known at this time. STAFF RECOMMENDATION FOR 05-06-98 PLANNING COMMISSION MEETING: Staff recommends approval of this master development plan provided that all staff, review agency, Planning Commission, and Board of Supervisors comments are adequately addressed. PLANNING COMMISSION SUMMARY & ACTION OF 05/06/98 MEETING: Mr, Lou Bernard with the Bank of Middleburg, the trustee of the Grim Estate, wanted to be assured that approval of the master development plan would not negate his company's right to review and come to an agreement on the off -site drainage easement issue. A member of the Commission inquired if there were discussions regarding the signalization at Routes 651/652 and whether the applicant would participate financially if signalization was warranted. Staff responded that according to the proffer submitted at rezoning, the signalization issue would be examined and potentially resolved at the site plan review stage; it was agreed that if signalization was warranted, Coca-Cola Bottling Company would participate financially. A motion was made and seconded to approve the master development plan with a waiver of the maximum disturbance requirement for steep slopes to accommodate the construction of the regional stormwater management facility and earth berm along Apple Valley Road, that the stormwater management issues be addressed at the site plan stage, and that all staff, review agency, Planning Commission and Board of Supervisors comments are adequately addressed. The motion was unanimously approved. The proposed master development plan indicates future water and sewer service provided by the Frederick County Sanitation Authority. Verify this commitment prior to submittal of the site plan design for lot 1. 2. The stormwater management plan indicates the future construction of one central detention pond to serve the entire master plan development. We will require the construction of this facility concurrent with the initial site development of lot 1. In addition, the master plan should reflect any and all stormwater easements required to convey runoff from all four (4) lots. We anticipate that some use of closed conduits will be required to divert runoff from lot 1 to the detention pond. -_ 3. An upgrade of the existing 12 inch CMP maybe required to accommod,e the new stormwater facility. This upgrade should be coordinated with the Virginia D01partment of Transportation (VDOT).
