It may also be useful to others interested in this zoning matter. The MDP is also in conformance with the proffers for Rezoning #01-06. All of the issues brought forth by the Board of Supervisors should be appropriately addressed by the applicant. It appears that the application meets all requirements. Following presentation of the application to the Planning Commission and the Board of Supervisors, and the incorporation of your comments, staff is prepared to proceed to approval of the application. MDP #04-14 Clearbrook Business Center June 24, 2014 Page 2 REVIEW EVALUATIONS: Virginia Department of Transportation: The Master Development Plan for this property appears to have a measurable impact on Route 11, the VDOT facility which would provide access to the property. VDOT finds the MDP acceptable. Once approved by Frederick County, please provide a signed PDF of the plan. Before making any final comments, this office will require a complete set of site plans, drainage calculations and traffic flow data fiorn the I.T.E. Trip Generation Manual, Seventh Edition for review. VDOT reserves the right to comment on all right-of-way needs; including right-of-way dedications, traffic signalization, and off -site roadway improvements and drainage. Prior to construction on the State's right-of-way the developer will need to apply to this office for issuance of appropriate permits to cover said work. Frederick County Fire Marshal: Plan approved. Frederick County Fire & Rescue: Plan approved. Frederick County Public Works: No comment at this time. Frederick County Inspections: No comments required at this time. The department will comment at the time of the site plan. Frederick County Sanitation Authority: Per your request, a review of the proposed master plan has been performed. The Frederick County Sanitation Authority offers comments limited to the anticipated impact/effect upon the Authority's public water and sanitary sewer system and the demands thereon. The parcel is in the water and sanitary sewer area served by the Authority. Based on the location both water service and sanitary sewer service is available. Sanitary sewer treatment capacity at the waste water treatment plant is also presently available. Sanitary sewer conveyance capacity and layout will be contingent on the applicant perforining a technical analysis of the existing sanitary sewer system within the area to be served and the ability of the existing conveyance system to accept additional load. Likewise, water distribution capacity will require the applicant to perform a technical analysis of the existing system within the area to be served to determine available capacity. Both water and sanitary sewer facilities are located within a reasonable distance fiom this site. Please be aware that the Authority does not review or comment upon proffers and/or conditions proposed or submitted by the applicants in support of or in conjunction with this application, nor does the Authority assume or undertake any responsibility to review or comment upon any amended proffers and/or conditions which the Applicant may hereafter provide to Frederick County. Planning & Zoning: A) Master Development Plan Requirement A master development plan is required prior to development of this property. Before a master development plan can be approved, it must be reviewed by the Planning Commission, Board of Supervisors and all relevant review agencies. Approval may only be granted if the master development plan conforms to all requirements of the Frederick County Zoning and Subdivision MDP #04-14 Clearbrook Business Center June 24, 2014 Page 3 Ordinances. The purpose of the master development plan is to promote orderly and planned development of property within Frederick County that suits the characteristics of the land, is harmonious with adjoining property and is in the best interest of the general public. B) Site History The original Frederick County zoning map (U.S.G.S. Inwood Quadrangle) identifies the subject parcels as being zoned A-2 (Agricultural General). The County's agricultural zoning districts were subsequently combined to form the RA (Rural Areas) District upon adoption of an amendment to the Frederick County Zoning Ordinance on May 10, 1989. The corresponding revision of the zoning map resulted in the re -mapping of the subject property and all other A-1 and A-2 zoned land to the RA District. On March 22, 2006 the Board of Supervisors approved Rezoning #01-06 which rezoned the subject properties from the RA District to the B3 (Industrial Transition) District with proffers. C) Site Suitability & Project Scope Comprehensive Policy Plan: The 2030 Comprehensive Plan is an official public document that serves as the community's guide for making decisions regarding development, preservation, public facilities and other key components of community life. The primary goal of this plan is to protect and improve the living environment within Frederick County. It is in essence a composition of policies used to plan for the future physical development of Frederick County. Land Use Compatibility: The parcels comprising this MDP application are located within the County's Sewer and Water Service Area (SWSA). The site is within the limits of the Northeast Land Use Plan and is designated for business use., Site Access and Transportation: The Clearbrook Business Center development will be accessed via a public street that will intersect with Martinsburg Pike. The internal road network will also provide interparcel access to the properties to the north and south. PLANNING COMMISSION SUMMARY FOR THE 6/18/14 MEETING: No questions or issues were raised by the Planning Commission. No action was required by the Commission. (Note: Commissioner Oates abstained from discussion; Commissioners Triplett, Dunlap, and Kenney were absent from the meeting.) Mr. Jenkins has submitted his Master Development Plan for the property zoned B-3 called Clearbrook Business Center. Mr. Vahidi has tried to rezone his property twice to B-2. Ordinarily, a Class C buffer would be required between a residential parcel and B-3. However, Mr. Vahidi's property is over 14 acres and recognized in the ordinance for setbacks as an Agricultural Use. I think the buffer should not be required for the following reasons: • The Comprehensive Plan has designated the land for commercial use for over 25 years • The Northeast Land Use Plan (NELUP) has a planned frontage road identified along Interstate 81 that cuts through the old fire -damaged farm house. • The property is not used, nor is planned to be used, for residential purposes as demonstrated in the attached letter from the neighbor. • The neighbor (Vahidi) does not want a screening buffer along the property line, see attached letter. • The planned development for Vahidi situates the stormwater facilities along the common boundary line, so a the buffer would only screen others trees and a pond. This lands lies flat receives drainage from under Interstate 81. • Finally, that farmhouse had fire damage in the winter of 2012 and has been used for storage ever since, see attached letter from owner. Therefore, I request that a Category C not be required along their shared property line as Mr. Vahidi's property is not a residential use. The intent when I bought this property, and my future goal, is to change the zoning to B-2, a commercial use. This has been called for in the Frederick County Comprehensive Plan for the past 35 years. The old farmhouse on the property has been vacant since there was a fire a few years ago. It has been used as storage ever since. My last attempt at a rezoning was denied by the Board of Supervisors. The reason given by Supervisor Charles DeHaven was timing because he felt my property should not be developed prior to my neighbor. With Mr. Jenkins' construction and my cooperation to aid in his development, I would hope the County will look favorably upon my next rezoning attempt.
