Sanitation Authority: No comment. Planning and Zoning: The Zoning Ordinance allows for Cottage Occupations with an approved Conditional Use Permit in the RA (Rural Areas) Zoning District. This property is located in the RA District, and an antiques restoration business would qualify as a Cottage Occupation. In adherence to the Cottage Occupation definition, all activities would be required to occur within structures. This proposed business will be conducted in an accessory structure, 25 feet from the principal structure. The nearest adjoining property is 16 feet from the accessory structure. No excessive noise or odor would be generated from this proposed business. Based upon the limited scale of the proposed use and an evaluation of the property, it appears this use would not have any significant impacts on the adjoining properties. STAFF CONCLUSIONS FOR THE 08-04-99 PLANNING COMMISSION MEETING: Staff recommends approval with the following conditions: All review agency comments shall be complied with at all times. 2. All work shall be accomplished inside a completely enclosed building. Any proposed business sign shall conform with the Cottage Occupation requirement (sign shall not exceed four square feet). PLANNING COMMISSION SUMMARY & ACTION OF 08-04-99 MEETING: The Planning Staff requested that a fourth condition be added, stating, "there will be no retail sales occurring on the property." The Staff explained that this was only to prevent the establishment of an antique sales shop on the site, which would be a more intensive use, and did not mean that Mr. Barney couldn't have an interested buyer stop by to look at something he had just restored. There were no public comments. Gainesboro Commissioner, W. Wayne Miller, noted that this property adjoins the Gainesboro • 0 W. R. Barney, Jr. CUP #11-99 Page 3 August 17, 1999 Methodist Church and Mr. Barney's property and garage is served by a shared driveway that goes across the church's property. Commissioner Miller reported that representatives of the church had contacted him, and although they have no objections to the cottage occupation, they were concerned that the shared driveway be kept clear, especially during church functions. Commissioner Miller also expressed concern that no excessive odor occur from the restoration process because ofthe nearness to adjoining residences. The Planning Commission believed that the addition of a fifth condition was warranted to ensure that this use did not adversely impact the church. It was recommended that this condition state, "there will be no activities on this property during church functions." The Commission unanimously recommended approval of the Cottage Occupation to operate an antiques restoration business with the following conditions: All review agency comments shall be complied with at all times. 2. All work shall be accomplished inside a completely enclosed building. Any proposed business sign shall conform with the Cottage Occupation requirement (sign shall not exceed four square feet). 4.
