with at all times. Appropriate review agencies, specifically the Winchester Regional Airport
Authority and the Federal Aviation Administration, should be consulted and their approval
obtained prior to removal of the lighting from each tower.

Based on review of the Federal Aviation Administration Aeronautical Study #99-AE4-
3577-OE of the referenoed tower, we offer the following comment per your request.
This tower was originally proposed for a 190' monopole but later the plans were modified
to reduce the height to 140' -145'. The Winchester Regional Airport Authority requested
this tower be lit based on the original height proposal and due to the close proximity.
Your company is now requesting to decommission and remove the existing lights on the
tower.
The Winchester Regional Airport Authority has no objection to the removal of the lights
from the Round Hill Methodist Church Tower.

This is in reply to your request to decommission the lights on the above
referenced tower.

do not have the authority to authorize your company to decommission these
lights.
Although the Federal Aviation Administration did not require it to be lit per their
aeronautical study #99-AEA-3577-OE, once a tower is lit, you must seek
approval from the Federal Aviation Administration to decommission the lights.
If you send me a copy of their written approval to remove the lights, I will then
provide you with a letter that we concur with their decision to provide to Frederick
County.

Hi Renny, this email is to confirm that the Winchester Regional Airport has given Crown
Castle International their permission to remove the lighting system currently installed

28, 1999.
Your Conditional Use Permit, 421-99 for a 140-foot, monopole Commercial Telecommunication Facility, was
approved with a waiver of the setback requirements and the following conditions:
1. All Zoning Ordinance requirements and review agency comments shall be addressed and complied
with at all times.
2. The tower shall be available for locating personal wireless service providers.
3. A minor site plan is approved by the County.
4. The tower shall be removed by the applicant or landowner within twelve (12) months of the
abandonment of operation.
5. Landscaping and opaque screening shall be provided to ensure that equipment buildings and other

REVIEW EVALUATIONS:
Virginia Dept. of Transportation: No objection to conditional use permit for this property.
Existing entrance is adequate for proposed use. However, should use ever expand in the
future, the entrance may have to be upgraded to VDOT minimum commercial standards.
Inspections Department: Structure shall comply with the Virginia Uniform Statewide

Planning and Zoning:
Background
The applicant proposes to build a 140' monopole Commercial Telecommunication Facility
that is designed to accommodate additional telecommunications carriers. The proposed
facility will be located on a 0.46-acre parcel in close proximity to Route 50, Northwestern
Pike, and Route 803, Round Hill Road, in Round Hill. It should be noted that Frederick
County recently approved three (3) Commercial Telecommunication Facility applications
along the Route 50 corridor for Shenandoah Mobile Company
Zoning Ordinance Requirements
Commercial Telecommunication Facilities are permitted in the RA (Rural Areas) Zoning
District with an approved Conditional Use Permit. Frederick County's Zoning Ordinance
specifies that a CUP for a Commercial Telecommunication tower may be permitted provided
that residential properties, land use patterns, scenic areas and properties of significant historic
value are not negatively impacted. Furthermore, additional performance standards shall apply
to the CUP review in order to promote orderly economic development and mitigate the
negative impacts to adjoining properties.
Zoning Ordinance Conformance
The applicant has provided an inventory of existing telecommunication facilities in the area.
One of the previously mentioned Shenandoah Mobile Company facilities, a 350'-high lattice
tower is located in this general area and is available for collocation. Also in the vicinity of this
location are the radio towers north of Route 50. The maps provided within the application
analyzing coverage need in this area appear to be sufficient to determine the adequacy of the
search area, and the existing coverage and capacity of the licensee holder in the vicinity of the
proposed facility. As is shown on the maps provided, the coverage needs will be met by a
facility in this location.

Staff' expressed concerns regarding proximity of the existing structures and the potential for
collocation on these facilities. In response, the applicant has provided addition maps depicting
the providers' coverage area if they were to collocate on these other facilities. The maps
indicate that the coverage needs of CFW along this corridor will not be met. The applicant
should demonstrate to the Commission the different technologies used by CFW and
Shenandoah Mobile Company, in particular, why the existing infrastructure works for one
provider but not another provider of a functionally equivalent service.
The proposed accessory structures would be visible from adjoining properties and road right-
of-ways. Therefore, landscaping and screening of any accessory structures would be required.
Should the tower be required to be lighted by the FAA, it would be provided with a dual
lighting system which provides red lights for nighttime and medium intensity flashing white
lights for daytime and twilight use. The Zoning Ordinance requires that these lights be
shielded from ground view to mitigate illumination to neighboring properties.
The proposed Commercial Telecommunication facility is generally in conformance with the
requirements of the zoning ordinance.
Request for setback waiver
The applicant is requesting a waiver of the setbacks pursuant to Section 165-48.6.(B)1 of the
Zoning Ordinance as they are proposing to locate the Commercial Telecommunication Facility
approximately 10' from the adjoining property and 40' from the Trinity Lane right-of-way.
The Zoning Ordinance requires that towers of 140' in height (as is proposed) be placed a
minimum of 175' from the Trinity Lane right-of-way and 165' from the adjoining side and rear
property lines.
The Planning Commission may reduce the required setback distance for Commercial
Telecommunication Facilities if it can be demonstrated that the location is of equal or lesser
impact. It would be impossible to locate the proposed facility on this property in conformance
with the setback requirements. Other parcels exist in the general area that are of sufficient size
to accommodate such a facility in a manner that conforms with the setback requirements of
the Zoning Ordinance. In this case, staff believes that the applicant has not adequately
demonstrated that the impact would be less if located as proposed by the applicant.
Obviously, the proximity of the tower to the adjoining properties and right-of-ways greatly
increases its visual impact.
Conformance with the requirements of Section 704 of the Telecommunications Act of
1996
The applicant is a personal wireless service provider. Therefore, the requirements of the
Telecommunications Act would be applicable. In evaluating this application, it has been
demonstrated that there is a need for the infrastructure within the area of the County

identified. However, the application does not identify other sites in the area that are large
enough to accommodate a facility. It is feasible that the provision of the same services could
be achieved in this area of the County using alternative methods and alternative locations not
identified by the applicant.
STAFF CONCLUSION FOR THE 10/06/99 PLANNING COMMISSION MEETING:
While recognizing that the applicant has demonstrated a need for a facility in this general area, staff
believes that this application for a Commercial Telecommunication Facility has not adequately
addressed the requirements of the Zoning Ordinance. The applicant has not demonstrated that a
waiver of the setback requirements would be appropriate to minimize the impact of the tower on the
surrounding area.
Should the Planning Commission choose to recommend approval of this application, the following
conditions of approval would be appropriate:
All Zoning Ordinance requirements and review agency comments shall be addressed and
complied with at all times.
2. The tower shall be available for locating personal wireless service providers.
A minor site plan is approved by the County.
4. The tower shall be removed by the applicant or landowner within twelve (12) months of the
abandonment of operation.
5. Landscaping and opaque screening shall be provided to ensure that equipment buildings and
other accessory structures are not visible from adjoining properties and road right-of-ways.
PLANNING COMMISSION SUMMARY & ACTION OF THE 10/06/99 MEETING:
An adjoining property owner, located on Northwestern Pike, was concerned about overloading of
an electrical transformer which both he and the church share, and which could adversely affect his
household appliances. His other concern was whether emissions from'the tower would adversely
affect the reception of his AM/FM radio, television, on-line computer, and portable telephone.
Another adjoining property owner on Northwestern Pike did not have objections, but asked if there
was a similar tower in the area they would be able to see.

The representative for the applicant stated that they will apply for and install a new, independent
commercial power service which would operate off of a new, independent transformer, and will not
impact others' electrical needs. The representative also explained why the opportunity for
interference with AM/FM radio and television was very low.
A representative of Round Hill Church was present to speak in favor of the proposed tower and
believed the tower would not negatively affect the visual aesthetics of the church or surrounding area.
Members of the Commission were concerned about the proximity of the tower to the adjoining
properties and right-of-ways. The applicant's representative had documentation of their search
process in which six properties were identified that could meet coverage objectives; however, only
the church property owners were interested in speaking with them. Co -location on nearby existing
towers was also discussed.
The Planning Commission believed that the applicant had demonstrated a need for a facility in this
area and unanimously recommended approval of the conditional use permit with a waiver of the
setback requirements and the following conditions:

complied with at all times.
2. The tower shall be available for locating personal wireless service providers.
A minor site plan is approved by the County.
4. The tower shall be removed by the applicant or landowner within twelve (12) months of the

Please .find enclosed the Airport's comments for the referenced proposed tower sites. After careful review by
our engineering fain, the Winchester Airport offers the following comments.
The intended use for communication towers at the proposed sites WN202, WN203 and WN206.do not
appear to impact FAR Part 77 surfaces or operations at Winchester Regional Airport therefore the Airport poses
no objection to these sites. However we are requesting the right to review all site plans along with completed
copies of Form 7460-1 as required to be filed with the Federal Aviation Administration and the Virginia
Department of Aviation. These forms must be filed at least thirty (30) days prior to construction. Final
comment and approval by the airport of any tower construction will be contingent upon receiving.a favorable
response from both of these agencies.
The site proposed for tower WN208 off of 522 south is strongly opposed by the airport for numerous
reasons. This entire area is located within the Airport's FAR part 77 surfaces and any pole would be within the
left hand traffic pattern for Runway 32 regardless of the height Any tower proposed tower construction within
the Horizontal surface would be not be considered for approval by. the airport. A copy of the Part 77 surfaces
has been provided to Paula Figgatt with CFW Communications for their future reference in planning tower
sites.

Administration Building at 107 N. Kent Street, Winchester, Virginia. This hearing is to consider
Conditional Use Permit #21-99 of CFW Intelos/VA PCS Alliance for a 140' monopole
telecommunications tower. The site is located on 161 Trinity Lane (Round Hill United Methodist
Church property) and is identified with Property Identification Number 52-A-142A in the Back Creek
Magisterial District.
Any interested parties having questions or wishing to speak may attend this meeting. A copy of the
application will be available for review at the Handley Library (temporary Loudoun Street Mall
location) approximately one week prior to the meeting, or at the Department of Planning and
Development located at 107 North Kent Street in Winchester, Virginia.
