Dear Ms. Figgat:
This letter is to confirm action taken by the Frederick County Board of Supervisors at their meeting of
October 28, 1999.
Your Conditional Use Permit, 920-99 for a 140-foot, monopole Commercial Telecommunication
Facility, was approved with a waiver of the setback requirements and the following conditions:
1. All Zoning Ordinance requirements and review agency comments shall be addressed and
complied with at all times.
2. The tower shall be available for locating personal wireless service providers.
3. A minor site plan is approved by the County.
4. The tower shall be removed by the applicant or landowner within twelve (12) months of the
abandonment of operation.

REVIEW EVALUATIONS:
Virginia Dept. of Transportation: No objection to conditional use permit for this property.
Existing entrance is adequate for proposed use. However, should use ever expand in the
future, the entrance may have to be upgraded to VDOT minimum commercial standards.
Inspections Department: Structure shall comply with the Virginia Uniform Statewide

Planning and Zoning:
Background
The applicant proposes to build a 140' monopole Commercial Telecommunication Facility
that is designed to accommodate additional telecommunications carriers. The proposed
facility will be located on a 4.96-acre parcel in close proximity to, North Frederick Pike
(Route 522), in Nain. An existing 100' guyed tower, owned by the Shenandoah Amateur
Radio Club, is located on this site. This tower will be removed, should this application be
approved, and the Shenandoah Amateur Radio Club will be leasing space on the proposed
CFW tower. The guide wires for the existing tower extend beyond the Patton property onto
the Kundert property. The proposed monopole will be located wholly on the Patton property.
Zoning Ordinance Requirements
Commercial Telecommunication Facilities are permitted in the RA (Rural Areas) Zoning
District with an approved Conditional Use Permit. Frederick County's Zoning Ordinance
specifies that a CUP for a Commercial Telecommunication tower may be permitted provided
that residential properties, land use patterns, scenic areas and properties of significant historic
value are not negatively impacted. Furthermore, additional performance standards shall apply
to the CUP review in order to promote orderly economic development and mitigate the
negative impacts to adjoining properties.
Zoning Ordinance Conformance
The applicant has provided an inventory of existing telecommunication facilities in the area.
Staff would concur that there are no existing facilities or appropriate structures available for
collocation in this general area. The maps provided within the application analyzing coverage
need in this area appear to be sufficient to determine the adequacy of the search area, and the
existing coverage and capacity of the licensee holder in the vicinity of the proposed facility.
As is shown on the maps provided, the coverage needs will be met by a facility in this
location.

Should the tower be required to be lighted by the FAA, it would be provided with a dual
lighting system which provides red lights for nighttime and medium intensity flashing white
lights for daytime and twilight use. The Zoning Ordinance requires that these lights be
----shielded from ground view to mitigate illumination to neighboring properties. At this time,
the proposed accessory structures are not visible from adjoining properties, roads or other
right-of-ways. Therefore, landscaping and screening of any accessory structures will not be
required.
The proposed Commercial Telecommunication facility is generally in conformance with the
requirements of the zoning ordinance.
Request for setback waiver
The applicant is requesting a waiver of the setbacks pursuant to Section 165-48.6.(B) l of the
Zoning Ordinance as they are proposing to locate the Commercial Telecommunication Facility
approximately 25' from the Kundert property, 50' from the Collins property, and 70' from the
Footstone Lane right-of-way. The Zoning Ordinance requires that towers of 140' in height
(as is proposed) be placed a minimum of 175' from the Footstone Lane right-of-way and 165'
from the adjoining side and rear property lines.
The Planning Commission may reduce the required setback distance for Commercial
Telecommunication Facilities if it can be demonstrated that the location is of equal or lesser
impact. It would appear as though this facility could be located elsewhere on the property in
conformance with the setback requirements. However, staff would recognize that the
proposed tower location, which entails the removal of the existing tower, would have less of
an impact on the surrounding area. The proposed tower would make use of the existing
disturbed area, eliminate an existing tower rather than creating additional towers on this
property, and eliminate the physical impact of the existing tower on the adjacent property. In
this case, staff believes that the impact would be less if located as proposed by the applicant.
Conformance with the requirements of Section 704 of the Telecommunications Act of
1996
The applicant is a personal wireless service provider. Therefore, the requirements of the
Telecommunications Act would be applicable. In evaluating this application, it has been
demonstrated that there is a need for the infrastructure within the area of the County
identified. The approval of this application would be in conformance with the requirements
of Section 704 of the Telecommunications Act of 1996.

STAFF CONCLUSION FOR THE 10/06/99 PLANNING COMMISSION MEETING:
Staff believes that this application for a Commercial Telecommunication Facility has adequately
addressed the requirements of the Zoning Ordinance in that a need for this facility, based upon a lack
of coverage and capacity in this part of the County, has been demonstrated. Further, the waiver of
setback requirements may be appropriate to minimize the impact of the tower on the surrounding
area.
Should the Planning Commission choose to recommend approval of this application, the following
conditions of approval would be appropriate:
All Zoning Ordinance requirements and review agency comments shall be addressed and
complied with at all times.
2. The tower shall be available for locating personal wireless service providers.
3. A minor site plan is approved by the County.
4. The tower shall be removed by the applicant or landowner within twelve (12) months of the
abandonment of operation.
PLANNING COMMISSION SUMMARY & ACTION FOR THE 10/06/99 MEETING: The
representative for the applicant stated that this was not intended to be a spec tower, but is needed to
improve their existing and growing customer base.
There were no citizen comments.
Commission members discussed such issues as structural capacity, co -users, lighting, and facility
needs with the applicant's representative. Members of the Commission agreed with the staff s
recommendation that this application for a Commercial Telecommunication Facility had adequately
addressed the requirements of the Zoning Ordinance in that a need for this facility, based upon a lack
of coverage and capacity in this part of the County, has been demonstrated. They also agreed that
the waiver of setback requirements was appropriate to minimize the impact of the tower on the
surrounding area.
The Planning Commission unanimously recommended approval of the conditional use permit with
a waiver of the setback requirements and the same conditions as recommended by staff, as follows:

Dear Ms. Figgatt:
Please find enclosed the Airport's comments for the referenced proposed tower sites. After careful review by
our engineering firm, the Winchester Airport offers the following comments.
The intended use for communication towers at the proposed sites WN202, WN203 and WN206 do not
appear to impact FAR Part 77 surfaces or operations at Winchester Regional Airport therefore the Airport poses
no objection to these sites. However we are requesting the right to review all site plans along with completed
copies of Form 7460-1 as required to be filed with the Federal Aviation Administration and the Virginia
Department of Aviation. These forms must be filed at least thirty (30) days prior to construction. Final
comment and approval by the airport of any tower construction will be contingent upon receiving a favorable
response from both of these agencies.
The site proposed for tower WN208 off of 522 south is strongly opposed by the airport for numerous
reasons- This entire area is located within the Airport's FAR Part 77 surfaces and any pole would be within the
left hand traffic pattern for Runway 32 regardless of the height Any tower proposed tower construction within
the Horizontal surface would be not be considered for approval by the airporL A copy of the Part 77 surfaces
has been provided to Paula Figgatt with CFW Communications for their future reference in planning tower
sites.

Winchester Regional Airport
Dear Ms. Figgatt:
Please find enclosed the Airport's comments for the referenced proposed tower sites. After careful review by
our engineering firm, the Winchester Airport offers the following comments.
The intended use for communication towers at the proposed sites WN202, WN203 and WN206 do not
appear to impact FAR Part 77 surfaces or operations at Winchester Regional Airport therefore the Airport poses
no objection to these sites. However we are requesting the right to review all site plans along with completed
copies of Form 7460-1 as required to be filed with the Federal Aviation Administration and the Virginia
Department of Aviation. These forms must be filed at least thirty (30) days prior to construction. Final
comment and approval by the airport of any tower construction will be contingent upon receiving a favorable
response from both of these agencies.
The site proposed for tower WN208 off of 522 south is strongly opposed by the airport for numerous
reasons. This entire area is located within the Airport's FAR Part 77 surfaces and any pole would be within the
left hand traffic pattern for Runway 32 regardless of the height. Any tower proposed tower construction within
the Horizontal surface would be not be considered for approval by the airport. A copy of the Part 77 surfaces
has been provided to Paula Figgatt with CFW Communications for their future reference in planning tower
sites.
