Thank you for the letter informing our neighborhood of the meeting Feb. 2 to review the
revocation of CUP # 30-99 for Winchester Motor Service "The Van Man".
The purpose of this letter is to state, in writing, some concerns I have of recent activity on
this location. I will be out of town the night of Feb. 2 and would like to have my input
considered along with all others.
In the past several weeks there has been significant activity on this property relative
to the coming and going of Diesel Semi Trucks as well as storage of tractor trailers
on the property. Besides the unsightliness of it, there is a bigger problem from the
noise — especially at night.
It is not unusual to hear one, two or more trailer refrigeration units rumbling
throughout the night. In addition, the noise of the large engines also creates tremors
in our home — and this goes on very late at night and in the early morning hours.
Simply put, imagine large semi trucks being parked outside your bedroom window
with their engines and refrigeration units running throughout the night. The noise
and rumbling is also significant in the evening hours.
It would seem this activity is in violation of the permit. The permit states that they can
operate a garage with no more than 5 cars and cannot expand the current non-
conformance salvage yard use.
It is also my understanding that because the salvage yard has been non-existent for
more than one year, the property cannot be used for such a purpose.
Please seriously consider revoking CUP #30-99.

The Frederick County Board of Supervisors approved Conditional Use Permit (CUP) #30-99 for Winchester
Motor Service on January 26, 2000, to operate a Public Garage without Body Repair on property identified
with P.I.N. #55-A-102 in the Red Bud Magisterial District. This CUP was approved with the following
conditions: .
1) All review agency comments shall be complied with at all times.
2) Fire Marshall comments to be complied with within 30 days of permit approval.
3) All work shall be accomplished within an enclosed structure.
4) Any proposed business sign shall conform to Cottage Occupation sign requirements; sign shall not
exceed four (4) square feet.
5) No outdoor storage of equipment associated with the business.
6) No more than five (5) vehicles awaiting repair shall be permitted.
7) Hours of operation shall be from 7:00 a.m. to 7:00 p.m. Monday through Saturday.
8) No expansion of the legally non -conforming salvage yard will be permitted.
9) Any change of use or expansion of the business will require a new Conditional Use Permit.
Violation of Conditions: Staff received a complaint regarding violations of the Frederick County Zoning
Ordinance at this property. Staff inspected the property on December 21, 2004, and noted the presence of
tractor trailers, debris, and tires located on the property. A letter of violation was issued, as was a notice of
revocation for violations of the conditions of Conditional Use Permit 30-99. These violations constitute a
violation of the conditions placed on Conditional Use Permit 30-99, approved by the Frederick'County Board
of Supervisors on January 26, 2000.

Staff conclusions for the 02/02/05 Planning Commission meeting: The holder of Conditional Use Permit
30-99 is in violation of the above -referenced conditions with regards to the zoning violations that staff has
received.
A recommendation from the Planning Commission for revocation of Conditional Use Permit 30-99 would be
appropriate. This recommendation will be forwarded to the Board of Supervisor for their consideration.
PLANNING COMMISSION SUMMARY & ACTION OF THE 02/02/05 MEETING: The property
owner reported that, with the help of her attorney, the lessee is being evicted from her property for violating his
lease agreement. The owner stated that she has removed approximately $1,500 worth of tires in the previous
two weeks; however, she needed additional time to remove the remaining tires and debris left by her tenants.
She said that she did not want to lose the CUP because it would affect her ability to generate income to clean
up and maintain the property. Her long-term plans were to clean up the property the best she could, fill it in,
and then sell the property.
Four adjoining property owners spoke to the Commission about the poor appearance of the property, referring
to it as an "eye sore" and a "real mess." Along with the parking of tractor -trailers, which was the original
source of initiating the CUP revocation, the adjoining property owners reported seeing tires, mobile homes,
drums which possibly contained chemicals, an abandoned vehicle, and debris. They also reported observing
fluids from vehicles and drums being emptied onto the ground and they were concerned about the long-term
environmental affects this type of activity has had on the property over the years, especially the creek that runs
through the middle of the site. They were also concerned about the safety issues, because neighborhood
children play in the area, and the appearance, because of the proximity of their neighborhood and an adjoining
battlefield site. One adjoining property owner reported observing someone living in one of the mobile homes,
evidenced by lights at night and a portable toilet.
Commission members agreed the property needed to be cleaned up and they recognized the property owner's
intentions to clean up the property. Nevertheless, they believed the drums needed to be investigated to
determine if chemicals were present, the property and creek needed to be evaluated for pollution, the mobile
homes needed to be inspected to find out if they were habitable, and a site inspection needed to be conducted
to determine the overall status of the property. It was decided that the Zoning Administrator would coordinate
a site visit which included the County's engineer, the building official, the fire marshal, and possibly, an agent
from the Department of Environmental Quality (DEQ).
The Planning Commission voted unanimously to table the revocation of this CUP for 90 days to allow the
property owner time to clean up the site and to come into compliance with the CUP; and, at the end of the 90-
day period, this CUP will come back to the Planning Commission for action with a staff report containing an
evaluation of site clean-up and CUP compliance. If the owner is in compliance and the recommendation of the
Commission is for the continuation of the CUP, the staff will automatically schedule an additional site visit in
six months to verify that the property continues to be properly maintained and the owner remains in
compliance with the conditions of the CUP. (Note: Commissioners Kriz and Light were absent from the
meeting.)

Status as of April 21, 2005
As of April 21, 2005, there has been no change in the status of this property. The Fire Marshal has visited the
site, as has the Recycling Coordinator and charged the property owner with violations of the County Code.
Staff has visited the property and has met with the property owner to discuss the violations of Conditional Use
Permit 30-99 (CUP 30-99). The property is not in compliance with the conditions of CUP 30-99. These
violations include:
1. A trucking operation.
2. Unused tires and debris.
3. Inoperable vehicles.
Staff conclusions for the 05/04/05 Planning Commission meeting:
The holder of Conditional Use Permit 30-99 is in violation of the above -referenced conditions with
regards to the zoning violations that staff has received. A recommendation from the Planning
Commission for revocation of Conditional Use Permit 30-99 would be appropriate. This
recommendation will be forwarded to the Board of Supervisor for their consideration.
PLANNING COMMISSION SUMMARY & ACTION OF THE 05/04/05 MEETING: The staff reported
to the Commission that as of a site visit on Wednesday morning, May 4, 2005, the site had not been brought
into compliance with the conditions set forth in CUP #30-99 or the County Zoning Ordinance. Staff reported
that the Frederick County Fire Marshal and the Frederick County Solid Waste Coordinator have both initiated
violation cases against the property owner.
The property owner, Ms. Shelia W. Beach, stated that her reason for not completely complying was a financial
one. She said that she could not afford the expense involved to have all the materials hauled away and she
could not get a bank to lend her the money for this purpose. She told the Commission about the various items
and bags of garbage she had personally removed. She remarked that her previous tenants left her with the
debris; however, she would continue to work on cleaning up the property.
Two adjoining property owners spoke and both said they had not seen much change in the appearance of the
property since the Planning Commission's meeting in February. One of the property owners stated that as of
May 3, at noon, piles of tires, mobile homes, an inoperable vehicle, and debris remained on the property, as
well as additional tractor -trailers. Both property owners wanted to see the CUP revoked.
They Planning Commission believed the property needed to be cleaned up and brought into compliance. The
Chairman pointed out that after the property was cleaned up, and if there was a legitimate use, there was
always an opportunity for the property owner to apply again for a CUP. By a unanimous vote, the Planning
Commission recommended that the CUP be revoked. (Commissioner Watt was absent from the meeting.)

On June 23, 1999, at 11:00 a.m., I visited the above -referenced property to conduct a site inspection.
My inspection of the site revealed the presence of the following zoning violations on the property:
Storage of unused appliances and tires on the property -is a violation of Section 165-47 of the
Frederick County Code.
2. Two (2) dwellings on the property constitute a violation of Section 165-25 of the Frederick
County Code.
3. The auto repair business located on the property is a violation of Section 165-140 of the
Frederick County Code.
These violations need to be abated in order for you to get your salvage license and your letter of
nonconforming use. In order to prove that the use of the property is nonconforming, you will need
to provide this office with information verifying that this salvage yard and automobile graveyard
business has been used on a continual basis on this property since November 1, 1973.
Furthermore, you will need to provide this office with information confirming the approval of two
(2) dwellings on your property, in particular, when the dwellings were placed on the property. This
office will give you thirty (30) days to provide information ofthe nonconforming use of this property

