Health Department: The Health Department has no objections as long as the structure is on
public water and sewer.
Sanitation Authority: No comment.
Planning and Zoning: This Conditional Use Permit application is in response to a zoning
violation complaint that staff received. The applicant was cited for operation of an illegal
business (assisted living facility), and obtaining the CUP is an available option to resolve the
violation.
The Zoning Ordinance allows for an assisted living facility with a Conditional Use Permit in
the RP (Residential Performance) Zoning District. This assisted living facility will be located
in the principal structure. The adjoining properties are located 25 feet from the principal
structure. Based upon the limited scale of the proposed use and evaluation of the property,
it appears this use would not have any significant impacts on the adjoining properties.
STAFF CONCLUSIONS FOR THE 09/01/99 PLANNING COMMISSION MEETING:
Staff recommends approval with the following conditions:
1. All review agency comments shall be complied with at all times.
2. This assisted living facility shall be permitted to provide for a maximum of five (5) qualifying
adults.
No business sign will be permitted
4. The applicant shall satisfy all licensing requirements of the Virginia Department of Social
Services and the County of Frederick.
PLANNING COMMISSION SUMMARY & ACTION OF 09/01/99 MEETING: The
President and Association Manager ofthe Glenmont Village Homeowners Association, Inc., Richard
Crane, was present to speak on behalf of the residents of the Glenmont Village subdivision. Mr.
Crane stated that this use was a violation of Glenmont Village's subdivision deed covenants.
Although the residents were not opposed to the Rickards conducting the assisted living facility, Mr.
Crane requested that the Commission add a condition that the applicant submit a written request for
a waiver of the subdivision covenants, in order to maintain the integrity of their association.

The Planning Commission explained that the County has no authority to enforce deed covenants and
believed it would not be appropriate to grant Mr. Crane's request by placing an additional condition
on the Rickard's conditional use permit. The Commission congratulated Mr. Crane, the residents of
the Glenmont Village subdivision, and the applicant for working so well together to arrive at an
amicable solution for all the parties involved.
No other citizens spoke. The Commission unanimously recommended approval with the same
conditions recommended by the star, as follows:
1. All review agency comments shall be complied with at all times.
2. This assisted living facility shall be permitted to provide for a maximum of five (5) qualifying
adults.
No business sign will be permitted
4. The applicant shall satisfy all licensing requirements of the Virginia Department of Social
Services and the County of Frederick.

Some facts, information, and questions to consider when developing an opinion or position:
• The Rickards are leasing with an option to buy;
• The facility will be limited to no more than five boarders;
Mrs. Rickard said she has no intentions of having more than three boarders;
No renovations to the house are contemplated;
• Facility health and safety issues are controlled by Federal, state, and local regulations;
• The question of handicap access and adequate bathroom facilities is not our concern;
• Frederick County cannot deny the application, based on our covenants,
• Sirens are not used when rescue service vehicles transport boarders to health appointments;
• No appreciable increase in emergency service is anticipated since there will be only three boarders;
• Supplies will be purchased by the Rickards, not delivered by commercial vehicles.
No doubt, one could come up with a host of other possible concerns or questions. But, this is such a
"low-level" use that any negative impact to the neighborhood will be negligible. We should appreciate
those who are called to serve humanity in this way.. We all have friends or relatives who would welcome
an opportunity -to have access to this type of facility as an alternative to nursing homes. And, remember,
we all will get old one day.
I will address the Planning Commission on September 1st to explain our covenants and implications of
setting precedence for allowing business in the subdivision. I will also speak on behalf of anyone wishing
me to share valid concerns, however, let's not derail Mrs. Rickard's effort to serve senior adults with
"nickel and dime" fears brought about by a lack of understanding.

Sherman and Bonnie Merryman have leased (with option to buy) their property at 113 Edgewood Drive
to Lynne and Timothy Rickard. The Rickards moved in late spring. Mrs. Rickard is a Registered Nurse
and finds her calling is to help those who are elderly and unable to live on their own. Lynne found out
she must be licensed and obtain a permit in order to conduct this type activity in her home. She has taken
the necessary steps to comply with all legal requirements.
The Frederick County Planning Commission will hold a public hearing on September 1, 1999 at 7:00 p.m.
in the Board Room of the Frederick County Administration Building, 107 N. Kent Street, Winchester to
consider the Rickard's application for a Conditional Use Permit for an Assisted Living Facility in their
home. The process to get to this point requires scrutiny by several agencies and departments, including
Fire, Health, Transportation, Social Services, and others. To my knowledge, all concerns expressed by
any agency or department have been resolved. Lynne and Timothy are doing everything possible to
minimize any negative impact on the neighborhood. The Frederick County Department of Planning and
Development is prepared to recommend approval.
Several of you have contacted me with your concerns. I have met with four residents on Edgewood, and
the Merrymans, the Rickards, and Mark Cheran of the Frederick County Department of Planning and
Development. I have shared yours and my concerns with everyone with whom I have spoken. After
considerable thought, contemplation, and prayer, I have concluded that I cannot, in good conscience,
take a position against the application, on any grounds, except as it relates to any possible violation of the
Glenmont Village Declarations of Covenants and Reservations.
You, as a citizen of Frederick County, have the right and an opportunity to express your opinions before
the Planning Commission on September 1". It is important to keep a few pointers in mind when you
speak at a public hearing. It never helps your cause to be hostile, abusive, or repetitive. You should have
your words thought out and prepared and limit your remarks to the time given you to speak. Whether or
not you wish to speak, it is important for you to attend on the 1' in order to be as informed as possible.
It's not fair to take a position on an issue without understanding all the facts; or for that matter, drawing
opinions about others without seeking to know something about them.
If you haven't taken the opportunity to meet your new neighbors, you should. Mrs. Rickard assures me
their door is open to all who would give them a chance_ Go knock on their door or give them a can at
667-9979. They'd love to meet or speak with you.
