REVIEW EVALUATIONS:
Virginia Dept. of Transportation: The existing entrance is inadequate for proposed use.
Significant improvements must be made to the existing crossover and entrance to provide safe
ingress and egress to this site by this applicant. Assurance that the needed crossover and
entrance upgrades will be constructed are necessary prior to VDOT submitting positive
comments for the issuance of this conditional use permit.
Inspections Department: Building shall comply with The Virginia Uniform Statewide
Building Code and Section 304, Use Group B (Business) of the BOCA National Building
Code/1996. Other codes that apply are CABO A117.1-92, Accessible and Usable Buildings
and Facilities. Note Section 1110.2.1 Exception #1 of BOCA (ADA 20% rule for additions
and renovations). Parking and building access shall comply with CABO Al17.1-92 and
BOCA Chapter 11.
Fire Marshal: No public or private water source available on site, fire apparatus will be
required to shuttle water to site for fire suppression activities. Plan approval recommended.

Planning and Zoning: The Frederick County Zoning Ordinance allows for humanitarian aid
organizational offices with an approved Conditional Use Permit in the RA (Rural Areas)
Zoning District. The applicant proposes to legally establish a humanitarian aid organizational
office and proposes to build a two-story frame office building, 40' x 44', on the property. This
building is in addition to the existing office and residence located on the property. OTAN
obtained a CUP in 1991 to establish an office as a cottage occupation.
Based on information provided by the applicant, a total of five (5) employees currently work
at the site. The number of employees that the applicant will have if this proposed Conditional
Use Permit is issued will be nine (9) full-time employees and three (3) part-time employees.
In light of the Health Department's comments, the number of employees located at this
facility shall not exceed fifteen (15). No additional residences shall be permitted.
The applicant meets performance standards established in the Zoning Ordinance, in particular,
the buffer and screen requirements. There is natural vegetation and wooded screening
between the subject property and adjoining properties. The setbacks of the subject property
and adjoining properties is 50 feet respectively.
VDOT has stated the existing entrance is inadequate for this proposed use. Significant
improvements must be made to the existing crossover and entrance to provide safe ingress
and egress. In addition, the Frederick County Fire Marshal has stated a 20-foot-wide roadway
must be provided to ensure access in cases of emergencies. An engineered site plan will be
required for this proposed Conditional Use Permit. This site plan will address all the
requirements of the County of Frederick Zoning Ordinance and the requirements of the
various reviewing agencies. Due to the nature of the VDOT and Fire Marshal comments it
is staffs belief that the approval of this CUP should be conditioned upon approval of the
above referenced site plan by the Planning Commission.

STAFF CONCLUSIONS FOR 10-06-99 PLANNING COMMISSION MEETING:

PLANNING COMMISSION SUMMARY & ACTION FOR THE 10/06/99 MEETING:
Members of the Commission questioned whether the wording of Condition #5, regarding the number
of employees, was consistent with what the Health Department had intended in their letter of August
12, 1999. Commission members decided that Condition #5 should be revised to read, "No more than
15 employees and two full-time residents shall be located at this property," in order to accurately
reflect the Health Department's comments.
One adjoining property owner on Chestnut Grove Road had concerns about the construction of the
20' roadway and whether OTAN would be required to obtain approvals from the adjoining property
owners for additional right-of-way. In addition, he inquired if the road would be built prior to any
other construction on the site. The OTAN representative stated that they had made arrangements
with the adjoining church property to secure additional right-of-way. The staff added that prior to
site plan approval, all easements must be executed and recorded.
The Planning Commission unanimously recommended approval of the conditional use permit with
the following conditions:

Thank you for the opportunity to discuss your land development plans. Your sincerity in
providing the visions and goals of OTAN show that you have the utmost regard for life safety
and property conservation.
Our discussion of the 20 feet roadway construction for ingress and egress is a fire
department priority. This was also your greatest concern and as you indicated would be the first
priority in OTAN's project phase. The package sent for our review did not address this issue and
the attached comment sheet reflects a plan disapproved based on that information.
The construction of a 20 feet wide roadway that allows fire department ingress and egress
will satisfy this requirement. A site plan review will allow the Fire Marshal's Office an
opportunity to address access to all buildings in the proposed phases. I would also recommend
portable fire extinguishers be provided for each building and training your staff in their use. You
indicated that their acquisition was already being pursued.

