Applicant must comply with all requirements of the state and County code pertaining to assisted living care facilities. No time limit was placed on this Conditional Use Permit. Therefore, once the assisted living facility is established it's operation may continue in perpetuity. However, it should be noted that if the conditions of approval of a conditional use permit are violated, the Board of Supervisors may, by resolution, initiate the revocation of an active conditional use permit. There is sufficient water and sewer capacity to serve this site. Planning and Zoning: Assisted living care facilities are permitted in the RP (Residential Performance) Zoning District with an approved conditional use permit. This property is part of the recently approved "Land Bays" residential master development plan. The location of this proposed facility is consistent with the design of the master plan, in particular, the design of Land Bay 1. The proposed facility is located adjacent to Route 642, Tasker Road, and the Frederick Woods subdivision. A road efficiency buffer is required along Tasker Road and a residential separation buffer is required adjacent to the residential uses. Staff would recommend that, in providing the required full screen, the applicant implements an earthen berm onto which the landscape elements are placed. A significant earthen berm already exists along Tasker Road. This, along with an earthen berm adjacent to the residential uses, will fulfill the opaque element requirement ofthe full screen and will provide a permanent, natural buffer that would significantly mitigate the impact of the facility on the adjoining residential properties and road right-of-way. An engineered site plan will be required for the construction of this facility. This site plan will address all requirements of the Frederick County Zoning Ordinance and the concerns of the reviewing agencies who have requested submittal of a detailed site development plan. Applicant must comply with all requirements of the state and county codes pertaining to assisted living care facilities. 0 America House Assisted Living CUP #004-98 Page 3 August 31, 1998 PLANNING COMMISSION SUMMARY & ACTION OF 08/05/98: The Planning Commission spoke with the applicant about the number of designated parking spaces, the construction of an earthen berm adjacent to the residential uses and modification ofthe existing berm along Tasker Road, and access to the site by way of Spanish Oak Road. Considerable discussion took place on whether the applicants anticipated providing a higher level of care at this facility at some point in the future, and whether this change of operation warranted an additional condition to the permit. After some consideration, the Commission did not foresee a change in impacts and decided that an additional condition was not necessary. There were no public comments. The Commission unanimously recommended approval of the conditional use permit, with the same conditions as suggested by staff as follows: All review agency comments must be addressed and complied with at all times. 2. For clarification purposes, we contacted Mr. Mark Smith with Greenway Engineering, the design firm for the Autumn Glen Development. Mr. Smith advised us of future planned expansion from a twenty-seven bed to a forty-one bed facility. Based on this new information, we asked for a site plan indicating total build out. As of this date, we have not received the latest site plan. The portion of Route 642 (Tasker Road) that this proposed facility is to be located has recently been constructed and is less than two years old. Based on the forty-one bed facility build out, referencing the 5th Edition I.T.E. Trip Generation Manual, it has been determined Route 642 (Tasker Road) should not be adversely affected by this project. As part of our standard practice, the Autumn Glen site plan including this proposed facility will be put through an extensive site plan and engineering review as it relates to the roadway network. All facets of the roadway design including entrances, turn lanes, tapers, pavement designs, and drainage will be included in this review. I trust this information is useful.
