Any proposal to use on -site sewage disposal must be initiated with an application that includes a design by a Virginia Professional Engineer and a soil evaluation completed by a soil consultant. Also, see attached letter dated I1-29-99 from Karl E. Evans, Environmental Health Supervisor. City of Winchester: No comment. Planning and Zoning: The Frederick County Zoning Ordinance, allows commercial outdoor recreation facilities in the RA zoning district with a conditional use permit. The proposed golf course would be a commercial outdoor recreational facility. This property is located in the RA zoning district and is presently being used as an orchard. The property is surrounded by a quarry to the west, Route 37, and vacant property to the east. The southern part of the property is surrounded by RA -zoned property that is used residentially and as an orchard. Generally, a golf course would have minimal impact on the surrounding land use, and would be keeping with the character of the area. Presently, this property contains a migrant worker labor camp. The applicant is proposing to convert two of the buildings into a pro shop and snack bar. In addition, two large trailers that are currently being used residentially by the migrant workers are to be removed from the property. The Health Department has commented that there are no objections to this Conditional Use Permit, if the property is served by public sewer and water services. This property is located outside of the SWSA as noted in the Frederick County Comprehensive Plan. Therefore, public sewer and water services are not available to this property. The Health Department noted any use of an on -site sewage disposal system must be initiated by an application with a design by a Virginia Professional Engineer, following a soil evaluation of this property. The applicant is in the process of addressing the Health Department comments. The approval of this Conditional Use Permit should be conditioned upon addressing these issues. Staff would recommend limiting the number of signs along Route 37 to one (1) and limiting the size of the sign to a maximum of fifty (50) square feet in area. This is in keeping with the rural character of this area, and will eliminate the potential for excessive signage along Route 37. An engineered site plan will be required for this proposed use; this site plan will address all the requirements of the Frederick County Zoning Ordinance and the concerns of the various reviewing agencies. The entrance to this site may be impacted by the future extension of Jubal Early Drive. It would be appropriate to consider this potential impact during the site plan development process. Any expansion of use or change of use would require a new Stuart M. Perry, Inc. CUP #27-99 Page 3 January 4, 2000 Conditional Use Permit, and an engineered site plan to address any new requirements. STAFF CONCLUSIONS FOR 12-01-99 PLANNING COMMISSION MEETING: Staff recommends approval with the following conditions: All review agency comments must be addressed and complied with at all times. 2. . One (1) business sign shall be allowed along Route 37; this sign shall be limited to a maximum of fifty (50) square feet in area. 3. An engineered site plan shall be approved by the County. 4. Any expansion of use beyond the proposed 18 holes or construction of additional facilities would require a new Conditional Use Permit. PLANNING COMMISSION SUMMARY & ACTION FOR THE 12/01/99 MEETING: Two persons came forward to speak about the proposed conditional use permit. The first, the owner of Candy Hill Campground, an adjacent property, spoke in favor ofthe proposed golf course. The other individual, a resident on Fox Drive, also supported the proposed golf course, but had environmental concerns, particularly with Abrams Creek and the wetlands on the Willow Grove Farm. He commented that he, along with several other Shenandoah University students, had recently presented to the Board of Supervisors the findings of a study conducted in this area. He pointed out that the wetlands in the Willow Grove Farm area contain about a dozen plant species that are rare to the State of Virginia. He hoped that all environmental regulations would be followed regarding the use of pesticides, herbicides, and fertilizers, and that the proposed golf course would be designed and constructed to be "environmentally friendly." The subject of failing septic systems in the Round Hill area was raised by members ofthe Commission and. a discussion ensued concerning the pursuit of extending water and sewer service to Round Hill, in light of the development that is occurring in this area. The Planning Staff pointed out that the County's long-range plans are to ultimately extend a line paralleling the west side of Route 37 from the 522 interchange area. It was also noted that if and when the DeGrange property develops, sewer and water will probably be extended to accommodate that property and the developers may participate in that effort in some form. Members ofthe Commission were very much in favor of the type of development proposed by Stuart M. Perry, Inc. They believed it served multiple purposes by keeping green and open space and providing recreational amenities to the citizens of the County. The Planning Commission 0 • Stuart M. Perry, Inc. ID # 32304 Frederick County Office of Planning and Development 107 North Kent Street Winchester, VA Dear Sirs, This office has received an application for a sewage disposal system construction permit to serve a golf course that is planned to be constructed at 1052 Merrimans Lane. The proposal states that the number of patrons will be a maximum of 150 per day and that there will be 8 employees at the business. It is also proposed to install a snack bar at the location. Based on these proposals, it appears that a sewage disposal system capable of treating and disposing of 1365 gallons per day will be required in order to comply with the Virginia Sewage Handling and Disposal Regulations. There is presently 1 drainfield installed at the property that will be used as part of the total system. This system was installed in 1987 and is approved at 600 gallons per day. Following a field review of this system, it has been determined that the distribution boxes will need to be repaired prior to final approval. On 11/22/99 a site and soil evaluation was completed for the 2'ld disposal site which was proposed by Mr. Bruce Legge. A preliminary field approval has been given for this site which is sized at 765 gallons per day. Based on the above information, it can be summarized that there is adequate area for sewage disposal based on the proposal as submitted to this office. It is important to note, that we have not yet issued an type of formal approval document as of this date. Before this office can issue the required permit to install the system, we must first receive plans from a Virginia Professional Engineer. The plans must include pump schematics, force mains, pump chambers, septic tanks and other items as required by our regulations. Page 2 November 29, 1999 Perry Golf Course I am also listing other items of concern that must be considered by your office prior to your final decision: 1) The owner must apply for a Restaurant Permit and be granted approval prior to opening the snack bar facility. The facility must meet all applicable criteria of the Virginia Restaurant Regulations. 2) The owner has agreed that the snack bar menu will consist of a limited (sandwiches) menu only. In order to keep water usage at a minimum, it is vital that all plates, cups, etc., be "single service type". 3) The present water system at this property is currently not in compliance with the quality standards of the Non -Community Water Supply regulations. The owner has indicated that he does not want to use this water source as a "potable water supply" and he will provide bottled water in lieu of offering well water to his customers. Please note, that by doing so, any type of water fountain can not be installed nor can well water be offered to the public at any time. 4) If this project is approved by your office, it is extremely important that safeguards be required in order to protect the areas which have been established for sewage disposal. This would include protection from any type of construction excavation or heavy equipment. I have met with Mr. Perry and described our concerns regarding a project of this scope that would be served by onsite sewage disposal. We continue to recommend that this project be served by public utilities if possible. The sewage disposal systems for projects that are "phased" tend to be very difficult to engineer and install as well as keep accurate records regarding site plan comments.