Subject: Outreach To Asia Nationals, proposed new office expansion, Phase I (only)
The existing sewage disposal system proposed to serve the occupants and employees for Phase I
of the project was evaluated this date. The system appeared to be functioning properly.
According to the application submitted to this office, Phase I is to consist of two full-time
residents who currently occupy the existing home and a maximum of fifteen. (15) employees.
The construction of this system was approved by the health department on June 7, 1979 for a
total domestic waste load of 600 gallons per day. Therefore, the health department has no
objection to the proposal for Phase I based on the occupants and employees noted above as long
as the following items are properly addressed:
1) The distribution box and the upper drainfield ditch are to be located to assure that no building
foundations are to be placed within ten (10) feet of the drainfield (20 feet if a basement
foundation is proposed) and to assure that no driveways or parking lots are to be placed over
the distribution box.
2) Any driveway or parking lot proposed to be constructed over the drainfield must be
supported by a minimum'of 30 inches of fill material over the top of the gravel in the
drainfield.
3) If a driveway or parking lot is proposed over the septic tank, the applicant must submit
documentation from a qualified engineer as to the proposed additional weight on the tank and
verification that the tank will withstand the load.
4) Prior to the construction of any additional sewage disposal system components for the new
building, an application for a construction permit must be submitted to this office and a
construction permit issued. At that time, the use of the existing conveyance line assumed to
be installed under the existing office will be considered. Part or all of that line may have to
be uncovered to verify that it meets the requirements of the regulations.
No guarantee is given or implied that this sewage disposal system will continue to function
properly in the future. Repairs will be required if the system malfunctions.

We have reviewed your request to defer construction of the crossover improvements until the next
phast of their on -site improvements begin.
As discussed by telephone, VDOT is willing to consider accepting a bond, in the amount to be
determined through a cost estimate supplied by your firm, for the construction of the crossover
improvements. This bond is to remain in effect for a minimum of three (3) years or until construction
of the crossover improvements begin. Should your client need additional time beyond the three
years, the bond will need to be extended until construction of additional phases begins. This bond
and agreement is for the crossover only and is not intended to be used for the commercial entrance
into the site.

Thank you so much for taking the interest you have in our quest to obtain a building permit from Frederick
County for present and future additions to our office. I appreciate all your comments and all the help you
have been to us in solving the problem to the entrance off Route 522 North onto our property.
After you Deft, I went back down to take measurements and re-examine the entrance again. Much to my
amazement I found on the left-hand side of the entrance where the erosion has occurred and has made the
drive dangerous that the end of the culvert pipe is 20 feet further up the ditch. I was under the impression
that the end of the culvert was almost directly underneath the entrance. Therefore, if we were to widen the
entrance we would have to put in a new culvert and re -direct the water run-off from Route 522 to a new
culvert.
Now I realize that all we will have to do is add fill over the existing culvert and re -direct the water from Route
522 into that culvert in a more proper way. This would give us a 30 foot entrance with a proper.slope on
that side. It would be impossible to get a 40 foot entrance and still have a proper slope on that side and a
maintainable situation. I have talked with the church on top of the hill and they have agreed to give us the
fill we need and the haul is very short so we will be able to keep costs at a minimum.
We do understand the need for a left tum lane coming North from Winchester and are willing to install it.
I would hope that you would seriously consider our sincere effort in trying to comply with all VDOT rules and
regulations that pertain to this matter and would grant to us a permit on the condition that we have a 30 foot
entrance. I would appreciate if you would expedite this matter as soon as possible and let us know of your
decision.

be. May God bless you greatly as you labor for the safety of all of us in Frederick County.

In response to a request from Mr. Otis Goodwin of Outreach To Asian Nationals (OTAN), staff has
reviewed and evaluated the possibility of amending the Zoning Ordinance to allow uses such as OTAN
to operate in the RA (Rural Areas) Zoning District. The Planning Commission reviewed the request
during a discussion on October 7, 1998. The Planning Commission's discussion resulted in a motion to
deny the proposed ordinance amendment. The Board of Supervisors reviewed the request on November
11, 1998, at which time staff was directed to redraft an ordinance amendment for the Board to consider.
Background on Zoning Ordinance Amendment Request
Staff received a request to amend the Zoning Ordinance to consider allowing non-profit foreign aid
organizational offices in the RA Zoning District. This request had been made by Outreach To Asia
Nationals (OTAN). OTAN established itself in Frederick County in 1991 as a cottage occupation. The
Board of Supervisors approved Conditional Use Permit #009-91 in 1991 allowing OTAN to establish
an office in an existing garage on OTAN property off Route 522N. Since that time, interest in OTAN
has increased; OTAN feels that an expansion of its facilities is necessary to continue providing their
services.
OTAN provides equipment, training, and, financial support to national church workers in Asia in their
pursuit of furthering their belief in Christianity. Funding for this service is derived from churches
throughout the United States. OTAN envisions the Frederick County location as the organization's main
office, providing administrative services and training. Limited overnight accommodations are also
envisioned for up to 10 persons.
With any expansion of this facility, OTAN will no longer be considered a cottage occupation; a cottage
occupation states that no more than one person, other than the members of the family residing on the
property, may be involved with the business. The type of use that OTAN has requested is not permitted

in the RA Zoning District. Therefore, OTAN has requested that the ordinance be amended to allow this
use in the RA Zoning District.
Staff Comments
The County's Comprehensive Policy Plan and the Zoning Ordinance restrict office uses in the RA (Rural
Areas) Zoning District. In the RA Zoning District, the typical office use will generate a significant
impact in terms of vehicular traffic and environmental pollution (air, groundwater, noise). As no public
utilities are available, wells and drainfields will be necessary. Emergency services should also be
considered; without public water available, pumper trucks would be necessary to respond to fire
emergencies.
In the RA Zoning District, the Comprehensive Policy Plan and the Zoning Ordinance encourage and
allow, respectively, uses that are associated with the rural community. Uses such as agricultural pursuits
and single family residences are permitted by -right. Uses that provide services to the rural community,
such as country stores, farm markets, feed stores, and auto repair, are considered and permitted on a site
specific basis. In either case, the uses are small in nature and provide services to the rural community
with minimal impact on the surroundings.
When considering an office use in terms of long-range planning, the differentiation between a for -profit
or non-profit use is not relevant. Both for -profit and non-profit uses will create a similar impact on the
property and its surroundings. It is the professional opinion of staff that an office use, whether for -
profit or non-profit, does not provide a direct service to the rural community.. Therefore, office uses
should not be permitted in the rural community (RA Zoning District), but should locate, as is presently
permitted, in the business district of the county were the necessary infrastructure and services are
available. The allowance of office uses in the rural community conflicts with the County's goal of
preserving the rural character of the RA Zoning District.
Further Considerations
Staff is concerned with the potential impact this type of use may have in the RA Zoning District, and
especially on the adjoining properties. Presently, if this use was located in the B2 (Business General)
District, adjacent to RA -zoned property used for residential uses, a category "B" buffer would be
required. A category "C" buffer would be required if the property was zoned MI (Light Industrial).
Therefore, if the use is considered appropriate in the RA district, it would be staff's recommendation that
a buffer component be utilized.

Research Considered by the MRS and Staff in Acting on this Request
Staff communicated with a number of representatives from jurisdictions from around the Commonwealth
to ascertain how other jurisdictions address, or would address, the issue before us. Summary of findings:
1. Does the establishment of an office, for whatever purpose, in the rural part of the county
concur with the County's Comprehensive Plan? In Frederick County, the
Comprehensive Plan indicates that office uses should be located within the Sewer and
Water Service Area (SWSA). The SWSA is generally located near Winchester and
Stephens City.. ,
2. `Urban Uses' - including offices, conference and training facilities - are typically located
near the urban core of an area. By locating the proposed use in a rural setting, you
contradict the community's long-range planning efforts.
3. The allowance of non-profit groups to locate in the rural areas of the County would
establish a precedent for future organizations of similar composition.
4. The more a community departs from traditional planning practices, i.e., keeping office
type uses near urban areas, the more difficult it is to maintain solid planning practices and
principles.
5. As uses spread from the urban area, the cost of providing services (fire/rescue/utilities)
increases significantly.
6. Non-profit classification is not a privilege that exempts the user from zoning
requirements. The CBN (Christian Broadcast Network) in Norfolk is a non-profit
organization that is quite large, yet adheres to the zoning requirements for that city.
Within Frederick County, a number of uses were identified that might have similar origins as that
requested. These projects include: Timber Ridge School, Rock Enon Boy Scout Camp, God's Glory
Land, and Project Hope.
1. Timber Ridge School. The Timber Ridge facility (Leary Educational Foundation, Inc.) was
established at its location in Reynold's Store prior to 1969. Based on its academic pursuits,
the facility may be classified as a school.
2. Rock Enon Boy Scout Camp. The Rock Enon Boy Scout Camp is a campground and
recreational area. While this facility has existed for a number of years, similar facilities could
be established with a Conditional Use Permit.
3. God's Glory Land. Issued a Conditional Use Permit as a Church retreat in 1994, the master
plan for God's Glory Land would also be considered a recreation area/resort. The facility
contains athletic fields, a swimming pool, bath houses, and a number of one -room cottages.
4. Project Hope. Project Hope has two local locations. The first is in the Airport Business
Center, Zoned Ml; used for warehousing. A second Project Hope facility is located in Clarke
County. This facility is considered legally non -conforming as it was established prior to the
adoption of the zoning ordinance. Based on discussions with a Clarke County representative,
facilities such as Project Hope would not be permitted under today's zoning ordinances. Nor
would the County feel an amendment to the zoning ordinance would be appropriate.

Conclusion
While staff is concerned with this requested amendment, attached is our attempt to draft an amendment
that would provide for the proposed use. The DRRS reviewed this request at their meeting on
December 10, 1998. The subcommittee is concerned that the requested use would be inappropriate in
the RA district, and unanimously recommended against the requested amendment.
Planning Commission Summary & Action of 01/06/99
In referring to the proposed definition written by the DRRS, the applicant, Mr. Otis Goodwin of
Outreach to Asian Nationals (OTAN), stressed that his organization is not a "humanitarian aid
organization," but is a "Christian Mission Board" directly connected to and supported by the local
churches in Frederick County. He stated that this is the office . and management facility for their
organization in ten other countries in Asia. Mr. Goodwin explained that their 20-year future plan calls
for additional buildings on the property, one of which would contain three apartments and two dorms,
whereby persons in the field or traveling might come for a short-term stay. In addition, under the
proposed Supplementary Use Regulations, Mr. Goodwin requested that the maximum building square
footage be increased to 25,000 square feet instead ofthe 15,000 square feet recommended by the DRRS.
The greatest concern expressed by the Commission was that allowing this type of use in an RA District
would create a precedent that cannot be controlled. Everyone was in agreement that OTAN was a
worthy organization and the service provided by them was beneficial; however, the Commissioners
believed this must be dealt with as a land use and the question of what types of land use are appropriate
in which areas needed to be considered.
In discussing the proposed definition of the use, members of the Commission objected to narrowing the
definition so much that it would exclude another group which provides a valuable service to the
community or foreign nations, whether they are religiously affiliated or not, or provided services or
supplies, when for the same outward appearances had the same impacts on the community and is of a
similar scale. They felt it would not be appropriate to amend the ordinance to accommodate a particular
individual in a specific zone.
The Planning Commission recommended denial of consideration to allow this use in the Rural Areas
Zoning District by the following majority vote:

Description of OTAN Ministries and Activities
The following is a full description of the activities and ministries conducted by Outreach To
Asia Nationals both in the United States and overseas.
Missions Statement: " To equip, train, and support National Church workers in Asia to
carryout the Great Commission (Gospel of Jesus Christ) to the untold millions."
Outreach To Asia Nationals is involved in Christian ministries in China, Vietnam,
Cambodia, Burma, Laos, Nepal, Russia, Turkmenistan, Bhutan and have targeted North
Korea and Mongolia as future ministry fields.
The stateside activities include OTAN personnel traveling to Churches throughout the U.S.
raising financial and prayer support for ministries overseas and National overseas
personnel. We do bulk mailings from the Winchester office to stay in contact with
supporters and raise fund for the ministries. The Winchester office serves as the main
headquarters. All financial and ministry records and reports are established and
maintained at this location. Overseas ministry management personnel work out of the.
Winchester office as well as the Bangkok, Thailand office. We collect medical supplies,
eyeglasses, hearing aids, etc. for distribution to the people in the overseas countries where
we minister. We organize systematic Biblical Christian training for National Pastors and
church workers in Southeast Asia and recruit Pastors in the United States to do the actual
training abroad. We organize medical teams using doctors and nurses from the United
States to do short-term medical ministries, providing medical aid in the countries where we
work. We maintain and staff a Children's home in Nepal for Tibetan refugee children.
The Winchester office takes care of transferring and distribution of financial support to
National Pastors, purchasing and distribution of Bibles, Christian literature, motorcycles,
computers, and other practical needs of the pastors in the countries we work in.
We produce on site most of our promotional literature, ministry brochures, newsletters, and
other literature used in the ministry. We do this by the use of computers, color printers and
small printing press. We use local printing firms to print some of our materials.
Outreach To Asia Nationals is not involved in any sales of merchandise or services
whereby customers would create excess traffic coming and going from the ministry
property. All funds are provided by local churches and individual supporters via US mail.

