This is written in support of John and Claire Bellingham for a Conditional Use
Permit to conduct a Counseling Service in their home at 200 Crestwood Lane in
the Woodbrook Retirement Community.
We are next door neighbors of Jack and Claire and find no objection to their
application for this Conditional Use permit. It is a fact that parking is limited in the
neighborhood but the addition of one car at a time for business purposes does
not seem, (to us), to present a problem. If necessary we would be happy to let
their clients use our driveway for parking.
Previous commitments keep us from attending the hearing tonight but we want to
assure all concerned that we whole heartily support the Bellingham's in this
application.

2) Fundamentally. the introduction of home occupations into this enclave of
relatively small cottages, grouped in modules consisting of four attached
homes, with numerous Lots yet to be occupied, seems to be
incompatible with nurturing of a tranquil ambiance sought by most
senior citizens.
3) Office space suitable for professional practices is now available in the nearby
Creekside Center. This Center is adjacent to Woodbrook Village, being
located just across Opequon Church Lane from entrance to Woodbrook
Village.
4) In view of the finality implicit in the Covenants (as cited above), I deem it
superfluous to recite other concerns which I have in this matter.

Health Department: Health Department has no objection as long as adequate public water
and sewer is made available.
Sanitation Authority: No comment.
Planning and Zoning: The Frederick County Zoning Ordinance allows for cottage
occupations in the RP (Residential Performance) District. This proposed Conditional Use
Permit application is for a counseling service in the residence of the applicant. This service
will be conducted by the applicants in a separate room of the home. (No more than two
clients will be seen at any one time.) The applicant stated that the number of clients that will
be seen on a weekly basis will not exceed ten. In addition, the applicant indicated that there
will be no weekend hours.
The property is located in the RP (Residential Performance) Zoning District with the
adjoining properties located approximately 25 feet from the sides of the principal structure;
no screening or buffers will be required. Based upon the limited scale of the proposed use and
evaluation of the property, it appears this use would not have any significant impacts on the
adjoining properties.
STAFF CONCLUSIONS FOR THE 01-05-00 PLANNING COMMISSION MEETING:
Staff recommends approval with the following conditions:
All review agency comments shall be complied with at all times.
2. Days of operation shall be limited to weekdays only.
Any expansion of use will require a new Conditional Use Permit.
PLANNING COMMISSION SUMMARY & ACTION FOR THE 01-05-00 MEETING:
Planning Commissioners asked the applicants if they were aware of any deed covenants that would
preclude business in Woodbrook Village. The applicants stated that before moving into this
development, they spoke with the owner/builder, Mr. James Vickers, about their intentions and he
waived the covenant that precluded home occupations.

Based on the limited scale of the proposed home occupation, the Commission believed the use would
not have a significant impact on the adjoining properties and unanimously recommended approval
with the following conditions:
