Virginia Dept. of Transportation: No objection to conditional use permit for this property.
Ekisting entrance is adequate for proposed use. However, should use ever expand in the

Inspections Department: Area of structure shall comply with The Virginia Uniform
Statewide Building Code and Sectiori 304, Use Group B (Business) of the BOCA National

Health Department: A repair application for a drainfield was submitted for this property on
4-25-95 but our records indicate no repairs were ever completed. A letter was sent to Jean
Lambrisky (see attached letter from Doug Dailey, Environmental Health Specialist Senior,
dated 6-16-96) detailing the steps required prior to issuance of a repair permit. The health
department cannot comment favorably on this proposal until an adequate sewage disposal
system is permitted, installed, and approved.
Sanitation Authority: We do not serve this area.
Planning and Zoning: This Conditional Use Permit application is in response to a zoning
violation complaint that staff received. The applicant was cited for the operation of an illegal
business (graphics workshop). Obtaining the Conditional Use Permit is an available option
to resolve the violation.
The Zoning Ordinance allows for a Cottage Occupation with a Conditional Use Permit in the
RA (Rural Areas) Zoning District. This property is located in the RA district, and a graphics
workshop would qualify as a cottage occupation. In adherence to cottage occupation
definition, all activities would be required to occur within structures. Based upon the limited
scope of activities proposed by the applicant and the requirements of a cottage occupation,
it appears this Conditional Use Permit would not have any significant impacts on the adjoining
properties.
STAFF CONCLUSIONS FOR 10-06-99 PLANNING COMMISSION MEETING:
Staff feels that this application is in conformance with the surrounding areas, and would recommend
approval of this application with the following conditions:

Thank you for asking Cloverleaf Environmental Consulting, Inc. to assist you with
designing your on -site wastewater treatment system. Our associate, Frank
N McComas, recently met with you at the property to review the site.
Based on Health Department documents you provided, an existing three bedroom
Cdrainfield serves the main house. A letter, June I3, I996, from Doug Dailey,
E.H.S. Sr., indicates a high rate recirculating sand filter was needed to compensate
Wfor shallow depth to rock and high water table. The replacement drainfield was
located by Eric Smither, E.H.S., and reviewed by the Environmental Health
lim Manager, Steven Stiefel. A family emergency delayed replacing the system with an

engineered sand filter design. You are now prepared to carry on with installing the
Wsand filter pretreatment.
The secondary guest house you plan to improve is not on a separate parcel and can
Cbe served by the replacement drainfield area. The proper procedure will. require
Wtrading one bedroom of wastewater capacity, to serve your secondary guest house,
from the three bedroom capacity of the existing residence. Thus, construction of
your sewage disposal system coincides with upgrading the existing drainfield to the
0 treatment system described in the Health Department's letter.

By tapping into the existing three bedroom system, we can incorporate a high rate
sand filter solution that will meet the sewage disposal needs of both structures.
Since the total wastewater capacity for this proposal already exists on the property,
it would be reasonable to request Health Department approval of your building
permit to the building department, until our construction plans and specifications
can be completed.

I am an adjoining property owner to the applicant. Upon attempting to review the
application, that your letter stated, would be at Handley Library -Donna Citron in the
reference dept. said they had never received a copy of the permit # 16-99.
It is good for our local businesses to thrive and I hope they do. Having recently
purchased the operating farm adjacent the applicant, my only concern is that the cottage
is within the set-off limits of zoning and that it may effect our agriculture applications. If
there is no possibility of our being limited our restricted to certain agriculture activity and
applications as a result of the cottage being constructed then we have no reason to be
concerned.