OTAN Facility Size Per Phase
Phase One will be an addition to the present office building, which will be 44 x 40
consisting of two floors for a total addition of 3,520 square feet.
Phase Three, Four and Five will be stand alone buildings, approximately 45 x 45 with
two stories consisting of 4,050 square feet.
The appropriate number of parking spaces will be constructed according to county and
state regulations.

OTAN Population and Traffic Statistics
Present employee population:
At the present time Outreach To Asia Nationals has six office staff members. Three staff
persons work five days a week, one staff person works four days a week, and one staff
person works three days and one staff person works one day a week. One
maintenance person works on the grounds one day a week. We also have volunteer
workers that come in at different times, as needed, but never more than two volunteers
here at one time.
Among the six employees there is much USA travel required, therefore, all are rarely in
the office at the same time.
Present traffic statistics:
Presently we have two staff living on the property presenting no traffic flow on and off
the property during business hours. There are only two other staff vehicles entering and
exiting on a regular daily basis. One comes from the North and one comes from the
South. One staff member and the maintenance worker enter and exit one day a week.
We do have occasional delivery service. At no time do we ever have more than one
vehicle entering or exiting the property onto Route 522. We have a Board meeting each
April and October bringing in 12 board members for two days. Most Board members
travel by plane, and are transported by staff members to and from the property.
Future employee population:
(Phase One is the addition on the present office building on the Preliminary Master
Development Plan)
Phase one addition would create an employee population of twelve staff members, nine
full-time personnel five days, one person four days, one person three days, and one
person one day a week. We would still have one maintenance man coming one day a
week and two volunteers will still come as needed usually one day a week.
Among the nine full-time employees, much USA travel is required, therefore, all nine
would rarely be at the office at the same time.

Phase four would create an employee population of thirty-two full-time personnel.
Among the thirty-two employees, because of much travel, all thirty-two employees
would rarely be at the Winchester office at the same time. Among the thirty-two, there
would be those who would work only four, three and one day a week on the premises.
We would still have volunteer workers as needed, but never more than four volunteers
on one or two days a week.
Future traffic statistics:
(Phase four is the second stand alone building to be added to the plan according to the
Preliminary Master Development Plan.)
There will be two staff members living on the property presenting no traffic flow on and
off the property during business hours.
Twenty other vehicles will be entering and exiting on a regular basis by the full and part-
time staff. Only three or four vehicles will come from the North and it is predicted that all
other vehicles will come from the South. Part-time and maintenance workers will only
enter and exit the property once a week and at different times. Among the thirty-two
full-time staff (ten married couples and ten single individuals), many will travel frequently
and will rarely all be at work on the same days. We will continue to have occasional
delivery services. At no time do we expect more than four vehicles exiting or entering
the property, at any one time onto Route 522.
Phase five is the third stand alone building to be added to the plan according to
the Preliminary Master Development Plan.
Phase five of the Preliminary Master Development plan will be a building that will
contain three small apartments, a large work area and a large storage area. The
apartments will accommodate retirees traveling South in the winter and North in the
spring. As they travel back and forth they will volunteer time working for the ministry
and stay in the apartments. The apartments will be used for the overseas staff traveling
to the United States from time to time. Traveling missionaries will also use these
apartments as available. Phase five will not increase our employee population and will
have little or no effect on traffic conditions to and from the property.