REVIEW EVALUATIONS:
Virginia Dept. of Transportation: No objection to conditional use permit for this property.
However, prior to operation of the business, a commercial entrance must be constructed to
our minimum standards to allow for safe egress and ingress of the property. Any work
performed on the State's right-of-way must be covered under a land use permit. The permit
is issued by this office and requires an inspection fee and surety bond coverage.
Inspections Department: Existing building shall comply with the Virginia Uniform
Statewide Building Code and Section 311, Use Group S (Storage) of the BOCA National
Building Code/1996. Other codes that apply are CABO A117.1-92, Accessible and Usable
Buildings and Facilities. Restroom shall be within work area and within 500' travel distance.
Please submit a floor plan of the existing building at the time of change of use building permit
application. A new certificate of Use and Occupancy shall be issued prior to operation.

Fire Marshal: See attached letter from Tim Welsh, Assistant Fire Marshal, dated December
15, 1999.
Health Department: No malfunction ofthe sewage disposal system was observed at the time
of the site visit. Use of trailer to be limited to a maximum of one employee; no public
restrooms permitted. No guarantee of the system's future performance is to be implied from
these comments.
City of Winchester: Planning Department has no comments.
Planning and Zoning: Public garages without auto body repair are permitted in the RA
(Rural Areas) Zoning District with an approved conditional use permit; all repair work must
take place in an enclosed structure. This business will be located in a 24' x 24' square foot
garage located on the property fronting Route 7. This garage is located on property that is
being used as a legally non -conforming salvage yard. This non -conforming use was
established prior to November 1973, when the Frederick County Zoning Ordinance was
enacted. The adjoining properties are set back 50 feet from the property as required in the RA

The property is surrounded by a hill in the rear where active residential properties are located.
Staff feels that screening and buffers would not be needed with the proposed application in
light of its location on this property. The applicant's use of this business will not impact or
expand the non -conforming use of this property. Prior to operation of this business, the Fire
Marshall comments need to be addressed, as well as the VDOT comments on entrance
requirements.
Based upon a thorough evaluation of the existing land use, the legally non -conforming salvage
yard and the limited scale of this proposed business, it appears that this business will not have
any significant impact on the adjoining properties.
STAFF CONCLUSIONS FOR 01-05-00 PLANNING COMMISSION MEETING:

PLANNING COMMISSION SUMMARY & ACTION OF 01-05-00 MEETING:
Four adjoining property owners voiced their dissatisfaction with the existing salvage yard and their
apprehension about granting a conditional use permit for a public garage. The concerns raised were
that the property was an eyesore and its appearance has gotten progressively worse in the last few
years; that the public garage was already operating and there is noise and banging as late as 10:00
p.m. and 12:00 p.m.; there are dogs barking and lights on throughout the night; there was concern
that the setbacks against residential properties were not being met; there was concern about security
and safety of neighborhood children because the rear of the salvage yard was not fenced in; and
finally, there was concern about pollution of the creek by fluids draining from inoperable vehicles.
The owner/applicant explained that she inherited the business and property and her plans were to
continue with the salvage yard business, but she will not continue to buy and sell vehicles. The owner
commented that she had made considerable progress towards cleaning up the property by removing
approximately 800 vehicles and numerous tires; her future plans were to place clusters of pines in the
rear of the property. In reply to a Commissioner's inquiry about whether she could meet the
conditions of the CUP, the owner responded that if the operator of the public garage could not meet
the conditions specified, she would have him removed from her property.
Members of the Commission had concerns about the appearance of the property, especially since this
was one of the major corridors coming into Frederick County. In addition, they were concerned
about the property's appearance because of the efforts that have been put forth in the last seven or
eight years by Frederick County and the City of Winchester towards developing the major corridors.
In response to the residents who spoke, the Commission believed their concerns were legitimate and
the question of whether the neighborhood residents and the County would be better served by voting

against or for the CUP was debated. Commissioners believed that if the CUP was granted, the
regulations and the law would work for the neighborhood residents in case the undesirable situations
continued.
Staff pointed out that the salvage yard was a legal nonconforming use that has been in continuous
operation since prior to 1973, and that the operation of the salvage yard was not subject to approval
of the CUP.
By majority vote, the Planning Commission recommended approval of the CUP with the following
conditions:
