Dear Mr. Cooper:
This letter is to confirm action taken by the Frederick County Board of Supervisors at their meeting
on September 22, 1999. Your Conditional Use Permit, #14-99 for a Cottage Occupation to operate
a custom auto detailing business was approved with the following conditions:
All review agency comments shall be complied with at all times.
2. All work shall be accomplished within an enclosed structure.
3. Any proposed business sign shall conform to the Cottage Occupation sign requirements; sign
shall not exceed four (4) square feet.
4. No outdoor storage of equipment associated with the business shall be permitted.
No additional employees shall be permitted.
6. No more then five (5) vehicles awaiting detailing shall be permitted. Vehicles awaiting
detailing must be located to the rear of the building.
7. No inoperative vehicle shall be allowed on the property at anytime.
8. Hours of operation shall be 7:00 a.m. to 7:00 p.m.
9. Completion of all site improvements must occur within 180 days of permit approval.
The Board of Supervisors conditioned the approval of this land use to require the completion of all
site improvements prior to any activity occurring on this property. The business may begin prior to
the 180-day limit described under condition 9 of this permit if all required site improvements are
completed and inspected; however, if these improvements are not finalized after 180 days from the
date of approval, the CUP will be brought back to the Board of Supervisors for potential revocation.

REVIEW EVALUATIONS:
Virginia Dept. of Transportation: No objection to a conditional use permit for this
property. However, prior to operation of the business, a commercial entrance must be
constructed to our minimum standards to allow for safe egress and ingress of the property.
Any work performed on the State's right-of-way must be covered under a land use permit.
The permit is issued by this office and requires an inspection fee and surety bond coverage.
Inspections Department: Existing building shall comply with the Virginia Uniform
Statewide Building Code and Section 311, Use Group S (Storage) of the BOCA National
Building Code/1996. Other Codes that apply are CABO A117.1-92 Accessible and Usable
Buildings and Facilities. Please submit a floor plan of the area of the existing building to be
utilized and apply for a change of use permit. Final inspection approval and a new certificate
of use and occupancy shall be issued prior to operation. Minimum plumbing facilities shall
be provided within 500' in accordance to the International Plumbing Code.
Fire Marshal: Emergency access must be maintained. Plan approval is recommended.

Health Department: The property owner, Sammy Triplett, advised this office today that
there is no sewage disposal system serving this structure. The Health Department cannot
comment favorably on the proposal until an acceptable sewage disposal system is permitted,
installed and approved (if possible).
Sanitation Authority: No comment.
Winchester Regional Airport: The proposed business does not impact airport operations.
There are no objections to this request.
Planning and Zoning: The proposed custom auto detailing shop would qualify as a Cottage
Occupation. In adherence to the Cottage Occupation requirements, all activities would be
required to occur within structures. The adjoining properties are 50 feet from the structure.
No excessive noise or odors would be generated by this proposed business. Based upon the
limited scale of the proposed business and an evaluation of the property, it appears this
proposed business would not have any significant impacts on the adjoining properties.
STAFF CONCLUSIONS FOR THE 09/01/99 PLANNING COMMISSION MEETING:
Staff recommends approval with the following conditions:

PLANNING COMMISSION SUMMARY & ACTION OF 09/01/99: The applicant described
the business as a reconditioning of automobiles, trucks, and larger vehicles and includes washing,
buffing, and some minor paintwork with a hand-held brush (no air -brush work), such as window
tinting and pin striping; no body work will be carried out.
Planning Commissioners inquired if the property owner had agreed to update the health system. The
applicant said that he rented two stalls (wash bay facilities) from the property owner and did not
know what the owner had planned to do with regard to the health system. Planning Commissioners
also informed the applicant that VDOT needed to be contacted regarding the commercial entrance
requirements. The applicant understood the recommended conditions of the permit and realized that
either himself or the landlord would need to work out the health and entrance issues.
There were no public comments.
Planning Commission members believed additional time was needed to complete the required site
improvements and amended the ninth condition recommended by the staff to extend the time for
completion from 90 days to 180 days.
The Planning Commission unanimously recommended approval of the request with the following
conditions:
